Part of the challenge for cal fire is that the conditions out here in the Santa Cruz Mountains are super dry. So dry, in fact, that in some places the fire is returning twice. Just because the fire has burned through here once doesnt mean it wont come right back. Reporter cal fire battalion chief tom mcewan has seen the flames scorch the vegetation and then return a second time with 100foot flame heights to take out what was left behind from the first run, turning the hillside into a moon scape. Completely burning out the second amount of fuel so were almost having to deal with the fire twice in places. Reporter not unheard of but highly unusual. Proof the extreme fire behavior caused by the drought. The fuels are in the 90th percentile. Explosively dry. Things are happening this year that we dont see in normal years. Were going to get started with reporter at this mornings briefing in gilroy, cal fire announced that it was able to hold the fire lines overnight. Firefighters are optimistic that todays temps, which are about 10 degrees cooler and the humidities, which are higher in the upper teens to mid 20s, will allow the 1100 men and women on the front lines to come closer to conquering this inferno. The School District tweeted out that administrators have instructed principals to keep the students inside to avoid potential Health Risks Due to the smoke. The firefighters will have cooler temperatures today, but there is a new concern. Wind. Meteorologist rob mayeda has the breakdown. Weve been seeing surges in activity. The rooftop camera from san jose state meteorology shows you the smoke fanning out. The temperatures have come down. 78 degrees along the fire lines. Moving forward through midafternoon hilltop temperatures till in the 80s. But down quite a bit from yesterday. Good news for humidity as you see the band of green showing up, heading through this afternoon into the morning as the marine layer deepens up, well see decreasing humidities, decreasing temperatures and wind could be an issue. The winds have not been too gusty of late as we head through the afternoon and the onshore winds pick up we could see wind speeds picking up. The onshore breeze means the temperatures have cooled considerably. Almost 20 degrees cooler in a few spots than the same time yesterday. The cooling trend right now thats going to have our temperatures in the 50s, 60s and 70s across the bay area could lead us into showers in the weekend, possibly the first rain of fall ahead in the 7day forecast. A sobering site yesterday in the north bay after a brush fire ignited by some kind of vehicle spread to a home in petaluma and really an entire neighborhood and proceeded to wipe out several homes to damage many others. The fire broke out yesterday afternoon along 101 and shut down both northbound lanes for an hour. Investigators say the fire was likely sparked by a vehicle. Of the 14 homes damaged, four are destroyed. You may have felt it. A minor quake shook aert pa of the south bay this morning. A 3. 2 quake hit at 8 26 this morning. People are now demanding answers following a deadly incident last night in the san diego area. Protesters gathering at the scene of a the shooing which happened near a san diego area strip mall. Officers shot a black suspect who they say was acting erratically and failing to comply with their instructions. Now, witnesses contradicted that statement when they spoke to our sister station in san diego, to the reporters there. Police also say that video that you are looking at right here provides proof that the man had his hands up and appeared to be holding something in a confrontational style at the officer. Thats a still from the video released by police. We are not sure what hes holding but it does appear to be something. Police are calling for peace as they investigate. Now is the time for calm. The downed Malaysia Airlines flight mh 17 was brought down by a russian warhead imported from russia to the ukraine. This is according to a dutchled team of investigators. Theyre accused in a beating last july that left an inmate severely injured. Both face one county of felony assault. The former inmate Reuben Garcia says the guards gave him a fractured jaw and other injuries. Contra costa county workers are locked in a contract dispute and they are promising and threatening to walk off the job on friday. The union represents some 1100 county Service Workers and their last contract expired back in june. A new bargaining session is set to take place tomorrow. The union says the workers will walk on friday if a deal could not be reached. The workers would return october 5th. Tyson foods is recalling about 132,000 pounds of Chicken Nuggets because they may be contaminated with hard plastic. The San Francisco board of supervisors have unanimously approved legislation to ban official city travel to states that sanction discrimination against the lgbt communities. A nationwide Teacher Shortage and housing crisis Governor Brown signed a bill allowing the School Districts to build housing for the educators. The state agency in charge of protecting us from bad Auto Repair Shops is allowing some shop owners to keep doing business even after being shut down for taking advantage of consumers. Our Investigative Reporter broke the story. Were talking about the bureau of Automotive Repair. Its 196 Million Agency created to help consumers recoup their money when repair shops commit fraud. Over the past year we have uncovered how the agency may actually be failing consumers by keeping the track records of bad repair shops secret. Now we are exposing a loophole allowing shop owners to legally keep doing business even after theyve been shut down for taking advantage of customers. This is broken glass. And youve never had your window broken. No. Ever. Reporter sound confusing . It was to albert delao when he heard the clanking from his suv which hed just picked up from this midas repair shop in san jose. Turns out while at the shop the car fell off the mechanical lift and crashed onto its side from several feet in the air. The bottom of the car was pierced and the passenger window shattered. A mechanic snapped the photos. He told us he and his coworkers were ordered by their boss to fix up the car as well as they could without telling the owners of the vehicle. That now former employee shared the photos and details of the coverup anyway. He tells me the car fell off the lift. At this point im like, no. Reporter management at the shop later admitted to the coverup but blamed their mechanics. After our investigation the bureau of Automotive Repair partnered with the Attorney Generals Office it try to issue penalties and shut down the midas, which is independently owned and operated. Our reporting found that for about 97 of consumer complaints sent to the bureau, repair shops never face any kind of discipline or enforcement action. Details of this specific settlement havent been finalized but the repair shop owners decided to sell off the business anyway and may now end up escaping any punishment while still being allowed to operate other repair shops. We discovered a loophole that allows them to keep serving customers at this repair shop three miles away even though the state accused the owners of committing fraud. The same people own both shops but the businesses are listed as two different corporations. As long as they stop operating under khan Brothers Incorporated they can keep running other repair shops without paying any of the penalties associated with that midas. The bureau settlement does not include any money for albert. Theyre there for the people, which is us. Give us what we lost. We have to find an attorney to help us, to take our case, which we havent found. Everybody wants money up front. Basically we just lost our vehicle because they dropped it. We lost everything. Reporter albert doesnt understand how a Government Agency created to be a watch dog for the auto repair industry can fall so short despite being armed with so much evidence. She didnt do anything. Reporter the bureau declined our request for an interview. Could the agency be doing more . Yeah. Reporter larry moore is a former president of the Automotive Service councils of california, a trade Group Representing over 800 repair shops across the state. He says he has made a career out of fixing bad repairs and wants the bureau to be more proactive in weeding out dishonest repair shops. A complaint triggers everything. If there are no complaints, nothing happens. Reporter so some badacting repair shops are just getting off the hook. Unfortunately. Reporter after seeing alberts story. State lawmakers began demanding changes. Earlier this summer a reform bill was passed to issue a wider range of fines and requiring more transparency within the bureau. Last week the governor vetoed the legislation, calling it, quote, unnecessary. The new owners of that midas tell us theyve replaced most of the employees there. As for the old owners, well, they still blame the coverup on what they describe as sloppy work by their mechanics. The former management also told us, quote, were honest people. Accidents happen. Within the last half hour the state treasurer announced that california will be suspending, quote, profitable relationships with the bank. Theyll also be suspending investments with the bank. These sanctions kick in immediately and will last for at least a year. Today crews begin the process of removing a river boat that capsized in the delta near Bethel Island. The spirit of sacramento sank earlier this month. The boat will be pulled from the water and eventually towed to the army corps of engineers facility in sausalito where crews will remove 600 gallons of oil and fuel.
