somehow ended yeardley's life threaten all of us. >> they told us basically we either take it off or they're going to start -- we get suspended. >> so much to talk about today. thank you for keeping us company here at hln. i'm christi paul. we have just learned that police in new york arrested nfl hall of famer lawrence taylor today as part of a rape investigation. now, a statement from the police department says the reported rape happened today in mont bello new york. the police say formal charges will be filed once their investigation is complete. but they say they'll provide more information at a news conference this afternoon. let me give you what we know. 51-year-old taylor was a linebacker for the new york giants from 1981 to 1993, and cnn's attempts to contact his agents have not been scuffle thus far, but when we hear from them, we'll bring it to you right away. "in session" host vinnie politan is with us to discuss more about this. so from what i have read thus far, there are some pretty frightening details about the really downright sickening. what can you tell us? >> well, one thing we're hearing is about the age of the alleged accuser is 15. and this is very significant, because if the victim is under the age of 15, it becomes -- in terms of statutory rape, if that's what they're charging, if it's conceptual not a forcible rape, if there is an age difference. if she was under 15, it's second degree rape. over 15, but under 17, is third degree rape. and that is a class-e felony in new york. looking at a maximum of four years in prison. that's if the charges are just related to the fact that he is 51 and she is under age. now, if there are any allegations of force or an assault here, then the charges can be escalated and it becomes a big, big problem for lawrence taylor. >> there are reports that she was bee beaten, as well, correct? >> that's what we're hearing. but i haven't heard if they're linking the two together yet, because it's not clear what the allegations are. that's why this press conference at 2:00 could be very significant. >> is it not clear whether he's the only one involved? >> that i don't know, either. that's another part of it. because he's -- you know, he's out at night. this is a guy who has a history with law. >> that's what i wanted to ask you about. what's his background? >> that's the problem lawrence taylor has. it's not his first run-in with the law, so when you look at the range of what he is facing, he's probably facing closer to the high end of the range than the low end. after he retired from football in 1993, he had a series of drug arrests in the mid to late 0s. he had some problems with some child support issues. i remember being at the scene of his arrest at his home in new jersey, 3:00 in the morning, back in 1997. >> wow. >> and just recently, he's also had -- oh, about eight years ago now, ten years ago, some tax problems. so he has some history. and people who come to the table with history face harsher penalties if they're sentenced. but we have to know what are the allegations, are they just related to the age difference, which is serious enough, but that's more of a statutory rape, because he's this age, she is this age. but if there is any sort of force or an assault, if it was nonconsensual then things become much more serious. >> and a 15-year-old run away is what i heard. is that not confirmed? >> i have not personally confirmed that yet. so i'm not sure on that part, either. but, you know, the relevancy of that will be, all right, you know, at trial that could be important. >> sure. >> but when police are trying to figure out what happens here, the two issues they've got to figure out is her age and whether or not this was consensual. and if it's nonconsensual with force, big problem for l.t. >> all right. hey, thank you so much, vinny politan, appreciate your expertise, as always. now, moving on, the suspect in the times square bombing plot reportedly made a practice run on the night of the bombing attempt, and he still made a big mistake, apparently. a law enforcement source says the suspect allegedly drove his car to times square the day before the attempted bombing. the source says he staked out several targets, then parked his car several blocks away to use as an escape vehicle the next day. on saturday, after he parked an suv filled with -- allegedly filled with propane tanks, gas and fire crackerses, he accidentally apparently left his escape car's keys inside. the source explains, shahzad had to take a train back to connecticut and returned on sunday to retrieve his get-away car. a law enforcement source says there is no decision yet on releasing a surveillance video that pur pouredly shows shahzad running towards times square saturday. casey anthony appeared in a florida courtroom to hear her attorney ask for all records related to the public funding of her defense to be sealed. but did the judge agree to it? jean casarez, a correspondent from "in session" for our sister network, trutv has been watching the action. this is important to a lot of people in florida, because at the end of the day, their tax money could be funding her defense. >> that's right. they're going to pay a lot of money. you know, the defense sort of had a lot of wins today, because all of these experts they wanted with a couple the judge tempered on, they're getting. so that's going to cost a lot of money. here's what happened. the defense had $275,000 initially. they got the best experts in the country with that money. now that money has run out. she is indigent, because those experts have done so much work on the case already, the judge really couldn't say they couldn't continue, because then you could have a due process constitutionalish be u. >> okay. i want to turn the tables here to the murder case at the university of virginia right now, and show some video, if people haven't seen it yet, of last night, where there was an emotional vigil at the school for yeardley love. the university president said the school had never been informed about a previous arrest of a la crosse player, the one now accused, george hughley, who is accused of slaying this women's team member, yeardley love. what do we know about this former arrest? >> well, we heard a little about it right away in 2008 he did plead guilty to resisting arrest, public intoxication, it was in lexington virginia. but what has happened now is that the arresting officer, a female, has come forward, describing exactly what she went through that night, with george hugeley. i think we've got that for everybody. take a listen. >> he became more aggressive, more physical toward me, started calling me several other terms that i'm not going to state now. surprised that he was involved in another type of incident involving physical violence, no. an incident to this extent, yes. >> now, here's something else we just found out. some legal court records came out. they're now sealed, but some information came out that at the apartment of george hugeley, they found a bloody la crosse jersey of his and also a letter he wrote to yeardley love. both things could be very significant. i'll tell you why. first of all, this has been brought as a willful, premeditated murder. what does that letter have in it? that could add to the prosecution's case. >> oh, okay. >> but also, a bloody jersey could help the defense. we know the defense attorney has said this was an accident. what if they change course? what if they say that he defended himself in self defense, because she did something, took an instrument at him or something? >> can anyone hear me? there we go. the question is, do you think people on watch lists should be able to buy guns? it's that simple. or perhaps you feel that a ban would infringe on innocent people's constitutional rights. i put the question on my facebook page, richelle carey, hln. a lot of responses right away to this question, right away. this is what amanda wrote. just because they are on a watch list does not make them guilty of anything. what happened to innocent until proven guilty? nikki says this. i believe they should, but that's not going to stop them from getting them anyhow. i feel we need to be safe in america, but i'm sure they'll find a way to smuggel guns if they can't buy them here. julie is calling us from madison, wisconsin. you are a gun rights activist, so i'm interested in your opinion on this. what do you think? >> caller: first, i have pistols and rifles, and they're all legally bought by my father who is a gun dealer. the thing is, is this. let's be logical and not get our emotions into this. logic states that if you're on a terror red list -- terrorized watch list, you've done something to set up red flags. so if it slows down the process of them buying a gun, i'm all for it. >> let me ask you this. some have said, you know, that sometimes people's names are on those lists, and they don't need to be. and then you would be depriving them of their right to buy a gun. what's your response to that? >> caller: well, i think the federal list is no more than a witch hunt. if you google 2-year-old on terror list, you see the patriot act being used against american citizens. it's nonsense. and criminals don't follow the law, yeah. so what's the point? >> so you feel like that even if this ban were in place, if someone wanted to get a gun, they would find a way to get one, anyway? >> caller: well, you have to look at who put you on there and why they put you on there. >> i beg your pardon?
