talk of players leaving, retiring and now this. the 49ers have this brand new stadium, and people aren't talking about what's happening on the field. they're only discussing what's happening off the field. >> my first reaction was, i just shook my head in disbelief. >> vera is the chief executive officer of ruby's place, a domestic violence shelter for women in the east bay. she's reacting tonight in the arrest of 49er fullback bruce miller. >> what i don't understand is any man, nfl football player or not, thinking that it's a private matter that women aren't going to eventually the significant other isn't going to say, that's it i've had, i'm out. >> police arrested miller for spousal abuse last thursday. legal analyst steven clark. >> but it's still a very serious charge, which could carry one year in the county jail. it could also require him to participate in a batterer's prevention course. >> the 49ers front office wouldn't comment on camera but released a statement saying we were disappointed to learn of these reports and will do our due diligence in collecting all relevant information. clark said this puts the niners back in the national headlines and not in a good way. >> they received a lot of criticism for the way they allowed ray mcdonald to play in the season at the same time an investigation was going on. now the 49ers are back in that same spotlight. >> the nfl put domestic violence in the spotlight during the super bowl launching this eye-catching public service announcement. >> no more. >> players saying "no more" to domestic violence. although the nfl campaign is relatively new, he says that shouldn't be an excuse. >> it should work that quickly. it's about a man hitting a woman. >> it will be up to the santa clara district attorney to decide if the spousal abuse charges will stick. reporting live in santa clara, i'm sheryl hurd nbc bay area news. the 49ers are leading in a category they would rather not be the number of players arrested. since 2012 the team has had 11 players arrested. most high profile for the team ray mcdonald and aldon smith. mcdonald as you may remember was arrested last august for domestic violence but never charged. the 49ers released him from the team in december after police investigated him again, this time for sexual assault. no charges were filed in that case either. and aldon smith has had many run-ins with the law. he's had three felony gun charges knocked down to misdemeanors as well as two duis. off the field and on more shake-ups, gore is expected to sign with another team. willis and smith expected to retire. and there are rumors that quarterback colin kaepernick could be traded. we'll have more later in the newscast. a lot of developments in the 49ers in the last 24 hours. we'll continue to follow all the angles and bring you the latest tomorrow on today in the bay which begins at 4:30. >> the sheriff's department continues to hunt for a suspected child molester. tonight a new tactic in their search. john l. carter has been on the run, he escaped during a doctor's visit in san jose. investigators believe he broke into a nearby apartment complex, changed clothes and left before officers arrived. today the sheriff's department announced it's forming a multiagency task force to track him down. a woman is dead and two men injured after a shooting in west oakland this evening. shots fired on chestnut street. our nbc chopper above the scene. police found the woman dead at the scene. the two men are in stable condition tonight. no suspects or motive has been announced. ♪ >> there will never be a [ bleep ] in sae. >> a video of fraternity brothers from the university of oklahoma chanting racial slurs is sparking outrage. protests on the sooner campus are getting the attention of college students at cal. we're live at uc berkeley where students say they're not surprised by the video. >> the president of the university of oklahoma joins hundreds of students protesting racism. >> this cell phone video shows members of sae fraternity singing racial slurs. members of a black student organization say it's not a surprise. >> a lot of people like to say this is post racial america. we're not in post racial america. and this is just a huge example. >> sae suspended the fraternity chapter. the university president ordered members to move out immediately. >> there is zero tolerance tr this kind of racist and biggoted behavior. >> sae says students involved with the video will be permanently banned from the fraternity. sae fraternities in the bay area have had their share of trouble. at stanford they lost their recognition over sexual harassment concerns. at berkeley the university no longer recognizes the organization after it violated student codes of conduct. >> there's so many things that go on in this world and on our campus every day. there's anti-blackness everywhere. >> you see gabby shuman believes the video reflects a culture of racism that still exists on college campuses. >> i've had an 800 person class and there's like five black people. >> the school is really divided racially. >> now in a statement tonight, sae says several other incidents have been brought to the attention of the national head quarters and each of those instances will be investigated. well demeaned harassed and pressure how ellen powell said she fell while at work. she took the stand today, detailing how she was treated by other partners. she testified about being uncomfortable during a flight to new york where her male co-workers debate the porn stars and talked about the hotness of yahoo ceo. she said a senior partner gave her erottic poetry and invited her to dinner saying his wife would be out of town. also she broke off a relationship with a co-worker who was promoted while she was fired. and a deadly san bruno pipeline explosion trial will begin in march of next year more than five years after the blast. pg&e has pleaded not guilty. they could face a fine up to $1.8 billion. eight people were killed. an entire neighborhood was incinerated on september 9th of 2010. he was fired for saving a raccoon. a local construction worker is fighting back against his bosses who wanted to euthanize the animal after damaging their construction site. terry mcsweeney is