ak-47 to kill the brothers as they stood in front of their mother's house. one of the brothers died on the scene, the other at the hospital. the gunman took off in a white vehicle according to witnesses. police tell us this is possibly gang-related. neighbors and friends say without a doubt. >> gangsters, we all know this. but that's what he don't want to do no more. don't care if people say there is no out. there is always an out. he did that. just to come home to see his mother doesn't matter. >> reporter: the older brother was a father himself. now the men are the 32nd and 33rd killings of the year. >> in the end they are unsuccessful because it will probably happen again. that's an unfortunate thing to say but it is the truth. >> reporter: 33 people have been murdered in the city of san jose this year so far. that's three more than the total of last year. reporting live here outside san jose police headquarters, bob redell, nbc bay area news. >> the roof of the ferry building caught fire. can you barely see the white smoke here in the picture, above the building. the fire started in the vent above the bakery. roads around the building were closed. no one was hurt. >> all right. i get that it wasn't serious. sfpd is releasing new surveillance video of the suspect accused of biting a bartend ear finger off np is outside of a bar that already closed. the suspect is still not in custody and police are kuling on public health to find it. >> joining us live from sfpd and just spoke with police. this is the one that i have to say we have not heard of before. what are police saying about it? >> good morning. they are calling it a pretty brazen attack by the suspects and while that surveillance video they just released doesn't show the actual attack, it gives us a good visual of the suspect. this took place about a m ago on the 1900 block of lombard street inside of the bar and in the surveillance video from sfpd, you can see the suspect walking around, eating food and also getting into taus el with his friend as his shirt eventually comes off. according to sfpd, the suspect was partying with friends earlier that night in the bar. when he tried get back in after closing he was turned away by the bartender. the suspect allegedly hit the bartender in the face multiple times and allegedly biting the victim's ring finger which was eventually earlier today more than fog. we have thunder there, showers weakening now, moving from east to west across the bay area this morning. a few more scattered showers across the area as hazy skies have broken out there in san jose. 67 degrees. what to expect now moving forward. less isolated showers that come to an end and see year thundershowers continue for the afternoon but our air quality still an issue. hazy skies linger. moderate air quality. here is the good news. we will watch a shift in the bind. that should push more of the smoke out of the bay area. that is one of the changes in addition to the heat making return appearance in some valleys. we will have a look tlat if the full forecast in a few minutes. >> that is a welcome change of direction. thank you. as we have been battling all of these fires after a week of full force ef reports from crews. the lake county fire is almost fully contain. the clayton fire which destroyed 300 structures is very close to being out. at about 95% containment. serial arsonist is suspected of starting that fire about a week ago on august 13th. the valley fire, one of the worse net california's history, burned just miles away from there last year killing three people and destroying almost 600 homes. that fire was sparked by faulty hot tub wiring. there are currently six large fires burning up and down the state of california. thousands of firefighters continuing to man the front lines, trying to their best to contain that. the vicious blue cut fire in san bernardino county is now at about 85% containment. thousands of people who are evacuated from their homes are now being allowed back but some are returning to find those homes levelled to the ground. the chim nie fire meantime burning in san louis obispo county. fair fighters are sighing they have a plan in effect to protect the castle should it come to that. the chimney fire's burned 31,000 acres so far. >> at the same time some cal fire firefighters are battling on the front lines of those fires, some of their fellow firefighters are marching to the state capitol asking for better wages and working conditions. members of the local union plan to walk five miles from their union offices to the capitol steps. last time firefighters rallied like this was back in the 1970s. the union says the firefighters at cal fire make way less than the state's other top fire agencies. here's why. according to the comparison provide by union leadership for local 2881, a cal fire captain earns up to $4600 a month as gross without retirement or benefits. they do earn over time their work week is 72 hours. a captain in one of the 20 largest agencies in the state could earn up to $8700 gross. their work week is