News Bloomberg Business Week with Carol mass here and show you generally from Bloomberg Radio Hello I'm Carol master with my co-host Julia Chatterley plenty ahead in this hour including a profile of former Harvey Weinstein lawyer David Boies plus Cape Town it is on the verge of becoming the world's next travel Mecca that's in our pursuit section but 1st I have sort of in the church motive and joining this group. I'm going to be 87 in a few weeks. For decades I have been buying small businesses after they've become big so I pay hundreds of millions of dollars. And it occurred today I've got to get these people earlier you know and. They haven't come out and said this is you know which take a step back because we all have a lot of fun we respect Warren Buffett it's hard to follow in his footsteps right but it's like who's going to follow and take over for at Berkshire Hathaway and everybody's been wondering about this yeah I mean there's been a tremendous amount of speculation Buffett is 87 mongers even a couple years older than that and I mean this is a conversation that's been going on for decades and frankly you know the quote unquote name in the envelope has changed over time you know we're certainly not the 1st people to write an article speculating about who the who the person is there sort of a journalistic tradition of this but what we do know is that as time goes on some of you know some of the names that had been thrown out there in the past for you know many of those executives are no longer at Berkshire or they're looking less probable now because of age or some other reasons to just break it down freezing temps of a ball and chain but the difference is off because they're also fundamental differences whether it's where they've grown up in the business energy versus insurance every step to age which we know is a critical thing to Warren Buffett to he won't say a young guy to come in there and have a good run running the business yeah yeah there I mean there are a couple of critical differences a just a just certainly one of them able as you mentioned grew up in the energy business he's he's been running a business that's actually been highly acquisitive you know within Berkshire they Berkshire Hathaway energy his business has actually gone out and bought more utilities they bought pipelines they've invested a lot in renewable energy. It's a place where part of Buffett's Empire Empire where you can count on his managers to go out and figure out you know what to do with all this cash that Berkshire is producing which is which is not solely unique to him but he's just has this track record of doing it over and over again and this is nothing to be here waiting to 1000 employees and not just that part of the business exactly exactly but you know something that's interesting about Abel and how he runs his business is that the head office has only about 2 dozen employees now that's that's a model that Buffett uses for the whole conglomerate you know the Buffett likes to play this up a lot he talks about how he's got about 2425 people in Omaha who oversee the whole conglomerate which has more than 350000 employees now so there's there's a nice parallel there between how able operates and how Buffett has been running the conglomerate when you write this story you know and I love this shit is Empire to me or how Buffett runs conglomerate and you say the head office for a bill in Des Moines occupies only one floor in a rest colored office tower has about 2 dozen staff I mean doesn't sound very modern or new. Well I mean the point there and you know when I speak with people who know Abel's business well the point is to make sure you push the decision making out to the actual business units and it's a very it's a very it's something that's straight out of Buffett's playbook and Buffett horrors of bureaucracy and has talked about the need for his successor to make sure that Berkshire doesn't become a bureaucratic enterprise he thinks that that's the kind of thing that kills a business over the long haul and what you've seen and how Abel's built his business is you know an effort to stamp that out to make sure doesn't create then that doesn't mean they don't have legions of people doing important functions is just it's just a question of where they. Position those people so of course you have a big h.r. Operation but it's going to be embedded within the utilities because they're actually closer to the customer they're closer to the regulators they're closer to where the decisions actually need to be made why this secrecy I think on a more practical level not naming someone gives the board more flexibility over the long term So yeah smart to tell you about in a very yes it's a buffet is able in to keep you know stay as c.e.o. Bush boys in Coeur that fight of course Felix Gillette profiles the famous litigator this week he joins us now to Felix give us the background of David Boies people know him. As sort of this famous courtroom litigator and champion of democratic ideals he represented Corker in the 2000 presidential Florida recount he was also famously represented the government the antitrust case against Microsoft he's had all these huge big high profile cases which has made him really arguably the most famous lawyer of his generation and because of his work fighting on behalf of gay marriage with Ted Olson who was George Bush's lawyer they kind of teamed up together to work behalf of marriage equality. You know he's become this more than just a Lorry's been someone who has been or feared particularly among liberals he said he run circles around Bill Gates Microsoft and yet I mean just to him I do not have a right capable of doing that yet known as this brilliant theory or room tactician you know he's been. Played in the h.b.o. Movie about the Florida recount there's been you know books about him countless magazine profiles all very glowing until suddenly this fall when his role representing Harvey Weinstein suddenly came became into the news and all these people who are. Very highly are all of a sudden like outraged by his association with Harvey Weinstein so maybe no surprise that Harvey Weinstein a well known Hollywood mogul you know had someone like David Boies in his legal right so talk to us about that relationship and how it kind of turned into a bit of trouble for David Boies right so he came under fire for this and what we did is kind of look back like where did this relationship start how did these 2 you know what were they what was David Boies working on on behalf of Harvey that turns out that they met each other not long after the Florida recount. Came to New York had lunch with Harvey Weinstein point among his media assets had a book published an imprint and Boyce agreed to write a memoir about his legal career for Harvey's imprint so that's how it started and then as Boyce was working on his memoir he also started representing Harvey and his brother Bob and their company Miramax and different things Harvey and Bob left Disney in 2005 boys represented them and he kept you know represented over the years in various things and the relationship grew closer then in 2012 becomes a lot more interesting because David Boies decided to start a film company of his own and in part this was because one of his daughters graduate from college was interested in getting into the film industry one of his partners and close friends try to think Schiller his son was also work in the film and this would be fun let's do something