escape at elmwood jail this weekend. you can see the sandal left on the barbed fence as he was trying to jump over it sunday afternoon. sources told nbc bay area that inmate made it over the first line but was arrested before he could make it over the second fence that surround the perimeter of elmwood. the sheriff's office hasn't identified the inmate but newly installed cameras captured the attempted escape. cameras were only installed after nbc bay area reported a lack of cameras around the perimeter. >> officials are trying to figure out what sparked a fire in a san francisco neighborhood. we brought you this as live breaking news on today in the bay. this is a building under development between 5th and 6th street. the fire started before 5:00 this morning and it took firefighters an hour and half to get it under control. because the building was vacant, no one was displaced or injured but it could effect the long-term affordable housing prospect there. sf gate said this is one of the most largest and anticipated mixed used developments san francisco has seen in the past few years. now we know there is a high profile field trip out of congressman out of carol costello who want to check the progress of california's high speed rail. pete is in san francisco and talked with one of the congressman who is leading the charge. pete? >> good morning. i spoke with congressman jeff denham. he is behind me at this federal building taking part in the hearing that should be wrapping up soon. he said this hearing is all about holding those in charge of the rail project, finding accountability and transparency, really thinking of it as a progress report of sorts. today's hearing which involved officials with the official administration, caltrans and california high speed rail authority was meant to provide an update on this ongoing high speed rail project. according to the numbers of the subcommittee overseeing the project chaired by denham, the initial cost after voters approve the bond measure in 2008 stood an estimated $33 billion. now he says the costs have jumped to as high as $118 billion. there is also changes in the focus with the developers not focussing on building a rail line first between the central valley and silicon valley. >> look, the federal government is spending a lot of money on this right now and the state taxpayers are being put on the hook on this. and so i think they deserve answers. >> they say there has been progress, employing 276 contractors and say the revenue generator from that line connecting from silicon valley will attract private investors for the rest of the system. the line between central and silicon valley should be wrapped up by 2025. live in san francisco, nbc bay area news. >> conference is scheduled for 2:00 this afternoon. as you know by now, over the summer, three oakland police chiefs stepped down amid a sex scandal involving police officers and a sex worker as well as a probe into racist text messages it which caused two police officers to be suspend just this month. >> across the bay, san francisco's police commission holds its last scheduled community meeting focused on finding a new police chief. those forums are geared toward finding a permanent replacement for greg sur who resigned in may. acting police chief recently announced he would be interested in keeping the job. tonight's community meeting takes place at st. mary's cathedral on goff street. now usually insulated from violent crime, walnut creek sawity first violent murder. a man was shot and killed outside after downtown bar. this happened early a saturday morning as the local hot spots were closing down just steps away from crowingian's sports bar and grill. the victim 38-year-old courtney brown was shot three times in his back. leaves behind a daughter and fiance. griffin is now held without bail. this is only walnut creek's second homicide within almost a five-year long period. >> turning now to the micro climate forecast, i know i wore a jacket out in the field this morning but we are warming up this week as we head towards september. it's been a cool summer for the bay area so far. >> i know a live look outside right now chris as you talk about jacket weather, some of that coolness has cleared way. let's bring in rob with a look at a hurricane approaching hawaii, rob. could that affect our weather here? >> can you see in san jose, one of the spots that was hazy and catching a break on the clouds. temperatures on the way to mid to upper 60s. can you see low clouds clearing. hazy skies in san jose and some of which you are seeing out there now high clouds starting to show up on the weather satellite. 63 in san jose and there are the clouds. this is at the outer fringe after hurricane approaching hawaii by wednesday. could cross the southern half of the big island with wind of 80 miles per hour. with you notice how this mid level moisture is caught up by the upper level wind and directed towards northern california. as this meets up with small weather system approaching our coast tonight. these two could come together for parts of the north bay that may increase a chance for some isolated thunder. now the problem is, the boundary layer below is quite dry. so fire danger risk may go up for parts of the northern sierra and northern coastal range. so how much rain can we expect out of the system? we'll have a look at our forecast in a few minutes. >> thanks, rob. panic at lax on sunday when what sounded like gunfire had people calling 911 reporting an active shooter. it was a false alarm but passengers ran out of the terminals and on to the tarmac for safety. some of them leaving the airport all together. there was chaos, confusion and then massive delays even after the all-clear from police. nbc's miguel almaguer. >> looking for any way out of the terminal they can find. a loud noise mistaken for shots fired inside at least three