julie, this bicyclist is very lucky. she was going the wrong way on a one-way street and she was hit by a tow truck. yet she survived. it happened before sunset during the busy evening commute. police say the bicyclist was going the wrong way on folsom street and ran right into the intersection at 7th. >> the light was green for the northbound traffic. she would have been able to determine which way her lights were going. >> reporter: the woman is only identified as about 40 with possible broken bones an a concussion. >> if anybody is riding the wrong way, no matter the vehicle they are on, they are up for some real problems. >> reporter: and marin bikes right on the corner of the crash scene, there were plenty of opinions about the recent rash of accidents in the city. there have been several pedestrian related accidents in just the last week. >> you see a lot of hurt people really bad. and unfortunately, everybody is at fault at this point it seems like, you know. sometimes it's a car, sometimes it's a pedestrian, but it is always tragic. >> reporter: gustavo fernandez came in to buy lights for his car after hearing about this crash. >> it is dangerous. >> reporter: ironically, the crash happened where there is a new bake lane. you don't always have to be right to survive. >> we have to share this small space with a big population. on a bicycle, on car, or foot, we have to learn how to share the space. >> reporter: police say they are looking at a surveillance camera that may have captured the crash. the driver of that tow truck stopped and is cooperating with the police. he does not face any charges now. live if san francisco, ken wayne, ktvu channel 2 news. across town in the richmond district, a pedestrian was struck by a car tonight on gary boulevard in fourth avenue about ten minutes before 7:00. here is a picture now of the scene. the fire department tells us the pedestrian was taken to kaiser hospital and the driver of the lexus stayed on the scene and was cooperating with police. taxicab drivers in san francisco want police to get involved with online ride share services. they say drivers like those for uber are not properly concerned ken pritchett? >> reporter: the fight between these taxicab services and the ride share services is not new. but the argument we heard before the police commission hark is relatively new. in union square, it is easy to spot the taxis, but other cars are available only through online sites like uber. >> they call these personal ride services tncs . we tall them illegal taxis. >> reporter: tonight before the san francisco police commission, taxi drivers asked police officers to cite these private web hire drivers. why? >> we believe the department has probable cause to stop any such vehicle for operating without insurance. >> reporter: their argument stems from a new year's eve accident in the tenderloin. a family of three hit by a car. a six-year-old was killed. the driver said he worked for uber. the company said he did not have a fare at the time. the company's $1 million per incident insurance policy only covers drivers on a call. >> that is pretty ridiculous. what if taxis were only inshoed on a call? >> reporter: there is an insurance gap. the commission says the complaint was for another agency at a fight bigger than just insurance. >> there are drivers that would like to kill off uber and i think that would be terrible for residents and visitors in san francisco. >> reporter: sew supervisor scott wiener calls the system broken and it is not their role to make new rules for this upstart industry. >> i don't think takeing the ruling for the cab industry and just putting them on uber and other ride sharing services makes sense. >> reporter: these online ride now, to breaking news out of the south bay where swat teams swarmed a san jose neighborhood tonight for what turned out to be a hoax. these are live pictures from the scene. santa clara county sheriff's deputies heard about a man with a woman shot and bombs on the property. they went to fruitvale avenue. they determined the report was a hoax and cleared the scene. we are now working to find out more about that original call that led to the response by swat. antioch police say the 43- year-old man who admitted to ktvu he kidnapped a seven-year- old girl is now charged with committing a lewd act on a child. the judge agreed to postpone his formal arraignment until he is assigned a public defender. douglas is due back in court next wednesday. he is facing six felony counts including kidnapping for sexual purposes with the use of a deadly or dangerous weapon. and possession of material depicting someone under 18 engaging in sexual activity. douglas said it was a plea for help in this jailhouse interview. he told us he did not touch the little girl or abuse her in any way. new at 10:00, governor jerry brown has upped his schedule by one day and plans to bring out details of his project tomorrow. brown's new budget totals $155 billion in spending. he says california has turned a corner after a decade of deficits. the governor also says caution is needed so the state doesn't encounter new financial problems. he wants california to pay down its debt so it is wiped out in the next three to four years. here are some of the high points in the budget. $70billion for schools k-12. that is an increase of $22 billion from the last budget. the governor is also proposing 670 million in new healthcare spending for mental health, dental care, and sub dance abuse. he wants welfare checks increased by 5% and his budget has a rainy day fund of $1.6 billion. the federal government has suspended activity at a foster farm after cockroaches were seen in the plant. it is one