arrested during last thursday's san jose rally for donald trump. here are the picture. they're 18 and 19 years old. three face felony charges of assault with a deadly weapon. the fourth is charged with misdemeanor refusal to disperse. it raised questions about san jose leadership and the police department in terms of the response. police investigators imply there will be even more arrests. they say by view video of the clashes, they've identified more suspects but they need victims to come forward and help identify their attackers. there are several new developments in the conviction. tonight, we have details of a recent text message from the victim to the county prosecutor. also, there's growing scrutiny about the judge who presided over this case. the judge, a former stanford athlete himself, now fighting off a recall petition and possible challenge to his own re-election. robert handa. this case is getting international attention. what's the local response now? >> first, you're right there have been some new legal steps. including an intention to appeal. today, we also did get to hear a new message from the victim that could raise the already high emotional stakes. it's election day and the judge is hearing threats of recall. a group upset at the six-month jail sentence the judge handed to former stanford swimmer brock turner. started an online recall petition on change.org targeting persky and has already generated hundreds of thousands of signatures. one of the men who came to the victim's aid says he hopes the attention encourages people to get involved when someone needs help. >> i never thought about it twice and i'm glad i did it. >> reporter: prosecutor says while still disappointed in the sentence, says the fallout has been good for raising awareness of the issues involved. >> this sentence has shed light on to where the conversation needs to go and this letter that the victim wrote was so powerful. i truly believe it should be required reading. >> reporter: the victim's letter talked about the anguish from the attack. but the prosecutor got a text from the victim in response to interview requests that speaks to newfound strength and why she prefers to remain anonymous. >> i don't need labels, categories, to prove i'm worthy of respect. to prove i should be listened to. i'm coming out to you simply as a woman wanting to be heard. yes, there's plenty more i would like to tell you about me. for now, i'm every woman. >> reporter: again, along with the recall efforts, the case will stay in the public eye because the attorney for turner has reportedly filed an intention to appeal. coming up, we'll look at some of the obstacles facing a recall as well as an appeal. live in san jose, robert honda, nbc bay area news. >> we'll also tell you more about the judge. we're learning tonight as many as nine men known as the trav travelers are now accused of beating a homeless man to death in golden gate park. police say the group attacked him three types other the course of three days last month. they're accused of dragging him to the lake in the park and repeatedly hitting and dunking him under water. his body was later found tonight for a gunman who opened fire at a liquor store in vallejo. it happened this afternoon at springs town bottle shop on springs road. several witnesses report add man carrying a handgun shot the kirchner. how do we know how the surgery went? >> reporter: doctors say just one day after the 12-year-old boy was stabbed, sitting in a bank, he is up and walking inside of the hospital here behind me. we're also told his family has arrived from arizona. now, the boy was here visiting his grandmother when yesterday he was attacked. this is 12-year-old jacob seen here on a go fund me page created by his family. >> a complete surprise, totally unprovoked, something we're calling senseless. >> reporter: police say yesterday jacob was waiting for his grandmother to finish her banking at this west fargo in san leandro when this woman stabbed the child three times with a pair of scissors. >> apparently he was very lucky. >> reporter: today, jacob under went surgery at oakland children's hospital to treat multiple stab wounds along his neck and along his back. one of the wounds needed more than 50 stitches. >> many times stab wounds can be -- be much more bruising in nature, so he's pretty -- he's a pretty miraculous recovery. >> reporter: the boy is expect to recover but according to the go fund me page called justice for jacob, there will be many legal and medical expenses ahead. >> one, she stabbed him in the back. that's when she went and robbed the other people in the bank. >> reporter: investigators say the 32-year-old woman was attempting to rob the bank. >> as she made it out those same doors she came in, she was arrested by responding police officers, taken noon cuinto cus still armed with the scissors, covered in blood. >> reporter: the suspect is being held at the county jail in dublin, held on attempted murder and robbery charges. reporting live from oakland tonight, nbc bay area news. >> thank you. also in oakland, take a look from our nbc chopper, a home going up in flames. you can see the firefighters on the roof. all the smoke there. this happened on 76th avenue at