white house. arlette saenz covers washington for us. you've been looking at this back and forth between kim jong un and president trump. what's the expected response from all of this, and how do we expect this to play out? >> really right now we're waiting to see how president trump is going to react to this. he set a red line when he said north korea shouldn't be gi in . they've now made two specific threats to the u.s. territory of guam in the span of 24 hours. now we have to see, how is president trump going to address this? he's going to be meeting later today with his vice president. that could be an opportunity for him to talk to cameras, but a lot of folks waiting to see how the president's going to handle this. >> a lot of people are on edge about this. there were a lot of searches about fallout shelters, and a lot of people wondering, can the president just launch a nuclear weapon at will? >> technically, yes, he could. now the constitution. >> thanks for making us feel comfortable. that's great. >> but the constitution gives congress the ability to declare a war, but there's little they could do to stop the president from just launching a strike. the president has the authority to make decisions to defend the country, so if he feels like there is a threat to the u.s., he would have that authority. and actually, the old white house press secretary, sean spicer was asked about this back in april, whether the president was ready to act alone on north korea. he said if he did decide to act alone congress would be notified but he would be covered under the constitution. >> what do we know about the state of the nuclear arsenal. >> the president was tweeting yesterday saying his first order of business was to modernize the nuclear arsenal. that was not the case. he signed an executive memo for a review of the posture. but it's actually the obama administration that started a modernization of the nuclear arsenal. that's going to take several decades, could cost over $400 billion. that plan is still in the works. there's no proof that the trump administration has taken any efforts or steps to -- >> any additional steps. >> exactly. >> understand. thank you, arlette. we are schooled, and we don't feel much more comfortable. we're going to move on, though, to several stories that seem ripped from the pages of a spy novel. >> an unarmed jet like this one has flown over areas where president trump is spending his working vacation. also the pentagon and cia headquarters as well. the flight was in accordance with a 15-year-old treaty in which the russian and american militaries are allowed to observe sites in the others' country. and diplomats in cuba have suffered unexplained hearing loss. they've attributed it to some sort of covert device that was secretly deployed. in retaliation, the u.s. has expelled two cuban diplomats. cuba says it is looking into the incident and cuba is a safe destination for visitors and diplomats. day four of the taylor swift sexual assault trial gets under way today in denver, but yesterday we saw the pop star's mother break into tears on the witness stand. andrea swift told the jury that she never saw her daughter being touched by the former radio deejay accused of groping her. but she did admit she wanted david muller fired which is what happened. swift testified that the alleged incident has caused trust issues which led to restrictions with the singer and interactions with her fans. and tiger woods has agreed to a plea deal to avoid conviction for driving under the influence. police found him unconscious in his mercedes benz on a florida roadside. this happening last may. woods claimed to be under the influence of a prescription painkiller and sleeping medication. woods has agreed to complete a year-long diversion program. and the boy scouts of america are facing another trial due to sex abuse allegations. that's after a judge refused to dismiss a case. filed by three men alleging abuse decades ago by a troop leader. maggie rulli has the latest. >> next to you, this is the best supervision a kid can get. >> reporter: for decades, the boy scouts of america have promised to keep your son safe, but now another allegation of sexual abuse is make its way to the courts. >> it's time that they take responsibility for destroying the lives of thousands. >> reporter: a judge moved forward in the case of three who accused their troop leader of sexually abusing them. denying to have the case thrown out since the allegations happened so long ago. chris malcolm says he's now ready to speak out. >> no one batted an eye to it. it was allowed to continue until he reached his ultimate goal, which was to molest me. >> reporter: in 2010, an oregon court found the boy scouts of america guilty of covering up sexual abuse by a scout leader in the '80s, awarding nearly $20 million in damages. the trial revealed that the scouts kept secret files of suspected child molesters for years before putting a program in place. >> the boy scouts have fought in courts around the country to keep these files private. >> reporter: corcoran is serving a seven-year sentence. he denies the allegations of sexual abuse. the boy scouts of america deny the allegations. >> you need to make them bleed a little bit, the boy scouts, so they do something for a change instead of ignoring it. >> reporter: they expect the case to go to court in november. maggie rulli, abc news, new york. and hurricane franklin is bearing down on mexico's gulf coast, strengthening into a powerful category one storm, packing winds of 85 miles per hour. franklin could trigger a storm surge of four to six feet near and north of the center. look at the eye. >> it looks very powerful. >> it does. all of this comes as forecasters revise their outlook for this year's hurricane season. it could be an extremely active one with 14 to 19 named storms. nine forming into hurricanes. five of them could be major hurricanes. this past winter, the city of seattle notched its wettest winter ever. now it has gone to the other extreme, marking more than 50 days without >> they've done it in wax. light the wick and take it all in. the scents of new york, come on, baby, light my candle, or actually, don't. ♪ come on baby, light my it's thursday, august 10th. from abc