of three in central california under investigation for nationwide salmonella out break. in a statement, foster farms says it has temporarily stopped operations to allow for enhanced sanitizing to take place. the usda says the plant will remain closed until foster farms has a plan to eliminate the cockroaches. health officials are reporting the first two deaths from the h1n1 flu virus. a 63-year-old man with health problems and a 48-year-old woman who was healthy died monday. neither had a flu shot. we talked with a doctor saying the flu vaccine is the most evictive way to fight the virus even if it is not completely effective. >> the flip side is that i would rather have something that will protect me 60 to 70% of the time as opposed to zero. it is not a perfect vaccine. >> the doctor sads too many of us are used to the flu, but 15 to 35,000 people die of influenza in this country every year. the medical center is seeing so many people with flu symptoms, they set up a tent to take care of the patients. it helps to isolate those with the flu bug. they use it to treat people who do not need to be admitted. they plan to set up a large tent tomorrow. coming none five minutes, how the up tick in flu cases is affecting the blood supply. the critical need for donations right now. the city attorney's office in san francisco is reviewing a claim filed by the parents of the 16-year-old girl who died after being hit by two fire trucks following the asiana plane crash. the claim accuses firefighters of knowingly putting her in harm's way. the legal claim also says the fire department failed to train firefighters to avoid hitting victims at disaster scenes. asiana flight 214 burst into flames to land. she was alive before she was hit by two fire trucks. a series of alto, amber lee, ktvu channel 2 news. a transgender student from hercules high school who claim to be a victim of bullying is being charged with battery. on november 15, 16-year-old jewelyes gutierrez was involved in a fight with three girls and it was caught on video. she says she has asked school officials for help but the bullying continued so she fought back. the sophomore is now charged with misdemeanor battery. >> it sends a message to bullies that you can bully individuals and that adults will then further victimize the person that you have been tormenting. >> no charges were filed against the other people involved. gutierrez's sister has started an online petition to drop the charges. a question on repealing the state law extending rights to transgender students will be on the ballot. they want to repeal the law that allows transgender students to use bathrooms and sports based on gender identity. there may not be enough valid signatures to put the initiative on the ballot. counties have until february 24 to verify all of the signatures. two people are recovering tonight from injuries they suffered in an explosion at a south san francisco bio tech firm. it happened this afternoon in a laboratory at the amjon complex. the two workers were taken to a hospital. one of them suffered facial burned and was reported in critical condition. this was not the first time a worker has been hurt at that facility. in may, a worker for a waste disposal company was burned while collecting waste there. the tesoro oil refinery in martinez has agreed to pay fines in air pollution penalties. it covers a total of 35 alleged violations between 2009 and 2011. twos in accidents if 2010 shut down the refinery. the bay area said they have since made improvement. with no them are as clean as this one. we found one in east oakland that has become a magnet for crime and where children pass everyday. it is a bus stop at international boulevard and 85th avenue being used the shell services right in front of a boys and girls club. and a church. >> little kids have to walk past here. there are bums and crack heads and that is not good for their environment. >> reporter: completely. >> i don't want to see what they do. >> what do they do? >> something they have no business doing. >> we serve kid ages eight to 17 and they have to pass that to get to and from the church and the school. >> reporter: last may, we highlighted the problems when someone stole a gold chain from a member of the allen temple baptist church. crews consider sent to clean up the site. but now oakland, jana katsuyama, ktvu channel 2 news. the attorney for the family of a 13-year-old girl who has been declared brain dead after a tonsil surgery last month is speaking out from twitter. christopher dolan says doctors are optimistic that jahi mcmath's condition has stabilized and her health is improving from when she was taken to children's hospital oakland. he also says jahi is now gets the treatment she should have gotten 28 days ago and he confirmed that procedures to insert a breathing and feeding tube on jahi were a success. for the second time in two days, a u.s. military helicopter has been involved in a deadly crash. tonight, the two sailers are dead and one is missing after a navy helicopter crashed into an ocean off virginia it it happened 20 miles off the coast of norfolk. helicopter crews scanned the wooders for the missing sailors throughout the day. two crew members were rescued and are in the hospital tonight. one is listed in serious condition. the cause of the crash is not immediately known. yesterday, a u.s. air force helicopter on a training mission crashed off the coast of england during a training exercise. all four of the crew members were killed. the white house is pushing back against scathing criticism from former defense secretary robert gates. he singles out vice president joe biden and offered mixed opinions about president obama.