hillside street in oakland. just about 90 minutes ago. firefighters say they could hear explosions inside of that home. they say two people were hurt. the cause is under investigation. in just two days, california's controversial death with dignity law kicks in. a bay area doctor will become the first in the state to specialize in helping terminally ill patients bring their lives to an end. nbc bay area's jodi hernandez. >> reporter: raj, the berkeley doctor already has appointments scheduled and will begin making home visits after thursday. he says if a terminal ill patient can't get a prescription for an end of life prescription or guidance from their own doctor, he'll be willing to step up and help. >> i think it's an important right for a patient to have. end of their life, control the way they die. >> reporter: he wants to make sure terminally ill patients can do just that. as california's right to life law goes into effect on thursday. the berkeley-based doctor will open the first practice in the state that specializes in end of life options. >> one of which might be physician-aided dying where they use a medication to die. but most of all what we're going to talk about somehow do we make you have a good death. >> reporter: will allowtients tr for a prescription for life ending medication. if their doctor won't participate and they meet the criteria, this doctor will. >> this needs to be a well thought out, carefully planned. >> reporter: the legislature passed the law following the widely publicized case of 29-year-old brittany me nard, an east bay woman who had a terminal brain tumor but had to move to oregon to legally end her life. he says it's about time patients have the option to end their suffering. >> said if this is done well, it is a good thing, a good way to provide one more option to patients who are dying. >> reporter: now, tonight at 6:00, we'll hear from brittany menard's husband who has fought hard to make this new law a reality. again, we'll get his thoughts at 6:00. reporting live in berkeley, nbc bay area news. i'm live in san francisco, where there is a push to give undocumented immigrants a voting voice. i'll explain coming up in a live report. and the tourist breaking alamo square park to snap a failed twice. it would allow undocumented immigrants to vote in school board elections. now, why this issue is gaining momentum again, kim. >> reporter: the political climate is the reason being given for the push to get this on the november ballot. if approved, it gives noncitizen bhos live within city limits a voice when it comes to their children's education. under this measure, undocumented immigrants who have school aged children in san francisco would be able to cast a vote only during local school board elections. school officials estimate this could effect about one-third their student population. >> right now, they don't care about the issues. because they know they can't vote. so it doesn't even matter. but now they're going to be, like, more motivated to vote and be able to have a say. at least their child's education. >> reporter: san francisco supervisor eric mars says this is about expanding rights and improving the city's school system. mars says the anti-immigration rhetoric from donald trump has mobilized supporters of immigration, pose bring giving this measure what it lacks in previous years. >> i think now's the time with a huge turnout expected in november, mobilized immigrant communities, with a grassroots effort like in the past, but even stronger given the climate. >> reporter: the measure needs board approval before it can be put on the ballot. that's expected this summer. it would join vote 16, which if passed would lower the legal voting age to 16 for those who live in san francisco. now, if this immigration measure does make it on to the november ballot and if it does pass it can still be challenged in the courts. school officials say they'll leave that up to a judge to decide whether or not it is constitutional. reporting live in san francisco, i'm kim yonenaka, nbc bay area news. an emergency today after a chase ended in a fiery crash. emts responded to 911 calls. police say a woman jumped in and took off. officers were able to catch up thanks to the gps system inside that ambulance. the woman lost control of the ambulance and crashed it on treasure island. she jumped out before it caught fire. this ambulance was an older model which requires keys to leave the keys in the ignition to keep the medical equipment charged. many of the city's ambulances have now been replaced following last year's grand jury report vealing the problem. the new models come with kill switches. we're in store for a beautiful weekend and a great time to take a hike. >> be warned if you take a lot of hiking, you cannot match the accomplishments of two people in the east bay. their story of determination and friendship. >> wendy and thomas have a lot in common. one they always loved hiking. another is that each of their spouses doesn't. it's why these two friends find themselves on the trail so much together and eventually on the journey that led right to tonight's bay area proud. the great thing about a good friend is that knowing all your quirks, they still want to spend