shorter, 56 hours. one of the union leaders of cal fire local 2881 writes quote we will not roll over at expense of the men and women who spend so much time away from their families fighting fires on front lines. our brothers and sisters deserve better. the bargaining team will continue to negotiate with the state but at this point the state says that they have to consider all of the other contracts they have pending as well. >> right now, an investigative unit ef collusive and many states injured workers say that california's workers' comp system is just stringing them along. now, some of the problem is too big to ignore. there are claims that workers' comp is driving out medical care. you will hear from a chp officer, ryan snyder, injured in the line of duty. his doctors requested treatment for man 300 times. some of the treatments were repeatedly denied. >> they take so long to get approved or they just never get approved at all. and it is hard it get better under those circumstances. >> is officer snyder the exception or the all over the united states and said, san francisco will have added 9,000 new apartment units in 2016 by the time it's over. san jose just under 6,000. now these are very encouraging numbers. take a look at what another american city is doing, seattle, 13,000 or remember, seattle is smaller than san francisco. l.a. and new york both about 21,000. new york times columnist point out the obama administration has been great for the stock markets. in fact the eight years the obama has been in office is the third best for wall street in history behind the clinton years. that was a dotcom boom. then calvin coolidge is still the all-time record holder. an economist for citibank says this november's election could be as bad as a black swan event. black swan events are wall street speak for an about it as you saw jeff feature this last night red swaeping beam allowing us for the first time to get in leak al into the south bay. we have this tool as we show you the unique challenge the bay area provides here with relation to the mountain top radar. as we have both in the south bay and north bay. curvature of the earth works against us as a lot of these fixed radar sites. storm ranger is a big help us to because it allows us to fill in the gaps we see in coverage out towards the tri-valley where the scans sometimes go up and over the tri-valley. we see right around san francisco. now that have you a mobile radar, have you the road from the peninsula and move over to the east bay. so storm ranger filling in radar gaps from the tri-valley and back over to san francisco. to track a number of items, not just related rain fall but damaging wind gusts and at times like we have seen recently in southern california, wildfire smoke plumes as well. so it has better detail, seven times faster than radars. and speaking of filling in coverage, isolated showers off-shore in marin county. now you see the fog and low clouds around san francisco. still the slight chance of a few scattered showers around some of the inner portions of the east bay. here as we head from about noon to 7:00 now you look at clearing skies inland but low clouds coming back in and more drizzle and mist out on the coast. watch out if you head to the sierras. can you see thunderstorms continue throughout the day. powerful ones, too. south of lake tahoe. large hail could be possible with stronger cells setting up south of highway 50. air quality still an issue today but good news, i think, with the shift in the winds. we should see, here is one of the high resolution models we use to see where the smoke is head next. now if a wind shift later today, notice how the areas around the bay area are clearing out a little bit. still smoke around the east bay and south bay. as northwest winds pick up, air quality starting tomorrow should improve from the mostly hazy skies we have been seeing here over the last couple of days. temperatures for another day staying fairly mild. upper 70s instead of low 80s we see around san jose for this time of year. numbers in the mid 60s. and mid 70s up towards the north bay. as we head towards the middle part of the week, temperatures on the rise. not so this morning clinton's e-mail controversy is in the headlines as collin powell is pushing back against a report that clinton told the fbi that advised her on the use of private e-mail. collin powell we're talking about a shortage of people in airport towers and radar rooms like this one here at sfo. too few air traffic controllers meaning too many positions. not only is that adding up to delays for all of us when we fly, some critics say it could mean a potential for higher risk that something will go wrong. >> this might be my last week. >> reporter: in the skies all over our country from san francisco to san jose. >> i'm hang up my head set and retiring as soon as you're down. >> reporter: from los angeles it miami, chicago to new york. >> i've done this for 32 years, it's time to go play somewhere else. >> reporter: all over the nation's airspace is air traffic