P. s secret weapon in florida, the 37yearold florida native is considered one of the foremost election law experts in the country. Lesser known than democrat lawyer mike elias whose name is known to many as a clinton attorney. He is glued to bill nelsons side to push for the recount. Johnson was crucial to Governor Scotts outcome and is watching florida and georgias matching laws ahead of the president ial race and she joins knee now. Good to hav now me now thank you for being here. Thanks for having me. Martha you said as soon as you saw marc elias heading to florida you knew you needed, too why. As elections attorney i recognized his name. I knew when i saw he was interested in this race it was going to be a big deal. Governor scott was victorious on november 6th. He won by 12,000 votes. If marc elias was still interested in this race after 12,000 vote victory i needed to Pay Attention to it, too. Martha in terms of the rules that need to be governed or perhaps changed what are they . These a really important question. I think after the 2,000 election, you know, florida took a long hard look at these election laws. Obviously they didnt want a repeat of that situation. There have been subsequent changes since. There was another issue in 2016 regarding provisional ballots and the state took another opportunity to look at their laws there. So, you know, thats very important. This state was not foreign to the concept of revisions to election laws and these laws were in place for a reason. Certainly when you have an opportunity to test them out like we did in this recount, there are going to be things that we want to review and see if we can do differently. These laws were in place and they had to be followed. Every single lawsuit that Governor Scott put his name on was intended to make sure the rule of the law was followed. Every single lawsuit the democrats tried to bring forward was to do something about that law in order to make sure their candidate could win. Martha what about what Stacey Abrams said about the legitimacy of the georgia race . I think thats so interesting and unfortunate, and i think the reason for her statement, perhaps, is that democrats have shown that they are not willing to respect the will of the voters. You know, rick scott won on election night. He was successful. It was 12,000 vote margin. The voters spoke. They were increb credibly clear. The entire state was put through this long prolonged recount process. Lots of folks taken away from their families from their jobs to volunteer. It was entirely unnecessary. The will of the voters was clear. In the history of american politics, we have never had a recount overturn a margin of more than 1200 votes. So you know when were sitting here looking at a margin of 12,000 votes, and 1200 votes is the most we have ever seen overturned, you knew this was going to got way of the voters, thank god. Martha what about the claim of Voter Suppression and the evidence, does texas cyst or not exist in georgia . You know, i think that the democrats look at elections these days as an opportunity for litigation. You know, they its just like redistricting. They havent been successful at the ballot box. And they are unwilling to believe that the same voters that could put donald trump in the white house would be the voters that would select their representatives now. They are unwilling to believe that so they are taking their fight to the courthouses. They feel like its our job and we did this with Governor Scotts lead. Its our job to make sure that these rules are followed and to protect the decision that the voters made on november 6th. I dont think there was Voter Suppression. I think it was important to make sure the law was followed and i was proud to be a part of Governor Scotts mandate to make sure that happened. Martha in terms of the matching laws. Matching the name to whats on the ballot when people check in to vote, theres a lot of suggestion that that was overly onerous for voters. Your thoughts . Yeah. So, you know, this is something the state looked at in 2016. This is something they have looked at incredibly recently and again there they put protections in place to make sure that it wasnt overly onerous for voters. The counties are required to provide notice to voters to tell them if their signature is not good enough. They can go in and have an opportunity to correct that. There are plenty of protections in place to make sure that, you know, their votes are counted. Republicans want people to vote. They want their votes to be counted. Its democrats that want to change the law so that valid legal votes are worth less because theyre bringing in lots of illegal votes are we to the place where you know if people are interested in georgia that they should start voting or if people really care about this race their vote should count twice kind of seen thats what democrats are looking here. Martha in terms of the laws that they tried to amend after the election was over in terms of how long they could go ahead counting ballots, are there challenges on that that you are pushing against as you prepare for the 2020 president ial election . Absolutely the democrats showed their hand what theyre willing to do to throw out headlines that had been established for years to require these new requirements for voters in order to get their vote counted. Its just quite ridiculous so yeah, i think the nrc at Governor Scotts lead going to see what we can do to fight these battles because i think its incredibly important to make sure that when a person goes in to vote they on the rules. They understanding what they have to do. They need to know that their vote will be counted. They also need to know that people havent followed the rules they are designed to make sure people can vote. They need to know that their votes wont be counted. The clear issue for me she was saying that people have to know that there is a procedure, you have to follow the procedure in order to vote. I think lots of people, especially i would point out in georgia did just that. They applied. They registered to vote. And its over 50,000, martha, Voter Registration cards rejected by guess who brian kemp the secretary of state, who was also the candidate for governor of georgia. Martha are these 50,000 people . Where is the outcry from them that their vote did not end up counting . Because, you know, a number of accounts of this say it doesnt seem to exist. That they are not seeing that. I dont think we are seeing it. Again, what you are dealing with especially in the Abrams Campaign is an effort to get people who were not participating in