into a lawsuit against the nation's largest for-profit art school: academy of art. the allegations? the school has illegally converted buildings into student housing. taking away from affordable housing in the city. scott/boxes nbc bay area's stephanie chuang is live at city hall. stephanie. live intro city atty dennis herrera says the academy of art has illegally they before previously low income housing converted to student housing. he said the academy put in a change of use request in 2007. he did admit that 11, 12 years ago the school did not apply or wait for zoning changes to people who have experts in urban design and all of that. none of which resides in the city attorney's office. so he is just taken that over now and he shouldn't do it. >> and the academy's president tried to offer san francisco one of the seven building in question on suddener street which is now student housing. he says that has 687 of the 157 previously low income housing units. in the 23 listed illegally converted building, the city hasn't included historic buildings on the wharf. pointing to june 29 as a date that a lot of the issues should be resolved because the school is expected arrested in 2014 for the murder. he was convicted by a jury earlier this month. our damon tu hey yo is talking to family members about the sentencing. the three directors accused of killing two people in the bay area are back in court today. this is the first time the suspects will appear together since one of them took a plea deal and agreed to test fie against the two. sean engel is working with prosecutor to help convict his former friends. the three are charged with murdering a canadian tourist and a tyker last year. right now attorneys for dana stubble field say they have more evidence that proves his innocence. police say he sexually assaulted a woman last year. stubble field claims the se kpx was consensual and that the woman wants money. san francisco's mayor says he will not fire the police chief. their effort to get the police chief fired is in its 16th day. five people are not eating solid food. they want the mayor to fire to chief over recent police shootings. member moving through. we're taking a look at some of the rainfall totals we've gotten so far in the east bay. that's where the rain started first. we've had about .04 of an inch. but as the system swings rain across the bay area. this was earlier over the sacramento valley. and we've seen it kind of taking an odd direction, moving farther west and to the south as it continue to spin around this area of low pressure that is now just to the east of us. we will continue to see some rain moving through, the potential of thunderstorms and a look at some of the heavy rain that now continue to move closer to san francisco. you're about to get heavy rain moving through there now as it moves out of richmond and closer to oakland, into san francisco and parts of the far south north bay. and the future cast shows that we'll still have rain through the rest of the morning into early afternoon. lunchtime hours we'll see the showers moving closer to the south bay. and we'll see this clearing out later on tonight. maybe a little bit of a break, still cloudy. and scattered showers into the start of the day tomorrow. that continues into the day. won't be a total washout but you'll have to have a head's up that we could have rain dropping even into early sunday morning before it clears out. the slow moving system will bring the potential of a quarter inch of rain which is close to the average of amount that we get during the entire month of may. for napa, if we get a half an inch of rain, it would be a nice soaker. the rain and the clouds continue for today, as well as tomorrow. and then it moves out early sunday morning. for the weekend, high pressure will be moving in and giving us drier and warmer temperatures by the end of the weekend into the start of next week and we'll see your mountain bikers sharing the coast view trail with hikers and joggers. but on some of the trails, mountain bikers report they're going as fast as 21 miles an hour using stra va. the speed limit on these trails is 15 miles an hour. records show over the past two years park rangers issued 26 biking citations. none for speeding. >> there are the renegades out there that cast problems. >> this park ranger oversees the rangers responsible for issuing citations. are you underestimatesing the amount of support that's need snd. >> we need more. we don't have the resources at the time. i can see there's very few citations written partly because of the time to get where the violation is and partly because we do a lot of education too. >> it's unlikely you're going to catch a bicyclist in the act. >> right. >> they want access to a half mile stretch on the trail. mountain bikers need a way to get to the mountain theater without having to compete with cars on narrow, windy roads. >> we're not acting on grandiose access to the trails. we're asking for something that addresses safety and connectivity. >> his group petitioned the state parks for this kind of use. >> i think they can provide the connectivity that the bicyclists need and the safety that hikers enjoy. >> this was not a park that was set out to have anything like mountain biking. >> this man has led hundreds of hikes on the mountain and worries about the environment damage from the hikes. >> when we cut down the trees and we totally disrupt the water flow. these are many rare, threatened endangered plants and wild flowers. >> the speed is what's so dangerous. >> the biggest concern for linda is safety. she says a mountain biker ran her down two years ago on the fire road and took off. >> a bicyclist came speeding down a hill, around a curve and hit me, knocked me down. i got all bruised and scraped all over one side of my body. >> linda wasn't want the bikers on easy grade saying there's already plit little accountability for those who break the law. >> we went to the ranger and reported it, there's nothing that can be done. we didn't know who he was. >> but mountain bikers feel they're at risk when riding on the roads. chp data shows officers were called out to 20 bicycle accidents from 2014 to april of 2016. >> a lot of people don't realize that some choose mountain biking because they're not comfortable biking out on the road. >> in a place where both hikers and bikers are most comfortable out on the trails, the road toward a compromise is still full of bumps. the change of use south bay family is suing the gilroy unified school district claiming it failed to report alleged abuse by a teacher. so lest bend said that her daughter received text messages from the high school to send him lewd pictures. as for the complaint by the family, officials say there was no criminal activity that required ley be dismissed. one of the san jose brothers accused of killing their own parents want to go to trial sooner than later. both brothers were here in court yesterday. now the cameras caught video of the 22-year-old, his younger brother 17-year-old omar was kept away from the cameras. the lawyers representing omar says they're ready to move forward and be back in court