controllers retiring and leaving their post. >> there is an inherent risk to the system when have you tired air traffic controllers, overworked air traffic controllers. >>. >> reporter: rich retired last week after 27 years at san jose national airport. >> if they don't have enough rest, if they are not adequately staffed, if they are working multiple shifts of overtime, ultimately what happens is mistakes are more likely to happen. >> reporter: according to faa data, san jose's tower currently has three quarters of the certified air traffic controllers that the faa considers full staffing. the problem is more severe at chicago o'hare, new orleans and miami. not just in airport towers either but in radar facilities known as tracons. staffing shortages at tracons in new york, dallas, atlanta and denver. >> not good for the flying public. >> reporter: steve mccoy works in sacramento's tracon where they handle outgoing and incoming airplanes into northern california and says his facility is at its lowest staffing facility since opening. >> instead of eight or seven people, we are limited to five or six, we have to slow airplanes down. >> it is a big video game you're not allowed to lose. report fred works out of san francisco's tower. >> we aren't compromising safety is but we will slow things down. if it gets to the point where we are over our limit, we will slow things down. >> we need to reform this whole process. >> reporter: because of the potential for delays of the public there they now have the attention of congress. faa acknowledges the problem and testify they are working to streamline hiring. >> we must commit to hiring training and supporting the best con troerl work force in the world. >> reporter: the agency announcing it will kpe indict some 1400 controllers. this shortage has been in the works for decades and could take years to fix. for example even if all 1400 controllers were hired tomorrow it could be 18 ms to three years before they are trained well enough to become certified. and many potential hire is wash out because of the demands of the job. >> we have seen delays. >> reporter: doug rice is a commercial airline captain. said pilots are noticing tired and overworked air traffic controllers across the country. >> sometimes you hear frustration. someone will get short with a pilot. you will hear that. you hear a guy making a mistake. he will set you up behind an airplane, sets you up high, misses an altitude. report we have seen complaints over nasa for the decade. hundreds of mistakes and delays where controllers site staffing shortages and heavy workload. take the example of one controlener burbank. covering for two supervisors and two controllers when he cleared two different airplanes to climb the same flight path and altitude. only the onboard warning system on the planes and pilot intervention kept the planes from colliding. >> does it concern you when people have to combine positions? >> absolutely. it is a more demanding task when you have to combine positions. if each person can work a hundred airplanes, if you're asked to work two sectors, can i only work 50 planes in each sector. i can't work a hundred in both. it is notal humanly possible. >> you think of the likelihood of an accident and people getting hurt increases? >> yes, that perfect storm is probably on the horizon. there could be a catastrophe and that's not something anyone want it see. >> reporter: a spokesman says faa shares frustrationes with low staffing levels right now and says so far 19,000 people applied for the 1400 open positions. he emphasizes that america has the safest aviation system in the world and that proper staffing and safety is a top priority of the faa but even if all of the air traffic controllers are hired tomorrow experts tell me another 1500 or so controllers are due to retire and will conflict of storms brought record breaking rain fall and flash flooding in texas. heavy rain pounding the austin area this weekend. several people had to be rescued as floods swept through the area. high waters also consumed streets and bridges and traffic. so far though no reports of injury. >> president obama will be in in baton rouge tomorrow to visit with the people of the city that have been ravaged by severe flooding. el tour the hardest hit area whereat least 13 people were killed last week and thousandis were were forced from their homes. the president rapped up a 16-day vacation on martha's vineyard yesterday. did receive criticize for not cutting that trip short to head to louisiana sooner. however, the governor of louisiana said this weekend he told the president to hold off virus could stick around for some time and gulf coast states are the most vulnerable. officials with the national institutes of health at nih said the zika virus could hang around the u.s. for a year or two. states like texas and louisiana could also see cases. florida's already been hard hit. zika has been found in two neighborhoods miami-dade county. last week nonrelated infections were found in miami beach and there is a