terminals, an evacuation at nation's second largest airport just before 9:00 p.m. >> why are we running? >> security said to run. >> there was confusion on the ground and uncertainty in the air. appearing on the peninsula for a fund-raiser. we can tell that you event is closed to the public hp his campaign team is not indicating when trump might arrive in the bay area, only that he spent yesterday preparing for debates ahead of the november election. and trump has not received the warmest of welcomings in the bay area. last time he was here supporters and protesters clashed. a police officer was assaulted. you will recall that eggs were thrown at reporters and a few in the crowd were even injuryed. police made close to a dozen arrests during event. all of that was back in june. mr. trump was also here for the california republican convention in april. protesters there blocking the entrance to the hyatt hotel in burling game. trump and his entourage had to stop on the freeway and jump over a barrier to get to the event. >> we are anticipating a big speech that donald trump has coming up about immigration. some people say is t is a change in direction. his camp said he is life this morning after police shot him while he was running. on highway 101, zigzagging to traffic. that man was on 101 on sunday just north of ralston avenue. chp say that man was running to both sides of 101 and through all lanes. police say they tried everything. but all of their attempts to try to get that man off the freeway safely failed to work. >> the pedestrian resisted. a taser was used to no avail to try and subdue him. and that's when the suspect produced a knife, raised it over his head and lunged towards the officer. >> northbound 101 in san mateo was shut down for several hours yesterday morning because of that investigation. the suspect is still in the hospital and has life threatening injuries. >> two young sister will be laid to rest on wednesday. haley and kate lynn marcus died last tuesday when they mom's pickup truck crashed into the river. their mom was at the wheel and managed to escape the crash but could not free the little girls from their car seats. clouds and mid 60s around the bay area and we will show you the beautiful view from tiburon looking off to the south. foggy skies earlier and we did have low clouds in san francisco. 65 partly cloudy skies watching high clouds closely as they increase later on 66 currently in livermore and here is the view into san jose. 65 degrees and our hour by hour temperature is out near san jose state heading toward afternoon. numbers close to 80 down from the average high which is close to 83 degrees. the winds are helping us out in terms of the smoke. you see haze in parts of the south bay but here is the high resolution model looking at wildfire smoke and that's the willow fire there in cal verous county. the bay area, seeing improved air quality for now as winds should keep a lot of the fire and chimney fire smoke away from the bay area today. that's the reason why air quality in addition to smoke particle condition improved and ozone levels looking good thanks to the all day sea breeze and air quality looking good. temperatures close to 80 in san jose. north bay temperatures in the 70s. and mid 80s this afternoon around the tri-valley and then we are going to be closely watching hurricane mad lin here approaching hawaii by wednesday but some moisture is getting drown towards california. that's the reason we see high clouds right now and later tonight a very small weather system get involved with some of the moisture and that as it crosses the coast. we will bring a chance of seeing some thundershowers speespecial late of the golden gate. you will see showers and most of that staying off to the north and you will see the evening commute and this area here north of marin county with the best chance of isolated thunder. now the problem is this is mid based convection. so we think we could see lightning without much in the way of rain. futurecast picking up rain fall sends most of that north of ukiah. in through here and north bay, and lightning strikes and that's bat news that could start more spot fires across northern california. we hope we don't see that. seven-day forecast as system clears on by showing you for san francisco and then we will closely watch areas to the north bay and that inland forecast may see isolated thunder into early tomorrow and trending dryer and warmer approaching thursday. back to you. >> coming up next, from california the state bar was created to investigate complaints and then hand down punishment to lawyers who cheat their clients so people know. >> that's how it should work. but a reporter revealed how the california bar may have been putting legal client at risk. now lawmakers are taking action. >> guys the list of concerns has grown even since the last investigation. questionable financial decisions and high priced salaries for bar employees. lawmakers at the state capitol are still fighting over how exactly to change the bar but there is a lot at stake for you at home. the bar itself and the woman now in charge of it all. >> we have challenges. there is no question. >> elizabeth parker is the executive director of the california state bar. she took the helm last year and is part of major leadership change and a public agency that for decades faced heavy criticism over mismanagement and misspending. >> we've got the right team in place that's working with a board to really make some of the changes that are needed and that have long been mentioned. >> california bar was created by the state nearly 90 years ago to protect the public from bad lawyers. but a recent state audit is accusing the bar of questionable or inappropriate financial decisions. the agency's largest expense is salaries for more than 500 employees but top executives at the bar get paid far more