are worried about erosion. rob mayeda kicks off the coverage. it's been fairly light so far. >> in most places north of san jose we haven't seen a whole lot. san francisco, you have a lot of clouds and 64 degrees. that's dry golden gate bridge. we have been seeing rain showers over downtown san jose. also 64 degrees. mild temperatures. you see the rain now has moved off towards alem rock and the s sunol grade. a little more approaching the coast. impressive view on the satellite. check out the area of low pressure off the coast of southern california accessing some tropical moisture. that's what makes this system particularly interesting as we have flash flood watches up just to our south from monterey county actually all the way down into southern california, the entire coast south of monterey now seeing flash flood watches as the heavier rains arrive. between this time and 5:00 this evening, not a lot of rain coming down. we think the totals will accelerate upward as we approach 1:00 a.m. some spots could close in on an inch of rain. this is the first of three storms over the next five days. the latest ones you can expect coming up in a few minutes on the second and third storms. >> people in pacifica are holding their breath hoping not to see a repeat of this, where waves take down part of the cliffs where apartments are precariously sitting. that's a story we have been covering for the last year as the seawall crumbles. pete suratos joins us live from pacifica this morning. you had a chance to speak with the city about storm trucks here and given everything that's happened last winter, what is being done differently? >> reporter: good morning, sam. i spoke with the public works department here in pacifica. they tell me they'll continue to monitor the coastal bluffs. you see the waves. it's pretty standard right now. i tell you, when the storm picks up, the waves can ghit 15 feet and jump over the seawall. >> it's pretty when you are looking at it. if it takes you by surprise, it's pretty startling, you know. >> reporter: very valuable warning for folks if you are walking along the pier or promenade. no doubt about that. last winter with the el niño storms we saw the homes evacuated due to concerns of coastal erosion on the cliffs. the city had to make repairs to different parts of the popular promenade. specifically, there was a seawall severely damaged. they'll monitor the bluffs and the seawalls and storm drains in the next few days. the city is reminding folks to do their part to stay out of home's way. >> for the public is knowing their surroundings and stuff as far as the coastal bluffs. that seems to attract a lot of folks to the bluffs to look at the ocean. so just be careful where they're walking and obviously turning your back to the ocean is always not a good idea. >> reporter: remember, a couple of weeks ago the city council here in pacifica voted unanimously to move forward on 12 more repair projects. the seawall that i just mentioned that was in need of repair at the promenade is about 90% finished according to the city official i spoke to this morning. take a look at these waves right now. you to explain. >> reporter: it took us an hour and a half to get here from san jose after commuting hours. just off 101 outside of sfo at the split. san bruno avenue, the interchange, the ramp for 380 is behind me. during normal commuting hours things slow to a crawl. caltrans believes it may be because there is no continuous express lane extending from here to santa clara county. transportation leaders have called a special meeting tonight to talk to community members about what should be done. this is cellphone video shot earlier of the amount of -- just showing the amount of congestion drivers face on the 101 corridor every day. stop go and go traffic. the red on the map shows which section of 101 caltrans is looking at. the southern segment would start at the end of santa clara's express lanes and extend to whipple avenue. the northern segment is from whipple to the 380 interchange where we are now. caltrans is looking for feedback as well as to discuss any concerns over environmental issues. they are having that meeting, again, tonight at 6:00 at san mateo city hall. reporting live in san bruno, lili tan, nbc bay area news. >> coming up right now, finally some late at the end of the tunnel for people who are trying to use the dmv this week. computer problems have plagued offices across california ever since monday. now they're almost fixed. here is a live look right now at the office in santa clara. you see folks are back there getting their tickets and getting services done. that's a pretty recent development, though. it only happened as of this morning. the dmv says there are only six offices left statewide at this point that are fully disrupted by the outage. almost 190 in the state of california. earlier this week many dmv offices could not process any transactions. dmv officials say you can avoid paying penalties basically by writing a letter in to the dmv explaining what happened. video from a bay area based coast guard crew making a massive cocaine bust on the high seas here. $73 million worth of drugs. members of the cutter here seized 5600 pounds of cocaine last month from a make-shift submarine off the coast of central america. the crew detained five smugglers. the crew is only now returning from its most recent mission. so far this year the team has helped to seize more than ten tons of cocaine. authorities are investigating the discovery of a body not far from hilltop mall in richmond. the chp right now only tells us few scarce details about this. it happened a little bit after midnight. a pedestrian was found dead near the on-ramp to eastbound 180. no report if there was a kind committed or what kind it was. we're still reaching out to richmond police for an update on that story. more crews in the hit and