He picks up his 6yearold from school, spends the afternoon playing with him and then returns him to his exwifes family. Are you able to see the change in him . Definitely. Its hard for him to communicate with me. Its hard for him to be able to express to me in english what it is thats going on, what he feels. Reporter chris and his attorney, jared gesner, are fighting to return nico to the u. S. They say marcelle altered several documents to conceal a premeditated abduction. Earlier this year a texas court found that marcelle wrongly and maliciously concealed nicos whereabouts. And a federal court in brazil affirmed nico had been taken unlawfully from texas. Still a judge ruled that he should stay in brazizi with his mother because he is well settled. We contacted the legal team in brazil for a response, citing privacy laws protecting minors in cases like these, her lawyers say they cannot comment, only the local court can. I think the most important thing to emphasize is both the United States and brazil agree that the child has been illegally taken from the United States to brazil. Reporter gesnerer filed petition to have nico returned under the hague convention, the International Agreement which states that custody should be decided in a chds home country. And under the treaty, a child who was illegally taken, must be returned to their country of residence unless theres a risk of harm t that child presented by the leftbehind parent. The Linn County Sheriffs Office tells cbs 2 news there was no previous connection between both men. Lehman is right now in the Linn County Jail on one Million Dollars bond. He is also listed in the iowa sex offefeer registry with two incidents in 2009 in clayton and johnson counties. This morning Cedar Rapids Police are still searching for shooting. Officers responded to the 1100 block of third street southwest monday afternoon where they found a man with a gunshot wound. He was taken to the hospital and is expected to recover.