on monday. legal experts say that's rare. >> the fact that this case is still on track for a preliminary hearing in what is a special circumstances murder after only ten days is highly unusual. >> as for the older brother, the legal team for him is asking for more time. a millbrae father had been missing for more than a week. his family desperate for answers. the sheriff's department is asking for help to find him. 27-year-old keith green disappeared without a trace last week. last seen leaving his apartment heading to a restaurant. but he left his car keys and wallet at home, his cell phone found a day later in golden gate park. last night friends and family held a vigil for green. >> it's a strong possibility that he was wearing a pair of nike type shoes. they were so florescent i figured they would glow in the dark. >> he's got two beautiful daughters and he would never ever walk away from them. >> if you have any information, contact the sheriff's department. a technical glitch in oakland could have serious problems in terms of public safety. but fortunately the communication system is working again this morning. the dispatch system crashed just before 3:00 yesterday afternoon. oakland's radio system also crashed forcing city official to jump on the backup system for about 30 to 40 minutes. you might recall that back in 2012 oakland had a major communications meltdown while president obama was in town. we're following a developing story involving former penn state military veterans are buried there every year. the issue here, these pilots are women. tracie potts has their story. >> i lane harmon died last year. she had requested to be buried at arlington national cemetery but was denied. >> i decided instead of taking no for an answer we would fight about it. >> harmon and lorraine rogers are among 1,000 women noncombat pilots who answered their country's call, flying fighters and bombers across the country, helping train the men who flew into combat. these women always had to fight for their place. >> they just did not want the women -- >> 40 years ago rogers lobbied congress for veterans' benefits. >> down there on the hill arguing. >> they won, including the right to be buried in va cemeteries but not arlington. it's run by the army. in march the house unanimously agreed that she should be buried at arlington, along with owes who supported the troop. >> you know, there's about 10 million veterans that are eligible to be honored in national cemetery but there's less than 100,000 spaces. >> today 100 of these female pilots are still alive. tracie potts nbc news washington. let's check in with kari. >> as we get a look outside, you can see the raindrops hitting the camera. as we go out and about, windshield wiper on in some spots. but in san rafael, the rain has just moved out. let's get a look at the radar. we see the rain covering a good part of the bay area, except for the north bay. and it continues to move closer to the south bay. also into san francisco, the east bay, some of the showers coming down there where it's been pouring for an hour or so and it's just now starting within the past 30 to 40 minutes in san francisco. when we see yellows and reds on the radar, that shows where the heaviest rain is and it looks like we'll see that for a few minutes as it continues to move farther to the south. getting a look at how much rain is in there and how hard it's coming down. it's coming down at a rate of a quarter or two, three-tenths of an inch per hour. it won't last long. adopt expect the rain all day. the rain starts to rotate to the south and it's moving around that area of low pressure that keeps our weather unsettled with cloudy skies into the evening. tomorrow, still some times of scattered showers moving through from the morning into early afternoon. it finally tapers off early sunday morning and our skies will slowly clear as we go through the day. so looking like a soggy first half of the weekend. and the rainfall totals show that we could get anywhere from a quarter of an inch to lesser amounts, about a tenth of an inch or maybe up to two tents of an inch around san francisco, which would be about half of the amt that we normally get during the entire month of may. this is a pretty good soaker of a system, even though we haven't had wide spread rain, we'll see this slow lu starting to move off to the east and the rest of the weekend will be drying out as the high pressure moves in and warmer temperatures by sunday into monday. a look at the microclimates today, into the mid to upper 60s, cooler than average because of the clouds and the rain. seven-day forecast shows you temperatures will be warming up. we're nl up to 68 today in brentwood. if you're going out to the giants game tonight, have the rain gear just in case. although it looks like much of the rain will be moving out, we'll have the clouds lingering. and the weekend forecast shows that the first part of the weekend will be soggy, temperatures cooler than average and warming up a couple more degrees on sunday, up to 70 degrees in the north bay. san francisco 65 degrees, and the tri-valley looking at 73 degrees there. i think the best day of the weekend to get outside, to make before coming to the u.s. from england a few years ago, cheryl edited a magazine called "pregnancy and birth". >> i've written and edited articles about pregnancy and parents. >> so when cheryl gave birth to her on son in 2009, she knew what was coming, or so she thought. >> i was blindsided by mother hood, completely blindsided by it. >> a baby that rarely slept more than an hour at a stretch stretched carol to the breaking point. a second boy two years later that wouldn't stop crying, almost pushed her past it. even while smiling on the outside, depression and anxiety led carol's mind to dark places. and she didn't feel like there was anywhere to turn. >> and i thought, well, this is what madness looks like. surely. i couldn't tell anybody because there's a huge shame associated with it. >> still, thanks to a caring and supportive husband, carol says she did make it through. and it has become her mission. >> this stuff is definitely shelters. >> to help other struggling moms do the same. she's started her own nonprofit, supporting mommas run out of her san jose home. for the past few months they've been collecting thousands of items of chirn ice clothing and toys, diapers and wipes ale meant for mothers struggling financially and likely emotionally. >> every woman needs support, no matter what walk of life you're in. but particularly the underserved populations of santa clara county really need your help. if we're in a position to help, why wouldn't we do it. >> she runs a drop-in support group and contacts moms in need with the professionals that can help them. carol knows there are other groups that do similar work but she was moved to create her own because it's her own experience behind it and there are some things that books and magazines can't teach you. >> i felt like i was driven to do this work. >> carol says supporting mommas clothing drive and mother's day delivery this year is just the first of what she hopes are many to come. garvin