news, this is "world news now." >> i don't remember that verse in the song. ♪ come on baby, light my candle ♪ >> i'm pretty sure that's what they meant. jack is soaking in all the smells of new york. >> love it. >> can you imagine if they could bottle it all up in one. >> we'll find out how they did it and give our own little smell test a little later. but a different test escalating this morning between the u.s. and north korea. >> it is a test for our foreign policy advisers and the president indeed. this is video from the u.s. naval base in guam where concerns are growing after the north called president trump's warning a fire and fury nonsense. >> the north now says it will complete a plan to attack the waters near the u.s. territory before the month is out. we begin with abc's cecilia vega. >> reporter: a new threat from north korea coming in, saying they will be ready to attack the u.s. territory of guam by mid august. this comes as president trump's warning shot fired directly at pyongyang is sending shockwaves around the world. but abc news has learned that threat caught some in the president's own inner circle by surprise. the president in that statement using language not vetted or pre-approved by his national security team. >> north korea best not make anymore threats to the united states. they will be met with fire and fury like the world has never seen. >> reporter: sources close to the president say behind closed doors with top aides, including new chief of staff general john kelly, president trump had discussed taking a tougher tone on pyongyang, but even members of his own national security team had no idea the president would go so far. >> he has been very threatening beyond a normal statement. and, as i said, they will be met with fire, fury and, frankly, power the likes of which this world has never seen before. thank you. >> reporter: within a few hours, north korea responding with its own warning, saying it is seriously considering a plan to target guam with missiles. the u.s. territory, home to crucial military bases and 160,000 americans is just 2,000 miles away. then rex tillerson sending a message of his own, landing in guam, offering very different words. >> i think americans should sleep well at night. >> reporter: the secretary of state striking a much softer tone. >> what the president is doing is sending a strong message to north korea in language that kim jong un would understand. because he doesn't seem to understand diplomatic language. >> reporter: then the president himself weighed in, tweeting, our nuclear arsenal is now far stronger and more powerful than ever before. hopefully, we will never have to use this power. but his initial words have sparked international reaction. from new zealand. >> i think the comments are not helpful in an environment that's very tense. >> reporter: to germany's foreign office, saying sabre rattling won't help. cecilia vega, abc news, bedminster, new jersey. >> speaking of sabre rattling, a lot of people wondering if this administration has a unified message. >> he apparently caught his cabinet off guard, and that's sparking worries that the administration isn't working from the same playbook. our arlette saenz monitoring the white house as usually. yesterday we were talking about how this may conflict with the diplomatic efforts. what does this mean that he's not in touch with his cabinet on this message? >> there's been some slight and notable differences in that message. president trump struck a bellicose tone in his warning to rth rea t otrs spped short of using that same language, raising the question of whether the administration is on the same page. defense secretary mattis put north korea on notice in his own way, saying north korea must cease any consideration of actions that would lead to the end of its regime and the destruction of its people. but he also highlighted the diplomatic push. and while the president specifically warned north korea about making threats, mattis's statement focussed on the regime's actions. and you saw secretary of state rex tillerson using a bit of a softer tone saying the president was simply trying to speak in kim jong un's language. but like many on the president's team, tillerson did not know the president would use those words of fire and fury. they did not speak until after the president's threats. he insists they are on the same page. a spokesperson at the state department says they are all singing from the same hymn book. >> they knew what the message would be, they just didn't know exactly those words. and so many people at this point are wondering about this whole back and forth. is this just words between trump and un? or could this actually lead to something military? what do the experts say? >> we know that u.s. pacific command is working on war planning and defense measures, but if north korea continues to make improvements in their nuclear program. if the tough sanctions do not work they will have to make a decision on whether to make a preemptive strike. or other type of action to stop north korea. a senior u.s. official tells abc they could be facing that decision in the next 6 to 12 months. >> it does appear they are singing from the same hymn book but different pages of that hymn book. arlette, thank you. the president is facing a lawsuit from that tweet announcing transgender people would be barred from serving in the military. >> two advocacy groups are bringing the suit on behalf of five active service members who claim the ban violates their rights and is unconstitutional. the pentagon has not moved to enforce that ban. and now to new developments in the russia probe. we're learning of a predawn fbi raid at the home of former campaign chairman paul manafort. he was woken up two weeks ago by armed fbi agents executing a search warrant at his home in alexandria, virginia. agents seizing documents as part of the special counsel investigation into the russian immedia meddling into the election. manafort's spokesman confirmed the raid saying mr. manafort has consistently cooperated with law enforcement and other serious inquiries and did so on this occasion as well. authorities have opened an investigation into the ambush that left six soldiers injured. a man deliberately slammed his bmw