employees are killed by a train. >> we are in oakland with that story. nick? >> this morning, we are here because unions continue to hold the line at the lake merritt bart station on day four of the bart strike, two daze after a bart employee was struck and killed by a train on the tracks between walnut creek and concord. investigators with the ntsb took over the accident scene on sunday and spent much of the day inspecting the train and conferring with local and state counterparts. this week, the inspector and his team said all will be tested for drugs and alcohol. safety records will be we viewed and digital data will help investigators determine who was in the cabin of the train and the speed at the time. >> we will spread out with the expertise that we get from 9 parties and look at every part of what went on. >> when you are involved in a pa facility you have to analyze the camera in the cab, they want your phone records. >> the victims have been identified as a contract worker and a union worker, both men said to have a great deal of experience 689 union members continue to hold the picket line with candles placed in memory of the workers. the mood has been somber. the workers say they will hold out until they have an offer for fair contract. at lake merritt bart for abc7 news. >> now the latest in the bart talks, the labor strike is better the fourth day and the board will hold a special closed door meeting this afternoon to discuss the strike and the negotiations. as of right now, no negotiations are scheduled. the biggest unions delivered a counter professional to system managers and leaders are looking to changes to workplace rules. >> if you have to drive you could see more traffic than on friday. this is the first monday of the latest strike. the highway patrol plans to have every available officer on the road to clear stalls and accidents. >> already at 5:03 leyla gulen is noticing more traffic in certain areas. leyla gulen? >> if you are traveling along the bay bridge expect to see plenty of traffic at the tolls, the cash-paying lanes are loaded up and in the next 15 minutes the metering lights are turned on. there are good alternatives. some folks are taking the richmond-san rafael which is quick if you are making it from the east bay to san francisco. right now, 59 miles per hour takes you into san rafael and it is a quick 13 minute drive to head into sausalito and toward the golden gate bridge. we do have a problem a motorcycle stalled in the center divider and not blocking any lanes and it is top speeds along 280 continues to the 280 sting. at the bay bridge toll plaza you can see that is what i am talking about, very busy in the early hour, so give yourself the extra bit of final to get to work this morning. mike? >> good morning, everyone, temperatures are cool this morning in the 40's and 50's and visibility at santa rosa, we are talking half mile visibility and in napa we were at three miles visibility. it is moving through the valley and some areas could be lower. four miles visibility at half moon bay. we have clouds through the san francisco bay and san pablo but not the east bay veals, your visibility is unlimited. downtown this morning, you can see the cloud cover is hanging around and temperatures today are going to be chose to average. north bay is 74 to east bay valleys 83 and around the bay we have 68 to 75 and stuborn around the coast up to 66. >> charter buses are back at nine bart stations as passengers line up early to get a ticket. amy hollyfield is at walnut creek. busier than friday? >> more people. more buses. that is the headline at walnut creek. it looks like several more people than we had on friday. look at the buss -- buses pulling up. officials said they wanted to make a change after what they learned on friday, that walnut creek was very busy. they wanted as many buses here to start the day as they could. it looks like they achieved that and we have seven here right now. these commuters started lining up early, first ones at 3:45 in line. the first bus starting at 5:00. it is the journey home that is painful. >> it took three hours to get home. i expect it to take longer today because i got out of class earlier yesterday. i expect to be hole around -- home around 7:30. >> it will be 15 hour day. the buses are running from 5:00 in the morning until 8:00 and they will take people home at 3:00 this afternoon and running until 7:00. you cannot just grab a bus in the city home. you have to get a ticket in the east bay this morning which is how you get on board in the afternoon. on friday, bart said 4,400 people decided to catch the buses and if what we see in walnut creek the number will go up. >> let's give folks a look at the ferry landing at jack london square in oakland. last time we went through just a few people and now many are waiting in line to cash the next boat to san francisco. it and first come first serve. you need to buy your ticket in advance before boarding in oakland. we are talking to riders with an update in half an hour. >> if you drive to work, here is what you need to know: car pool lanes on 80, hearing on act tran it labor dispute. the bore will decide whether a cooling-off period is warranted. they asked the governor to start the process for a cooling-off period after workers threatened to strike. the union has rejected two contracts with a.c. transit. >> work stoppage is underway at the port of oakland. dozens of truckers rallied yesterday to voice their complaints saying they have gone 10 years without an increase in pay for cargo load and costs have increased. the drivers believe the port should pay them a monthly stipend to meet green standards. >> hard to believe only 5:09 and leyla gulen is looking at the metering lights going on. >> they have not turned on yet but they will in the next ten minutes. we are seeing exceptional heavy traffic at the bay bridge toll plaza. we are at 11 to 15 minutes to get from emeryville to san francisco with slow downs in the eastbound direction. that is indicating volume and it is coming and going and we have construction on the bridge. that can be due to that. most of the construction in the bay area has been lifted and the cones have been taken away. the westbound of san mateo is moving fine. from fremont to the peninsula is looking good. on 280, there is a problem with a motorcycle. northbound 280 at geneva avenue is in good shape if you are traveling from daly city to san francisco. 