Earlier today politico reported that democrats secretly think the Mueller Report will be a dud but it may not stop them from investigating the president and his allies. The news coming in hot. Harris i want to ask first there are reports and the Associated Press saying that the white house wants an early look. You spoke with the white house, the president personal attorney. Rudy giuliani contacted me and said the a. P. Report is not true. Associated press is breaking this hour saying that giuliani, the rest of the legal team want an early look at muellers findings before the public sees it. He says that is not true. They are confident, giuliani tells me that bill barr the Attorney General will handle this appropriately. As you said. After two years of investigating, mueller has basically said his probe is over with no further indictments. Even the critics like comey telegraphed they are no longer sure there was collusion or Obstruction Of Justice. On the surface that sounds like good news for the president. That means flatly he and member of his family, close aides will not be indicted by Robert Mueller. However, we still dont know the specifics of the report. This hardly means that all the probes are over. Democrats run the house as you noted. They are already talking about bringing mueller in as a witness for sworn testimony. They could find other damaging information on the president that does not lead to a mueller indictment as we say but could be considered by the house for possible impeachment. Lets not also forget the Southern District in new york, where the former Attorney Michael Cohen pled guilty to crimes already, they are still
investigating Trump Organization business doings. The president and white house is not in charge of this process. That is bill barr. In terms of the Mueller Report being released to congress, the public, remember, barr took charge at 4 35 eastern. Tie he time. He contacted the white house and said it was coming. He informed the judicial committees and said the Special Counsel submitted today a confidential report explaining the prosecution or the declanation, declining to prosecute. He says i may be in a position to advise of the special conclusions this weekend. This is in barrs hands and he could say this weekend there is no collusion or Obstruction Of Justice. Harris there are two type of final report. Mueller report to the Attorney General and then the Attorney Generals report to congress which is basically his summation of what the report says. We wont know what is being
left out of it. But there are some suggestions. The time of the information that could be left out as i am reading tonight of a report to congress or the republic. Could it be grand jury information . Executive privilege . Classified material . There is a lot we dont know. But those are the options of the things we might not see. Absolutely. Number one as bill barr said in the confirmation hering in a normal prosecution, a normal case, if you dont prosecute someone that information is not just dumped out there in terms of what led to the decision not to prosecute. But this is an extraordinary case and this is the president of the United States. So even though it is clear now tonight, that Robert Mueller, is not going to indict the president. That is the headline. But there is still other information in the report that could be damaging politically and of a sensitive nature. We are talking about russian interference. Not collusion. There appears to be no proof that russia, you know, changed the result of the 2016 election. But did they interfere . That is what is investigated. The n. S. A. , the c. I. A. , other agencies are going to say this specific information we dont want dumped out in the public. Some of this is secret. So that is part of the process with barr and congress. Harris one last on point with you and then i will move on. It is interesting as we look at this. And the big question, too, is when you say no further indictments, i want to know. Does that mean sealed induetments . I want to know what that entails. Maybe that is something we will learn. You raise a good point. In the last 24, 48 hours or so there are other networks having liberal commentators coming on and former c. I. A. Director john brennan saying more indictments are coming. As you say, other speculating that there could be sealed indictments kept secret. Hang on. Mueller is saying a, no more indictments. B, remember, adam schiff two years ago said there is evidence of collusion before this got got harris look. John brennan former director

But the idea that there is more indictments is not true. Harris ed henry, thank you. That question of what comes next is so important. Because william barr will make a decision not only what the public will see but what congress will see. Talk to me about the process. I think it is important for your viewers, harris, to realize the reason we have bob mueller is department of justice, who otherwise would handle this felt like they had a conflict. So mueller in essence worked for the department of justice. That is who the report goes to. The only obligation to notify congress is if he had a recommendation that his supervisor Rod Rosenstein or
bull barr bill barr did not follow. Barr is going to read the report and i think he will want to share as much as he can. Barr understands what ive understood from day one. Muellers number one job is report on what russia did. The second part was with whom if anyone did they do it . That is the democrat focus, their obsession. That was not muellers obsession. Im sure he will want to share with the Intelligence Committee this is the way to prepare for 2020 and beyond. The democrats can subpoena him. They can bring mueller to capitol hill. We have three separate branches of government. Congressional investigators, do you remember when the house Intelligence Committee had to vote to turn over transcripts to the special council . Harris yes. They didnt take a vote on that. Why didnt the Special Counsel just go get them . Why did they have to ask another branch of government . Because we have three separate branches. This report belongs to the executive branch. Just like congressional investigations belong to legislative branch. Its not just classified information, grand jury material, privacy act. Its also the fact that the f. B. I. And the department of justice do not exonerate people. That is not their job. Harris right, they report it. Their job is to indict people. Its really not to write a report or hold a press conference. What comey did with clinton and laid out all the reasons he could have charged her and did not set a terrible precedent for the country. Prosecutors shouldnt do that. Charge, shut and go to trial or dont charge but dont fail to charge and then layout all the reasons you could have and maybe should have. Harris its interesting. Because Rod Rosenstein said he would stay onioned the point we thought he would be leaving midmarch. What he has been saying in recent days and even sent a
