During that time period where the man was chasing the woman and was cornered by the police. No one is in danger now. Were told the woman involved in this incident is okay and was uninjured. The d. A. s office is here investigating, theyre waiting for the Coroners Office to show up. Many more questions yet to be answered and we are expecting in about ten minutes for the deputy chief to be out here giving us more information and an update on how this all evolved. Well, we are awaiting confirmation from contra costa sheriffs, but we have been able to put together at least part of the scenario based on information we have gathered here in lafayette. An apparent kidnapping and attempted extortion here at the chase bank in lafayette. It ended when police surrounded a car here in the parking lot just about 2 00 this afternoon. Now, some of the details were learning are from the website news 24 680, they are reporting that a resident of lafayette was kidnapped from his home on sweet drive, thats about a mile from here, and driven here by the suspect to this bank, chase bank, ordered to go in and withdraw money. At that point with the suspect still inside the victims white subaru, outside the police were called. A witness who works at a business next door told us this is what she saw when she went out on her lunch break. I was going to my car. It was just a couple of cars, you know, down to my car. There was a guy sitting in there. After i sat in my car, i saw the police car came and he was point the gun at him. As for a gun, according to the witness, the police were calling for the suspect to drop a gun or show a gun. At this point we are waiting to hear from contra costa sheriffs about whether that suspect actually had a gun. We understand one might have been stolen from the home in lafayette, but it may have been left behind there. Again, the suspect is under arrest. Around 3 00 this afternoon a car collided with the bike at lee avenue and coit drive, not far from dover park. The driver of the car stopped nearby. Prosecutors say power and the abuse of power by these three deputies are at the center of a murder investigation. Today was the first day of the trial for these guards. They are accused of fatally beating Michael Tyree, an inmate in the Santa Clara County jail. Vic lee is live at the courthouse tonight with the story. Vic . Reporter well, dan, all three defendants have already pleaded not guilty. Each on 1. 5 million bail. Today the prosecution and the defense gave and finished their opening statements. Prosecutors open statement, Michael Tyree was beaten to death. The three sheriffs correctional guards sat impasse ively listening. Braker said power and abuse of power is what this case is all about. Several jurors winced when they showed a photo of the bruised, naked body. He displaced Text Messages sent by ferris which was disdainful of inmates and said the guards enjoyed watching them suffer. The only lawyer who spoke on camera afterwards called the texts meaningless, bravado, in a macho jail culture. He echoed what his cocounsel said. It is not a homicide case. Its either an accidental case or a suicide. Reporter but the prosecutor said that after the autopsy, death was caused by blunt force trauma. The medical examiner ruled it a homicide. The defense told jurors sheriffs investigators did a sloppy job in reviewing tyrees death and the defense would use evidence they gathered to prove he was still alive after the three deputies left his cell that night. Listen to the science, attorney Judith Odbert said, not to the prosecutions happened picked witnesses. Many of the prosecutors witnesses will be inmates who lived in the same cell block. Witnesses, because theyre all convicted felons, some of them have been convicted for murder, some attempted murder. Reporter the defense believes this is what caused tyrees death. The cause of death happened as a result of him standing on the toilet and falling off and slipping and the skid marks actually on the toilet seat from his feet. A 13yearold santa rosa boy killed by a sheriffs deputy will have a park named after him. Sonoma county supervisors today awarded a 3 Million Contract for a park to be built in memory of andy lopez. He was carrying an air soft rifle resembling an Assault Rifle when he was shot seven times in october, 2013. The fouracre park will include a teen zone, skateboarding spot and a community garden. When police were initially called around 2 20, it took us about three and a half, four minutes to get here on scene in the 200 block of penobscot. Officers made contact with her. They came in with their sirens so she could hear they were responding. Because she was mobile, it took a little time to find her. When they did, they secured her. The suspect then took off running away from the police. The police pursued him. Knowing the pertinent facts that, one, he had a restraining order against him for Domestic Violence and, two, that he had weapons registered to him. So with those two facts in mind and the visual presence of the weapon, the onscene sergeant set up a very extended perimeter, called for a rifleman to take a position of advantage so he could secure the rest of his officers. They started to talk to him as he stopped for a short period of time, tried to negotiate his surrender. Unfortunately, there was an exchange of gunfire. One of our officers fired one round and we believe that he discharged a round at himself into his face. With that, that ended the confrontation. Medical was called in. The Fire Department pronounced him deceased on scene. The coroner will be taking the investigation along with the District Attorney of san mateo county. We have an officerinvolved shooting protocol that takes the investigation from here away from the agency thats involved in the shooting. And they will be providing Additional Information from that point. The additional things that we know about this incident that you might not know about initially right now is we have had a decent standing with this individual over the last this last month. So, for example, our First Contact with the suspect came around march 9th of a very what we call a low level Domestic Violence dispute where the individual was taken into custody for a nonDomestic Violence related incident. On march 10th we had another incident involving the two parties involved in this incident. The wife and her exhusband, where the exhusband is believed to have broken into her house and caused a ruckus with her present. That prompted the officers to provide an emergency restraining order for her protection thats good for seven days. At that time the officers confiscated all the weapons in the house that were registered to him and took them in for safe keeping, a normal Domestic Violence protocol. Because it was a violation of a restraining order on march 14th where the suspect again confronted her, she went and sought an extension of that emergency protective restraining order through the courts which were granted on the 15th. Her emergency protective restraining order was going to expire on the 17th. San francisco is making a preemptive move on a proposed muslim registry. This morning mayor ed lee signed an ordinance into law that prohibits the city from participating in any type of registry based on religion or ethnicity. During the campaign President Trump vowed to establish a registry for muslims in the United States. None has been created. San francisco is said to be the first city in the nation to enact such an ordinance. Abc 7 news was in San Franciscos financial district as supervisor Hillary Ronan introduced a measure that makes Companies Choose between building the border wall and doing business with the city. The proposal bans companies that bid on the wall from contractoring with San Francisco. Lets move to consumer news about cars. Newer models mean newer features but some are not safe. Michael finney is here to tell us about that. Its amazing. Car shifters used to be intuitive and easy to use, but now many car makers are adding style and Design Elements to their interiors. They might look better, but Consumer Reports says these new shifters can be confusing and even potentially dangerous. For decades cars with automatic transmissions had a simple straightforward shifter like this one, but some newer cars have shifters that look or function differently. The new designs can set their model apart or offer a touch of luxury. Consumer reports warns those new designs can be complicated and even counterintuitive. The problem with these unconventional gear slerkelectos they make it hard to consistently pick the correct gear, especially park. In the worst case that means the car could roll away. Im in a Mercedes Benz glc. The shifter, no matter what position youre in, it always returns to the center and makes it hard to see what gear youre in. Putting it into park is a small button at the end which is blocked by the steering wheel. Another problem, since its not immediately obvious whether the transmissions are in gear, neutral or park, on some models its possible for the car to roll after the driver gets out. Some manufacturers have builtin safeguards. Ford, lincoln, acura, honda and gm all automatically return to park if the door opens with the engine on or if the engine is shut off in gear to prevent those rollaways. Consumer reports believes so strongly that these confusing shifters can be dangerous, it now deducts points for cars that dont have builtin fail safes that prevent rollaway accidents. Now, so far Consumer Reports ratings, more than 50 cars have had points deducted from their scores due to confusing shifters. Models from Mercedes Benz, chrysler and lexus, ct200 have dropped their ratings enough to lose their recommendations. Now, if you already own a car with one of these shifters, Consumer Reports recommends you always double check when its in park and use the emergency brake any time youre going to step out of the car.
