Team coverage of this storm since 4 30. This mid day we have even more angles covered. Man of the hour is our meteorologist who has been using our newest piece of Weather Technology to track that storm. Yeah in fact were showing you all morning the storm ranger how it is scanning the skies and showing those rain droplets on our lens. Look at the rain fall. In San Francisco we didnt have as impressive amounts still a little more than a quarter inch and near soma about a quarter inch there. And near sfsu a little bit more than a quarter as well. Down the peninsula not as much Half Moon Bay less than a quarter of inch. There it is, tracking the rain making its way to the inner bay and will pull south into the south bay as we make our way home for the rush hour commute. This is just the first system of a series of two headed our ways over the next couple days. Lets talk now about our Newest Technology storm ranger. There it is sitting a top mt. Allison looking all good in its glory. You see the rain falling over the radar site. Light midst and drizzle. Again our storm ranger, the reason it has such awesome capabilities because it can do a 7 1 scan compared to the National Weather Service Sites and it has the highest resolution you can find as far as radar tracking. We will track these storeles as they move on these storms as they move on through. Meantime scott will handle the rest. I want to tell you about a major mess that is still on the road. This is on 101. The first video in of a big rig loaded with produce over turned during rush hour so salad shutting down the lanes. Live look at highway 101 in palo alto. 880 on your right. You can see how great it is out there. Indeed we are tracking all of the problems. You know this is the fall shuffle over here. They had all this produce on the roadway that truck clearly has all this clean up to do. We still have the clean up but thank goodness we have the video at that level of the clean up. I want to show what the traffic shows right now as the system continues in. This. You can barely make out the lights coming north bound. There is still four lanes of traffic blocked in the north bound direction at san p. E. D. Ro road. Lets show you the map. Still very slow heading towards lincoln and north san p. E. D. Ro. Lincoln and north san pedro. That is the toughest dry for the bay. And soupy conditions making it tough to dry. The earlier problems for bart, there were power issues in the area, look like theyve been resolved. Still a ten minute delay on the corridor. Weve had soupy conditions in oakland and windy in the hills. South of there were still okay. Black to you. Power knocked out to tens of thousands of people. Numbers continuing to cliel. Climb. Were told theres 23,000 Power Outages or homes without power across the bay area. Mostry in the east and north bays. We will continue to monitor that. One of the biggest areas without energy is richmond. We sent pete there what are they telling you this morning . Yeah, good morning, scott. Pg e says around 12,000 people affected by the Power Outages in the east bay. Were near 23rd street near richmond and sutter avenue. You see pg angd e are working on a down power line. Folks tell me it was the wind this morning that knocked down that power line. Even causing some flames in the area. Thats what theyve been working on for at least the past couple hours. This issue is pretty widespread throughout the city. Lets go to that video we shot off richmond parkway. You can see the traffic lights are out. At richmond parkway and pittsburgh avenue causing quite the back up during that morning commute. We did speak with local businesses talking about scrap metal. We talked about how their power is out as well as local customers, heres what they had to say. When we get power to the scales we could probably do something but looks like not right now. It happened this morning i think around like maybe 4 00 or 5 00. I was sleep and i woke up and it was just dark and i was like what happened, my dad was like, its power went out. I was actually up getting ready for work and it was around 6 30 the power went out. And we were bouncing around also to the north bay this morning. Youre seeing video of winedsor and rain and that area raining as well. Right now were seeing the pg e crews leaving, they dont have eta when power will be restored to the area but did tell me all hands are on deck at this time. Nbc bay area news. Pete, thank you. The storm amping up Major Concerns in pacifica as whipping waves pound the coast. Theres worries erosion will bring down more buildings. We continue coverage live in pacifica. Youve been there all morning. Any signs of things calming down . Doesnt look like. No the waves are definitely much larger, could be because the tide is in. You are seeing swells out there easily in the 15foot range. This is not the worst weve seen it over the years. Before weve seen the waves easily crashing on to the street. Still if you look to your right there are some people who have come out here. It is a spec ackle to see the first storm rolting in. No surprise the National Weather service has issued a Coastal Flood Advisory extending to 9 00 tonight from point reyes down here to pacifica down to big sur. There is concern in the city pacifica specifically about what these large swells do to the cliff side. Drone footage you will recall last year one apartment complex was red tagged and evacuated as it teetered