letter today of this effect saying that there should be no details on anyone who is unindicted. What is the significance of that . Maybe it goes along with what you are saying. That if you didnt indict and you didnt charge move on. Its manifestly unfair to name someone, say in a Conspiracy Indictment as unindicted coconspirator. They cant prove they didnt do it and they are not going to be in front of a jury that can determine the look of guilt. So prosecutors have to be very, very careful naming people in indictments that are not going to eventually stand in front of the 12 of the peers and have peers pass judgment. The other thing about the report, it would not surprise me at all if they interviewed people who said six or seven different things. That is the nature of the eyewitness testimony. In a political context you will seize on whichever witness said whatever is most beneficial for you and you
will ignore the five other people who saw all the stoplight was green and not red. Which is why when politics and the criminal Justice System clade it is always the just collide, its always the Justice System that perishes. I hope he does not, i hope he does not set 200plus year of precedent in this country about not forcing people to prove their innocence on its head. You cant prove your innocence. The president cant. You want to get his first reaction and then we will talk more. I would first argue that the department cannot adopt a
double standard and should cooperate willingly. But if it doesnt, we will have to subpoena the evidence. Well have to subpoena mueller or others to come before the congress and answer questions. Because if there is evidence of a compromise, whether its the level of criminal conduct or not it needs to be exposed. Harris is he saying he wont believe the report if it Doesnt Show Collusion or Obstruction Of Justice and any other kind of a crime and this president and others will not be indicted is what we are learning tonight, that there are no further indictments . The strategy to keep the could, the russia cloud over the administration until 2020. Adam has seen nothing i havent seen. So how can two people have such disparate view of the evidence . I never saw evidence of collusion of the Trump Campaign and russia and adam says he has direct evidence. Two former prosecutors and reasonable people cannot have views that disparate unless you look at it through a political prism. Swalwell said that indictments were coming. If they can get mueller and barr an say this witness said that, and this witness said this, then outed is a political win for then its a political win for them even though a loss for the country. Claiming once the entire report is released it will tell us Something Different from the fact there are no indictments as we now. Its mazing to watch them shift the its amazing to watch them shift the goal post. The big story is President Trump will pounce. If the republicans are exxon rated its exonerated its about the pouncing. trump obstructed the investigation over and over and over. There is not one iota of evidence he on instructed the investigation. No indictments, if there were more you wouldnt expect it to be of the people around President Trump. Forget President Trump but people on the left suggesting no indictments came down is supposedly because you cant incite a sitting president. Its instructive that bill barr was previously Attorney General for president 41. Democrats pounded him again and again in the Confirmation Hearings. And he repeatedly said im going to be in charge of the report. They said john cornyn, as you know, key republican said Rudy Giuliani says they will get the report and they might make corrections to it before it goes public. Barr on camera, under oath said no. Im going to be in charge. So that is good news and bad news for the white house. If there is bad stuff in here, barr is not going to cover it up. If there is good stuff that clears the president he is going to finally get the

And trey gowdy echoed this as well. Of course he may have said it first. If you dont put as much as you can out it fuels the speculation. Already there are fake reports circulating online. So then i question what i even put the information out there that there are no more indictments coming . We fully understand that they need to be held together until they can be released. The fake news, or fake report argue for the transparency. Put out the substance of the report with the notable revisions or things you hold back. Harris 100 agree with you. Some people will stop with that, we know it. Putting aside premise on which the investigation started. Lets see what is in it. Dont get ahead of ourselves but see what is in it. Its telling there are no more indictments. See what is in it and be objective about what we are finding there. I hope the democrats can be objective about that. We should all be happy about the good news that our president is not corrupt and did not collude with russia. That is good news no matter what side of the aisle are you on. Harris what is the tone on capitol hill . You have been there and you know what people are talking about. I was speaking about impeachment amongst democrat House Members whether they got the report first or not. The efforts were to try to get