101 is at stop speed and you can see traffic slowing down. it is chilly to get us started. >> grab a coat. 40's and 50's. watch out if you are headed to the beaches. strong rip currents from the north bay to monday stray sneaker waves are the big threat and the possibility at the jet difficult or if you like to fish on the outcrops, watch out for the sneaker waves. they could knock you off the rocks. stay away from those until tomorrow. there is no specific timeframe. keep an eye on that. the day planner, definitive times the next 12 hours: clouds. only the east bay have not seen the cloud cover. temperatures are upper 40's to low 50's. by noon clouds are dissipating but still stubborn. inland in the east by at 72 and east bay has the most sunshine so you will be close to 80. by 7:00 this evening, grab a coat we will check with dick epstein behind the wheel jointing us by cell7 technology. how is the bay bridge toll plaza looking, dick? >> matt, i came in from the emeryville area on highway 80 and the traffic is moving. it is starting to build. the traffic is starting to backup here now getting to the toll plaza. i passed the west grand avenue off ramp which is a quarter of a mile before the bay bridge toll plaza. you can see the traffic backup has started in the cash lanes. the fast track lanes in the center appear to be moving but they are backing up. we have a substantial backup starting here at the bay bridge toll plaza. i looked at the clock and it is only 5:15 so this is an early start. matt? kristen? >> we will check back in a minute. >> concord police hope video hopes to catch the people who robbed a convenience store, the second time they were hit in two weeks. one man is raiding the cash register and the other is taking t-shirts off the racks. authorities are interviewing the co-convicted killers who used forged documents to escape from a florida prison. investigators are trying to figure owe how it amendments. they promise more arrests. the two men were taken into custody on saturday at a panama city beach motel. authorities say they were waiting to be picked up and taken out-of-state. >> financial news j.p. morgan chase bank moves to settle charges but could face a criminal investigation stemming from the financial crisis. >> here is jane king with the bloomberg business report business. >> j.p. morgan chase bank is not off the hook for criminal charges related to the sales of mortgage bonds and the runup to the financial crisis. they have struck a deal with the justice department to pay $13 billion to settle a civil probe. $4 billion is if consumer relief for those hardest hit. investors today looking at results from mcdonald's and netflix. net film will report it now has more paid subscribers than hbo and mcdonald's have not had huge success pass is loading up quickly and we are at 40 minutes westbound from tracy to dublin along highway 4 from antioch to concord it is 20 minutes. we we through san rafael to san francisco is 17-minute commute. on the waze app there is fog reported. northbound and southbound 680 watch out for the fog. 101 southbound the headlights toward you and toward the shopping center show traffic building. give the bart bus it is 46 degrees. direction accordingly. the same temperature in pleasanton hill. danville and dublin at 47. lafayette is 50. pleasanton is 49. concord is 48. pittsburg, antioch, brentwood, all in the low 50's. we of at 42 in novato. we are 49 in foster city. redwood city is 51. alameda is 51. cupertino is 52. everyone is now covered. from the exploritorium the clouds are lurking over the bay. we are off to a cloudy start and low sunshine today and the clouds will be disturb around area. the cool trend stays over the ocean. another seven days without measurable rain and we will probably go through the month without measurable rain. low-to-mid 60's along the coast and mid-to-upper 60's in richmond. mid-to-upper 70's in the north bay and we have upper 70's to low 80's through most of the east bay valley and livermore is 83 which could be the warm spot. cloud cover in all of the same areas this morning and temperatures are the same as you step outside. as we move ahead, look what is happening to the west: area of low pressure and an upper low is cut off from the main low enhancing the sea breeze so we will see cooler conditions in the seven-day forecast. just joining us or headed out the door, the ntsb plans to interview the operator at the controls when a bart train hit and killed two workers on saturday. one of those killed has been identified as a member of the we union. the other man is a contract worker, larry daniels. >> two, day four of the bart strike. it is making your drive pretty heavy there as we look at the bay bridge toll plaza engineer dick epstein behind the wheel this morning. dick, how is the drive? >> matt, the driver is starting to build here on the bay bridge westbound into san francisco. i cleared the bay bridge toll plaza and the metering lights were not on when i went through but the traffic bunches up when you get through the metering lights where the lanes emergency together. i am now on the incline section headed up toward the tower and traffic is starting to move again doing 40 to 45 miles per hour. we are