time with you. thomas page for example can tell you all about wendy wheeler's obsessive need to highlight and catalog the trails these two longtime hiking buddies have covered together over the years. >> she wants to highlight things during the trails and i'm like -- >> in wendy's defense if she hadn't kept such good track, the pair might never have realized a pretty ambitious goal was within their reach. >> something just sounded like a cool idea. >> the idea? hike every mile of every trail in every park in the east bay regional park district. more than 1,200 miles in all. that because of spurs, dead ends, would take the pair more than 3,000 miles of hiking to complete. >> i don't even know if we said it. like, we should just, like, try to do all of them. >> wendy and thomas worked on their goal for more than a decade from the point when this were just one 30 mile away hike from finishing. but two years later, they still haven't. thomas, you see, has been beset by medical issues. blood clots mainly. that have limited what he can tackle. and wendy, though she could have completed this goal ten times over since then, flat-out refuses to hike those last miles alone. >> it's kind of our goal, not my goal. it's something we've been doing. you know, who cares if they finish in six months or a year or -- doesn't really matter. whatever you personally want to do, right? i'd rather finish it with him. >> thomas swears if the hiking boot were on the other foot, he would do exactly the same. >> yeah, it's going to be together. you know, can't -- you can't do it any other way really. >> it is apparently just another great thing about a good friend. they would go to the ends of the earth for you, just not the end of a journey without you. now, the good thing, you can see, they are hiking together again. the last 30 miles of the journey is the wilderness in the east bay and it's a pretty rough trail that probably will take an overnight stay to finish. so wendy isn't quite sure she wants to take on that the responsibility of having thomas on the hike that long but he's getting better and certainly when they do those last 30 miles, we'll tell you about it. >> we hope he makes a quick recovery. if you need more proof fire season is here, look how close this brushfire got to these homes in danville. nbc chopper overhead. it happened right before noon today near glen hollow road. thankfully, though, no injuries and no damage to any of those homes. just as a precaution, the warm weather and wind could add to a lot of fire danger. >> we've been saying it's a great time to go for a hike. hayes our best day? >> thursday and friday, some really excellent weather across the bay area as all areas expecting a cooldown, not just at the immediate coastline where we have that typical fog. you can see right now from weather underground, looking towards san francisco, beautiful layer of fog right now shrouding the city and currently a chilly 61. it's not foggy everywhere. we have 75 right now in the east bay. a lot more comfortable for us. right here across the peninsula, 72. blue sky, unlimited visibility. right now specifically in downtown. a little bit warmer than 73. we will have this fog returning. we've been dealing with for the past couple of mornings. it will mean for bay and golden gate bridge commuters, we'll have some areas of drizzle you'll want to watch out for. and across the south bay, 56. so as we take you into your microclimate forecast for wednesday, numbers cool a few degrees. that will put us at 82 in morgan hill. for the peninsula, you'll really start to feel this chillier wind at your back. 75 in palo alto. san francisco, typical weather in the 60s with areas of patchy fog throughout the day puts the mission at 63 degrees. for the trivalley what a nice reprieve from last week when we had those 100s. tomorrow, pleasanton, 79. looking good in oakland, 69. walnut grecreek, 78. 70s from napa to the valley. tomorrow, this trough of low pressure offshore. will have larger i pacts on thursday and friday. there's some rainfall associated with it. all of that rain is heading right up towards seattle and portland. we'll see the bottom edge move in. some cooler air, helping to filter in the wind. it will be breezy to gusty over the next four days. you'll start to notice it once we hit thursday's forecast. dealing with winds at about 20 mys per hour. that continues on friday. it looks like the windiest weather ahead will hit us once we hit saturday's forecast. could go as high as 30 miles per hour. that cooler wind, again, helping to drop our temperatures. let's look at the result. thursday, 78 degrees. by friday, 77. on saturday, 80. notice, by sunday, we go up to 88 degrees. certainly some hotter weather on the way. just enjoy the next couple of days. you can see in that weekend forecast, it really looks like the best and most enjoyable weather will be on saturday. once we hit sunday, we'll be close to 90 for those interior valleys. we're tracking more and we'll have details tonight at 6:00 p.m. >> keep those barbecues here using a tiny oxygen mask to help this kitten breathe. the fire broke out in an apartment building and raced through three apartments. 11 people were evacuated. no one was hurt. that kitten is
