rapeing a woman after a domestic disturbance call. graves and three other officers responded to a husband and wife having an argument. the woman, a hotel maid, said she wanted to stay at that hotel. she says he returned later and raped her. >> if the accusations are true, he will be punished for his behavior. we're very saddened by this event, but important for the public to know the vast majority of our officers conduct themselves with a high level of professionalism b integrity, and honor. >> the woman reported the attack in october, and after a five-month information, officer graves was arrested for forcible rape. police know once i game aware of this incident we quickly and proactively initiated a criminal investigation with the district attorney's office. this is an extremely serious allegation and if proven true, the officer will be held accountable. officer graves is a six-year veteran here with the shoes police department, and we just learned that he posted bail, $100,000. so he is no longer in jail. we have just obtained these court documents, that call that he be ordered to take an aids test because of the nature of the attack he is accused of. reporting live in san jose, nbc bay area news. maryann, thank you. now to developments in the search for the malaysian airlines plane. there is word that malaysia's military has radar data to show that they changed course and were flying much lower than planned before it disappeared. the search zone has been widened to include hundreds of miles from the last position recorded by civilian authorities. nbc kira simmons has this from kuala lumpur. >> they're saying they believe it may have tracked flight 370 west of here to a place caughted t -- and it suggests the plane may have diverted and travelled some way before it did finally disappear. today we were invited to follow the search and rescue to fly with them. we were on a military transport plane taking part of this desperate mission. we took off searching for an aircraft now missing for days. the heart of the operation to find out what happened to flight 370. >> the water stretches out on either side of us. ocean on this side, ocean on that side, and the straight is 705 kilometers. >> they scoured the ocean. while in the air, they made contact with six other airplanes also looking. >> we're flying low over the ocean off the coast of malaysia. well below 1,000 feet. and you can see everything and nothing. there is no sign of flight 370. >> the flight took off from kuala lumpur heading to beijing. the original search has now been expended to the west. that is where we search today, another day without success. >> how frustrating is it that we still have not found the aircraft? >> it is us from straighting. >> they have been out over the water now for four days. they will keep going. they say it is still a search and rescue mission, they simply hope to find out what happened. >> at one point, flying low, that plane started to circle and circle very steeply flying around debris they spotted. in the end, like much of what they have seen appeared today be simply left by fisherman. we were up there for eight hours and managed to search 50 kilometers of ocean and there is a vast amount of ocean to search. thank you. there is a big question emerging this this disappearance. this this day and age of technology, why is it so hard to find a missing plane. it was last seen on radar, and then experts say 120 miles off shore. they were going to use gps to find the exact location, but for many routes, the gap between communications can be as long as an hour. >> they're operating around all parts of the world with varying technologies and getting that data back to controllers is difficult. >> not only is it difficult to pinpoint where they may have pit the water, but where it may have travelled after that. >> it can glide a long way under the water to a different location. they don't go straight down, it can cover a lot of distance before it settles. >> the water in that area is surprisingly shallow, but even in the black box is submerged, it will ping. crews have not gotten close enough to hear it. we have coverage of the missing on our website. the public face of the ntsb is stepping down today. debra was front and center of the asiana flight crash a year ago. she is leaving her post as the chairman of the ntsb next month to become president and ceo of national safety counsel. christopher hart will take over her position at the safety board. senator dianne feinstein is accusing the cia of a criminal act. this morning she revealed the cia searched the senate intelligence committee computers. she is demanding an apology. the intelligent committee which feinstein chairs, is trying to investigate the rendition program in which it captured and interrogated terror suspects. >> today the san jose city council will discussion a pilot program to put some of san francisco's homeless into hotel rooms. nonprofits will help them find jobs and permanent housing. it would cost about $1 million a year for housing 60 people. san jose's historic landmarks commission will meet today as tell to talk about whether to say one of the city's iconic buildings. the century 21, one of the famed domed movie theaters, scheduled to shut down. the property across from santana row has become very popular, but they will not let it go without a fight. the action council collected nearly 5400 signatures. they hope the historic landmarks condition will add the theater to the list of historic places. the two over theaters are also scheduled to close down on march 31st. a family of three held hostage by a cat. the standoff that had the owners calling 911 for back up. >> have you heard about the affordable care act? what if it was in a tunnel, would it know to wait. if it dropped a person off at the store, would it be able to drive off to park itself? and how do you make sure the technology on board doesn't track your movements? >> the regulation should provide that the data not be used for any purpose like marketing or advertising without the consumers opt in consent. without appropriate regulations, they be able to gather unpres t unpresented information about those vehicles. driverless car technology will be looking over our shoulders in every highway and byway. >> that was a consumer workman's comp dog group speaking this morning. they signed into law last year a bill that would allow the public to use driverless cars. they ask that they come up with those rules for next year. >> great questions, all right, bob, thank you. a new study suggests what many scientists suspected, heavier women have a greater chance of ovarian cancer. the american cancer society and the national cancer institute listed obesity as a suspected cause of cancer, and the new report saves that women do not have to be obese, that risk begins growing in overweight women as well. a family in portland trying to decide whether to keep their cat after it attacked a baby and forced the family to take cover in a bedroom. it is a 22 pound himalayan. his owner says he has a history of violent behavior. >> he is charging us. he is at our bedroom door. >> one moment, okay? >> i think it is fair to say i wouldn't be here with you today if i didn't have something to plug. have you heard of the affordable care act? >> i heard about that, it doesn't work. why would you use the guy that created zoon -- >> health care.org works great now. >> some of the state's top officials be tour a bay area water facility today in hopes of getting a better idea of how to deal with the krout. secretary of the interior sally jewel and other o pishls are heading to a pumping plant. they're going to examine how the state's water is maintained and moved. they're going to talk about the federal and state response to the severe lack of water. the state has come up with a plan to save millions of farm raised salmon from the drought. they say dry river beds will not be able to travel. if they can't make it to the ocean by river, they may drive. they plan to truck more than 15 million young salmon to the sea. they say it will help keep the fishery afloat. >> they represent the adult fish that will support our fishery in the year 2016. so if we get these fish moved in trucks, their survival rate goes way up. >> here is the trouble with driving salmon to the sea in a truck. if the fish never went down the river in the first place, wild life experts worry they won't know how to get home, how to get back up the river for the spawn later this year. san jose firefighters plan to fix leaky faucets and turn off sprinklers. instead of using hoses to wash down the driveways, they will use brooms instead, but they can use as much water they need to put out fires. >> we're just people, okay?
