And mike emanuel on capitol hill. We begin with john. John . Neil, good afternoon to you. The president tried for 35 days to break the democrats and could not break them. They held together and so the president was the one that had to back down today and say that were going to open government, but he did get a negotiation over the last 24 hours from the democrats a pledge to negotiate on Border Security. But strikes me that nancy pelosi had been offering that for weeks. I dont know if the president got more of a commitment from the democrats to include funding for a border wall. The white house officials told me that there are a number of democrats that do seem inclined to give the president money for a border barrier, much of which off of the rio grande in the state of texas. The president theres threatening that if the democrats dont give him what he wants, he has options to use. Listen here. We really have no choice but to build a powerful wall or steel barrier. If we dont get a fair deal from congress, the government will either shut down on february 15 again or i will use the powers afforded to me under the laws and the constitution of the United States to address this emergency. That would likely include a declaration of a federal emergency, the office of management and budget has identified several billion dollars that could be put toward wall construction. What is ironic about what the president said today is that lindsey graham, senator from south carolina, suggested to the president exactly the same thing on Fox News Sunday with Chris Wallace back on january 13th. The president politely refused and said thanks, i want money for a border wall in a funding bill. The president is changing the sales pitch. He was talking ant a concrete wall across the southern border. Then he talked about a steel barrier. Now hes changed that to a greater degree to say this isnt just steel and wire. This is also electronics, technology. Call it a smart wall. Listen here. The walls we are building are not medieval walls. They are smart walls designed to meet the needs of Frontline Border agents. We do not need 2,000 miles of concrete wall from sea to shiny sea. We never did. We never proposed that. What is ironic about that is just a week ago, President Trump said yes, the wall is medieval. Worked back then and will work again now. Hes trying to sell this idea to democrats. As he gets in to three weeks of intense negotiations using a Conference Committee format, which Chuck Schumer just a moment ago seemed to think might be something that would yield fruit. He wants to get as much agreement as he can because he really wants a border barrier because if he doesnt get it, the base will say, wait a minute. You promised this during the campaign and now youre not delivering on it. Hes going to use whatever sales pitch he can to get agreement on a border barrier. Its pretty clear and Chuck Schumer and nancy pelosi let this be known in a press conference they just wrapped up that the president lost on this round. Neil . Neil john roberts, thank you. Mike emanuel now on capitol hill. Mike . Neil, good afternoon to you. Now the work begins. We expect the congress will pass this deal to fund the government for three more weeks in short order. When theres an agreement, things move quickly. We expect it to the senate to the house and to the president and so the shut down will end at five weeks long, 35 days. Then the hard works begins. Three weeks to hammer out an agreement on Border Security. I talked to numerous people on both side of the aisle that said theyre open to updating, upgrading our security at our southern border. Some will not go there for a physical barrier. Some would prefer drones and technology or manpower on the border. Its interesting to see if the president could sell that to his base as a 21st century wall. Well watch and see. Bottom line, both sides are saying the right things at the moment, that theyre willing to sit down and talk on Border Security. Three weeks is not a lot of time when you consider weekends and lawmakers going out of town to go visit with their constituents. So it will be a challenge ahead in the coming three weeks. When theres deadlines, sometimes there can be action, neil. Neil thanks, mike emanuel. Now to the man that was responsible for a Senate Pickup by republicans. North Dakota Republican senator kevin cramer. Now a member of the Budget Committee. Senator, welcome to you and belated congratulations on my party. Thank you. Neil would you vote for what youve heard . I will vote for what ive heard. Largely because this president is proposing it and is willing to sign it. Ive said all along im happy to vote for a bill that reopens the government that the president is willing to sign. If hes going to veto it, no point in voting. Neil you had a threeweek window. If the president says if he doesnt get some funding for a wall, we could revisit this all over again. What do you think . The president has positioned himself for victory. Hes been generous in his negotiating up to this point with himself. Hes been negotiating both on his behalf and speaker pelosis behalf by being flexible honestly. I think that the reports that you just had from your reporters here on the hill outline that history. He has moved and moved and moved. To the point now where hes willing to do the threeweek c. R. But hes we should take him seriously. He has this power understood the constitution and the statute to declare an emergency. Neil hes had that power the last 35 days. He never implemented it for whatever reason. What makes you would in three weeks . I think some things have changed. A couple of them. One is that we had a senate vote. Yesterday we voted on two bills. Call them test votes. We had to get that done. He saw the reality of the outcome. We now are in our second round of employees not getting paid. Were starting to see the aggregated, maybe consequences of the shut down. After yesterdays vote, it was clear that many democrats, at least my colleagues are willing to talk about a will. Even support some version of barrier with dollars. We should be encouraged by that. Neil you think linking this to the continuing operations of the government, whether this president doing it or other president s that we have to find a better way . No, its not, neil. We have to get rid of this weaponization of the budget using Government Shutdowns. Im committed to that. I signed on to a bill today. Other members did as well that werent previously open it. Theres a lot of discussion. Well talk about it in the Budget Committee within days if not a couple weeks. Weve got to remove this weapon from the arsenal. Neil senator, thanks very much. Senator kevin cramer of north dakota. A lot of people wondering why did and how