>> just happen to leave. and just happen to have a diamond necklace on. >> thanks, guys. sflmp we're going to move to washington now, and a major blow to the spy agency program that collects data on millions of our phone calls. a federal judge has ruled it's almost certainly unconstitutional. a decision that will spark more action in congress and confrontation at the supreme court. abc's jon karl is at the white house with more. and the administration says they will review the decision. but their position has been, it's constitutional and keeps us safe. >> reporter: that's right, george. the president himself has said point blank that this program saves lives. he said that no fewer than 50 terrorist plots have been broken up thanks to this program and a similar one that tracks internet traffic. but the judge seemed to take issue with that. saying, there's an utter lack of evidence that a terrorist attack has ever been prevented by this program. and in stark language, he said it is clearly unconstitutional and an invasion of privacy. saying, quote, i cannot imagine a more indiscriminate and arbitrary invasion than this systematic and high-tech collection and retention of personal data. on virtually every, single citizen. i have little problem believing that the author of the constitution would be aghast. >> reporter: this will now go to the supreme court. that's right. and there are several other legal challenges to this law. they will all be brought together and go to the supreme court. but nobody doubts this will ultimately be decided by the supreme court. >> and quickly. a new abc news/"washington post" poll out this morning, showing the president is still stuck at some of the lowest approval ratings of his presidency. >> reporter: yeah, and look at this, george. asked who do you trust to handle the country's problems? the country is evenly divided between president obama and the republicans. that's quite a change from last year, when you saw the president had a big 15-point advantage over republicans. now, the country is saying, either one, about the same. >> it's been a rocky year for the president. thanks very much. you see behind us, the snow is beginning to fall. it's a new hit slamming the northeast, while wildfires blaze along the california coast. ginger zee, very busy, tracking all of it. >> listen, coast to coast, we have issues. we want to start on the east coast, because that is where people are getting on the roads and getting out this morning. it's not going to be easy. just a little bit of snow, people start to slip and slide. that's going to go on. one to three inches. this is a clipper system. and just that. it moves very fast through. but morning hours are going to be a mess. anywhere from philadelphia to new york city to boston. just because of this. and interior could get more snow. want to show you snow totals, how much to expect. it's not a ton. it could be a dusting to just over an inch. boston at two. but again, we're talking also about the west coast. they're hot. they're very dry. 94% of california in moderate or greater drought. this morning, it's an all-out assault. more than 300 firefighters, frantically battling a wild blaze. chewing away at big sur, california. at least 15 homes have been destroyed, nearly 100 people forced to evacuate the area. >> we've been told to pack some bags and prepare, in case we do get evacuated. >> reporter: the flames, roaring through about 500 acres. officials hope they will contain the blaze this week. the cause of the fire is still under investigation. but much of california is experiencing the driest calendar year on record. >> big sur is historically one of the wettest places in california. and we've had virtually no rain here all year. >> virtually no rain there. san francisco, many places, i'll be hitting more on how that drought is affecting all of california and the west, coming up. >> things looking better tomorrow. >> did i hear 50s this weekend? >> by the end of the week, we're much warmer. that sounds so balmy, doesn't it? >> sure does. let's go to abc's amy robach in for josh, with the top stories. >> we begin with major changes at doctors offices across the country. and that could influence the drugs that you're prescribed. glaxo smithkline has become the first major pharmaceutical company to say it will stop paying doctors to promote its drugs. that's a long-standing industry practice many view as a conflict of interest. it comes as glaxo faces a bribery investigation in china. a new report out this morning is questioning billions of dollars in your taxpayer money spent in washington this year. among the highlights, or lowlights, depending on how you look at it, $630,000 spent by the state department to increase the number of likes on its facebook page. $914,000 to study romance on the internet. and $3.5 million to cover airport solar panels with tarps so they don't reflect the blinding sun. a total of $30 billion in spending is highlighted in senator tom coburn's report on government waste. a must-read. a new shakeup at the vatican. pope francis has removed an outspoken critic of abortion and same-sex marriage from a powerful post at the church. conservative cardinal raymond burke was head of the vatican's highest court. this move is seen as reinforcing the pope's vision for a more inclusive church. today, he spent his 77th birthday visiting with the homeless. back here at home, the baltimore ravens gave detroit the boot. the boot off the kicker's foot. justin tucker. six field goals. 