bay area news. tough questions for the family of the man who was shot and killed by san jose state police. campus police opened fire on antonio lopez back in february, just a few yards from san jose state. police claim lopez, who was carrying a dry wall cutting saw charged at an officer, and then that officer's partner who was standing behind him opened fire. lori valdez, lopez's long-time partner says she has witnesses who can prove that is not true. >> i do not know why and how this truly happened and why killing him was seen as the only option. i don't understand how his life did not matter. why was he targeted? why is it because he fit the profile of an undocument ld day laborer or is it because he couldn't speak english? >> valdez says she would like to see the officer involved in the shooting charged with murder. she says her 4-year-old son will now grow up without a father because of unjustified shooting. san jose state police did not return our calls. san jose police department asking for if the public's help in finding raquel. she was last seen yesterday morning. she is 53 years old and is considered at risk because she suffers from alzheimer's, dementia and severe depression. she has the mental capacity of an 8 to 10-year-old. and after some rays of sunshine, the rain is heading back to town. a new storm is arriving tomorrow. our chief meteorologist jeff ranieri has the details tonight. >> yes, the live doppler scan in just over 250 mile radius is not showing wet weather right now. we do want to show you just off the coastline, we are finding some areas of rainfall. it's not very heavy or widespread, but eventually as we get this cold front beginning to move closer offshore, that is going to push some showers across the bay area by tomorrow's commute. we'll have more on that coming up. i want to take you to one other issue if you're doing any traveling for tonight. we have strong and severe weather from st. louis down to dallas. not only tornadoes, but grapefruit sized hail in all of this. we'll have more on all of this coming up in a few minutes. thank you, jeff. new developments in the ft. hood shooting. tonight we know the accused shooter, ivan lopez was on medication and undergoing treatment. still no word on what motivated him to open fire, killing three people and injurying 16 others. he joined the puerto rico national guard in 1999. earlier this year he was transferred the to ft. hood where he was working as a truck driver. lopez also drove trucks in iraq years before but reportedly did not see active combat. when he was examined last month, the army shows he showed no violence. >> we had strong evidence of a medical history that indicates unstable conditions. >> lopez's wife told nbc news she was talking to investigators all night pane we know the family home was also searched. in a sad twist, this gunshot is the same place where that convict eed killer and ivan lop bought the weapons used in the massacres. as for the survivors, doctors expect all of the victims to survive the shooting. three remain in critical condition and two will still undergo surgery. raj? snchts now . now to our continuing coverage of the fbi case. keith jackson just got out of jail in oakland a few minutes ago. this comes after his mother, seen outside the courthouse agreed to put up collateral. he's accused of funneling illegal donations to the state senator and attempting to sell guns to an undercover fbi agent. jackson's attorney praised the the decision to release him on bail. >> it will be good. he has a stable home. he has a long-time companion, and it will be good for him to be home. it will also be good for him to be able to come to our office, which the judge has ordered. prosecutors plan to appeal that decision. all 26 people charged in this case are due back in court on tuesday. a violent home invasion in san leandro. a man says he was blindfolded, tied up and pepper sprayed. the man lives on donovan drive. he says yesterday afternoon two men, one armed with a gun, forced himself into his home. they tied him up. they freed himself and went to a neighbor's house to call police. and it's happening again in san francisco. people who live in the north beach neighborhood say rats are everywhere. rats, they say. nbc bay area's stephanie troung covered another investigation in a different city. is there a common thread here? >> hi there, chris. it seems the the common thread is the central subway process, and a few months ago we covered the story in one of the neighborhoods, and now we're hearing the same complaints in north beach. spotting rats everywhere. some of them close to the construction work for that project. first the complaints came in of rats. so many business owners began to complain. now they're creating problems two miles away in north beach. >> they're doubling and doubling and doubling. >> they're all over the place. t they're getting used to humans and less scared. they're more after the food. >> the san francisco municipal transportation agency, which is in charge of the central subway project, says the construction work in north beach began a little over a year ago. close to washington square park. crews completed excavation work at the pagoda theater. projects are ongoing, like this one on the sewer line. >> they're stepping all