That fight escalated into a shooting and now a 17yearold girl is dead and her younger brother is on the run. An emotional Mario Tolliver is comforted by family outside the Apartment Building where police say his 14yearold son, mario, shot and killed his 17yearold daughter, justice tolliver. A young mother who is survived by her 2yearold daughter. Shes a good mother, a good person. Justice was a beautiful young lady. She was shes a young mother. Shes a caring she just wanted to be there for her daughter. Reporter the brother and sister argued inside their apartment before the shooting. Stuart isnt sure where the 14yearold suspect got a gun, but hes not surprised the teen had one. Even if he wasnt my family member, i wouldnt be surprise if these young kids dont carry guns. Thats the nature of what they do and what is at stake in this day and age being from here. Reporter while police sort out what happened, stunned relatives worry about the future of a little girl who no longer has a mother. Her daughter is 2, shes 2 going on 3. We just feel bad for her. Reporter police say the 14yearold shooter is on the run, with Police Searching for the teen, his family wants Mario Tolliver to turn himself in. Tonight, we know more about the death of the first b. A. R. T. Police officer killed in the line of duty. Sergeant tom smith died from a single bullet wound to the chest fired by a fellow officer during a probation search in dublin on tuesday. The bullet struck smith in one of the small areas not protected by his vest. Its still unclear why the other officer fired his gun, but investigators are calling it an accident. Members of b. A. R. Right now the family is telling me this has been a very hard week for them, and as you can imagine, as they look at this memorial, it comforts them. We were just really surprised how fast those trains do no when youre standing out on the sidewalk. Reporter its important for linda to know how her granddaughter died on the tracks in san jose. It being that its that close to a school, its scary that this goes on every day. Reporter 14yearold danica was on her bike going to school when a train hit her in the intersection. The family is still wanting for waiting for a report from the Sheriffs Department. The importance is that it doesnt happen again, that there be an awareness of what happened. Reporter just feet from the tracks, theres a huge memorial with messages from fellow classmates, letting the family know how much she was loved. It brought us comfort. Most of us wouldnt think twice about answering a knock at the door at 10 45 in the morning. But when a palo alto couple did that, three armed men forced their way inside. It happened on palo alto avenue. The elderly couple was left shaken but not physically hurt. Neighbors are rattled, too. There is a escalation of arrogance and violence. And thats something to be concerned about. Police say it doesnt appear the couple was targeted. Theyre working on a more detailed description of the men. If you have a Home Security camera, San Jose Police may be knocking at your door one day. Council is proposing a central database where residents would let the Police Department know they have cameras. The goal is to help police catch criminals and deter crime. The ability to provide immediacy to the department by letting them know if theres a video camera somewhere nearby, they can talk to the owner and ask for permission to use the video. His plan suggests discounts for homeowners that want to install cameras. Police need your help in finding a hit and run driver in the east bay. This video was taken off of a bus last friday morning on willow avenue. It happened just yards from the Hercules Police station. Youll see coming up a man in that circle is crossing the street, an elderly man. Then you see an suv hit him, knocking him to the ground. Witnesses say the driver got out, approached the victim, checked on him and then the driver got back in the suv and drove around the victim and took off. That victim did suffer a serious head injury but is now recovering at home. Life in prison plus 21 years. Thats the sentence for the teen convicted in a string of crimes, including stealing a lamb lambergenie. Wade will be eligible for parole but not for several decades. You might remember this black smoke billowed over the bay area after two fires just a few weeks apart at a Metal Recycling plant. Now the Investigative Unit have learned leaders are calling for more accountability. Vicky nguyen joins us now. Reporter we on tabtained a letter asking regulators for a meeting to protect residents from future fires. There have been six major fires at the facility since 2007. Five of them at plants operated by sims metal. After two fires in november and december at sims Metal Recycling in redwood city, a call for action. In a letter dated january 16, the city manager wrote to federal regulators saying reporter sims is one of the Largest Companies in california recycling metal from old cars and appliances. Since 2007, five fires have erupted at sims facilities. Three of them in redwood city. Were as concerned as everybody else about what started these fires and were committed to making sure they dont happen again. Reporter but critics say regulators havent done enough to prevent the fires or the pollution of the byproducts. It is toxic, because we have now identified lead and other chemicals that are part of that scrap metalling process. Reporter regulators at the department of toxic substances control plan to reclassify the waste as toxic in 2007. Then the director told us after she left, the department was pressured by industry and backed off. Theres no accountability for an endtoend process and making conclusions. Reporter tonight in oakland, the dtsc is again studying the issue, now in its 30th year of debate. Why is it taking so long . Those are all good questions. Thats one of the things that our director also was frustrated with, the idea that these issues have been coming up repeatedly. Reporter as for the meeting requested by redwood city leaders to talk about the fires, that is scheduled for january 29th. Asthma sufferers often blame the smog filled air they breathe outside to trigger their condition. You can see theres a lot of mold right here. This is the only place that ive noticed my sons allergies are really bad and his asthma kicks in here because of the dust and all of the mold. Reporter she says her son, devin, has asthma. He was diagnosed when he was a baby. Its definitely scary. Its definitely a quality of health issue. Reporter according to the Alameda County Public Health department, more than 1 3 of oaklands population is considered at risk for health problems. A large number of children suffer from asthma, and the superior of their homes could be the problem. Alameda county has a Program Designed to help those families. We understand that sometimes parents dont know about inhome asthma triggers. Thats why we provide them the education. Reporter she believes education can help families learn what cleaning products to use to avoid asthma attacks and it can help clients go after land lords to better maintain their property. Health officials believe asthma is often misunderstood, especially here in the bay area, education is the key. Asthma is not to be taken lightly. Its a serious condition that, yes, it can be deadly.