run of south bay. the driver of this white acura left a bicyclist in critical condition on fremont avenue 10:30 in the morning. the the car should have damage on the front windshield, possibly the front bumper and passenger mirror. happening today, a south bay father accused in the deadly beating of his own baby returns to court for the first time in two months. san jose police arrested matthew zabala. he is facing murder charges in the death of his 6-week old daughter. he is also facing separate charges tied to domestic violence. later today he is scheduled to enter a plea in court. the raiders could be getting a boost for the "d" a boost for the "dd." smith applied for reinstatement. his one-year suspension for violating the league's substance abuse policy officially ends on november 17th. smith had previously been to rehab in 2013. that followed two dui arrests and he served a nine-game suspension for that in 2014. the search for a chinese sailor has been suspended as he was attempting to sail halfway across the world. it's a journey that began in san francisco. he set sail last week bound for shanghai. the coast guard released this videophone the sailor's boat spotted near hawaii on wednesday. you notice he is not on board. the man has not been heard from in over 36 hours. he was attempting a nonstop solo transpacific sailing record. staying in the waters right now, mystery at the beach. marine biologists today will try to find out why a blue whale died and washed ashore near thornton beach in daley city yesterday. the species is endangered. the last blue whale discovered in the bay area washed ashore in 2010. coming up next at 11:00, the faa is ready to hear complaints over new flight paths over the peninsula. when you can make your voice heard zto, celebrating its ipo on the new york stock exchange this morning. it's the biggest ipo of the year, raising $1.5 billion. the stock is getting punished in trading this morning. apple generating buzz. the company is in the midst of yet another product announcement. showing off new mac computers. scott mcgrew joining us right now. what's new with these? >> new macbooks, something we haven't seen from apple in a long time. they're faster, thinner, better, more powerful. tim cook here pointing out it's been almost 15 years since apple's very first powerbook. the newest laptops have brighter screens and, according to apple, show 25% more colors. i didn't even know there were more colors to show. here is phil schiller talking about some of the thinness. but the top feature is a tough screen above the keyboard. it's contextual. it will change its function depending on what you are doing. other news this morning, twitter did, as expected, and announced it will cut 9% of its staff. that works out to 350 people or so. the company cut about the same number this time last year. ceo jack dorsey has a lot of challenges. i'll tell you about three. it put itself up for sale. but few companies were interested in buying twitter. nobody proposed. secondly, slow growth. while more people use twitter each month, the growth is painfully slow. and lastly, stocks -- twitter stock is under its own ipo price. they're using stock to pay some of the employees. this is a vine. in a surprising move, twitter said it will shut down its vine app sometime in the near future. little videos, usually sort of comical like this one. in a post, twitter says nothing is happening to the app today, but they are going to be able to shut them down at some point. the vines are on the website. you will not be able to make new ones. you'll be able to watch the old ones. twitter doesn't say why. sam, live video is where everything is moving. pre-recorded short videos, maybe not as interesting, the vines, as they are, say the facebook lives. >> you're absolutely right. live video part of it. also instagram developing its own video as well eating into that. >> they all have them, right. fishing nets designed to catch swordfish are reeling in more than that after the california coast. endangered animals like whales and sea turtles have been caught and killed inside the nets. fishermen say the impact is overblown and call the nets a necessary tool. tonight at 11:00, our investigative report takes us off the coast to show us the real impact. he's obtained 25 years' worth of government records to find out just how often sea life is actually being killed. >> these are invisible curtains of death placed in the ocean. everything that swims into it becomes its victim. >> other states, and even the united nations, have taken steps to either ban or restrict the use of these nets. so why is california allowing it, and what's at stake for the fishing industry off our angeles station that he has been arrested several times before for protesting other causes. otis says this was an act of civil disobedience. he wanted to remove the star and auction it off to raise we've been talking about all morning, the rain. rob, you said we're tapping into serious subtropical strength to get it moving. good morning. >> it's a statewide impact. it's the south bay right now toward morgan hill. to the east you're seeing showers and rain across the santa cruz mountains. most of the bay area not seeing much. the first line of showers has moved to the east. a little more approaching the north bay into the afternoon, but you can see the system cranking up offshore. it's off to the southwest of southern california. the area of low pressure will track a little more northeast heading towards the evening. that's why evening and overnight we should see the rain rates increasing for parts of the south bay. south to north close to what is a weakening hurricane seymour. some of the midlevel moisture is spilling towards california. it's the connection the weather models have been hinting at for days. what changed is a lot of the moisture is being redirected south of san