Now overtime is about to become mandatory for San Jose Police officers. This is not welcome news for a beleagu beleagu beleaguered department. Damian trujillo broke the story. Reporter the Chiefs Office tells me he needs to meet the minimum standard Staffing Levels in order to keep his officers safe on the street. So mandatory overtime looms for his rank and file. These officers captured two people today after a foot chase with the suspected burglars. Beginning this weekend, those same officers may be forced to work part of the next shift as well if the need arises. We have certain mandatory minimum Staffing Levels in the department that we need to adhere to. Reporter san joses assistant police chief says there have been days when the number of onduty officers cant meet those minimum Staffing Levels. Not anymore with the mandatory overtime. Well take volunteers first, obviously. And reversing seniority that were still working out, well hold over that amount of officers that we need to ensure that we have the minimum Staffing Levels in patrol. Overworked and fatigued officers will not improve safety in our neighborhoods. Reporter the police union points to this 2yearold report by the city auditor. It says workers comp claims increase when officers work a big number of hours. Were obviously worried. We know our workforce is tired. We know theyre working a lot of overtime. They answer the bell time and time again. But they are tired. Reporter but the assistant chief says while the city and the police union work out a labor deal, his office has to take action to keep the officers and the streets safe. The officers will have to work a minimum of three hours of overtime if called upon, and thats two hours for those on the midnight shift. Now tonight at 6 00, an nbc bay area exclusive. We have new detail news on a truck fire that brought traffic the a halt at the bay bridge toll plaza. This is what commuters saw this morning, a truck on fire, a man acting bizarrely, and now some say this man in the picture intentionally set that fire. Nbc bay areas Jodi Hernandez is live in oakland with more on this unusual traffic delay. Jodi . Reporter janelle, it certainly was unusual. The chp says that driver actually paid his 6 toll here at the toll plaza. But its what took place right after he drove through here that snarled traffic and left commuters gawking. Usually this is a boring commute. A 45hour commute. Reporter but narin nadoos commute was far from routine. This is the video he took as others snapped photos of a man dancing and acting erratically near the bay toll plaza as flames engulfed his truck. Its bizarre. A truck on fire, completely engulfed. It wasnt like a normal accident. It didnt look like it. We are told that he admitted to starting the fire. Reporter the chp says luckily a department of Homeland Security officer was driving through the toll plaza on his way to work when the mans antics stopped traffic. He and other officers detained the 32yearold. So it was apparent to officers on scene that he may be suffering from sort of psychiatric emergency. Reporter though the incident caused headaches for commuters, the chp says the driver will not be charged. Instead, he is undergoing a mental evaluation. Naidoo says its a commute he wont soon forget. He did light his truck on fire but is still sentenced to pay the toll and pay his due before attempting to cross the bridge. Something is off. Reporter the chp says the man received minor injuries from the fire. He is being treated at Highland Hospital for those injuries tonight. And also undergoing a psychiatric evaluation. However, president obama did lay out a plan of action for the collapsing country. American combat troops are not going to be fighting in iraq again. Ultimately, this is something that is going to have to be solved by the iraqis. This is at a News Conference late this morning. The president said the top priority is to secure the u. S. Embassy in iraq. Number two, significantly increase intelligence and surveillance to get a picture, a better idea of the terror group isis. And number three, provide an additional 300 military advisers to help train and support iraqi forces. The president says he will consult congress if he decides to use military force. Speaking of which, a big move in congress today, House Republicans elected a new majority leader. Its Kevin Mccarthy from bakersfield. The 49yearold mccarthy is the first californian and the youngest person to ever be the majority leader. He becomes the second most powerful person in the house behind the speaker of the house, john boehner. Mccarthy was elected to Congress Just eight years ago. He replaces eric cantor, who lost in the virginia primary last week. One man. One man. One woman. One woman. A controversial march against gay marriage hit the streets of washington, d. C. Today. In washington, d. C. , archbishop Salvatore Cordileone led several thousand protesters from the capitol to the steps of the supreme court. The leader of San Franciscos Catholic Church was the Main Attraction and the first speaker to take the podium. The truth is that every child comes from a mother and a father. And to deliberately deprive a child of knowing and being loved by his or her mother or father is an outright injustice. This is our very nature. No law can change it. Reporter the archbishop also asked the crowd to hold back on hate speech, even though they may be tempted. When you are relentlessly and unfairly painted as a bigot and punished for basically stand the big basic truth of marriage as a basic foundational societal good, its easy to respond in kind. Dont. It will now allow its ministers to preside at gay weddings in states where gay marriage is legal. The church also wants to redefine marriage as a union between two people instead of only a man and a woman. The San Jose Fire Department tells us no injuries thus far. Here is the good news. The fire is under control, and that no other homes have been threatened. There is very light wind making it very good for the firefighters. Keep it here for any updates. Were back in a moment. Now to an nbc bay area exclusive. We investigate vta train safety as the Transit Agency is gearing up for thousands of new riders in time for the 