thanks for joining us. i'm kris sanchez. >> they're just wrapping up a news conference condemning white nationalists. they're headed to a rally set to take place on sunday in the city. however, organizers of that rally also condemning white nationalists. nbc bay area's pete suratos live to sort all this out. pete? >> reporter: good morning to you, marcus. the rally set to take place in berkeley this sunday made an impromptu appearance saying she is denationalizing white supremacist groups. i asked her point blank how she felt about her event on sunday being associated with those groups. >> i do not support white supremacy. white supremacists are not welcome at thi my rally. we do not want hate people there. we do not want violence there. if anybody intends on violence, do not come to my rally. >> reporter: he is the organizer of a marxist rally set to take place at martin luther king jr. park on sunday. he identifies as a transgender female and embraces the diversity. he said this event was created back in june before the charlottesville attacks. but during that news conference with state and city leaders on the steps of berkeley city hall, they were condemning racism and intolerance, calling sunday's rally a white nationalist event. i specifically asked the organizer why they are calling this a white nationalist rally if the organizers are claiming white nationalists are not welcome. here's what they had to say. >> from what we're seeing, people like richard spencer and cal chapman and some of the very alt right leaders that have been in berkeley said they intend to come this weekend. we don't know how many people are going to come. we just have to be prepared as a community to keep our community safe and we will do that this weekend. >> reporter: now, as it stands, the organizer says she's expecting around 300 people to show up, which is around the same number we're seeing on the facebook event page. we want to point out this event is not permitted by the city. it's not a city-sanctioned event, obviously, and city officials are encouraging folks to avoid this area on sunday afternoon to be on the safe side. we're live in berkeley, pete suratos, nbc bay area news. >> all right, this will be a busy week for us. thank you, pete. breaking news, an amber alert for a child on the central coast is still in effect. police say the child and the abductor are now in a different vehicle. he was abducted this morning. the boy has brown hair and brown eyes about 4'5" wearing blue jeans. he was taken by a man who is considered armed and dangerous. people did request that amber alert after officers were called to a homicide scene in santa maria. police found a blue volkswagen golf. the two were reported to be in that earlier this morning, now police say they're likely in a black 2017 jeep cherokee with the license plate on your screen. it is 7 xzk 698. right now police are keeping a close watch on freeways but also on airports. they believe the suspect is a flight risk and could be trying to head to russia. we will continue to follow this breaking news story here and on our social media platforms. we'll bring you the latest details as we get them. a new development in a push to recall a south bay judge. judge aaron perski has been under fire after he sentenced brock turner to six months in jail for sexual assault. many felt that sentence was too light. nbc bay area scott budman is live in san jose this morning to explain why the state attorney is now getting involved in this battle. scott? >> reporter: well, good morning, marcus. the battle is still on, but the legal part is still on hold. as you said, there is an update this morning in the recall effort. earlier today the state attorney general filed papers to support the effort to recall judge perski. that recall started shortly after judge perski handed down a six-month sentence to brock turner after turner was found guilty of sexual assault. despite the support of the attorney general, the recall effort still needs a judge's decision to move forward. local judges have recused themselves from the case. >> judge perski has hired donald trump's arizona state director to manage his campaign. that tells you everything you need to know about judge perski's bias against women and his views on sexual assault. >> reporter: judge perski's attorney was also here today. she says they'll have further comment when a decision is reached on where the recall goes from here. those pushing the recall effort say they need 90,000 signatures and they're aiming for the june 2018 ballot. san jose, scott budman, nbc bay area news. returning to our climate forecast. another sunny day on tap for most of the bay area, although it's a bit late to start, right? >> here's a live look in richmond from our traffic cameras. traffic moving along. today started as a muggy one, but kari hall tells us it will warm up today. >> yes, you can see all clear skies, and we are going to have some slightly warmer temperatures today, and camera going out there in haze valley, but we see it is clear in san francisco. also for the south bay, mostly clear skies. i want to show you the temperature trend for the rest of the bay. reaching into the upper 70s, and as we head into the evening, a nice, comfortable one as we