jose. in the coast and monterey county. soberanes fire burn area under a flash flood watch. if you're heading south the watches extend all the way down. highway 101 into santa barbara and los angeles. very mild right now. that's the other aspect of this storm as it pulls in the subtropical moisture, the air is quite warm. it usually holds extra moisture. between now and 7:30 the rain totals are not expected to be that extensive. highs today in the upper 60s. later tonight and early tomorrow morning the weather models indicate some of the deeper moisture will start to work closer to the bay area from midnight until 7:00 a.m. tomorrow morning. that will be our opportunity to see the rainfall totals go up. still a chance to see some thunder overnight into friday morning. the 7-day forecast. we'll see a break tomorrow afternoon. saturday, a few north bay showers as more rain arrives saturday night into sunday. another break, trying to hold up for halloween. notice it says rain late. and then the fourth system, if you include the one we had earlier this week, that's another system due in on tuesday. the storms stacking up out here in the pacific. the second one that's coming in for the weekend will bring cooler temperatures, lowering snow levels in the sierra but our attention turning to the halloween forecast as the storm drops in by monday night. coming up we'll why she is taking a stand so that her students can sit comfortably. the u.s. charges 61 defendants in a call center scam based out of india. it's a scam that has tricked at least 15,000 people into minutes. school district is kg a lot of - a battle going on between an east bay high school teacher and her school district is making a lot of students uncomfortable. literally. the teacher bought new chairs for her student but the district is not letting the students use them. we have more from san lorenzo. >> reporter: it might seem strange that amy bellamy has 24 school chairs stacked on her apartment patio, but the school where she teaches won't allow them inside. bellamy teaches ninth and 11th grade english at san lorenzo high school. and right now her students use decades' old chairs like this one. she says she has been asking the school district for new chairs for three years to no avail. >> i was like, can i get some chairs? is anybody going to order chairs? i have kids getting poked, pinch, bleeding, clothes torn. >> reporter: she raised $700 on go fund me and bought new chairs that meet district criteria from a legitimate school supplier. she thought she solved the problem. she was wrong. >> my admin told me, no, absolutely not. you didn't go through the right process, et cetera. >> reporter: an e-mail from the san lorenzo unified school district reads in part, the issue here is the chairs were purchased without any approval from an unauthorized vendor amongst other things. for future, ms. bellny can certainly request for a vendor to be reviewed for considerations. the school district tells me they just bought $12,000 worth of new student desks and chairs for the students that should arrive within the next few weeks. but that's still too long of a wait for this teacher, who is now stuck with 24 chairs that she won't need. >> i am just tired. i am fed up. it's not fair that my kids have to sit in that kind of condition. >> making matters worse for bellamy, she has to remove the chairs that she bought from her patio because it violates her lease. well, change may soon come to the skies above to help quiet down airplane noise heard on the ground below. the faa wants to cut down airplane noise. these complaints have been increasing ever since flight paths to is sfo changed last ye. they'll hear recommendations that could alter the right now on the bay area. and it is only a taste of what's to come. let's take a live look right now at the radar. we see those bands heading east there. north and east. the man who knows much more about where this path is going and where we are seeing the most amount of rain right now is meteorologist rob mayeda. >> the radar showing most of the rain hung up south of san jose. periods of light rain at times but nothing really showing in san jose yet. the clouds. similar temperatures but rain drops, nothing north of the golden gate right now. we're watching the surf near the coast. our weather underground camera at ocean beach shows you the skies. wave height 7 to 8 today. the swells will build to 14 feet by sunday. in terms of rain, south of san jose right now, highway 101 down highway 17 to the santa cruz mountains is where the rain is flying right now. over the span of the next two days, santa cruz mountains but especially the central coast will pick up 2 to 3 inches of rain. there are more systems to follow. here is what we're seeing now and stretched out across pacifica. energetic pattern, a developing storm that will become sunday's system. another one behind that. so we are talking about three storms, and the rain totals adding up. over five days. a full look at that and the possible impacts on our halloween forecast coming up in a few minutes. with all the wet weather there is a new wet-weather solution for cable cars in san francisco. a special type of crushed glass is being used in combination with a rubber-like adhesive. that allows those folks -- the cable car operators to be able to turn around the cars at the end of the line without slipping. in the past you know how they used to do this? with duct tape. so they're evolving there. our nbc knife held up a store at the hillsdale mall in san mateo last saturday night. here are sketches of the man and woman reportedly responsible. police say they were looking for a safe inside a store but ended up leaving without money or valuables. call san mateo police if you have information about those suspects. out of jail and back at home. san francisco film maker and activist kevin epps is