61-yarder, putting the ravens ahead for good, with less than a minute to go. they win, 18-16. finally, it's no fun digging your car out of the snow for anyone. not even a king. but look at this. that is the king of jordan, king abdullah ii. he felt so sorry for one family stuck on the side of the road that he stopped and he joined other good samaritans pushing their car out of the snow after a freak storm. look at that. a true man of the people. and nowadays, there's always a camera to catch all of that kindness we're happy to spread joyfully today. now, the manhunt for carjackers that gunned down a young attorney in a new jersey mall. police are looking for the killers of justin friedland, as he tried to save his wife. abc's reena ninan has the story. >> reporter: the ambush took place on the second floor of the parking garage sunday night. 30-year-old dustin friedland, and his wife, jamie, both lawyers, their arms full of packages, were headed back to their car around 9:00 p.m. friedland opened the passenger door for his wife and was heading to the driver's side when two men approached. demanded keys and fired shots. one of them killing friedland, the other one ordered his wife out of the car. then, took off in the range rover. an anonymous tip led police, to this boarded up house, where the victim's stolen range rover was found abandoned. with the back window shattered and inside damaged. friends and family of the victim coping with the unbearable news. friedland's uncle releasing a statement to abc news. i want the punks responsible to pay. i want them to die. i want them to get what they gave. >> he was a tremendously loving, kind guy. it's really just a tragedy and senseless violence. >> reporter: police are still searching for the suspects, lara. >> thank you so much, reena. now, new safety concerns about anti-bacterial soap, used by so many of us. the fda is cracking down, now asking companies to clearly show that benefits of these soaps outweighs any health risk. and dr. richard besser is here to tell us about it. >> this is big. for the first time, the fda is taking a move against the companies that make anti-bacterial soaps. and the reason for that is there's concern about safety, as well as whether they work. the companies say they've been able to show they killed germs. the fda wants them to show now that they also keep us healthier. and the reason for that is there is concern that some of the chemicals in these products can promote resistant infection and act like hormones in our body. >> do the opposite of what we're hoping for. do we use them? or do we not? >> i've never been a fan of anti-bacterial soap. regular soap and water, you use it properly, it will keep you very safe. these soaps don't kill viruses. that's what we're really concerned about. i reached out to the companies. they say, we're confused about this. we've been presenting data to fda for years. and we think consumers should have them. >> you said so important for all of us to know. i want to point out. this does not involve hand sanitizers or wipes. >> it's a good backup. alcohol sanitizers are a great way to go. >> thank you. we have a warning for all of you flying this holiday season. this hidden camera video, an abc news exclusive, of airport baggage handlers brazenly stealing. abc's pierre thomas has more on the shocking results of this government sting. and how you can protect yourself from airport theft. >> reporter: this morning, officials say this is why you want to be careful about what you pack in your checked luggage. these airline baggage handlers are stealing, caught on hidden cameras hidden in the belly of the plane. caught on hidden cameras. watch as this baggage handler finds a wallet. bingo. there's the cash. let's count it. maybe there's more. yep. credit cards. let's take those, too. video of the brazen theft, obtained exclusively by abc news, from the new york regent's port authority police. and they have a holiday warning. >> they are hard-working, honest people, by and large. there are some people that are tempted. >> reporter: tempted, indeed. the sting was set up after israel's airlines was getting complaints from