the election to come out to vote for a first time. Lots of firsttime voters are talking here about young people, minors who typically are not quick to participate in the midterms. I think they lose interest. The point here is i dont think that brian kemp should be running an election in which he is a candidate. Martha is it right for Stacey Abrams to charge that there was Voter Suppression in the georgia race, katie. It is not appropriate to charge Voter Suppression. You cant cite something if it doesnt exist as evidence of Voter Suppression. Juan 50,000 registration. Making argument that because the secretary of state brian kemp cleaned up the voter roles 8 years ago he was suppressing the vote. The problem is when you dont clean up voter roles a its illegal to do that and b its voter fraud. Job of every secretary of state not just in georgia to make sure those rolls are cleaned up. We pride ourself on peaceful transition of power. This continuing refusal to accept the legitimacy of elections when you just dont like the outcome, we keep hearing all about attacks on democracy, the delit jittization of our elections not accepting a result because you dont like it without any evidence toe back up your claims of Voter Suppression or voter fraud even, that causes real problems. Martha people have to have a confidence in the system and that the system works on all sides. When you look back into this idea of Voter Suppression, it was a law that was passed in 1997 under a Democratic Legislature and democrat zoe miller to make sure people who had died and moved out of georgia were not on those voter rolls because they didnt want anyone to abuse those lists of dead and moved away in order to have to create vote fraud. Isnt that a good thing . Juan thats a great thing. Heres the thing. There is no evidence of voter fraud. We are not discussing that we are talking about people who filled out a Registration Form and saw it thrown out. We are talking about people absentee ballot being discarded. We are talking about polling places, martha, being closed and told the toilets dont work. Oh its a black neighborhood, thats why we are closing those polling places. Okay. That was a lot to unpack there. Go back to claim no voter fraud here. Thats exactly the point. The reason the secretary of state goes through the rolls and make sure there are not eligible people on the rolls to prevent those kind of voter fraud. This idea that you are arguing that there was suppression in polling places closed purposefully in black places to keep them out of the voting places is a serious charge to make and we havent seen evidence of that. We have seen because we know about polling places being closed. Yuan, it wasnt because they were closed africanamericans. Martha one more comment and then i have to go. I think what you are seeing here is a situation where republican candidates say were going to choose our voters rather than have voters choose the candidate. And they do that by focusing on surprising voters who they think are young, minorities and oftentimes women, martha, hog they think are not going to vote republican. Some reports that he was shot in the face. Some reports that he shot himself. Incidents started before 3 30 this afternoon local time when a man and woman were walking here near Mercy Hospital. They had a conflict. The woman ended up on the ground and woman stood over her and discharged multiple shots and entered the hospital and thats from multiple witnesses from the scene here. One thing we heard very clearly from the witnesses the amount of chaos and terror that was here at the hospital. I heard six shots. Six or seven shots, pop, pop, pop. I dropped my grocery bags on the sidewalk and told the man lets seek cover. And so we sped off to the side. I kept recording and i heard six more shots. Now, the local abc affiliate is reporting that the gunman is a former feign fiance of one of the victims. Indication thought motivation here was a domestic conflict. One of the things that is very apparent is the kind of danger that Police Officers face every day rather routine duty at a hospital turned deadly and just a matter of moments and police are about 45 minutes late giving their update on the scene out here and on this officers condition. So tonight after years of watching migrants climb over the border fences at night and sometimes in broad daylight. One of the newer low tech devices being used is enormous amounts of barbed wire, more than 12 miles of it now stretches from the beach in california to the san ysidro port of entry and around that port of entry in places. Today they shut it down for several hours there to lay concrete barriers and new wire to keep order there where there are reports that migrants may attempt to rush the port to gain entry. They are being pressured by some tee yua tijuanans to go bao honduras. We know of instances in tijuana and other cities people coming in caravans are committing crimes. So were pressing, i am protesting that we want the government to take control. We want them to stop them at the border and register them and check who theyre. You look at all that rar wire being laid down on top of all the walls people climbed over in the past. Why wasnt it done before. We have always had wire in our inventory of what we did at the border across the southwest border. Its not something new. I think based on the size of this caravan, beared on the violence and the force that we had seen used by this caravan, we really thought it was in our best interest to take a look at our vulnerabilities and some of the gaps that we had at the border and quickly make those assessments and do what we could to put up infrastructure at our borders at our points of entry to make sure we didnt have mass incursions. Martha the understanding is there is about 6,000 people across the border and that they are near the port of entry in san ysidro and that the people in tijuana want them to go back to honduras. How do you think this is going to end . Well, i think, you know, from the very beginning this caravan has been different. Not only just because of its size but because of the violence. The criminal elements in the caravan. The use of force. And in the messaging of the individuals in the caravan. So, i think in mexico, as they went through mexico and now have arrived in tijuana, we have individuals who are waiting in line and orderly waiting in line for a process of asylum to come through the ports of entry and make their requests. Martha i understand about 100 people who are being processed every day. Through the typical procedure that is expected to be carried