49ers new stadium. Trains are on a collision course, and faulty wheels that could derail. Thats what we found. Nbc bay areas vicky nguyen joins us with the details. Vicky . Reporter we reviewed months of inspection records for the valley transportation authority. They reveal a list of critical fixes that vta has been slow to make. State inspectors found vta violated safety procedures and state regulation, failing to maintain its trains, leading to situations where trains could collide headon or potentially derail. Now vta trains carry 140,000 riders a day. They share the roads with thousands of cars. Records reveal vta has failed to fix signals and to get its fleet into compliance with state standards. Now time having run out as levy stadium opens in august. Inspectors say they are still finding problems. When your inspectors found these problems, what did they instruct vta to do . Not run those vehicles. And we found that they did run them after that. Vta is a very safe operation. We have very professional operators, and i encourage everyone to ride vta. Garvin . Reporter they say their friendship started the day they met in sixth grade and has been going strong all the way to their sophomore year at cupertino high. Thats the year this thanks to eshawns caring and generosity and leadership that their bond went to a whole new level. Every other year at cupertino high school, they hold a hall of fame rally. Where exceptional students from years gone by are honored. This year, though, they took time to honor an exceptional act of kindness from one of their current classes. It was no easy task. Reporter one big enough to bring sophomore Michael Munson to tears. This is his life. And thank you, guys. Reporter it was back in february that michaels dad martin, an active, outgoing 53yearold fell while walking his dog along cupertinos saratoga creek. Martys back hit a rock on the way down. He says he knew he was paralyzed the moment it happened. Michael tried to keep the bad news a secret at school. But his best friend, eshann sharma saw right through that. I went to him and i turned him around, and i saw tears in his eyes. And i knew something was really wrong. Reporter he desperately wanted to help michael at any cost. And soon learned what that cost was. The next few days, michael just came to me really sad. Yeah, we just got the medical bills. The wheelchair cost 25,000. And im like wow. [ cheering ] reporter eshann immediately dove into fundraising, holding dinners, rallying his classmates, not stopping until they got to that magic number and beyond. He has been a really good friend to me. And i just kind of wanted to reciprocate it. To be honest, he is someone that i cant express more gratitude towards. A relationship that i cant really explain. Like, its amazing. Reporter made all the more amazing when martins wheelchair arrived this past monday. So if you bring the back up. Reporter this one actually a loner until his personally fitted one is ready. It didnt matter to marty, though, who immediately took it out for a spin. Weve been following that fire east of downtown san jose in the foothills. What do we know now, jeff . You can see the live pictures coming in. Just excuse it if the signal tends to go in and out. It is our live helicopter shot. Two homes, again, have been destroyed. Wind gusting up to 16 miles per hour. The firefighters tell us right now the fire is under control, but knowing what i know and what i have covered, it just takes a little bit of some member activity to spread to this very dry brush. And we still could see it ramp up. Again, firefighters definitely think they have the handle on it. But were going to continue to watch that very closely. You can see the location of this fire that has put a lot of nerves on edge here in the East San Jose location. Its way off here from downtown san jose. Again, in the foothills right off clayton road. Wind at 8 miles per hour. The top gust that we could see tonight at all with some of those hot spots would be 20 miles per hour. I dont see anything higher than that. And the smoke will be blowing away from downtown san jose at this point. But if youre in the neighborhood of clayton road, you want to watch that sky very carefully, and also just Pay Attention in these kind of situations. It can happen quickly. Firefighters go door to door and may ask you to evacuate. Until we get the all clear, keep your eye to the sky. Get a look at the wind gust forecast, and you can see for hills above a thousand feet, likely see wind gusts about 20 miles per hour. So fire danger through this weekend. Were not looking at major windstorm, but thats all it takes with our drought to keep that fire danger up there. Get a look at the sky camera network. The fire, the live video we have in the south bay coming in in the first quadrant. Then you can see in San Francisco much cooler weather at this hour with fog at the coastline. That cooler weather is going to stay with us throughout parts of tomorrow, helping to gradually decrease that fire threat. So well get a look at the fog bank right now at the coastline. It is pretty extensive here, stretching from point reyes, all the way down to santa cruz. So as that continues to roll in over the next 24 hours, its going to keep our interior valleys from getting into the 100s. That is the good news. In fact, san jose, as we head throughout our friday forecast, looking at 84 degrees and sunny skies. Get a little hotter here as we look towards saratoga, also cupertino. Still some upper 80s. For the peninsula, 72 in san mateo. Palo alto expecting 84. San francisco, onshore wind and importing humidity, keeping the temperatures down. 68 along the embarcadero and 67 throughout the marina. North bay, east bay, and trivalley a wide mix of temperatures. Fire concern up there in napa with 86 degrees. Cooler expected in sausalito with 73. Take a look at the trivalley. It still will be close to 90 degrees. Thats going to be the hottest location as we head throughout our friday forecast. By this weekend, its going to be the first weekend of summer officially arriving early in the morning on saturday. And you can see, well keep some cooler temperatures for the south bay, San Francisco, and the trivalley expecting 87.
