intended. >> at the center of the debate are those full-body scans and the aggressive pat-downs. is the tsa crossing the line? here's neal karlinsky. >> reporter: to hear the increasingly loud rallying cries you'd think america's airports have turned into one big peep show. where hordes of unsuspecting passengers are being groped and molested. >> how is it the freest country in the history of the world is now subjecting their citizens to panty pat-downs? >> reporter: the field generals in this crusade against the tsa and its full-body scanners and enhanced pat-downs include a random passenger with a camera, a toddler, and a talk show host. john tyner from san diego is now known worldwide as the "don't touch my junk" guy for this video he recorded of his own tsa close encounter. >> we're going to do a groin check, slide that down, i'm going to do that two times in front and two times in the back. if you like a private screening we can do that. >> dient here but if you touch my junk i'll have you arrested. >> it was just frightening. >> reporter: meg mcclain, a radio talk show host who claims she was singled out and handcuffed by the tsa. a moment captured on surveillance video. because she pushed back against the new security. >> they used full palms with fingers, they feel around your breasts, your genitalia. it's just completely dehumanizing. >> reporter: then there's the 3-year-old. a youtube video of a 3-year-old upset about having her teddy bear x-rayed while the tsa patted her down is for some the perfect example of airport security run amok. even though this isn't part of the new enhanced security. >> it is ridiculous that 100% of the people are being put through these very intrusive measures when you know that 100% of the people are not risks. >> reporter: the outcry is over these full body scanners that can see through clothing. the government says people's identities are protected but there have already been problems. >> bottom line is i think there is some dignity that has to be involved in this. in my opinion, i think they need to find something a little bit better. >> reporter: then there is the question of radiation. the government says the scanners are safe. pilots who have to pass through them on a daily basis aren't so sure. including the biggest hero pilot around, captain sully himself. >> i think it's unnecessary for the flight crews to go through them, first, and second, i think it poses some radiation risk. >> reporter: but opting out of the scanners only causes more problems. now that enhanced pat-down techniques give agents the right to feel inside the legs, the front of a woman's bra, and more. >> you're going to be searched either way and you're going to be invaded either way. >> reporter: on capitol hill the tsa's chief acknowledged the new pat-downs are invasive. but he said they're necessary because the government has been able to smuggle items through normal security in its own tests more than they'd like to admit. >> the intelligence, coupled with the repeated covert testing led me to conclude that we needed to be more thorough. >> and if a little privacy goes out the window, you're okay with that? >> yeah, it's not like we're being strip searched to get on the plane. >> digitally strip searched. >> but it's not that extreme. so i'm comfortable with it. >> reporter: a recent cbs news poll shows americans overwhelmingly support the use of full-body x-rays, something hard to reconcile with the very vocal minority. >> enough people opt out, these tsa abuses will come to a standstill. >> reporter: a growing grassroots campaign is encouraging people to opt out of the full-body scanners next wednesday. the day before thanksgiving, and a slightly busy time in the nation's airports. the goal, to force the tsa to change its methods. >> raise holy hell. >> reporter: passengers hoping to force change through protests next week will likely find themselves in a very long line. i'm neal karlinsky in seattle. >> always something. this is literally the biggest backlash since 9/11. tsa says it's gotten more than 1,000 phone calls and e-mails just in the past week, people complaining about the new procedures, the scans and the pat-downs. >> i'm flying for thanksgiving, one of the big questions i wondered is, how much earlier am i going to have to show up? they're saying on average you can take about 30 seconds to get you through, now it could be two minutes. you still have to plan earlier because regardless of how it plays out it's going to take extra time. >> you probably should leave for the commercial break. leave during the commercial break, get a head start. >> be happy to go. coming up next, the hollywood hunk named "people" magazine's from hollywood but not really surprising here. eva longoria, tony parker, calling it quits. they filed for divorce after seven years together. they were married in july 2007 but filed papers in california wednesday. >> three years together. >> seven years together, three married. >> i gotcha, i'm sorry. >> so they are calling it splitsville. they both kind of -- rumors for weeks now. earlier this week eva denied it. then they went online, yesterday she went on twitter, the statement she released said, where was it here. it is with great sadness that after seven years together tony and i have decided to divorce. we love each other deeply and pray for each other's happiness. she said that on twitter, he went on facebook, essentially said the same thing. this is the reason why. apparently tony wasn't the most faithful of husbands. shocking for a professional athlete. he