on the edge. Another one owners took down out of concern near the ocean. And the prom [ inaudible ] last year damage the by the storm. The city voted to spend 3 million for a dozen repair projects look for the funding. Go for the grants. We have to worry about our City Infrastructure for one thing and the safety and health of our citizens. The city of pacifica still needs to fix part of its sea wall from the damage last year. The plan is to partner with the army corp of engineers to get it done. Weve got quite a bit of surf out here. Month surfers, probably too dangerous and the winds are still sustained. People in the area are told dont get close to that. Obviously stay away from any downed power lines. Pg e tells us more than 12,000 people are affected by the Power Outages in the east bay, a good chunk of them here in richmond. They are working on the downed power lines. A san jose marijuana shop has refused to pay the citys business tax for years. Its now ready to strike a deal but the city may not be willing to take the money. Investiga Investigative Reporter to explain. Guys, this all centers around why the shop decided not to pay taxes in the first place. According to the federal government possessing and selling marijuana even for medical purposes is illegal. At the same time 26 states have laws on the book thats allow the medicinal use of marijuana, including here in california. That confusion has led to a bitter fight in san jose around over 1 million hang in the balance. David armstrong proudly grows all this marijuana. He runs medi marts a pot shop in san jose. But for the past four years hes openly refused to pay the citys 10 business tax, which is required of all medical marijuana shops. He owes at least 1. 3 million. Why is he stalling . He believes paying his taxes could land him in prison. I wasnt going to pay a tax that breaks state and federal law and be looking at ten years to life. Armstrong and his legal team believe paying the tax would mean theyre admitting to selling marijuana. Which is still illegal under federal law. So medi marts sent this offer to the city of san jose, its willing to pay 1. 3 million with a catch. The deal says the money will not be labelled as a tax but instead a contribution and the citys right to randomly inspect the shop would also have to end. Do you see any problems with the offer . I think theres concerns. Richard doyle is the City Attorney for san jose. You dont want to send the message you dont have to play by the rules. One way or another were going to get the money. In july a judge ordered medi marts to pay up but has appealed to the Supreme Court but a decision has not come down. To say there isnt continuing resources and everything spent by the city to fight this is that a consideration with this. You dont see it a matter of if they have to pay, its when. I think theres risk but i think we have the upper hand. David ball is a law professor at Santa Clara University and specializes in marijuana regulations and policies. Theres going to have to come some day of reckoning because right now were speaking out of both sides of our mouth. State saying its okay for people to use and the federal government saying its not okay for people to use and theres been no attempt to reckon ill those two. But the professor says as long as they are admitting theyre enabling others to possess marijuana many exposes them to criminal liability. So not paying tax the only way they can protect themselves from federal prosecution is by not engaging in any potissession of marijuan at any point. In choosing not to pay the tax now theyre breaking local laws. Thats right. Lawyers for the pot shop disagree. Attorney saying they believe san jose is playing a dangerous game of semantics. If the tax were worded differently for Different Reasons than theres no problem but the word sales in there. The word business is in there. So its a matter of characterization and what its for. Regardless san jose believes its owed even more money because of penalties and interest thats accrued. The city council will likely decide by the end of the month whether to accept armstrongs deal or keep fighting him in court. If youre asking me to break the law, state and federal law, simply so you can collect a tax on a sales or transition of a controlled substance we simply cant do it that way. Well federal law does ban the use of marijuana, federal government has guidelines that says prosecuting someone isnt likely if they follow local laws and regulations. In fact of the 16 pot shops in good standings in san jose the city tells us none have ever faced prosecution from the feds for paying their taxes. Really for about 5 00 or 6 00 well see the showers push in. This is 9 30 in the evening. Look what happens between 9 30 and 6 00 in the morning. It just rains in the same location. Saturday night into sunday. Thats where we will have the issues. We will get enough rains with strong winds talking about more Power Outages and more trees into saturday and sunday. Rain fall from both storm systems, we could get half an inch in the south bay. And more than an inch in Half Moon Bay. That will be heavier pockets of rain. Potential for more than an inch is possible for the next couple days just depends when this system is going to stall out. Right now looks like it will stall out to the south bay tomorrow night into sunday morning where we will get higher amounts of rain and stronger winds.