travel warning for women heading to those neighborhoods. counterfeit drugs were found in prince's estate. the pills had a powerful opioid called fentanyl. they were inside aspirin and vitamin bottles tuck need a suitcase in duffle bags and dressing room. prince did not have a prescription for any controlled substances in minnesota. authorities are investigating how in oakland at $2.67. roughly $2.70 in san jose and around $2.80 in san francisco. >> and we don't have to car pool any more. >> no, we always ride together. >> and fancy ranger. >> and car pool at 4:30 in the morning. right now temperatures in the 60s. hazy sunshine but socked in by low clouds. san francisco's 63 degrees. you can see san francisco there, misty skies at times and we did have a few brief like showers pass by a bit earlier this morning. in san jose, 67 degrees. hazy sunshine there too and out towards tri-valley, livermore, 69 degrees and a trend moving forward through the day. livermore school district back at school and temperatures not all that bad. low 80s for high. average high should be closer to 87 degrees. so here is that interesting weather we had this morning. just off the coast there in marin county. those were thundershowers as the system moved moisture from east to west across the bay area and a lot of the more active weather for the rest of the afternoon is aiming in across the sierra and you can see that east of fresno. look at the lightning strikes around mammoth and yosemite as we head toward the afternoon. clearing skies now, showers for us mostly done. if you head it high country during the day, watch out for ongoing thunderstorms. low clouds surging back across the bay as we head towards the evening commute. there you see thunderstorms around. some are very intense we think south of highway 50 heading through afternoon. here is something good we think for air quality. winds aloft, expected to shift as we head into tomorrow morning. what we are hoping for is going from a day like today where we are still seeing moderate levels of smoke around at area. at least for north bay and east bay we get better as winds begin to shift slightly into tuesday and wednesday. hopefully a little bit of relief from some of that smoke we have been seeing the last couple of days. >> high temperatures near 78. mid 60s closer to san francisco. mid 70s in the peninsula. there you see still slight chance of a strie shower around the hills around santa rosa for the afternoon. looks like the chance of showers have left the forecast around livermore. seven-day forecast will be trending slight slily warmer for san francisco. change is coming for wednesday around the tri-valleys. some inland locations approaching closer to 90 degrees. dry forecast moving towards the middle part of the week. i want to point your attention back to the sierra. this is composite radar and also consider a base reflective scan or dual polarization radar. now what if you could drive a doppler on wheels right to those sites we're seeing there on the radar with the perfect tool at nbc bay area as you can see it includes the technology of the existing radar as we have now. but a higher resolution, seven times faster and right there on-site with more on what storm ranger can do, here is chief meteorologist, jeff ranieri. >> weather in the bay area can bring strong winter storms producing flooding to follow and drizzle reducing visibility dramatically in just a moment. then the hot summer weather that can relentlessly fuel wildfires. tracking these conditions with a conventional doppler radar in the bay area micro climates can be challenging as our topography of mountains, hills and valleys can track data. there is a new way to track with storm ranger. mobile radar on wheels we can move where the weather will be most active. this will become part of nbc doppler radars, making it the first for any television market in the world. but it's not just any doppler radar. it is a equipped with dual polarization. that will enable more of a two dimensional view of what is happening inside a storm. letting us know more accurately how hard it is raining. there is also an x-band radar. this can provide higher detail on wildfire smoke and where it's headed. storm ranger will improve accuracy when a storm hits the bay area. here's why. as the current national doppler service radar is at 3,335 feet above sea level, it can often overshoot the top storms from san francisco to san rosa. this leaves gas in rain data. this issue is solved. since it is on wheel we can move the doppler radar to give the best scan for whatever conditions come our way helping to build a data gap and bring you the most accurate weather super excited. >> our sister station knbc has been tracking it to track the blue cut fire smoke. so we are looking at air quality, severe wind gust, severe storm potential and in the rare instance there are tornadic events, we would know before software systems. >> and the one along the peninsula. >> where the sunnyvale tornado. low-level scan such as this can pick up that rotation. >>