in san francisco with the details. >> i'm right here on the embarcadero. this is where todd sutton released the small raccoon in the bushes at the base of this famous structure. when you think about cupid, you get an idea of how todd feels about animals. >> it was a cute little raccoon, a baby. it was trapped in a cage. why are you going to kill an animal for no reason? >> the animal had gotten inside the renovation project at the san francisco museum of modern art, where sutton was a dry wall foreman. he said one of the contractors hired a professional trapper to catch the animal and put it down. sutton found the animal before the trapper did. >> i boxed it up hid it in the garbage can, wheeled it out to my truck and went back to work. >> before he could release the animal he was fired. sutton called animal control who told them to release the animal nearby because it's -- >> territorial. i was on the spot with this raccoon, you know. >> so the raccoon got his freedom in the bushes along the embarcadero. but sutton has hired attorney steve javie who admits there's not a large field of raccoon law. but there's the first amendment. >> when someone makes a personal moral statement which didn't harm anyone i do think that's a protected act. >> sutton's working for another company now, but for less money. jaffe says the lawsuit may include attorney fees emotional distress and punitive damages. >> i did what i thought was right and this is where it got me. >> we contacted meiswinkel construction but they did not return our call. i have been looking for the raccoon tonight and i know todd sutton is hoping it with hbo. beginning next month you can get hbo content for 15 bucks a month. you can stream shows, like game of thrones. google rolled out a new version of its online flight comparison tool. the site is unique because it shows a map along the search so you can see what destinations are in your price range. users can compare the cost of traveling day to day with the best prices highlighted. just be [ laughter ] >> as you can see, we're looking at temperatures in the low to mid 50s outside and a little bit of patchy fog around the golden gate bridge and peninsula. not too much low clouds in dublin. san jose with patchy low clouds for the morning. right now a preview of your morning commute. going to be tough mid span through the bridge driving through the clouds right now. misty skies at 52 degrees. low clouds coming in around sunset across the central bay and filling in overnight. very similar to what we saw this morning, is what we should wake up to tomorrow morning. but the change will come during the afternoon as all the high clouds from this impressive-looking system begin to spill across the bay area filtering out some of the sunshine. heading into tomorrow morning, low clouds to start and by lunch time mostly cloudy skies and perhaps a few sprinkles as these clouds thicken up approaching sunset for tomorrow. hour by hour with your forecast for 8:00 in the morning, you're seeing temperatures pretty similar to what we have right now, 40s to low 50s, areas of low clouds and fog. a few sunny breaks around lunch time and by 3:00 all locations mostly cloudy but perhaps mild temperatures for inland locations even as the clouds thicken up. highs tomorrow in the 60s to low 70s. 75 in los gatos. san francisco in the mid 60s. north bay, highs in upper 60s and low 70s. pleasanton and livermore, highs in the mid 70s. wednesday now, we see this weather system bringing in a chance of showers for the morning commutes and probably lingering into the evening commute as well. jump ahead now to tuesday night wednesday morning, scattered showers mainly during the daylight hours, then after 7/8:00 most of the activity heading toward the east. but rain totals with the system unfortunately doesn't look for promising. less than a quarter inch for most of the bay area. potentially locally higher on the coastal hilltops of the north bay, but most locations getting enough to wet the ground get the wipers going for your driving in the morning on wednesday, but totals relatively light compared to this winter. and with temperatures fairly warm, the impact may be a few inches of snow but up at 7,000 feet. mainly rain showers below blue canyon in the sierras. all this for wednesday. soon as this clears high pressure builds in and the temperatures vault up. here comes the chance for showers mid week. thursday and friday temperatures upper 70s. south of san jose, as we get into the start of the weekend, very close to 80 degrees. south bay temperatures there on saturday, one more weak system. perhaps tossing some showers into the north bay on sunday. but the second half of the week feeling more like summer around the bay area as we head towards next weekend. >> looks that way. thanks, rob. coming up, what's for dinner, the diet that could save your life. >> and we have jimmy. >> hey guys we got a great show, you gotta watch. we're up next. ♪ ♪ ♪ ♪ ♪ ♪ ♪ ♪ ♪ ♪ great rates for great rides. geico motorcycle see how much you could save. >> buyer beware. new legislation will be introduced tomorrow requiring warnings labels on sodas and other sugary drinks. it's a proposal by scott wiener one of the key backers of a soda tax initiative, which lost in the november ballot. he said it's important for the city to warn its residents about the dangers of soda just like for alcohol and tobacco. if approved it will appear on the 2016 ballot. it's all about the fish. the pest protection against cancer might be that type of diet. a new study found that vegetarians who also eat some fish had a 43% lower risk of colon or rectal cancer than non-vegetarians non-vegetarians. colorectal cancer is the second most deadly cancer in the u.s. after lung cancer. >> too much praise may have an unintended effect on your kids. a new study suggests that constant praise for the tiniest accomplishments could lead to narcissism. narcissism has been increasing over the past two decades. the study also found more parents in western countries overvalue their children and treat their kids as more deserving than other rs. up next how the 49ers plan to get out of this mess. we live in a pick and choose world. choose, choose, choose. but at bedtime?