dip back into the low 70s by 8:00. as we look all around the bay area, our high temperatures today reaching into the upper 80s, it will be warmer in the tri-valley. some of our interior valleys feeling a boost in those temperatures today, and the humidity will be taking a dip, too. so we'll talk about all of that, what's ahead for the rest of the week coming up in the full microclimate forecast. >> thanks, curly. thank you so much, kari. an early morning earthquake shakes parts of the bay area. we brought you live breaking coverage on this story on "today in the bay." the 3.5 magnitude quake struck early this morning across parts of the g.s. we heard some people on line with reports of shaking. there were no reports of damage. the fight at levi stadium is not playing out on the field. they say the city owes them a lot of money but they say that's not right. bob redell is there live. we see this distance, but what are the numbers about at this point? >> reporter: good morning to you, kris. the city of santa clara's auditor commissioned proves they owe $2 million for the running of the stadium. they think the audit is riddld d with errors. the city wants them to cough up the money or face legal action. $894,000 was used for construction money. $718,000 for unpaid parking fees and more for staff costs. these unpaid amounts are a violation which prohibits tax money to be paid for this. they said they failed to bill them for the $984,000 and that the city wasted money on an audit to have revealed that previous unpaid amount. the mayor of santa clara admits they need to do a better job. the first step is to hire a city manager with experience managing large stadiums like levi's. >> santa clara was ill prepared to manage a stadium of this magnitude. we're changing things and we're fixing it. >> reporter: mayor dilmore is demanding they pay up money owed to the city. >> hopefully they'll cooperate and produce the documents, but if not, we're prepared to take legal action. >> reporter: the 49ers claim by releasing those documents, it will hurt their negotiating power with musician and other acts who want to perform here at levi stadium. the city says there is a way to keep groups in china and russia. they say this is a crackdown on those who are helping north korea with its nuclear and missile programs. 10 entities and six individuals are the targets. the treasury this replaces their current options. mercury news is reporting this morning on a settlement finalized monday. the college closed down because of concerns from the education department. in total, 13 campuses closed. now the people who purchased student loans will have to pay out millions of dollars. the company has about three months to notify students if they no longer owe money. that will be is car for more than 9,000 californians. others will have their debts partially discharged. new at 11:00, congresswoman nancy pelosi is talking about the gender conflict nationwide. she announced the new on saturday. we're following a developing story. the navy looking at the possibility of a cyber attack led to a deadly collision between a u.s. destroyer and a tanker in southeast asia. today the navy announced the remains of several navy sailors had been found in a compartment of the u.s.s. john mccain. janice mackey fryer has more. >> reporter: divers now searching the flooded areas of the destroyer that collided with an oil tanker monday. it comes amid new details of what possibly went wrong. a u.s. navy official telling cnn that the warship suffered a steering failure during its approach into the strait of malacca. navy officials have ordered a temporary halt of all operations worldwide for a global safety check, the navy not ruling out a possible cyber attack. chief of naval operations admiral john richardson tweeting, possibility of cyberintrusion or sabotage. no indications right now, but review will consider all possibilities. for the 7th fleet based in japan, it's the fourth major mishap in just six months. in june the u.s.s. fitzgerald, another destroyer, collided with a cargo ship. seven sailors were killed. the ship's top two officers since relieved of their duties. it now means two american-guided missile destroyers are out of action with tensions at a high with north korea. but for now the focus very much on finding those missing sailors, and of course, taking care of their families. now back to you. state lawmakers want to cut lead exposure. the issue is of elevated lead issues in water gained national attention because of the crisis in flint, michigan. here in california, one proposed bill would urge doctors to ask more questions to assess the family's risk to lead exposure. they would be held to a higher standard regarding that data. another bill would require people to test their water for lead and follow cdc standards. the numbers are comparable or higher. 