apparently had a dalliance with his former teammate's wife. so that's kind of the reason. the guy was brent barry. the wife of parker's former spurs teammate brent barry, that apparently is the reason they split. it could have been two women as well. that's what she's told some people, it was more lowest combined total of judges' scores and viewer votes is -- brandy and maks. >> i don't know how to feel right now. >> reporter: brandy wasn't the only one stunned. >> i'm so disappointed. >> reporter: brandy had 57 points out of 60. bristol had 53. even though bristol's consistently been at or near the bottom of the judges' leaderboard she managed to waltz her way right into the finals. >> to have opportunities like this show, to have fans that keep voting us in -- >> reporter: prosecutors say a man in wisconsin was so enraged he blasted his tv with a shotgun and sparked an all-night standoff with a s.w.a.t. team. >> this season has been crazy, let's be honest. it's been another one of those nights. >> reporter: the judges' scores are combined with viewer votes to decide who gets the boot. >> if you really want someone other than bristol to win, it's pretty easy. get on the phone, get texting, get on your computer. if you don't do that, you shouldn't complain. >> reporter: online people are calling for a boycott and for bristol to withdraw. we found hundreds of messages on the "dancing with the stars" message board suggesting a tea party conspiracy. one viewer wrote, "the voting has obviously shown it can be skewed by the political party maniacs." >> i think that people are voting for us because i'm relatable. they see the consistent improvement in my dancing. >> reporter: but is the show about most improved or best dancer? a study out last week suggests it could be political. republicans ranked "dancing with the stars" as their ninth favorite tv show. i'm vinita nair. the case viewed as a testing ground for trying terror suspects in civilian courts has ended in a stunning acquittal. >> prosecutors say the defendant was a bodyguard for osama bin laden who took part in the u.s. embassy bombings that killed more than 200 people. a jury in new york convicted him on just a single charge. abc's jason ryan is in washington with the latest. hi, jason. >> reporter: thank you, vinita and rob. a federal jury in new york has cleared the first guantanamo bay detainee to face trial in the united states on all but one of the 286 terrorism charges he faced for his role in the 1998 u.s. embassy bombings. the verdict could be a blow for the obama administration. and plans to try 9/11 mastermind khalid shaikh mohammed in a u.s. court. ahmed ghailani was accused of participating in the bombings of u.s. embassies in kenya and tanzania and was found guilty on conspiracy charges to destroy buildings and property of the united states. but he was cleared of more severe terrorism offenses. the trial was to be a test case for other prosecutions of guantanamo bay detainees, including five of the 9/11 conspirators that are still being held at the facility. criticism of the verdict has already begun, with republican members of congress saying military commissions would have been a more effective way to handle the case. congressman peter king, the likely chairman of the house committee on homeland security, said he was disgusted that ghailani was acquitted of so many of the terrorism counts. a justice department spokesman said they had respect for the jury's verdict and they are pleased that ghailani faces a minimum of 20 years with no parole and a maximum penalty of life in prison when he is sentenced next year in january. rob and vinita? president obama is trying to drum up support for the nuclear treaty with russia at a white house meeting later today. former defense secretaries and secretaries of state from both parties will be there. the treaty was put in jeopardy earlier this week when a key republican lawmaker came out against it. secretary of state clinton says it is an urgent matter. >> this is not an issue that can afford to be postponed. so we think once we take that message with the urgency that you've heard from the three of us, we will get the votes and we will pass this treaty. >> the treaty would reduce the u.s. and russian arsenals of strategic warheads. it is one of the president's top foreign policy objectives. when the new congress meets in january the leadership of both parties will be the same. current speaker of the house nancy pelosi was elected by her colleagues to be the new minority leader yesterday. moderate democrat heath schuler challenged her, getting a few dozen votes. but there were no challenges to ohio republican john boehner, as was widely expected he was unanimously elected to be the next speaker of the house. his election came, ironically enough, on his 61st birthday. he is now promising a wiser, more focused leadership. senator lisa murkowski declared victory and says she will return to capitol hill for another six years. the alaska republican incumbent celebrated last night in anchorage. she becomes the first senator to win a write-in campaign in more than 50 years. despite republican pressure her tea party-backed challenger joe miller has not yet conceded. is sarah palin weighing a run for the white house in 2012? she now says she is huddling with her family and thinking it all over. one thing the former alaska governor says she does know is who would win. she made a prediction in an interview with our barbara walters. >> and i'm looking at the lay of the land now and trying to figure that out, if it's a