out. Im just curious there is a lot of people who said this was ridiculous that this was all overstated. That there is no invasion going on. And that this is simply not a big deal that it was used for election to put fear into people before the election. What do you say to that . I think from what we see in tijuana, the 6,000 that we have. 6,000 plus we have in tijuana, the other 1200 to 1300 potentially more now that we have in mexicali, the caravan and those members, just the amount of what we see in those caravans is real and its problematic for us as they look to potentially avoid or try to circumvent the normal process coming through our ports of entry in a legal way. Martha there is a lot of talk about Kirstjen Nielsen being removed from her post. Do you think there is a need for new leadership . I think what we are doing right now, i think under dhs and what we are doing today, we have great leadership in what we are doing and how we are attacking this problem set that we have. This is a big issue. And there are gaps in how we handle immigration, the process, the loopholes that we have in the law. So there are gaps that need to be closed in order for us to be successful. Martha i want to ask you one more quick question before i let you go. The president pointed out he thought it was interesting, ironic was his word a lot of people coming through in the caravan are waving the flags of the home country they say is persecuting them and making it impossible for them to live in that country. Do you find that surprising . Well, i find that we have seen that in the past. But mexico has offered these individuals. They have offered them asylum status. They have offered them work permits. They have offered them workshops on how to obtain work permits in mexico. Central americans passing through mexico if, in fact, they do have fear to be in central america, they have an option. You know, first thing i would say about betsy devos the education secretary is that last year she said that she was going to promulgate some new guidelines to make the process more balanced and she has delivered on that promise. And i think she deserves a lot of credit for that you are right. The issue here is due process. And the accused were not getting the due process that they should get. If the process is going to have any integrity whatsoever, and even the courts have stearated to recognize this. There have been a number of state and federal decisions that have said that the accuse have had a right to crossexamine the accuser and that is not happening in a lot of College Campuses. Martha Everyone Wants accusers to be heard. And you also want the other side of the equation to also be heard. And we did a documentary about this a couple of years ago. And talked to a few different young men whose lives had been dramatically altered by this and young women would say that their lives were dramatically altered in similar situations as well. Not all the time is the accused guilty. And this is just one story to give you a sense of what we are talking about here. I got a phone call from the schools title 9 department telling me no Uncertain Terms that i had to pack up my stuff and leave my dorm immediately. To john, it had been a sexual encounter of a type not uncommon among james comey young people. Even jane doe had not called it assault at first. He still remembers their long discussion the day after. We talked for nearly three or four hours and we alcoholichockit up to you a drun mistake. Now here he was the campus rapist. Young men kicked out of class. Not allowed to be in the same room with young women. So your thoughts on where this was . Being accused of something is not the same thing as being guilty of it again, the case was stacked against the accuser or against the accused person under the obama guidelines. I think some balance was needed there because you want the outcome to have some support, some legitimacy on both sides. I think these guidelines put in place by devos will do that they will give the whole process more integrity and more satisfying conclusion i think will come from having a more fair process in place. Martha it also divides which pieces are possible to adjudicate on campus. And just so everyone knows the panels that make these huge decisions affecting peoples lives are usually three professors who has been picked sort of somewhat randomly to listen to this case and decide upon it. And under the new guidelines all of the evidence that they gather will now be able to be accessible by both sides. A lot of people might not realize this but under the obama guidelines that is not what happened. You couldnt even hear what she was accusing you of or he was accusing you of. We now know that cia has concluded in their assessment that mohammed directed the government to complete the killing. Trump has been hesitant to accept the conclusion of the cia on a number of issues. We know he wants to work closely with the saudis but its disappointing that he seems to be overlooking the intelligence assessment because he has made some calculation about what is in the National Security interest of the United States via iran or the oil targets. I would argue letting the saudis get away with this and making excuses for them is actually very much not in our National Security interests and he can decide whether or not he wants to side with the cia or the saudis, then choice shouldnt be hard. Martha we have a long history of looking the other way, not just the previous president to the other things. I just wish he could be more up front by saying, the cia believes this with a high degree of confidence as marie said. Its unacceptable and there have been some consequences, and make the pivot to what he said directly, there are Strategic Interests of the United States. They will work with them on some important issues and we can do both of these things at the same time. I think that he tried to strike that balance and i would like a little bit more of an overt condemnation mbs because i think its pretty clear based on our intelligence and what we know now what theyve concluded. I hate the way the president makes these offthecuff sort of snide remarks solely because someone criticized him. Bill mcraven is not a Hillary Clinton supporter, hes not a political person. He led the most successful rate of recent years, which they did as soon the cia had found him. They moved immediately, they put together a plan. I think the implication at the end of that answer was, if mcraven had been better at his job we could have gotten bin laden sooner. I dont think there is a shred of evidence behind that.