7.5% of kids under the age of 6 had elevated lead levels in oakland. more than 4% tested positive in san francisco's mission district. and alan rock area of san jose tested at 3%. the lead numbers from the state department are from 2012. doctors say they are indeed hearing from people who chose to ignore the repeated warnings and looked yesterday at yesterday's eclipse. i hope you were not one of them. if you're not sure if you have eye damage, here's some advice from a san francisco eye doctor. >> if you're having light sensitivity, watery, pain in the eyes, if you still have an after-image like you got flashed with a light bulb, then you should call someone. >> the doctor says the most common problem is treatable, and that is a sunburned cornea. a permanent damage, though, could include vision loss and that can happen when the retina is exposed to too much don't want to look at the sun today as well, but at least we can see out at the bay area now that those clouds are out of higher, and we'll begin to feel warmer in some spots. let's take a look outside at anderson reservoir. we had some clouds rolling by there earlier, and as we look at twin peaks in san francisco, still some clouds at times. for the most part we are seeing some sunshine. as we take a live look outside in fremont, we see the sun. let's check out the temperature trend. we'll be in the low 80s by early afternoon hitting our high temperature at 3:00 today and then some mid to upper 70s through much of the evening. a great evening to head out there with the kids after school and enjoy some extra time at the park. the 7-day forecast is at the bottom of the screen showing san francisco keeps those temperatures in the 60s, more changes for the south bay. today we'll head to 82 degrees in san jose. gill roadwroy will see a high o degrees. 80s for pleasanton and then we move to pre mofremont where it' degrees. san francisco, you'll notice it's a touch warmer and part of the reason why, we see the clouds clearing earlier and north bay up to 78 degrees in santa rosa. you probably felt the increase in humidity, especially this morning. we are seeing that monsoonal moisture causing a few of those spotty showers around the sierra, even some lightning strikes as you get a look at some of those icons there that pop up within the last couple of frames. we are going to feel that humidity decreasing as we go through the day. of course, great news, but as far as how we'll see -- if we could see any rain, it doesn't look like we'll see any developing and clouds moving in by late tonight and early tomorrow morning. if you're making plans to head out to at&t park, this is a live look. it's nice and sunny now. it will be sunny by the time you arrive at the park this evening, but then as the game goes on, it will start to become mostly cloudy as those temperatures drop. we'll be in the lower 60s tonight, so bring a nice, warm jacket. san francisco reaches into the upper 60s today and over the next several days. the warmest day will be on sunday and we'll also have that kind of weather for the inland area where we'll reach the peak of the warmth, but look how hot it will be, up to 94 degrees. look for that and try to keep it in your weekend plans in the kings mountain area. officials say people in the area should be cautious. we'll be right back. sexually assaulting a 4- year-old girl. here )s the mugshots of 39- year-old "blanca torres" and just in, sunnyvale police arrest two people for allegedly sexually assaulting a four-year-old girl. here's mug shots of both of them. police say torres was babysitting the victim with a fourth friend when that assault actually happened. detectives added a search to torres' phone and revealed searches to child pornography. torres has shared homes with other children in the past and many have trump has vowed to move forward in the war on afghanistan. >> it could include more troops but the president didn't give any specific numbers. now he's headed to arizona for a campaign-style rally. edward lawrence has more from washington. >> reporter: president donald trump gave little specifics for his strategy in the war on afghanistan. >> we are not nation building again. we are killing terrorists. >> reporter: but the president wants an honorable and enduring out come to the end of the war. president trump gave no specifics on troop increases but made it clear more resources will join the war. vice president pence gave more details. >> in regards to aa aa aa aal - that are there, isis and all involved. >> pakistan has much month gain with our effort in afghanistan. they have much to lose if they harbor criminalists and terrorists. >> reporter: he now heads to arizona for a campaign-style rally. in a statement the mayor of phoenix says he's disappointed that the president chose to hold a campaign rally as our nation is still healing from the tragic events in charlottesville. the president also hinted he may pardon former controversial sheriff gerald arpaio. he was convicted for ignoring a former court order. he has no idea if he's going to get a pardon. edward lawrence, nbc news, washington. more than 40 people are hurt this morning after two high-speed commuter trains collided early this morning. no one has died, that's the good news. but it happened west of philadelphia and authorities say one of the trains was headed into a station in upper darby when it hit a parked, unoccupied train. listen as people who were on board describe that crash. >> my face hit the wall, put a big hole in the wall and i went straight down. i blacked out. it was loud, and it hurt, but i can't really tell you much more than that. there was