close to the speed limit on the bridge and when you get through the backup going through the bay bridge toll plaza it does not thin until you get beyond the metering lights which as i said, are not yet on. matt? kristen? >> thanks for the upday to day. >> doctors are sending a warning to new strike is on day four. it is 5:30. thank you for jointing us. ntsb investigators are looking to what killed two bart workers on saturday. we are in oakland with the latest. nick? >> the ntsb workers arrived yesterday and when they got this after they arrived they tested the horn of the train and the brakes. they moved the train away from the crash site at the lake merritt bart station. union members are holding the picket line. this is the fourth day of the bart strike and the second day the safety board has taken over the investigation. last night, bart employees at the walnut creek and lake merritt bart stations stood together in solidarity and held a moment of silence to honor the to men who lost their lives after being hit by a bart train on saturday. the victims were identified at a contract worker, larry daniels, and christopher shepard, a member of the union. >> the family is grieveing. we are in a state of shock. it is a senseless tragedy. ridiculous. preventable. >> shepard was a senior track engineer and worked for bart three years. officials say he and daniels were inspecting the tracks near walnut creek when a bart train on routine maintenance run hit and killed them. ntsb is leading the investigation and they expect to be in walnut creek inspecting the rains and safety records for the next few days. union members that moved here have been somber. the operator of the train could be interviewed today. the union members say they will stay here until there is a contract. we have also learned that ntsb will hold a media briefing this afternoon at 4:00. you can follow that on abc7 news >> the latest now in the bart talks. the board will hold a special meeting this afternoon to discuss the strike and negotiations. the labor strike enters the fourth day. the unions have delivered a counter proposal to managers which includes changes to some work-place rules. no negotiations are scheduled. >> we are in day four of the bart strike. leyla gulen? >> it is busy. mass transit is rolling. ace train one is on time. ate train three will roll any minute. if you use bart from pleasanton you can ride to fremont along ace train and capital corridor. ace train three arrives at fremont at 7:10 a.m. and train 524 will be waiting at fremont until 7:16. other transit agencies are helping out during the strike. that will help you get to where you need to be. if you hit the road, you will be running into very heavy traffic. we have report of an accident eastbound highway 4. look the at westbound direction, 16 miles per hour. the waze app shows you are 50 minutes from tracy to dublin. you can download the waze app at google play. mike? >> tracking fog and low clouds with live doppler 7 hd. the lowest visibility is in santa rosa at half a mile fowled by napa at three and five in novato and san jose. we have clouds around our neighborhood but the east bay valley which is clear. you can see the winds blowing out onshore. that will mean slightly below normal temperatures. it will take until about noon to have total sunshine around the bay. the east bay valley is where you will see the 83. north bay inland is around 74. we have the cooling trend in the seven-day forecast. kristen? >> many commuters will pack the bart stations running shuttles and are seeing more people early in the morning compared to friday. abc7abc7 news reporter, amy hollyfield, is at walnut creek. >> we had a huge line but we now see the end of the line because bart provideed more businesses. they are taking what they learned from friday and applying it today. we have enough buses. we noticed it tapers after the here at 8:00 without a trip into san francisco. >> here is how it looked 59 the peak: the line was longer than friday but i have good news. one rider ahead it here and texted she was on the 5:00 bus and got there at 5:25 and says today's ride was faster than friday. we are hearing that tough part is not right now but the tough part is the ride home especially the approach to the bridge when you are in the city. we are hearing that friday it took people two or three hours to get back to the east bay. the buses are available from 5:00 to 8:00 in the morning and the round trip brings you hope between 3:00 and 7:00. >> the commuters are turning to ferries to get across the bay. jonathan is at the jack london square terminal in oakland to see how that is going. job -- jonathan? >> if you look to the right you can see this is the line for the 6:00 ferry forming in the last five minutes sin the 5:30 departed. they held the boat an extra minute to those running from the the lot. there is limited packing. they advise people to find another way to get here rather than driving. transit options are limited. there are 400,000 who usually ride bart. 19,000 will be able to fit on the ferries with the extra four boats. the ferries will be at capacity. folks in oakland are advised to by a ticket before you get in line. though are not sold on the boat. you will have to have cash on the clipper card of the folks are asking for your patient. >> i expect we will do the best we can. be parent. the the unions are losing support. that is what i see. >> they are unrealistic. at a time when people should be happy to have jobs...not happy about it. i teach at san francisco state and we have not had a raise since 2007...angry. very angry, actually. >> that is the sentiment we have been hearing from the riders who have stopped to talk to us on the way to catch the boat much the boats leave every 45 minutes. the next leaves at 6:00 a.m. news updates. >> the family of a woman