than other state employees in similar leadership positions. and in fact 13 employees at the bar receive bigger salaries than the governor. >> it may not be correct to assume there is just a one size fits all size of pay structures throughout california's governmental entities. that in fact is not the case. >> critics say it is hard to justify salaries when the bar can't even afford to carry outity own basic responsibilities. the state bar has a fund to pay back client who are ripped off by dishonest attorneys. if that fund is dangerously low, according to that state audit, not only to the california bar failed to take steps to address the problem or to communicate the funds true financial situation, it did the opposite. the fund totalled $2.2 million last year. but the bar needed $18.9 million po pay outity backlog of claims. that's a shortfall of $16.7 million. and the audit accuses the bar of trying to keep that gap secret from lawmakers. >> the audit found that some people are now having to wait between four and five years before they are ever paid. >> and that's a real concern. >> parker says the bar has since transferred $2 million into the fund from other resources. but says a long term fix might mean raising membership dues that all california attorneys are required to pay. nearly $400 each year. >> but we don't want to make that request before we're certain that every dime we spend and indeed every charge we make is calibrated with public protection in mind. >> but why hasn't that been done already? >> i can't answer that question. i wasn't here then. >> but what about the last year when you were here? >> well, it's being done, that's what i'm telling you. >> private consultants have been hired to look at spending with, including salaries and benefit packages. >> if the state bar can't afford to carry out its main mission, which is protecting the public, does that mean the bar is spending its money in way that it shouldn't. >> i have to say i don't agree with your premise. i think our issue is are we not doing wonderful protection work with a very impressive work force, but are we doing enough of it. and there i would say, no we're not. >> earlier this year we will show you how the bar is failing to keep watch over some of the state's worst attorneys. >> i have to thank that news reporter. >> david chew says our investigation pushed him to coauthor legislation to reform the california bar. he is now calling for more representation of nonattorneys on the bar's board of trustees. and he wants the attorney general to appoint an independent enforcement monitor. >> we have been finding out there's a lot that's crawling under the surface that is not what it should. >> chu also wants to create a commission to study whether the bar should split into two separate organizations since he says it currently serves as a lobbying group for lawyers and watch dog that is supposed to discipline them. >> we would separate those two functions as is the case for every other major profession in the state of california. >> elizabeth parker won't say whether she supports that idea. >> but if despite new leadership, the bar is facing the same types of criticism year after year, doesn't that tell you something is wrong? >> well, you know, i guess i'd say that i think we're turning this ship around. and i think we're going in the right direction. now it is a big ship and it won't turn in a day but if you and i are sitting here in a year, i'm going to be able to show even more changes. >> some would argue the ship is already sinking. i heard that. i don't agree. >> attempts to split the bar in two or even just study the issue is now unlikely. after strong opposition in the state senate. lawmakers still fighting for other session ends then. law make verse been deciding a flurry of measures already approving some 200 bills that are now awaiting governor brown's signature. there are about 300 more measures still to be heard by senate and assembly members this week and again only until wednesday. the dead deadline for a new law is set for september 30th. >> research shows that more parents are delaying for refusing to get vaccines for their children but the reasons why shifted. in 2013, 87% of surveyed pediatricians say that they faced vaccine refusals. that figure is up from 75% in 2006. but now doctors say that more parents are saying that they feel immunizations are unnecessary and fewer are worried about the risks associated with them. so the majority of parents who close to delay vaccines say they didn't want to burden their children's immune system or subject them to multiple shots. here in california, children are required to their vaccinations in order to attend school. >> facing charges of vacation. >> maybe his boss will give him a couple extra days. a category 3 storm overwhelmed the levy system and drainage canal and more than 1800 people died in the flooding. tens of thousands had like this in san francisco. but what is interesting is the types of clouds. we will talk about that in a moment. high level clouds but let's talk about the tropical atlantic because now into early september this is the peek of atlantic hurricane season. category 3 gaston way off-shore. but off western cuba, this is off florida and another tropical depression off the coast that will curve towards north carolina and then curve away from the eastern seaboard. right now officially tropical depression 8 but to become a named storm here in the next few hours, here is hawaii. look at hurricane madeline. this approaches the big island and will miss, looks like, the upper half of the hawaiian island. possibly a big impact there on the big island. notice how some of the moisture is pulled away, drawn upwards by upper level wind interacting with small weather system right there. and that's going to cross into northern california over the next 24 hours. so that is what we are