blood, everywhere. the driver was all banged up and there was this one girl bleeding out of her face pretty bad. >> train up and be counted. >> reporter: in israel, rocks felony, windows shattered. alameda police consider that a hate crime. some carried signs in response to the recent words and actions. >> everyone is outraged, kind of scared, and wants to stand up against it, that we don't want hate here. we're diverse and we like being diverse. >> we've had a lot of these things happening. things have been escalating here. i don't think that's okay. i don't think it's okay to ignore it. i think we have to stand up. >> reporter: terry mcsweeney, nbc bay area news. >> they're still trying to identify the people responsible in both of those incidents. they do have surveillance video of the synagogue vandalism, but they aren't releasing it yet. we'll let you know if they do. happening today, the suspect accused of shooting and killing an off-duty oakland firefighter is expected to be arraigned in about two hours. we brought you that breaking news on that shooting last thursday during "today in the bay." suspected gunman al juneau has been accused of killing a police officer. one died from his injuries, a second is in stable condition. the search continues for a gunman who shot a popular bay area rapper in richmond. this is video taken moments after 39-year-old charles william, also known as keke desneak was shot. he survived an oakland shooting back in january and his fans are really hoping he'll survive this one, too. >> there's a lot of hate going on. i don't see why richmond, but it's a lot of hate. we need to come together, we need to do better. >> police are not releasing any information about a possible suspect, but they want the community to know there is no threat to the public. president trump has signed a bill to help speed dna analysis in criminal cases. the dna act was sponsored by east bay congressman eric swalwell and senator diane feinstein. it allows them to use new technology that can read dna samples in 90 minutes or less. now testing can happen at the time of a suspect's arrest. lawmakers believe this could also help with the rape kit backlog as well. an east bay state senator is introducing a bill that, if passed, will treat crimes by white nationalists as terrorism. senator nancy skinner says that her bill will strengthen the state's anti-hate laws. her bill would also expand to groups protesting against white nationalists. skinner says there is a loophole in the current law. she says the changes would allow full prosecution of groups pushing for hate speech. this is in response to the protest in charlottesville. also happening today, a palo alto unified school board will discuss spending more money to investigate reports of harassment and misconduct involving students and staff. palo alto reports this morning that the district wants to spend $200,000 more in order to look into palo alto reports. they have already spend the $200,000 allocated. palama palo alto online says this has already affected the district since may. they would consider suspending expired visas for eight days. nbc's kristin dahlgren reports. >> reporter: this is really the latest move in the tit for tat that's been going on between the u.s. and russia. the embassy in moscow announcing it will temporarily stop issuing non-immigrant visas in russia, and for any visas it is issuing, you can only get them in moscow now. a direct response to russia saying the u.s. had to reduce personnel in russia by 755 people. the state department says moscow's order really calls into question russia's seriousness about pursuing better relations. the state department spokesperson tweeting, the reduction in personnel means staff needs to focus on u.s. needs first. about 250,000 russian tourists visit the u.s. every year, so what has russia's response been? foreign minister lavrov was frosty saying they're trying to propose discontent among their own government. although he said there would be no immediate reciprocal action and they wouldn't take it out on u.s. citizens. but if the past is any indication, i don't think anyone would be surprised if relations continue to spiral. kristen dahlgren, nbc news, london. continuing coverage now. lawmakers pushed to tackle california's affordable housing crisis. renters pay 50% higher rates compared to other states. homebuyers facing prices that are two and a half times higher than average in the rest of the country. >> there is a housing crisis. in the last 10 years there's been a reduction of two-thirds of the funding on the federal level and affordable housing funding. >> anything above 500,000 still has some play, some inventory there, but below that number, it's quite a dogfight out there. >> state lawmakers return on monday. they will then push a regulatory package that includes regulatory reforms, plus money for low-income housing. this morning more complaints over apple's new headquarters in sunnyvale. they talked to the mercury news this morning, and they say the new space campus now blocks their view of the santa cruz mountains. they say it is a prison wall and that the construction continues to disrupt their daily lives. apple says the company sees all the complaints and is working to minimize the