accused of killing an acquaintance at his home on monday. the d.a. says there was insufficient evidence to file charges but the investigation continues. a tearful epps spoke to us. he sat down with nbc bay area's cheryl hurd. >> reporter: questions that need answers tonight. did kevin epps have a gun? if so, did he pull the trigger? and did the victim have a weapon? police are not answering those questions tonight. all epps and his attorney would say, the d.a. made the right decision. >> i can't really convey what i am feeling because it's highs, lows -- >> reporter: the lows? police arresting kevin epps for allegedly killing a man in his glen park home. he attributes the highs to the fact that he is now free. >> i am just really about uplifting, empowering my people. >> reporter: epps has been doing that through film for 20 years. he is best known for documenting the effects of violence in san francisco's poorest neighborhoods. he never thought he would become the focus of a criminal investigation. >> i can tell you it's a case of self-defense. >> reporter: the victim, marcus polk. the two men knew each other. polk's son spoke to us on monday saying his father may have come to epps' home uninvited. >> call the cops, have the guy exited from the building. don't [ bleep ] kill him, man. >> the d.a. has not closed out the possibility there could be further charges. that's why we are being careful about what we say. >> reporter: tonight the two were direct in applauding san francisco's criminal justice system for not pressing charges. >> there is justice for a black man, you know, i got a lot of friends, a lot of stories. i am one of them. and, you know, i thank san francisco for making the right and just decision. >> reporter: in san francisco, cheryl hurd, nbc bay area news. some disconcerting numbers now. higher percentages of blacks and latinos are criminally charged in santa clara county than other racial groups are. that is the conclusion of a new study by the santa clara county district attorney's office which finds that latinos represent nearly half, or 45%, of all criminal defendants in the county. 10% of those charged were african-american. 24% of the defendants were white. as for asians that figure was 9%. the d.a.'s office plans to conduct further studies on the reasons for the gap. two san francisco city workers are being called heroes this morning. what they did was amazing. they stepped in to stop a bloody knife attack on market street. footage shot just after the stabbing on tuesday shows police officers holding the suspect down. you'll see it in just a second. the suspect is identified as a 37-year-old transient. police say the suspect asked a man nearby to borrow his pocket knife and then attacked the knife owner for no reason. two mta workers happened to be driving by at the time, saw the incident unfolding. they got out of their truck and tackled the assailant. >> there was a gentleman lying on the street over here, actually, who was clearly injured. it almost looked like six or seven emts around him with a giant crowd that had gathered. >> the mta sent out a letter of recognition to honor what the workers did, citing their bravery. the victim is expected to fully recover from his injuries. there is a new twist in the ongoing battle over the sinking millennium tower. the city of san francisco is blaming the people who live in the building for not solving their own problem. the statement uncovered to court papers after the tenants sued the city. jackson vander becken reports it has the condo owners there fuming. >> reporter: pat dodson owns a unit on the 42nd floor of the millennium tower. she says she is tired of the finger pointing over who is to blame over the sinking building's problems. >> there is no reason not to go forward and fix the building. it's only getting worse. >> reporter: she is especially upset by the latest twist in the blame game. the city of san francisco has just filed legal papers arguing that the condo owners themselves are to blame for their problems. specifically, the city says, the owners knew about the sinking problem for more than a year and failed to do everything reasonably possible to fix the problem. the city says owners knew about the issue at least as early as june 2015 but did nothing. even as the building continues to sink, the city argues there has actually been no damage to the units other than negative public perceptions due to bad publicity. the city says owners still have unimpaired use and enjoyment of each of their units. in the legal documents, the city argues the residents should go after the developer, millennium partners. it also says the residents should go after the architects and engineers saying the city is immune from liability. >> the city knows better. clearly the building is not stable and not secure at this point from the risk of an earthquake. >> reporter: nbc bay area news. >> at some point hopefully that gets cleared up. we're seeing plenty of rain out there, rob. where is it concentrated right now? >> the south bay. you see the storm has access to a lot of subtropical moisture aimed in for now on the central coast and into parts of the south bay including san jose. this is the first of three storms we are watching over the next five days. the latest in your microclimate forecast when we come back. a $250 mistake when selling concert tickets. i'm chris chmura. nebras nbc bay area responds next. to a south bay manhlearned that trying to seltkets on "stubhub" can be l nbc bay area responds to a south bay man who learned that trying to sell tickets on sub hub can be very costly if you are not reading all the fine print. consumer investigator chris chmura joins us with that man's story. chris. >> reporter: good morning. dan had two cold play tickets for the concert at levi stadium in december. he needed to sell them so he went to stub hub to do just that. he