the president impeached. Nancy pelosi, the House Speaker saying, holding them back, lets see. What is the tone . Is it as bitter as it looks from the American People perspective . From all of us outside. Yeah, well, i think on the democrat side they are deeply divided on that issue. So the tone depends who you talk to. There is a wide spectrum on the democrats side. There are those who like you noted call for the impeachment every single day. There is those like adam schiff who claim there was direct evidence of collusion. That turned out not to be true, didnt it . Then there is the more moderate side who would caution us all and they understand this is deeply divisive. And that calling for impeachment for any crime they can find is harmful to the country, not helpful. Harris the president tweeted and then i saw your reaction to it on the recent nonbinding vote, it was 4200 in congress about releasing the Mueller Report. You said i got no pressure one way or the other. We voted yes is because this investigation has been terribly divisive and i see great benefit to total transparency. Anything less will result in conspiratorial fingerpointing and greater division. That is what we want to avoid. The more transparency we have and the less likely we have the democrats can turn around and say you didnt release that. We know there was something. You just didnt want to release it. We want to avoid that in the entirety. We understand that there might be Classified Material that cant be released but the more transparency, the better for the American People. Thats why the vote was so unanimous. Harris if this turns out to have been something also than a look at what russia did to interfere, has this been exercise in few tillty if there are futility if there are no further indictms coming which is what we are told

I wonder if you are concerned about this as well. That we didnt get maybe what we could have gotten had we solely focused on what the russians did. I dont know if you heard Michael Caputo but he said he wouldnt be surprised if the russians had been doing this for years and years and years. Its not surprising. Its almost guaranteed. Russians engaging in Election Interference is nothing new. Russians engaging in intelligence operations against the United States is nothing new. We should never be surprised about that. Work to defend ourselves from that and we should look into what happened in 2016 and 2018 but it will happen in 2020. The russians will do it again. The question is always how much of an effect will it have and if there were americans involved. It doesnt look like there
was. The point is we should take Cyber Security seriously and protect the elections in serious ways. Harris that is the next battlefield they say. Treasured veteran, someone who has been there many times and we treasure the veterans who fight for the nation and what we believe in. That is the goal to try to make it even for everybody to get to the facts and protect that democracy. Before i let you go, what is next in terms of pushing against democrats who would want to try to impeach the president . What will republicans do . What is the strategy at this point . Will you get out in full force with messaging or leave it to the white house . We need to be objective. That is what they are doing. Digging up any and all reasons they can to hate the president and impeach the president and undermine this president. We have to be objective about
this. When the report is transparent as i hope it does the truth will come out. You cant infringe on someones Civil Liberties the way the democrats wish to do looking for every possible reason why the person might have committed a crime that is not really how the country works. We heard word that he was leaving the building or had left. Your latest . The latest from the white house and the president spending the weekend at maralargo is that this thing is over. The fact that Robert Mueller will be leaving the special Counsel Office in the next few days is indication that the Russia Investigation is over. And Robert Mueller doesnt have anywhere else to go. Not to say maybe the Southern District of new york doesnt have somewhere else to go but the Office Of The Special Counsel will be closed down. I am told that the president is glad that this is all over. Its not likely that we will here anything about the special report, the Special Counsel report at least until sometime on sunday. They have a lot of material to go through. It will take a while to put them a summary and deliver to congress. Rudy giuliani telling me that this marks the end of the Russia Investigation. We are confident there is no finding of collusion by the president and this underscore what is the president had been saying from the beginning he did nothing wrong. The president said week after week this is nothing but a witch hunt. This is only an attempt to overturn the 2016 election. The president has had success making the case because 50 of the people polled said they believe the president is subject to a witch hunt. There was an Associated Press report out that giuliani demanded to see the report before it goes to congress but giuliani called me to say its absolutely not the case and its up to william barr what he wants to do. Then there is the bigger picture. The sense here, harris, if this report goes a Long Distance toward exonerating the president , does congress try to get ahold of the whole report and the investigate i materials investigative materials . There has to be a warehouse of those. If it fully exonerates the president do the democrats recalibrate completely what they were planning to do and go after the president on Something Else . A lot of unknowns here. I think its safe to say it
will likely be 24 hours before we here more developments on this terms of what it contain contains. Harris we will let them hand the helicopter. The democratic chairs are demanding the Justice Department release, quote unquote, without delay the full report its receiverred from the Special Counsel Robert Mueller. They expect Attorney General barr to hand over all evidence that mueller uncovered. That is what john roberts was just talking about. That they have to push for that. And since they Justice Department cannot indict sitting president , this raises serious question over whether