good thing for the country, for the discourse, for my family, if it's a good thing. >> if you ran for president, could you beat barack obama? >> i believe so. >> you can watch the entire interview with sarah palin on "barbara walters' ten most fascinating people" december the 9th at 10:00 p.m. eastern. the man in charge of keeping every airline flight safe is standing by those controversial security checks even in the face of some outspoken criticism. >> the tsa chief says no matter what happens at airports over this thanksgiving holiday, security policies are not going to change. john hendren has more now. hi, john. >> reporter: good morning, rob and vinita. it turns out that extra attention you may have noticed at the airport security line isn't routine at all. the nation's top transportation security official says his agency has recently discovered major gaps. the federal government now says there's good reason for heightened airport security. in government tests, transportation security administration chief john pistole told congress federal agents have routinely been able to smuggle banned items on planes. >> so the intelligence, coupled with the repeated covert testing, led me to conclude that we needed to be more thorough. >> reporter: that explains the rise in the use of those full-body scanners which some critics call an electronic strip search, and intimate pat-downs that pilots equate with sexual molestation. that prompted passenger protests like this one. >> if you touch my junk i'm going to have you arrested. >> reporter: after a flood of complaints, one group won't have to undergo intensified searches. >> children 12 and under are exempted from the enhanced pat-downs. >> reporter: tsa officials say they're working on a system to exempt pilots, who already undergo extensive security checks. asked if pat-downs make him uncomfortable, pistole said -- >> yeah, so it was more invasive than what i was used to. >> reporter: but, he added, they're necessary. almost 400 body scan machines have been deployed in u.s. airports. magnetometers can identify metal but bombs can be made of liquid and other hard to detect materials. the government continues to receive intelligence suggesting terrorists are intent on smuggling bomb components on planes bound for the u.s. the heightened security could hardly come at a worse time for the travel industry. airlines and travel agents say they're now worried people will start canceling their holiday trips, depressing an already downtrodden economy. rob and vinita? one of those political robo calls triggered the evacuation of several buildings at ft. bragg. army officials apparently mistook the automated call, which was in a haitian creole language, to be a bomb threat. the military and federal investigators looked into the matter and concluded the call appeared to be a call to vote from a haitian political action committee. former reality tv producer bruce beresford-redman has been ordered to remain los angeles. >> reporter: hollywood producer bruce beresford-redman appeared before a magistrate in the same t-shirt and blue jeans he had on when he was arrested. his only words in the hearing, "yes, your honor," to confirm his name. mexican federal police accuse beresford-redman of aggravated homicide in the death of his wife monica. he was their sole suspect, yet it took 7 1/2 months to gather the evidence and clear the red tape to have the fbi and u.s. marshal service arrest him. monica's sisters were in court to watch. >> this is just the beginning we are here, ready to keep on fighting for the justice for my sister and for the love that we have for her. >> it's not our job to identify another suspect. but there certainly have been other crimes committed in that area, and in particular, that same hotel. there were two other homicides at that same hotel. so we think that the police certainly should have looked for other suspects before they arrested our client. >> reporter: bruce's father had no comment leaving the courthouse. the federal complaint alleges that bruce had an affair. the trip to a cancun resort was to patch things up but they fought as monica learned he was still in touch with the mistress. witnesses say they saw fighting, heard screams, and the sound of something being dragged in the room at 6:00 a.m. bruce allegedly gave conflicting stories about the noise. first, that they had fought about the children's behavior. then, that it was their 3-year-old playing a noisy game. he claimed monica went shopping later that same morning and never came back. he waited until the next day to report her missing. >> there is no happy ending on this. you know? it's just the hope for -- to get where we need to go so justice is served. but yesterday's republican and democratic elections. >> the bill is passed. >> reporter: for the democrats, the captain did not go down with the ship. >> how would your ratings be if $75 million were spent against you? >> reporter: house democrats were devastated at the ballot box, losing more than 60 seat and control of the house. but they re-elected some familiar faces. >> i'm proud to be part of this leadership team. our consensus is that we go out there listening to the american people. it's about jobs, it's about reducing the deficit, and it's about fighting for the middle class. >> reporter: nancy pelosi goes from house speaker to minority leader. steny hoyer from majority leader to minority whip. james clyburn from whip to a newly created post, assistant minority leader. it happened despite an insurgent run against pelosi by heath