passengers about items missing from their baggage. jewelry, cash, laptops. iphones, ipads. seven workers charged in the scam. at the new york region's three airports, there were nearly 600 reports of luggage theft in two years. and it's not just new york. in minneapolis, this baggage handler is caught on tape stealing $84,000 worth of goods. it's not just airport workers doing the stealing. in phoenix, police were recently searching for these men, accused of plucking other people's luggage right off the carousel. that, after a 2009 case where this man and his wife were charged with stealing hundreds of bags. what can you do to protect yourself? was it sexual harassment? >> that's the big question. also ahead, the courtroom battle over the million-dollar painting of farrah fawcett going to the jury. her former "charlie angel's" co-star, jaclyn smith, offering emotional testimony. who she says fawcett would wand to have that painting. and will ferrell going to be here. mr. ron burgundy, with his co-star, baxter. there he is getting the star treatment this morning. he steals the movie. might steal some thunder here today. ready for his "gma" debut. >> i cannot wait. to visit with them both. we begin this half hour, with the latest on a chilling murder mystery out of hawaii. a young woman found dead in the ocean. her boyfriend, vanished, and considered a suspect in her murder. but could he have been a victim as well? neal karlinsky has the story. >> reporter: seven months after 25-year-old brittany royal was found strangled and dumped in the waters off hawaii's big island, family and friends are wondering if the main suspect, her 23-year-old boyfriend, bo johnson, might actually be a victim, not a killer. >> we're so in needing to find out mode that it's blocking the grief process, which has been really difficult for us. >> reporter: brittany and bo recently told their families she was pregnant. they were living in this tent, while visiting ohio, while bo was looking into buying land on the island's famed lava fields and starting a tour business. he vanished at the time of the murder, leaving behind his i.d. police have called him a suspect. but anonymous letters and flyers have turned up on the island, claiming that bo was targeted by the real killer. because of his ambition to buy native land. haole, a term for white man, had to be killed before he buy land, to send a message. another note talks about both being murdered on the lava fields. and asks the killer to confess. >> there was a man who came to our house, when i lived with bo in hawaii. and he came and threatened our lives because we had trespassed on what he considered his property. >> reporter: but in a statement, police tell abc news, nothing has changed. our investigation, thus far, has identified boaz johnson as the suspect. the case remains very active. if bo did pull off the murder, he would have to escape a hawaiian island with few resources and no i.d. if he didn't do it, a killer is still on the loose. for "good morning america," neal karlinsky, abc news, seattle. >> thanks to neal karlinsky for that. we turn to the georgia high school senior suspended from school for hugging his teacher. you see it right there. he said it was innocent. school officials say it was sexual harassment. it was all caught on camera. you can reach your own judgment. here's abc's john muller. >> reporter: take a look at this surveillance video. watch as 17-year-old sam mcnair comes up behind his teacher to give her a hug. seemingly innocent enough. not according to gwinett county's rules. the high school senior is being suspended from duluth high school until next december, which means he won't graduate on time. >> my heart dropped. my future is flashing by in my head. and i'm just like, oh, my god. this is happening. >> reporter: let's watch the hug again. according the a discipline report, the teacher alleged that mcnair's lips and cheeks touched the back of her neck. >> she explained what didn't match what i did. and i'm like, wow. this is crazy. >> reporter: mcnair's mother, april, was shocked to hear the news. >> i'm like dumbfounded, really. it's crazy how the incident happened and brings such a harsh punishment on derailing a child's future. >> reporter: the gwinett county schools would not be interviewed. they did release a statement saying, hearing officers consider witness testimony. a review of the known facts and a student's past disciplinary history when determining consequences. mcnair's mother is appealing the decision. the teen does have a disciplinary record, which includes past suspension. but none were the result of sexual harassment. overnight, reaction from parents and teammates. >> i can see if you suspend him for a week or two. but not a whole year. >> sam is a hugger. he always says, if you give a hug a day, it might change somebody's