into soldiers and sped away. the attacker led police on a five-hour chase which ended when cops opened fire on that suspect. closer to home, hurricane franklin is gaining strength. this in the gulf of mexico. >> the sixth named storm, franklin, has become the season's first official hurricane. category one, packing winds of 85 miles per hour. >> both hurricane and tropical storm warnings are up from the gulf coast. we have justin povick tracking all of it for us. >> diane and kendis, good morning to you. franklin making its second landfall early on this morning. we are looking at still some very, very gusty winds and the potential for extremely heavy rainfall. we have the concern here for damaging flooding along with mudslides, very gusty winds as well. this will be steadily weakening later on this morning into the afternoon, but the heavy rain will continue into the overnight. diane and kendis. >> justin, thank you. and for those of you who hoped winning powerball would get you out of work today, we've got some bad news for you. >> you have another opportunity to do it. no one won the jackpot. in last night's $307 million drawi drawing. the winning numbers. 12, 30, 36, 47, 62, the powerball was 9. the next drawing is saturday, worth at least $356 million. >> and don't toss your tickets just yet. three of them one in iowa, one in oregon, one in texas. they are worth $1 million apiece. that's not too shabby. >> none in new york. i do think we have some new kinfolks in iowa or texas, don't we? >> emily, thank you. and world leaders are weighing in on the conflict, as many expressed some concern over this. >> yes, they are. arlette saenz joins us. >> north korea's neighbors in the region are expressing a lot of concern about their latest threats. south korea announced its security council is convening an emergency meeting today to discuss the north's latest plans and south korea's military is warning if the north acts it will face powerful and stern responses from the south and its allies, including the u.s. in a news conference this morning, the prime minister of australia echoed the response. >> the north korean regime's conduct must stop. it is dangerous and it must stop. they must come to their senses. what they are doing is putting the peace and stability of the region and indeed the world at risk. >> reporter: but there's also u.s. allies criticizing president trump for the language he used in his warning to north korea. new zealand's prime minister says the president's comments were not helpful and germany's foreign office cautions that sabre rattling won't help. japan is saying they would be able to fire at any missiles that north korea launches towards guam. >> in their anti-missile defense system they have there. and i believe guam also has, they have plenty of u.s. troops there receiving that threat from north korea. what more are we hearing about that threat? >> this is really the most specific outline that north korea has given regarding any threats that they've been making. they named a number of missiles and the exact type of missiles that they would be firing at guam, as well as saying they would do it by midweek. present it to kim jong un. president trump warned that if north korea makes anymore threats, there will be fire and fury. he's created a red line. there's already been two threats from north korea in the past 24 hours. how is he going to respond. >> i kind of miss the days when north korea was angry over a movie with james franco. do you remember that? i miss those days. thank you, arlette. >> and president trump has tweeted a sharp response to comments senate majority leader mitch mcconnell made over the battle over health care. >> on monday, the republican senator said the president had excessive expectations about how quickly things happen in the democratic process. the president's tweet, senator mitch mcconnell said i had excessive expectations. but i don't think so, after seven years of hearing repeal and replace, why not done? meanwhile, ron johnson has apologized to john mccain. johnson was speaking on a radio show, talking about mccain's vote that led to the senate's failure to repeal and replace obamacare. listen. >> he has a brain tumor right now. that vote occurred at 1:30 in the morning. some of that might have factored in. >> really? >> you hear the reaction from the host of that show. the spokesman for senator mccain responding, saying it is bizarre and deeply unfortunate that senator johnson, who is from wisconsin, would question the judgment of a colleague and friend, senator mccain has been very open and clear about the reasons for his vote. and there's also new tension between the u.s. and cuba after the u.s. expelled two cuban diplomat in retaliation for a string of incidents. those incidents took place at the u.s. embassy in havana and other facilities. several diplomat experienced unexplained hearing losses. they have been attributed to a covert sonic device that was deployed. cuba says it's looking into the matter. and authorities are trying to determine what caused a house explosion in milwaukee. neighbors saw flames shooting 75 feet into the air. the home was being renovated but is now just a pile of rubble. no injuries have been reported. investigators say there's no indication this was caused by a gas leak. now to a tragic construction accident. a worker crushed to death under slabs weighing up to 40,000 pounds. they were being lifted by a crane when they shifted and fell. local authorities are investigating. and mexico bracing for the first atlantic hurricane of the season. >> franklin which has triggered flooding on cozumel island and yucatan peninsula and is now a category storm parking winds of 85 miles per hour. taking aim at mexico's gulf coast. accuweather's justin povick joins us. >> good morning, kendis and diane. franklin, the season's first hurricane after making its second landfall early on this morning it will be steadily weakening, but we're still concerned about high winds and extremely heavy rainfall. great sdimpact from tampico and vera cruz. mudslides, the potential here for over a foot of rain. meanwhile, in the northwest, still concerning here with heat, poor air quality, and we're also talking about elevated fire danger. kendis, diane?