schuler, conservative blue dog democrat who netted an impressive 43 votes to pelosi's 150. >> it's about truly making a difference in our caucus. to ensure that the moderates are heard within the caucus and that we have a seat at the table. to get that many votes, that's a lot better than we expected. >> reporter: republicans awarded the men who led them to victory at the polls. unanimously picking ohio congressman john boehner as the next speaker of the house and eric cantor as the number two republican, going from minority whip to majority leader. because the house speaker is next in line in presidential succession after vice president, the full house has to vote on boehner's selection but that is usually a formality. john hendren, abc news, washington. a florida woman who visited haiti is now the first american known to have died from the impoverished country's crisis with cholera. meanwhile, haitian protesters took to the streets for a third day of anti-u.n. demonstrations. they blame u.n. peacekeepers for spreading the disease. more than 1,000 haitians have died in the cholera outbreak. things got rough at protests against tuition hikes for university of california students. the clashes on a san francisco campus took place after students tried to get into a university board of regents meeting. all of their anger stems from a plan to increase student fees by $822. 13 people, most of them students, were taken into custody. >> an officer started hitting me more, then an officer came over, took a pepper spray canister and sprayed us all. >> i understand there's real passion and emotion. but you know, all we can hope for is that they -- you know, that everybody behaves. >> four officers were injured. one of them had to be treated at a hospital. very interesting story here. surprising findings this morning from a new survey on marriage. just released by "time" magazine. the poll shows that 40% of americans believe marriage is an obsolete institution, up from 28% back in 1979. the survey also shows that wedded couples are wealthier than unmarried couples with incomes about 41% higher. and just 28% of americans say there is only one true love for each person. conventional wisdom not necessarily being believed anymore these days. interesting. here's a look at your thursday forecast. stormy out west. another day of heavy snow in the cascades. rain in seattle, portland and northern california. rain and mountain snow in northern idaho and western montana. thunderstorms in south florida and some showers from cleveland to buffalo. >> 54 here in new york. 63 in atlanta. 83 in miami. just 30 in the twin cities. 40s in chicago, indianapolis and omaha. 56 in salt lake city. 76 out in phoenix. if you have something to celebrate this morning how about doing it with some of the world's oldest drinkable champagne. >> all right. it was nice and chilled after nearly 200 years under water. the bubbly was salvaged from a shipwreck in the baltic sea back in july. >> one champagne expert said he tasted hints of honey and peach. when they are sold at auction, some of the bottles could fetch over $70,000 each. didn't he just ruin one bottle by tasting it? >> no kidding. it's been a long week. >> they said after the "titanic" sank there were bottles of corked champagne that they found in the ship wreckage, some of the champagne that was used to toast the initial voyage. >> it's miller time, 5:00 somewhere. we'll be back with more after this. as we approach one of the busiest travel days of the year the debate over tsa screening procedures is sky high, pun intended. n honking. a short time ago, this woman suffered from around his house. these people chose freedom we'llwork wit your doctor. we'll work with medicare and lçur private insurance. we'll even service your scooter anywhere in the country. call the sco÷"er store today. as we approach one of the busiest travel days of the year the debate over tsa screening procedures is sky high, pun intended. >> at the center of the debate are those full-body scans and the aggressive pat-downs. is the tsa crossing the line? here's neal karlinsky. >> reporter: to hear the increasingly loud rallying cries you'd think america's airports have turned into one big peep show. where hordes of unsuspecting passengers are being groped and molested. >> how is it the freest country in the history of the world is now subjecting their citizens to panty pat-downs? >> reporter: the field generals in this crusade against the tsa and its full-body scanners and enhanced pat-downs include a random passenger with a camera, a toddler, and a talk show host. john tyner from san diego is now known worldwide as the "don't touch my junk" guy for this video he recorded of his own tsa close encounter. >> it was just frightening. >> reporter: meg mcclain, a radio talk show host who claims she was singled out and handcuffed by the tsa. a moment captured on surveillance video. because she pushed back against the new security. >> they used full palms with fingers, they feel around your breasts, your genitalia. it's just completely dehumanizing. >> reporter: then there's the 3-year-old. a youtube video of a 3-year-old upset about having her teddy bear x-rayed while the tsa patted her down is for some the perfect example of airport security run amok. even though this isn't part of the new enhanced security. >> it is ridiculous that 100% of the people are being put through these very intrusive measures when you know that 100% of the people are not risks. >> reporter: the outcry is over these full body scanners that can see through clothing. the