Along the way you see the guards right hand smack the student. Seconds later he hits him again. Martinez is thrown out of his wheelchair on to the floor. Reporter martinez gave us his account today as he left Childrens Hospital after he left to get another check up for his injury. He slapped me. He slapped me so hard that i fell off my chair. I had a scar right here. Reporter martinez says he had protested when the Security Guard tried to clear the hall and wheel him to class. He says the guard handcuffed him and he admits spitting on the guard in protest. But martinez says what was not caught on the tape was the guard beating him and throwing him to the ground after an elevator ride that was off camera. Martinez who has Cerebral Palsy says when he told the guard he was in pain he cursed at him. He said i dont [ bleep ], he said i hope you dont walk in two or three weeks. He said that . Yes. Reporter his mother speaks off camera says he wants justice for his son. She says she took pictures of his neck, chest and hands and says she doesnt want this to happen to anyone elses child. The district immediately fired Marshell Mitchell had been hired as a substitute Security Officer in november who then passed a background check. Basically snapping and punching the students several times. Throwing hill out of the wheelchair or dumping him out of the wheelchair on to the floor throwing him out of the wheelchair. Im trying to do the right thing and just have justice for everybody. Reporter francisco says he wants the district to take some sort of action against the second Security Guard seen in that video. News chopper 2 captured these pictures just after a box truck crashed into a guardrail at the end of a connector ramp from highway 92 to 280. Fortunately no one was hurt. As for funeral arrangements theyre still working on that but plan to bury limb here in san jose. The parents of the killer elliot roger have broken their silence issuing a statement through a family friend. Peter and chen roger say the feeling of knowing it was our sons actions that caused this tragedy can only be described as hell on earth. The rogers said they were on their way to their 22yearold son last friday night when they heard about the shooting spree. They said thats when their worse fears came true. And the girl youre looking at is our local california girl. Attorneys made their Opening Statements in the trial of stow. Stow suffered severe brain damage when two fans beat him up in the parking lot of Dodger Stadium three years ago. He was at court yesterday but he was not there today. Stow is asking for millions of the dollars in damages for medical care. The words between stow and his friends and the two men convicted actually started in the stands. This is not something is that happened in the parking lot, oh my gosh. This is something that went on for three hours with security doing nothing about it.