day. >> i'm afraid to give anybody a hug now. >> reporter: for "good morning america," john muller, abc news, new york. let's talk about this with abc's legal affairs anchor dan abrams. >> the headlines everywhere, were student suspended for hugging teacher. when you actually watch that video, and according to her, this was more than a hug. you see at the end there, it appears that he is trying to kiss her on the back of the neck. why isn't this teacher entitled to a sexual harassment-free zone? this is not like the 6-year-old we read about, where he tried to kiss a classmate. this is a 17-year-old senior here. who, he's not just hugging, but appears to be trying to kiss. >> kind of a blind side there. >> yeah. and you see her at the end, sort of push him off. this is an unwanted touching. imagine if this would happen in the workplace. >> so an infraction no doubt. but a year's suspension? >> it's a tough sentence. they said he was in trouble before. that's why he got the stiff sentence. i remember when i was in high school. i got in trouble. i got in trouble again. and a snowball i threw landed near a teacher and i got suspended. >> dan? >> that's "pop news." now, we're going to talk about the two moms. pictures post-pregnancy have gone viral but for different reasons. karen said she has a near-perfect body. and it's not all it's cracked up to be. and she's taking aim on fit mom, the california mom of three, whose picture sparked outrage. bianna golodryga has the story. >> reporter: these two women might look like they have a lot in common. both mothers of three. both now internet sensations after posting postbaby body photos that have gone viral. but their messages are completely different. 35-year-old taryn is making waves for her series of postbaby body photos. she says after her third child, she became obsessed with getting back to her prepregnancy body. working out to get this body, she considered plastic surgery. >> my body changed a lot after having three children. and i tried really hard getting back into the shape it was before the pregnancy. >> reporter: but now, she's showing off her current body. 20 pounds heavier with a rounder stomach. a postbaby body that women think is more realistic. >> you can love your body before and after. >> reporter: her photos are drawing comparisons to maria kang, the mom of three, whose what's your excuse photo caption, led to a firestorm of reactions, with many accusing her of fat shaming. >> i'm not a bully. >> reporter: she is now speaking out against kang, saying these ideals are unrealistic and unhealthy. and wants to encourage women to love their bodies at any size. >> health is not dictated by someone's looks, their size or their weight. >> reporter: but kang says she is simply a healthy mom, trying to be a positive role model. is there a right or wrong answer in this great mom debate? >> i think my water just broke. >> reporter: but this morning, an illinois mayor says he doesn't want the mtv show filmed in his town. >> i think it sends a wrong message. i don't have my head in the sand to realize it doesn't go on in this town. it does. let's not add to the glorification process. >> reporter: according to more than one facebook fan page, one of the characters on "16 and pregnant," lives in tinley park, illinois. where the mayor is discouraging local businesses from allowing camera crews in. >> what's my five minutes on tv? how do i get on there? i get progress. is that a good message to send out? >> reporter: neither the teen or mtv would confirm their roles in the show. but pictures and their bundle of joy are showing up on social media. supporters of the series are disagreeing with the mayor, saying it does anything but glamorize pregnancy. >> i challenge someone to watch the shows and walk away from them and see anything in their lives that appear to be glamorous. >> i don't think we were in this situation, we wouldn't be this unhappy right now. >> if we didn't have a kid, we wouldn't be together. >> in our view, this is sex education for the 21st century. >> reporter: mtv has declined to comment. >> it's not clear how far the mayor is going to take this fight. but if he wins or loses, a lot of moms feel he has sparked an important conversation. one that is affecting a lot of teens out there. >> reporter: for "good morning america," linzie janis, abc news, new york. >> we asked viewers how they thought about this mayor's reaction. and ann marie sweeted, i think it's something that all teenagers should see. there are some things our children need to be taught. another viewer tweets, being a teen mom myself before it was so-called cool, the show is disappointing, being that young and progress should not be rewarded with a tv show. very divided. >> i feel if you watch the show, you see that it is horrible. it is a horrible life. >> it's very