did the president get to this point. Many are pointing to the nations skies. The delays that were building up at the airports with tsa workers calling out, a shortage of air traffic controllers. David lee miller is in la guardia with more. David lee . Hi, neil. Were in terminal b. Even though the partial ground halt ended four hours ago, theres still very significant delays. The arrivals her at la guardia delayed 1 1 2 hours. The departures about an hour. This is bigger than la guardia airport. There are other airports also affected by the events today, including newark, philadelphia and boston. The impact essentially rippling through the air transport system. Were told according to flight aware, the number of delays today reaching 14,000. The number of cancellations, 861 nationwide. The faa blaming an increase in sick leave at two facilities for what took place today, those facilities in st. Petersburg, florida and washington d. C. The faa says those facilities are responsible for monitoring aircraft at high altituded. The president of the National Air TrafficControllers Association spoke with dana perino on beef beef and said his membership is very relieved at President Trumps announcement about the ending of the partial Government Shutdown. Absolutely. Its euphoria. Theyve been going through some struggling times. You know, ive heard some sad stories of decisions that had to be made of parsing out your medication to putting food on the table, i cant afford to come to work, i cant fill up my gas tanks. We talked to a number of travelers here at la guardia airport. The consensus seems to be that they have sympathy for the air traffic controllers. Many passengers we talked to pointing their fingers at the politicians in washington. Neil . David lee miller, thanks very much. Take a quick break here. Take a look at the corner of wall and broad. They terrorized my wife, my dogs. Neil former trump adviser roger stone indicted on seven charges that go anywhere from obstruction to justice to witness tampering, making false statements. If he looks like a guy concerned, he had a funny way of showing it. He indicated he would fight this, theres nothing to the charges, that the president was and remains a friend for the better part of 30 years. Hes not expecting a pardon, isnt looking for one. Lets get the read on this from former Justice Department official, law Professor John hu. Good to have you back. Can you hear me . Yes. Neil okay. What did you make of this and the significance of this indictment today . Neil, first, theres two points. First, i think stone is guilty. I think mueller has him. Not guilty of actually conspiring with the russians or with Julian Assange and wikileaks. What hes guilty of is lying to congress. On that hes its not a question of intention and misunderstandings. He was asked directly by congress did you contact wikileaks, did you work through one or two other people. Did you text and email them. Mr. Stone said no, flatly no. Mueller has emails and texts that stone was sending trying to get in touch with wikileaks. The second point that is important to observers, theres still no evidence that mueller has uncovered of any kind of conspiracy between trump or the Trump Campaign and with the russians and wikileaks directly. If you look at the indictment closely, looks like stone is just trying to get his nose in the middle of things. Hes bothering wikileaks all the time saying give me some information, tell me what you have. Tell me youre going to drop something out in the public. Wikileaks doesnt respond. Seems like theyre coming him at arms length. I dont think stone had done anything illegal if he told the truth to congress. Neil how big of a deal will that be for him . Other allegations and issues and counts are not really cutting to the core as much as that, the one that you mentioned, lying to congress. What is he looking at . Still, its a serious crime, lying to congress under oath. We call that in the Justice Department a world of prosecutors, a process crime. Not the substance, conspiring with the russians. The fbi and the Justice Department actually try to make a point of going to after people who lie to them, who lie to congress because if people dont voluntarily tell you the truth, our whole Justice System could collapse. Neil why did they do it this way, john . I know they have raided Paul Manaforts home to get documents and that sort of thing. The same with michael cohen. They never arrested a guy and took him in this manner. Im wondering, how it was that roger stone got that distinction. Neil, a good question. This is the part that i dont like. The heavyhanded way, arresting stone, treating him the same way you might treat a dangerous fugitive or potentially violent criminal, this is an old guy. He likes to conspire, likes to send emails and talk on the phone. Neil he telegraphed it himself that he was convinced he would be charged of something. Yeah. Sometimes prosecutors and the fbi they can make a deal and say why dont you voluntarily appear at our office or at the courthouse and turn yourself in. If thats what you do with people that you respect. Way want to make a show of this. When people lie to congress and the fbi, they want to make a show of hauling them in like a common criminal. Neil you mentioned, this may be outside the normal parameters of questioning. Cnn had footage of this takedown early this morning. Do you think someone tipped them off . Oh, of course. These things are always telegraphed ahead of time. You have probably seen it before with wall street guys. When theyre arrested. Neil with rudy guliani. I remember the days of going after those inside trader guys. Rudy was a master of it. Cad him the perp walk. It doesnt have any effect if there was media to record it. Youre the ones that make the perp walk possible. Neil youre right. I notice that all of these people brought in like from a michael cohen, paul manafort, george papadopoulos, variations of lying. Lying to congress, lying to the fbi. Very few with district russian tie collusion charges mostly about lying. Thats i hope people remember one thing from today. Almost all the crimes that mueller has gone for with the top people, stone, manafort, flynn, the people you mentioned, its mostly been for lying. Thats what goes to the lesson of the washington scandal. Its always the coverup that is worse than the original conspiracy. If people had just told the truth, if manafort and stone werent playing games, they wouldnt be going to jail. Neil wellput. People forget that. Thank you very much. Good catching up with you, john. Thanks, neil. Neil where does that investigation go . Where do we go after a shut down that presumably ends tonight . Well crunch that live tomorrow when cavuto live hits the air.
