"in the back, i can see an arm moving. but not sure if anyone can get to it." )) ((christianne klein)) >> police say the bus flipped over on its side and wrapped for hours emergency crews worked to remove kids from the mangled debris. as for the driver... 24 year old john-thony walker... he now faces five counts of vehicular homicide among other charges. --- and according to an arrest affidavit... walker was driving well above the posted 30 mph speed limit on a narrow, winding road. a mother who lost one of her three children on the bus says she had warned the school that the driver of the bus allegedly drank regularly. ((i been calling up to them know my kid(s) said he's drinking on the bus. he's putting the liquor inside the frozens, inside the water bottles.)) ((christianne klein)) walker is scheduled to appear in court next tuesday./// ((christianne klein)) that deadly crash has renewed the debate about seatbelts in school buses. ((paul joncich)) >> the government's top is no federal mandate requiring them. kris van cleave reports from washington. (mark rosekind / nhtsa administrator) "we know that seat belts will save lives if we put one for every kid on every school bus." the head of the national highway traffic safety administration says three-point seat belts like the ones in your car... that go across the shoulder and the waist... should be on every school bus. but there's no federal mandate. six states require seat belts on school buses but only california meets the nhtsa recommendation. administrator mark rosekind says his agency has been weighing whether to mandate belts on (mark rosekind / nhtsa administrator) "we're not denying that this is going to be a challenge but we are looking at every angle from research to funding to figure out how to help everybody nationwide get their kids even safer." nhtsa estimates four children die every year in large school bus crashes. it believes seat belts would reduce those deaths by half. this seatbelt manufacturer's rollover test shows the impact of a crash on unbuckled children. (ken saczalski/crash investigator) "the belts are good and they are certainly very good in a rollover where you might be ejected if you didn't have that belt." 73-hundred and 10-thousand dollars to retrofit each school bus with seat belts. with an estimated half-million school buses in service... the cost would be in the billions. administrator rosekind suggested new buses could come off the assembly line standard with seat belts: (mark rosekind / nhtsa administrator) "the manufacturers could do this on their own... starting now." kris van cleave nhtsa says because of the cost it could take up to a decade or more if ever to get a seat belts. the ntsb believes 3 point seatbelts would improve school bus safety. kris van cleave, cbs news, washington. ((christianne klein)) >> the mother of one of the victims told the judge she failed her son for trusting that ccsd would protect him. 8 news now reporter karen castro has been following the justice center. karen? ((karen castro)) >> one of the alleged victim's mother testified the school failed to notify her even after administrators had received two separate complaints that her son was being bullied. aimee hairr first learned her son was being picked on by another mother whose child was in the same band class at greenspun junior high school. back in september of 2011, the mom wrote an email to administrators notifying them hairr's son had been stabbed with a pencil the news came after the alleged victim had already filed a complaint with the dean. hairr testified she made several attempts to get an adminstrator on the phone and eventually spoke to the school's assitant principal who told her she had the option of removing her son from the school. hairr testified, in the months after september, she believed the bullying had stopped because her son would tell her everything was fine at school... even though she noticed changes in his behavior. in january of 2012, her son finally confessed the bullying had not stopped and that's when she and never return. ((aimee hairr - alleged victim's mom: because my son was--- sexually assaulted and school administration knew it. they had the opportunity to make the choice, giving me a courtesy phone call but they chose not to.)) ((karen castro)) >> during cross examination, hairr admitted her husband checked out her son for a pencil stabbing... but found nothing. hairr also said she never knew about her son being called homophic names until after he was removed from school. the defense has argued there is no evidence proving ccsd violated the students' constitutional rights... as stated in the civil lawsuit. ((karen castro)) >> there were no oral closing arguments during court today. instead, the attorney's have agreed to submit written statements to the judge... which could take months. a ruling is not expected until reporting live, karen castro, 8 news now.