the d. O. J. Policy is used as a pretext for the coverup of misconduct. That is among the democrats and the six House Committees calling for that without delay, release of the report. According to the Associated Press reporting at this time. Before we get to the congressman can we pop up on the screen the letter that came from the Attorney General. The Special Counsel has submitted to me today a confidential report explaining prosecution or the Declination Decisions he has reached required by the 28 c. F. R. I am reviewing the report, and anticipate i may be in a position to advise you of the Special Counsel Principal Conclusions as soon as this weekend. And now the Ranking Member on the house judiciary committee, doug collins. Congressman, i bring you in now to get a look at what happens next in all of this. Hey, harris. How are you . Harris fantastic. A busy friday night. You received the letter. What is next course of action. Well, i think this follows what we talk about. I talked about this a lot in the last few weeks. This follows the course of action laid out by the regulation at justice. That is what bill barr is doing. He is doing exactly what we knew he would do. Follow regulations to a t. He delivered the investigation and maul mule turned over the report for him mueller turned over his report to him and his explanation. Its important to note the several things out there. I will report what we know. That is from the letter and where we go next. The letter clearly states that there was no interference by Attorney General or acting Attorneys General in any request by mr. Mueller in the investigation. That is a big Talking Point that the democrats make sure no one interfered. He had time to do everything. He completed it. What will happen now as said in the letter mr. Barr, the Attorney General will then prepare his report and then send that to us as early as this weekend. At that point in time well have the process of what mueller found. It will be coming out to the public as we go forth in the way that Bill Barr Set Out in the regulation. I want everybody to understand what happens next. Report will come out and up to bill barr on how it comes out. He has to give it to us as he did today. So far he has done everything by the book. That is a good thing. Harris we know from what it said in the letter you receiverred that he may be in a position to advise of the Special Counsel Principal Conclusions by this weekend. Are there members who are ready to accept the information and get to work on it immediately somewhat is happening on the hill tonight . Yes. We are prepared, our office is prepared. Im sure that the Chairmans Office and chairman graham and
the Ranking Member Finestein Committee are as well and well be prepared to get it out. Go back and remember, Attorney General barr going through the conversation and he wants to release as much as legally possible. There is a lot of conversation tonight and including the democratic friends who seem to be going concerning now about the fact that this doesnt seem to be leading where they always thought it would be leading. At this point in time, what we are seeing is him putting that together. Classified information in there possibly. There is a grand jury that is not going to be released. And his own investigation. He will release i believe and he said publicly all that he can legally put forward. I think that is where we will see this. Democrats are just going to have to understand that. They booked evening on a report that may come back and say exactly what we have been saying for two years and the president has been saying that the collusion was not there. But that is still to come. But they are, i think they are
panicking now. Harris quickly. The Southern District of new york cases that were put forth. We have seen them go far and wide. What happens next for the president with regard to any of that . This would, every indication we have on this, this would not affect the cases. The cases will continue on i believe, talked about before that those are, you know, proceeding on and are getting the further down the line. Remember the Inspector General at the department of justice is still investigating the fisa abuses. There are things we need to go back to remind people what really did happen. If the report comes back as we think it will and there is no collusion. Hopefully that is what it will say and we think it will. But we can go back to show where there were oncers at the department of justice and the other things that precipitated the Russia Investigation. Its a place where after we saw sentencing of one of the principals in this case they lit up with what comes next. That sentencing for manafort perhaps could be something that the federal level, that could get a pardon from the president. The causes if they were to
the cases if they found manafort or anybody guilty could not be privy to a president ial pardon. There will be further court action. You are quite right. It will be in districts outside of the Russia Special counsel investigation. Cases that arise for example out of the Southern District of new york. I want to share information with you and the folks at home. I have had a lot of contact with the individuals who have been questioned by the Special Counsel in the last two years and i have not been able to report the information because they asked me to hold until the report is complete. I feel like i can share some of it now. It goes to the idea How Comprehensive The Investigation was by Special Counsel Robert Mueller. The individuals described to me an investigation driven by the forensics and the by the documents. June 2016 trump tower meeting, the republican convention, the changes to the party platform, they were almost treated like
a crime scene if you will in terms of how people were interviewed, the documents collected, Phone Records and the individuals were challenged on the version of events with that paperwork. For some people who were witnesses, not forgets, they were still looking at legal bills upward of 100,000. That gives you the sense of the Financial Hardship of the individuals who were simply witnesses in this investigation. Harris we heard from Michael Caputo this hour. He joined me and he was one caught up in this. Separate from the Southern District of new york but he sad down with muellers team sat down with muellers team. Its expensive and a lifechanging event to sit down with the prosecutors and have everything lay bare. Right. The other thing to emphasize is we are talking about Special Counsel Robert Mueller. In the building behind me the Inspector General michael