government says people's identities are protected but there have already been problems. >> bottom line is i think there is some dignity that has to be involved in this. in my opinion, i think they need to find something a little bit better. >> reporter: then there is the question of radiation. the government says the scanners are safe. pilots who have to pass through them on a daily basis aren't so sure. including the biggest hero pilot around, captain sully himself. >> i think it's unnecessary for the flight crews to go through them, first, and second, i think it poses some radiation risk. >> reporter: but opting out of the scanners only causes more problems now that enhanced pat-down techniques give agents the right to feel inside the legs, the front of a woman's bra, and more. >> you're going to be searched either way and you're going to be invaded either way. >> reporter: on capitol hill the tsa's chief acknowledged the new pat-downs are invasive. but he said they're necessary because the government has been able to smuggle items through normal security in its own tests more than they'd like to admit. >> the intelligence, coupled with the repeated covert testing led me to conclude that we needed to be more thorough. >> and if a little privacy goes out the window, you're okay with that? >> yeah, it's not like we're being strip searched to get on the plane. >> digitally strip searched. >> but it's not that extreme. so i'm comfortable with it. >> reporter: a recent cbs news poll shows americans overwhelmingly support the use of full-body x-rays, something hard to reconcile with the very vocal minority. >> enough people opt out, these tsa abuses will come to a standstill. >> reporter: a growing grassroots campaign is encouraging people to opt out of the full-body scanners next wednesday. the day before thanksgiving, and a slightly busy time in the nation's airports. the goal, to force the tsa to change its methods. >> raise holy hell. >> reporter: passengers hoping to force change through protests next week will likely find themselves in a very long line. i'm neal karlinsky in seattle. >> always something. this is literally the biggest backlash since 9/11. tsa says it's gotten more than 1,000 phone calls and e-mails just in the past week, people complaining about the new procedures, the scans and the pat-downs. >> i'm flying for thanksgiving, one of the big questions i wondered is, how much earlier am i going to have to show up? they're saying on average you can take about 30 seconds to get you through, now it could be two minutes. you still have to plan earlier because regardless of how it plays out it's going to take extra time. >> you probably should leave for the commercial break. leave during the commercial break, get a head start. >> be happy to go. coming up next, the hollywood hunk named "people" magazine's sexiest man alive. an apology from sarah palin's daughters. stay tuned for "the skinny." can i really leave? ababababababt here we go. >> ladies, this one's for us. >> yeah. have at, go for it. >> go for it, girls! >> "people" magazine is out with their sexiest man and for once, i agree. take a look at who has won the search, there he is, ryan reynolds, you are the sexiest man alive. you're also hilarious. take a listen to what he said when talking about the award. >> how i managed to usurp george clooney, who, you know, in a word, dreamy. in some ways it's sort of humbling. >> yes, there he is. humble and also self-deprecating. he says you have to go with the flow, this gives my family entre into teasing me for the rest of my life. in case you're wondering a little about him, he is from canada. he's the youngest of four brothers. and yes, ladies, he is taken, married to scarlett johansson for the past two years. he said the most difficult part is going to be organically working his title into a conversation with random strangers. well-deserved, all the ladies here love you, ryan. >> all right. while you towel off from that story, i'll move on to the next one. this is sad news from hollywood but not really surprising here. eva longoria, tony parker, calling it quits. they filed for divorce after seven years together. they were married in july 2007 but filed papers in california wednesday. >> three years together. >> seven years together, three married. >> i gotcha, i'm sorry. >> so they are calling it splitsville. they both kind of -- rumors for weeks now. earlier this week eva denied it. then they went online, yesterday she went on twitter, the statement she released said, where was it here. it is with great sadness that after seven years together tony and i have decided to divorce. we love each other deeply and pray for each other's happiness. she said that on twitter, he went on facebook, essentially said the same thing. this is the reason why. apparently tony wasn't the most faithful of husbands. shocking for a professional athlete. he apparently had a dalliance with his former teammate's wife. so that's kind of the reason. the guy was brent barry. the wife of parker's former spurs teammate brent barry, that apparently is the reason they split. it could have been two women as well. that's what she's told some people, it was more than one woman. so that marriage is over. >> let me guess, he's not commenting on the infidelity charges. >> from what i've heard on facebook he has not said anything about the infidelity charge yet. >> kind of sad. >> it is. she wants her name back. >> bristol palin is now apologizing for her sister's homophobic slurs. we talked about this story yesterday. essentially what