uploaded images of the tickets on the software of the site noting the section, row and seat numbers. there was one thing the software didn't note automatically, that the seats were limited view which was printed on the tickets. when the buyer purchased the succincts and noticed they were limited view. they complained to stub hub which canceled the sale. it canceled the sale and charged dan $253. the additional cost to the buyer to purchase another pair of tickets in addition to the ones he thought he was buying from dan. dan was floored. he did make a mistake here. stub hub shared with us a screen shot of the disclosure section during the process where dan should have shared for his seats were limited view. dan insisted it was an honest mistake and stub hub ultimately agreed with him so it refunded fan the $253 as a one-time courtesy. take your time when navigating a process like this, read through everything and don't skip any steps. by the way, dan went on to successfully upload about to be removed. they're lighting the last symbolic fires of the season at ocean beach at 10:30 this morning. the san francisco fire department joined the rangers for the symbolic good-bye. they'll be there teaching preschoolers about fire safety as well. beach fires will not be allowed again until the end of february. we've been seeing just a string of rain storms this morning. rob mayeda will let us know where the latest rain is. >> most of it hung up around the south bay. interesting trajectory for the moisture being drawn into the system, some of it coming away from a weakening hurricane to the south. this is hurricane seymour at the bottom of the screen. winds at 80 miles per hour weakening rapidly. the upper-level moisture drawn into central and southern california. as we zoom in more you'll see areas north of san jose not seeing a lot right now. that should be the trend for mid afternoon today. closer to san jose, you're seeing light rain and the temperature 64 degrees. the wind out the southeast at close to 12 miles per hour. areas south of downtown around highway 85. south san jose into morgan hill and the santa cruz mountains seeing scattered showers for the moment. as we head through the evening commute, that's when we think the rain will begin to spread and become a bit more heavy at times as we head overnight tonight into some of the heavier showers moving through the central bay. quickly towards tomorrow afternoon we'll see late-day clearing and showers lingering around the hilltops of the santa cruz mountains. for monday things look dry. monday into tuesday another storm crosses into the bay area. sierra snow levels close to 10,000 feet. by monday dropping close to 6 thought feet. for halloween we could see 6 to 8 inches of show around 7,000 feet and maybe more than that as the tuesday storm rolls in. if you have plans in the high country this weekend, be prepared for rain and wind through saturday and quickly dropping snow levels on sunday. now the halloween outlook for you. we're calling for ghostly cloudy skies through 7:30 in the evening. as you saw there on the storm time line, it's monday night into tuesday, look at that, 9:30 you start to see the rain cross through. sunset this time of here is at 6:12. if the trick or treat times are early in the evening, things look okay. you notice the rain does fill in by monday night into tuesday. playing that out across the board on your 7-day forecast. brief break friday into early saturday. sunday breezy and rainy. there you go. halloween night late into tuesday, the rain keeps on going. in fact, the long-range models keep chances of rain every 36 hours into the following weekend as well, starting off november on another wet note. sam, parents who need help juggling work, school and after-school activities. jessica aguirre took a ride with a company called zoom and found it's not just busy parents are benefiting. >> how are you? >> good. >> reporter: think of it like uber for kids. >> go ahead and hop on in. >> reporter: instead of curb to curb service there is child care too. >> you're welcome i4 days a week this sixth grader uses zoom to get home, get a snack and get to gymnastics when her parents are tied up at work. >> it lets me be independent and without my mom being on my tail all the time having to take me from like school to gym and all that and be like, do you have your snack? do you have all this? it's nice to get a break from that. >> reporter: zoom is one of the handful of start j-ups making inroads. ka dm,go and hop skip provide drivers with child care backgrounds to busy bay area parents. this woman started zum after a start at ebay. it had ten drivers when it laurened last year. >> all of our drivers come from child care experience. they go to phone and in-person interviews. they're fingerprinted, background checked. >> reporter: the majority of drivers are women, made up of stay at home moms, nannies and teachers. plus army veterans like this woman who home schools her four kids. >> being a stay at home mom you can feel left out. >> reporter: after two months on the job she says she feels empowered. bringing in $24 to $32 an hour. >> i feel good toos a a financial contributor to my family. my husband said your confidence level has been way up. >> reporter: the price for parents? rides start at $8 for car pools and 16 for solo rides. >> it's fairly easy to use. >> reporter: coco's dad says the extra cost is worth it. he receives notifications during every step of his daughter journey. >> life beforezum was chaotic. >> reporter: there is no guilt. coco prefers it this way. >> yo, mom, do not watch this! >> reporter: going it alone. >> bye! >> reporter: makes her feel all specialized ride-hailing companies are popping up too. lyft for seniors and safer for women. it launched in boston and is coming to california next year. when we come back a look at the bay area's ill
