Search and rescue for the possibility this could be a passenger train. Obviously, it turns out it wasnt. It was a Union Pacific train carrying 21 empty rock cars when this car became derailed. You can see how strong the force was when it was dragged a short distance. One man working in a brick building about 100 yards away said he could feel the work place shaking. Workers closer to the derailment said it was no mistaking what was going on. A lot of metal noise, and then you hear a crash. And we looked over the wall up here and saw the thing leaning on its side. Look said like the axel broke, the springs and wheels laying all over the place over there. The exact cause is not known yet. One san jose fire captain says yes, it does look like the rail car did lose its wheel because one of the wheels sections the axel and wheels are a good, i would say 50 yards away from the axel derailment. He point out that the train was traveling slow which was a good thing. It is up to Union Pacific to figure out what caused the train to fail. No one was hurt. Right now, what were waiting for is the heavy equipment that Union Pacific has, some sort of crane, perhaps, on a rail or maybe by the street services, to lift this car out and get it out of here. This just in to the newsroom. Two minor earthquakes rattled the bay area this morning. The latest a 3. 1 near san leandro. It struck about an hour ago, just about a mile from central san leandro. About a half hour earlier, a magnitude 2. 6 quake struck near american canyon. No reports of damage or injuries in either quake. A 22yearold man is fighting for his life right now after he was shot in his heart, in his head, and in his abdomen. Police combed for evidence in morning. They report the man and two friends were outside their apartment before 4 00 this morning when they had a confrontation with two men who stopped in a small silver sedan. Police have not released a specific suspect or vehicle description at this time. San jose police also investigating a separate shooting around 9 30 last night on almaden avenue and oak street just a few blocks south of downtown. One man is in serious condition at a local hospital. No one is in custody at this time. This is the same intersection where a man was shot and killed on saturday morning. Another man was injured in the shooting. Police have not made any arrests in that case either. The story of the escaped child molester continues to develop. The santa clara Sheriffs Department now getting help after Janell Carter escaped from a deputy on friday. Carter was under guard as he visited a doctor at valley medical center. He got away from a deputy and broke into a nearby apartment complex, changed clothes and left before officers could catch up. Investigators say carter has a tattoo that reads amy on the left side of his neck. Police are investigating after dozens of shots were fired outside an east bay hospital. Oakland police say as many as 30 shots were fired outside Highland Hospital late last night. Believe it or not, no one was hurt. No word yet on any arrests. Also investigating a deadly shooting on Chestnut Street about a block away from a high school. One woman died at the scene. A man and a teenage boy are in the hospital this morning. Good morning. The same three San Francisco supervisors who led the effort on a Soda Tax Initiative last november are now introducing new legislation today. San francisco Supervisor Scott Wiener is proposing a label on ads for sugary drinks warning of opiecebeseity obesity, diabetes, and tooth decay. It would take up 20 of ad space. The same standard applied to tobacco warnings. They would fine retailers 1,000 if after 30 days notice they fail to take down warning that doesnt have the labels. There are two other supporting proposals. They want to ban sugary drink advertising on city property. She said Soda Companies are spending billions of dollars every year targeting low income and minority communities which she adds not by coincidence, also has some of the highest risk of type 2 diabetes. Supervisor eric marr wants to ban the city from spending money on sugary drinks all together. Now, the state beverage stray group says the three pieces of legislation demonize the soda industry, oversimplifying a complicated issue. A spokesman said for instance milk based products like lattes and frappuccinos would be exempt despite containing as much sugar and calories as sodas. You may remember last november a San Francisco soda Tax Ballot Initiative failed, getting 55 of the vote falling short of the two thirds necessary. If would have leveled a 22 cents per can tax. It did pass in berkeley. In an updated press release by the supervisors indicated it does not actually require a vote at the ballot box but instead that this new warning labels effort only needs to be passed by the board of supervisors as an ordinance a process that will take a couple months and it should be in effect by summer. Mark ferrell is sponsoring the legislation, which is largely targeting pro Baseball Players who choose smokeless tobacco. The proposal would apply to games at all levels from the pros all the way down to little league. That would mean the parents, hopefully. If passed San Francisco would be the first city in the nation to ban all Tobacco Products in sports stadiums. The Santa Clara ValleyWater District is going to take its first look at a water rate hike today. The district wants to raise rates by as much as a third. Heres the irony. Its not because of the lack of water. Its from the lack of water use. District Officials Say people conserving more during this drought has caused them to sell more water and theyre losing out on millions. The east bay murm utility dwirkt talking about similar rate hikes. Now, east bay mud is also talking about going after meter cheaters and people who steal water. The agency has never fined people who get water without paying for it but with the drought, the district is talking about fines and possible criminal penaltyies. Its a growing trend with water agencies. In december the contra costa Water District increased its fine for stealing water from 25 to 250. Now, if you only get fined 25 for stealing water, and youre billed three times that it doesnt make sense. Thats why the fine would make sense. Stop stealing as of now. Right now.