movies you know and you know what's interesting is they did some projects together. But in the end it sort of complicated the relationship with Harvey Weinstein because they weren't just he wasn't just a client lawyer relationship there was also this. Relationship in terms of doing business in the movie industry together Ok so it's complicated you know fellows forward to the New York Times starting to investigate right what's been taking place right so this all blows up a son. Really in November when the New Yorker reports that you know as part of all of these you know dozens of women have came forward and made allegations about sexual harassment sexual abuse by Harvey Weinstein. As part of the as all this was going down that Harvey Weinstein it hired a number of private investigators to essentially defend him trying to stop some of the newspaper investigations into his behavior and one of the things that was revealed in this New Yorker article was that David Boies had signed off on a contract with this company called Black you which was working on Harvey in part to try and stop me and investigation exposé by the New York Times So when this came out in The New Yorker all of a sudden New York Times saw this and said hey wait a 2nd David Boies represents us and he's also representing and he's also working to try and kill our reporter reporting on the story and they were very upset they called it great betrayal Trost and very publicly so do you know we're not going to represent us anymore I mean he's the former Israeli intelligence officer right it was a just and right. Taking place yeah and so that's really what triggered all of this backlash and I think it's part of this broader thing at the top in the culture right now where you know the Harvey Weinstein downfall has triggered this huge cultural treasure all these men you know have been kind of pulling back the curtain on all this bad behavior but the same time it's also raising all these questions about this ecosystem of covering lawyers managers agents around us and so I think within the broader conversation people are looking at David Boies in part because he's known as kind of the ultimate person in terms of being a corporate fixer in terms of a problem solver and so they're looking at him and looking at Harvey Weinstein and I think in way what happened here when you go back in time and c.s. Of Legacy of. Right it's going above and beyond the call for you I mean you look back at his career and there's kind of this pattern that's happened a couple times where he's gotten very deeply involved with clients friends family members whether it's doing side businesses like this film group that he started and what you see again a couple times is that basically there's always this moment where he could but the relationship with this person would hurt his business is business a cruise along they've got plenty of clients who can walk away from it but instead he kind of sticks with these people to the point where there's really this collateral reputational damage as a as a result of them and you know when you ask him about that he says well that's you know I think probably lawyers have different tolerances for when you get out it feels like misrepresent representation to me he kind of let this investigation right it was his name it wasn't Weinstein right people it right interesting Yeah and that structure right and it also I think. It's more complicated it becomes you know some people we talk to were like Well in 2015 you know when the timing model in New York went to police and made some accusations about Harvey there was press coverage. Not just of how the female employees but also about the men who like Brad and models get paid anywhere from 15 per hour to $200.00 per hour so if you're hiring 30 models you could end up spending quite a bit for 3 to 5 hour party which is going on there for years right it's not a new thing but as you note in your story it's picked up a lot of momentum you're seeing more and more companies in Silicon Valley doing what's going on 2 trends with this kind of activity the 1st is that increasingly companies don't want their employees to know that these are models in previous years they may have addressed them all the same or something so that it was very clear this is just a spice of the party or given a task like bartending or hostessing picking up people's coats and they've transition from that to the atmosphere on. Right we always talk about what it is like when it comes to pursuits there's a list of wonderful watches that you guys always cover this one has to do with World time watches which are what yes so a world time watch is a watch where you can tell the time in you know up to 30 different time zones just by looking at the face of the watch not a digital watch or mechanical watch and this is an old fashioned style of what not old fashioned but it's a it's a longstanding style of watches sort of began in the 1930 s. As a way for people who are traveling around the world just to kind of know what time it was everywhere else and you would think that these days this kind of watch would be sort of obsolete right because you get on your phone you can always see what time it is anywhere is sort of not something that you think of like needing to have a device always on your wrist telling you but actually this year I noticed that a ton of different watch companies were coming out with new world time watches. And I so I asked a retailer in Manhattan this. From Wednesday which is on 5th Avenue huge watch sailor said why is this and he said you know business people still want to have people who travel around the world for business still want to have it on their wrists and they you know they could have an apple watch or a you know an Android Wear watch but that is plasticky and metal and it doesn't look good with your suit and people really like sort of the elegance the elegance not only of the computation of the watch but of the looks of the watch with the suit and I agree it's one of my favorite kinds watches from an 810 and I'm talking about this Silicon Valley's nearest chair I don't really see anything different We're going to think it. I really feel they have a totally or so this is new chair from a company called vitro in the chairs called the Pacific and the reason why I'm writing about it is because I've ordered thousands of them for the new Apple headquarters out in California so this is like speaking of status symbol like this that has just announced here is designed officers when he does something we really do know this right so this is launch this chair from like a new sort of random chair to like a really cool Silicon Valley chair and it's basically coming up against the air on chair which is kind of what we have in this office and you have in a lot of offices is that fabric chair with lots of levers you're sort of like the broom where you move locked in there's a you don't know if you know you don't you Tauriel to like learn how to yes this was actually somebody who instructed us because I use the chair right exactly and for a long time that Aaron chair was the chair that like if you cared about your employees this is the chair that you had and this one is actually slightly less comfortable in the sense that you're not designed you're not supposed to sit in it for hours and hours and hours at a time which is why their own chair was sort of made the customisable the way it was this is just meant to sort of blend into the surrounding more.