horowitz, they have been running parallel or a tandem investigation if you will in three key areas. One of them is the allegation of the fisa abuse. That is abuse of the Surveillance Warrant System in the 2016 campaign and whether there was an honest application or a straightforward application that did not withhold evidence from the fisa court in October Of 2016 for Trump Campaign aide. Or whether exculpatory evidence or the evidence in conflict with getting the application was presented to this court. The other investigation has been looking at issues that arose out of the clinton email investigation in 2016. Specifically the leaking of classified information. You recall that former f. B. I. Director james comey said he deliberately leaked a memo of a conversation with the president to kickstart the Special Counsel investigation which in effect it did, along with his firing. So its the followon action. Harris we will get into it now, james comey. That is interesting because it segues to the new information from you. What is interesting, harris. I have a stream of advisers, allies of the president texting me saying we are live and all over the story. They are saying what about james comey and the fact he testified under oath he used a friend to leak out those memos of the conversations with the president to force the naming of the Special Counsel number one and suggested its because of Criminal Wrongdoing by the president. Then you fast forward last night. We had on the program last night, james comey, the same man had an oped in the New York Times breaking last night to this morning saying we dont think there is evidence of collusion or Obstruction Of Justice. I dont care he said. I have no idea whether the Special Counsel will conclude that mr. Thrump knowingly con spared with the russians or
obstructed justice with the required corrupt intent. I also dont care. Even though comey and the other critics have been saying for a year and a half they believe that all of that evidence might be there number one. Number two, ally of the president just texted me how is it that james comey hours before the report came out was able to do an Expectation Setting oped . Hey, guys, this is probably not collusion here. When Catherine Herridge and all of us are reporting we dont know what is in this report yet. Its confidential. Only the Attorney General has it. James comey who the president said is a key ally of mueller and they were friends, they denied that. But he is able to go out hours before and say probably not going to be a lot. Not saying it proves anything but interesting question. Harris one thing we learned about james comey he is all about james comey. Probably a person who could tell you that better than anybody is Hillary Clinton. Because remember what he did in the july before the
election. It caused a cloud over her, her team members said. President trump said was wrong about comey and reason to fire him. Then it turn around to say firing comey was Obstruction Of Justice. Michael caputo was on, former member of the Trump Campaign earlier and he talked about the disruption in his life. I want you to talk about what it is like to sit down and talk about this case with the prosecutors. Well, harris, as i have been forward about, i have spent 12 hours testifying in front of the House Committee and schiff and Eric Swalwell who repeatedly said they are 100 certain that there was Russia Collusion. They said it many times. Now we know that there was no
collusion. I didnt grow up any wealth whatsoever and i have four kids to put through college. What the overreach of the government has done and what this investigation which lasted one year, ten months and six days has done to the individuals destroyed lives. Look what they did or tried to do to jerome corsi. They asked him to sign a document to plead guilty to a crime. Now we see that the Mueller Investigation is over, and they are not charging corsi with any crime. This is what is going on. This is overreach of the government that was started because Hillary Clinton took 5 million and created a false dossier and james comey, the Messiah Complex james comey, The Man Who Discernment in his mound and what is right and mind and what is right and wrong and took that to President Trump and launched investigation because Hillary Clinton couldnt win an election. That is what this is about. They tried to prove that trump cheated when he never did. I i was there every single day. We work harder than they did. We outsmarted them. They are still not comfortable with the result and trump won the election. Harris you have talked with and i mentioned earlier the Associated Press reporting now that the democratic chairs of six committees demand they release the full report they receiverred from Robert Mueller. Why would it not happen given all the things you said depending what the facts are about collusion. It was never a crime. Obstruction of justice. Conspiracy. Other things that they may have looked at. Certainly tampering with an election by the russians but collusion was never a crime. So when you hear they want full transparency isnt that something everybody agrees on . You and i both want the same thing. We want to see the full report. What we know and we heard for countless hours on the Cable News Network is trump was going to fire comey and
congress had to save him. Then trump was telling sessions, barr and rosenstein to over see the investigation. We no know none of it was true. I want to see the full unredacted report because the taxpayers have a right to see where 40 million went of their money to prove something i knew from day one. There was no collusion or cooperation or coordination between the Trump Campaign and the russians. Trump beat hillary fair and square and we knew it from day one. And the people use the badges and the positions of government to ruin peoples lives. Jim comey and Andrew Mccabe who now has a criminal referral against him i hope that bill barr has accountability to the people. So there are no current indictments as it relates to Russia Collusion and no sealed indictments is what this indicates to us which is a clear signal that the entire hoax is finally over. this report . I think what is going to happen. Democrats are still going to overreach. They will continue with the socialist agenda and try to impeach the president.