found dead at san francisco general hospital is demanding answers after new revelations. lynne spalding's body was discovered in a stairway october 8 after being reported missing from her hospital bed. a hospital orderly stepped over spalding's body twice on the stairs october 1. the orderly notified a nurse who called the sheriff. it is not clear if the department sent someone to investigate or where they looked for the body and it is unclear why the hospital does not follow-up on the report. our reporter will have more on the mystery of spalder's death on "good morning america" this morning at 7:00 a.m. >> officials say a large apartment building that caught fire in walnut creek did not have an automatic sprinkler system. you can see flames ripped through the roof of the two story apartment complex that started before 2:00 a.m. yesterday. it does not appear suspicious. no one was injured. the flames destroyed six units. the fire officials say the build ing has smoke detectors but in sprinkler system. >> day four of the bart strike of the you can see the traffic and we will check with leyla gulen. >> we-hearing from our tweets. a tweet on vallejo ferry says it is very full, takes 50 percent longer to get to work. it is busy, indeed. over the bay area bridges, the golden gate bridge is between nine and 12 minutes. along the bay bridge, that is 12 minutes. the san mateo bridge is 12 minutes. 21 minutes gets you from emeryville to san francisco. each minute the time is moving up. the bay bridge toll plaza shows we are stacked up. we are at 15 minutes. between emeryville to the toll plaza it is slow. it is cold this morning. pack the sweater. >> it is cool. vallejo is 48. walnut creek is 47. if you are waiting for the buses or ferry, dress warmly. you can see the top of the eastern span of the bay bridge is hard to see. the clouds are getting thicker. inland we do not have clouds. you will have temperatures at seven degrees above average and livermore is 83. everyone else is the same and san francisco is below average by five degrees. around san francisco, next 12 hours are 46 to 53. clouds will open around the bay and inland and cloudy at the coast inland. 64 at the coast and 80 in the east bay so close to seasonal averages. the clouds return to all neighborhoods, and 70 inland while it highway 580 from downtown oakland and got on at harrison street. half a mile further down 580 is where the brake lights come on. on the 580 and 24 maze and continuing to the split with 580 and highway 80 the final leg before you get on the causeway for the toll plaza you can see the brick lights and this is the way it has been all the way through the maze from the macarthur maze, the 580 maze look at the ramp coming in on 24 backed up like this. we will see how long it takes for me to get to the toll plaza but it is going to take a while. >> thanks. we will check with you all morning. redwood city construction bomb could take a toll on drivers downtown and the city council is working to fix the problem. according to our media partner, the council will look at raising hourly rates at parking meeters to a dollar an hour until 8:00 p.m. installing real time signs and informing drivers of parking availability. >> you can get rid of old tires for marin county residents until november 1 starting today. tires left in backyards or rural properties pose a fire threat and crete a breeding ground for mosquitoes. they can be dropped off at the recovery center in san rafael or at the redwood city landfill in novato. the program is limited to marin residents and excludes businesses. >> less pain at the pump: the average flown has fallen two cents a gallon. the nation wide average is $3.36. albuquerque, new mexico, has the lowest average at $3.03. the highest is san francisco at $3.81. gas prices appear to be nearing a plateau and will stabilize. >> we will check with leyla have a planned new accident 80 in the westbound distribution from hercules. watch out for that accident that is blocking a lane. we are seeing very heavy traffic. we will look toward highway 24. i will have that in a little bit but i can tell you the traffic is solid stream of headlights in the westbound direction and it will take you 20 miles per hours to head from walnut creek into oakland. if we have it, i want to show you. it is nothing but headlights westbound. this ride only takes 12 minutes and now it is taking 20 minutes, so nearly twice as long. mike nicco will keep us updated on the chilly morning forecast. >> no matter where you are standing, all upper 40's and low 50's. it is cool. maybe not as cool as last week with clear conditions when we had 30's inland. you can see it is dry this morning. you are not having to wait in wet weather. if you are headed to san francisco, forest hill is 74 and downtown is 49, and everyone else is 50. portrero hill is 54. richmond is 50 and san lenadro, at 51 and waiting for the bus in pleasanton it is 44 degrees and 46 in american canyons and 52 in bemont and palo alto and santa clara. as we look from our roof cameras over the bay, we will have the clouds peel back to the coast at noon and they will stay stubborn. slow cooling trend all week but the wet weather will stay over the ocean. the cloud cover shows it is increasing and never makes a push into the east bay valley but covering everyone else dug -- during the morning. by noon it is back to the coast and holes will develop in the afternoon. we will check out the temperatures and we talked about how it will be cooler-than-average because of the clouds and low-to-mid 60's in san francisco and richard and upper 60's to 70's to the bay shore until fremont and palo alto and mid-70's in the south bay and mid-to-upper 70's in the north bay and upper 70's to mid-80's in the east bay valley. livermore is 83. tomorrow is like today. a slow cooling trend as the