over them. it's so dark, you don't see them until you put a light on them. you see them and they start running. >> reporter: the department of public health says the city has received 83 complaints of rats so far this year. most recently in north beach area. they've placed six bait boxes along the perimeter and sealed the holes with wire mesh. some park goers say they see the rats so often they're almost used to it. >> had it run right under me, under the bench. i was like whoa! but it's cool. >> reporter: doesn't bother you? >> as long as they don't bite me. >> reporter: and so far no reports of that happening. now rec and park officials are expected back out here at washington state park tomorrow to check the traps, along with the department of public health inspector to monitor any activity. the streets are not the only places rats are popping up. we'll have that part of the story coming up at 6:00. live in san francisco for nbc bay area news. a different issue forced people from their homes and work in a different san francisco neighborhood today. firefighters ordered an evacuation because of a strong smell of gas at pacific heights around 10:00 this morning. a truck hit a gas main on pine. pg&e crews capped the gasoline in about 30 minutes. it took them a few hours longer to repair the broken line. still ahead at 5:00, lost and found 20 years later. how detectives stumbled upon stolen jewelry and the creative way they're tracking down owners. >> i'm scott budman, a tech ceo stepping down because of a political contribution. we'll have the story next. >> on a here's what we know. federal agents shot someone outside of a wal-mart and fairfield police shot another person across the street, which appears to be an apartment complex. we don't know if the two people shot are dead or alive or what condition they're in. we'll continue to stay on top of the breaking story and bring you new information as it comes into the newsroom. a donation, a controversy thanks to pinterest. they found necklaces, rings and watches inside of a car during a traffic stop. among the stolen valuables were charm bracelets. they were swiped in san jose 20 years ago. officers found the owners after posting photos on pinterest. detectives still have other stolen items to return. go on and see the pictures. maybe you'll find your long lost ring. wouldn't that be nice? olympic ice skater met the president and the first lady as well. the teen was among the 200 olympic and paralympic athletes invited to the white house. >> you have done a great job. what an extraordinary achievement to represent the united states of on the olympic games. congratulations. good job. >> he thanked the athletes for their performances at the winter games in sochi, russia and met these guys. >> i was in a band with him. we ended up hanging out together. >> that's christian on the right. robert on the left. the three have been friends since high school. bonding over music and video games, and on this day getting together to buy bus tickets. specifically buying them lawrence burg, new mexico. being as close as a bus will take you to the beginning of the continental divide trail. more than 3,000 rugged and often desolate miles from end to end. they plan to hike all of it this summer. at first he had done long distance hiking before and thought it was fun. they ought thought it would be bsht with a mission. and that's where scott carpenter comes in. the fourth high school friend enlisted in the marines after graduation and through them learned o it have wounded warrior project. helping wounded veterans just alike back home. so on the days they have left the friends are getting in as many hikes miles as they can, keeping their boots on the trail and into the morning commute. by 6:00, 7:00, 8:00 tomorrow, we'll see the rainfall twabd p towards san francisco and san jose. certainly it will be enough to get the roadways wet. then throughout the afternoon it pushes east and will likely keep scattered showers in the forecast for the afternoon. no doubt the morning will be the worst of the wet weather. trace amounts to maybe .05 inch throughout the next system. friday, the best possibility of the rainfall in the morning hours. by the afternoon we get sun breaking out. 64 in san jose. belmont, 63. san francisco, upper 50s to about 60. so devastating mudslide. what has investigators puzzled as they work to identify the victims found in the rubble. bit of a mystery tonight at the site of the deadly mudslide north of seattle. rescue crews recovered a body that doesn't match anyone on the missing person's list. the only clue could be his gold molars. authorities think he was a hiker or was on the highway when the wall of mud swept through the small town. this happened last month. 30 people have died. 15 remain missing. people who live with the threat of deadly earthquakes should be warned when they're about to hit. lawmakers have requested funding for an earthquake early warning system. they say using berkeley, cal tech and the university of washington have collaborated on an early warning system. it gives just a few seconds notice. just enough time for people to take cover. installing and maintaining a sensor system on the west coast would cost $16 million a year. >> b.a.r.t. is upglading your ride. newer seats,
