Im a little bit disappointed. I think he probably should have gotten a little less, you know, lesser sentence, but i also understand what the judge is coming from as well. Reporter the judge admonished yee saying he abused the publics trust, pointed to his role in a gun running conspiracy calling it hypocritical given yees stance on gun control. He pled guilty in july. When someone does something wrong and is sorry for what hes done, obviously, you really cannot discount the many years of Public Service and all the good things that hes done for the community and for society in general. Reporter the naacp and other groups made it very clear to us yesterday and very loudly again today it does not trust san jose to fight the reinstatement of Phillip White without public pressure. Protesters assembled outside the superior courthouse in downtown san jose today calling for the city to once again fire officer Phillip White after he was reinstated earlier this month after a binding arbitration hearing. White was fired in october for tweets that some believe threatened supporters of the black lives matter movement. There was a lot of people who have felt that arbitration is a final nail in the coffin as a community. The people of san jose just are not going to accept that. Reporter civil rights attorney nick emmanuel, on behalf of the san jose naacp, filed a socalled writ of mandate which asks the court to order san jose to fight whites arbitration victory. San jose is the only entity that can legally challenge the arbitration ruling on the grounds white violated public policy. Quite simply, he threatened bodily harm to the very people that he was sworn to serve and protect. Reporter as we reported mayor sam liccardo has already announced plans for the city council to discuss fighting the arbitration decision. The mayor says todays legal action by the naacp will not affect his timetable or process. These are really moving on separate tracks, and the council needs to make its own decision based on the evidence before it. Reporter mayor liccardo says he still plans to have the city Council Start discussing its strategy in a private session tuesday. The city had 30 days to respond to the naacps request from the court. We talked to eight different Corrections Officers and we discovered a history of inmate physical and mental abuse that dates back those years. Just this past weekend two independent audit groups reached similar conclusions. The commission was formed following the beating death of inmate Michael Tyree last september. Three Corrections Officers now face murder charges in tyrees death. They say these problems existed long before tyree died.