impact on people in the area. a los angeles jury awards a 63-year-old woman nearly a half billion dollars, and it's a verdict against johnson & johnson which finds that the company failed to warn the woman about the cancer risks associated with its talcum powder. >> but johnson & johnson maintains its products do not cause cancer. the company plans to appeal that case while fighting many others. nbc's joe fryer has the latest. >> reporter: do you have any fear that you might die here? >> yes. >> reporter: she said she used johnson & johnson's baby talcum powder for years. now she sued the company, saying it failed to warn her about the talcum powder's cancer her video was played for the jury. she was too ill to attend the trial, but monday she learned the jury awarded her $417 million. >> my client, i think today, has done what she wanted to do. she's going to die. she's losing that battle. but she's so happy she won the battle for the other women in this country. >> reporter: johnson & johnson is facing thousands of lawsuits from women who claimed the company ignored studies linking talc to ovarian cancer. in four other cases, juries awarded damages totaling more than $300 million. johnson & johnson is appealing those verdicts and plans to appeal monday's decision because the company says, we are guided by the science which supports the safety of johnson's baby powder. her company did win a trial in march while another suit was thrown out by a new jersey judge. >> you don't put a cancer warning on a product that doesn't cause cancer. >> reporter: bart williams, a lawyer for johnson & johnson, spoke with nbc news before this week's verdict. the company argues the most credible research proves baby powder is safe, pointing to government agencies, including the national cancer institute which wrote in april, the weight of evidence does not support an association between perrenial talc exposure and a risk of cancer. >> the thought that johnson & johnson would sell that product knowing it can cause cancer in women is just outrageous. >> as for ava, her attorney says it's possible she won't live another month. she wants johnson & johnson to add a warning label to its baby powder, but the company has no plans to do that and says it's preparing to defend itself continually in future trials. tina went to use the new card, she was told it only had $2 on it, not 79. target told her the card was used in las vegas. tina said she was overseas the day of that transaction. she said she showed target proof that she was not in las vegas but never heard back. so she reached out to us for help. we contacted target and it sent tina a new gift card for $79. target didn't explain what happened. in a statement it just confirmed it had resolved the issue with tina. gift card fraud is rampant. some thieves have even figured out how to steal from your card right after you purchase it and ar >> we're going shopping today, that's great news. we do have some good weather out there for no matter what you have to do, about to head out and run some errands or getting ready to pick the kids up from school. i want to give you a tour around the bay area. it's 62 degrees right there in tiberon, and 65 degrees in berkeley. as we get a look at a foggy coast in daly city, right now it's 60 and you'll get a little bit of clearing as we go through the day. the 7-day forecast is at the bottom of the screen to show you it will be heating up the next several days. we can still in some spots leave the air-conditioning off. we'll be at 82 degrees today in san jose. a little warmer in gilroy, up to 86 degrees. east bay also looking at some upper 80s there. from concord down to danville, up to 89 degrees, while oakland today up to 72 degrees. also some 70s for much of the peninsula, san carlos at 75 today. and palo alto looking at a high of 77 degrees, 70 in the mission district, and that is where we'll feel just a little bit warmer than it did yesterday. we're also feeling a slight boost in those temperatures in the north bay. napa, we're going to see that high there up to 81 degrees. no matter what you have planned for this afternoon, maybe it's a beach day. if you're going to a spot like santa cruz, it's going to be in the low 70s for much of the early afternoon. we're going to see those temperatures holding steady and then this evening cooling off as soon as the sun sets back into the 60s. in sonoma and napa valleys, into the upper 70s. we could briefly hit the low 80s there but it's mostly going to stay in the low 70s for the afternoon from 3:00 to 6:00, then some upper 60s at 7:00. we'll also feel those winds picking up from the west at about 10 to 15 miles an hour. you won't feel as much of a wind if you're going golfing in the tri-valley. throughout the rest of the evening it's going to be warm, too. today begins that warming trend and will continue to have some higher temperatures heading into the weekend. so if you want to go golfing, today is probably your best day. in the upper 80s for much of the afternoon. make sure you bring some sunscreen. we're also going to see mostly sunny skies in san francisco over the next several days, but we do have to start out with those clouds. we haven't had the deep marine layer giving us the fog that we've