difficult. >> a dose of reality never hurt anybody. there's that phrase, scared straight. if that's what the show is able to do, there's something good to be said about it. going to george, with john mayer and katy perry. >> here on the couch. i want to talk to both of them. the two of you never sat down for a tv interview together. >> yeah. >> we don't know what kind of body languages we're supposed to be exhibiting. >> you get too close, it's too touchy feely. and you get too far, they say, i don't see chemistry. >> they'll see chemistry in the video. >> how did it happen? >> i smell a lot of scotch around -- a lot of the crew members. yeah. >> yeah? how -- >> no one wants to admit it. >> you immersed yourself in character. not only in doing the movie. but promoting the movie for months and months. how has that been for you? >> you know, this movie presented itself with a unique opportunity. and i love kind of performing as ron burgundy. and so, when we had our first marketing meetings with the studio, i kind of put it out there that i would be up for doing a lot of stuff in character. and it's great. it kind of tells the story of the movie in a different way, without having to just do the standard interview thing. and it's -- it's -- everything we've done has been unique in its own way. and people have loved it. >> yeah. and we used -- >> exactly. the news itself, all the news outlets, give us a whole second wave of promotion because they show all the stuff. >> i'm glad you mention that. do you find a subtle irony or not so subtle irony in the fact that the news -- we love the movie. and yet, there are some not-so-subtle jabs. >> a not -- yes. not a subtle irony at all, that ron burgundy is celebrated by the media itself. and he's a horrible journalist. he would never be hired by anyone in real news. but i think in a way, all the news outlets like to know that they're still being looked at and paid attention to. >> we all laughed so hard. but there were some moments where there was some cringing. >> yeah. >> when ron discovers that car chases equal ratings. >> yes. yes. yeah. i mean, that was kind of what was fun about doing this movie was to make a real funny, broad pg-13 movie. and at the same time, have a little satirical edge to it. >> let me set up the premise. so, you try -- you do reassemble the gang, the team, for a very big opportunity. and i'm going to show a clip right now where you all are back together. >> yes. >> and you are reminiscing. take a look. >> one other time you dared to chug that beer stein full of woolite. >> he did it so quickly that he said that's the equivalent of drinking poison. >> oh, lord. >> i was in a six-month coma. they said from the neurological damage, there's no way i live past 55. >> you got three years left, my friend. >> how was that, being with the guys? >> just reminiscing about -- yeah. horrible stuff. it was great. i mean, we kind of picked up right where we left off nine years ago. and you know, i'm very good friends with steve and paul and david. and so, to kind of get the band back together, so to speak, was great. >> we had james marsden on yesterday. he's the new part of the team. >> he's an ugly guy. hard to look at. >> yeah. and you definitely enjoyed poking fun at that. he was telling us about literally 20-minute takes, that you and adam, adam mckay, the director, would just let it go. >> and that's one of the great things about shooting on digital is you can just go for literally 20 minutes. and it's a great tool for improv and comedy and that sort of thing. we have an alternative cut of the movie, that will probably be on the dvd, with 300 brand-new jokes. >> oh, my. and trying to keep it together, i imagine, would be -- >> no, it's impossible. that's the fun of you know it's working well. of that joy in performing translates on the screen. >> your costar, another costar, baxter, the dog, has been with us all morning. he's coming here with questions from the fans. >> i'm surprised. he would not talk to me all morning. >> he is a little jealous. baxter, thank you so much. he has a card that reads, ron burgundy, please tell us the secret to such great hair. >> oh, the secret to such great hair. you have to condition. >> conditioning is everything? >> yeah. yeah. a leave-in conditioner, if you can find one. and get at least 15 hours of sleep a night. >> wow. minimum. >> that really, you know, teases the hair follicles. >> you said that ron burgundy is based on mort crim. >> well, that was the initial idea for the first movie. is watching mort kind of talk about his relationship with jessica savidge, way back if the day. and i did pattern off his voice. i thought it was funny that here he was, he had been retired for years. and he still spoke like a newsman. ron, there's a little shade of mort. >> anybody today that embodies the spirit?
