Tonight their Attorney Says that officer may have violated Department Policy. Abc7 News Reporter is in the newsroom with the details. Sergio . Matt, john burris says he has information that the patrolman may have violated Department Policy during the arrest because he didnt have key pieces of equipment on his utility belt. With no taser or even a baton, burris says the officer resorted to the most deadly weapon, his gun. Richmond police say they have Surveillance Video that proves the Fatal Shooting of Richard Perez was justified. Tonight Attorney John Burris says the sixyear veteran of the department was not properly equiped for this incident. Through a confidential inside source that the officer was required to have his baton and his taser with him, and he had neither. According to burris, this is a key detail because officer wall legion wally jenson could have used nonlethal force if he had it available. Not having baton or pepper spray or any of that, is that a requirement by the department or a state requirement . It is not a state requirement, of course not. Departments have policies, and they have these policies and it is for a particular reason. Richard perez was outside uncle sams liquor when officer jenson intervened. Perez was acting belligerent so officer jenson said to sit on the sidewalk while he performed a records check and thats when the officer was attacked. Attorney john burris tells a different story. The officer was trying to put handcuffs on him and he did resist that. The officer for whatever reason pulled out his gun and shot him. He was not within a foot. He was over five feet away. San jose police are searching for the people who burglarized Ray Mcdonalds home last night. Officers responded to a report that the 49ers defensive linemans home was robbed. They said someone forced entry in the home and stole personal items. The home was vacant at the time. He was in arizona preparing for the game against the cardinals. Investigators say food left unattended on a stove gutted one apartment and left others damaged. It started after 4 00 in this fourstory apartment building.
