Mr. Trump is not a target of the Michael Cohen investigation. Some of the reporting on the raid and word that Michael Cohen was ready to flip and testify against the president may be a bit of it had of itself. Maybe its a sign that a tap on the brakes is in order here. That case is directly related to the president. He told the president that cohen is likely to flip. Speak what you see panic among the trump team that he might fl. Should the president listen to those who are telling him he should be worried cohen will flip . We dont know if Michael Cohen will flip on President Trump. Martha ken starr former independent counsel in the clintonwhitewater probe joins us with his reaction to all of the news tonight. But first, chief National Correspondent ed henry live at the white house without the late, breaking news tonight. Theres a lot. New signs that President Trump is not a criminal target in either the Michael Cohen or Robert Miller investigations, but instead what were seeing is some of the onetime fbi officials who have been challenging the president s candor, namely james comey and Andrew Mccabe as you just noted in that tweet, are facing new scrutiny themselves tonight. Bottom line is bloomberg kicked a lot of this off today by reporting that in a meeting last thursday, Deputy Attorney general Rob Rosenstein again told the president hes not a target in the mueller pro. The president is a subject of the investigation, meaning his conduct is under investigation, but theres not enough evidence to charge him. That point had been reported last month. Whats significant is that rosenstein is now repeating this for the First Time Since the president s longtime personal attorney, Michael Cohen, had his home and office rated. Fox news is specifically hearing rosenstein also told the president hes not a target of the separate cohen investigation. That is new. We pressed rosensteins office for the his his version of the conversation and we got this. Important to note, mueller has not ruled out making the president a target in the future based on evidence that could emerge, the same could happen in cohen investigation, which may explain why the president also beefed up his legal team, adding an ally, rudy giuliani, the former new york city mayor have spent strolling critical of the fbi and Justice Department were going right on Hillary Clinton, well turning up the heat on the president. One of those fbi officials who has challenged the president is mccabe, who was fired for leaking and then lying about it. Now the Inspector General at the Justice Department has sent a criminal referral to the u. S. Attorney here in d. C. Over allegations that mccabe lied to internal investigators of the fbi. Cnn asked comey what he thought about mccabe lying. Watch. Im conflicted. I like him very much as a person, but sometimes even good people do things they shouldnt do. Ive read the report, are not the judge in the case, im not the discipline decisionmaker in the case. I think it is accountability mechanisms working and they should work because is not acceptable in the fbi or the Justice Department for people to let candor. Comey has been charged with candor problems of his own. Chuck grassley said that some of the memos leaked out had classified information even though comey said and sort of testimony last year, he deliberately left classified information out of his my most so they could be leaked. We heard the Justice Department will soon release redacted versions of of those comey mem, so we may be able to finally sorted out. As for mccabe, his cant put out a statement. We are confident that unless theres a former Justice Department officials said today that given the fact that its coming from the Inspector General, it carries a lot of weight. Martha ed, thank you very much for that report tonight. My next guest led the independent counsel investigation into president bill clinton. Starting with whitewater and ending with clintons impeachment about lying and the Monica Lewinsky affair. Former independent counsel and former solicitor general ken starr dreads me now. Welcome, great to have you with us tonight. Thank you, good to be with you. Martha you heard the set up piece and you heard all of this with regard to mccabe and what the president has been told about the Michael Cohen investigation, what jumped out at you about all of this . One key element is that the president has been told again that he is not a target and this is from the Deputy Attorney general for the United States. That is pure gold and that could change because the facts and all of that. The second thing is the Inspector General who is a career official at the Justice Department has made this criminal referral, thats a very important step, its a dangerous step obviously for mr. Mccabe, but it shows that these guardrails are working, that these accountability mechanisms as director comey said are in fact in place. I think that should be a great assurance to the american people. The third thing that jumps out at me is that the president has hired a brilliant lawyer. Of course, Everybody Knows that americas mayor is a lawyer, but i would tell you this based on my personal experience with rudy giuliani, theres probably no better lawyer in the United States to handle this kind of very highprofile situation. Martha very interesting. I want to go in on a moment for Andrew Mccabe and james comey, because theyre going after each other here in the president just said as much in the tweet that he put out, he felt that james comey had thrown Andrew Mccabe under the bus, but what Andrew Mccabe has been criminally referred to for his lying to fbi investigators about releasing information, acting as a source and then saying he didnt to a story in the wall street journal. We know that when Chuck Grassley asked fbi director comey at the time whether or not he had ever been a source for any information that went out to the press on this investigation, he said never and he said never twice. Then he came back and said i did leak information to a friend of mine because i wanted to get it out there to start a special counsel. What do you make of that . Its extraordinarily serious. First of all, lying to congress, like lying to the fbi, like lying under oath, and he was under oath when he testified before congress. Its an extremely serious thing. As a potential felony. Martha he was a private citizen at the time. I was just sharing some information with a friend. No, he was carrying information that he received were created in his time at the fbi. He cant do that, its totally inconsistent with his fbi conduct. Its ethical constraints. You dont leak. You dont get documents out of fbi headquarters at the hoover building and then start sharing them directly or indirectly with the reporter. Its a very serious breach of what the fbi stands for, which is integrity. Both mr. Mccabe and mr. Comey have a lot to answer for now. Martha we expect to get the full Inspector Generals report, which will go back and look at the decisions that were made in the Hillary Clinton investigation by former fbi director james comey. He doesnt seem to be worried about that at all right now, but clearly that is part of the subject of this ongoing investigation. I do want to ask you about this Michael Cohen matter a little bit because this has been an investigation that sort of began with Robert Millers investigation into russia. Now it has gone down the chain and should be pointed out that the federal investigators sort of kick to part of it up to new york and said there are Financial Issues that we are concerned with Michael Cohen and it appears is this an investigation that has gone too far away from its original mission . Stormy daniels has become the new Monica Lewinsky one could say. The differences, the lewinsky thing was about lying under oath and encouraging others to lie under oath. It was about abuse of power, so its a totally different kettle of fish, but cohen thing is incredible to me. I believe all americans should be concerned. Whats the justification . There was hard and in place, there was official review, but there is a process that will protect the attorneyclient privilege and it should be. Its one of the most important elements to protect the liberties, so im very concerne concerned. Martha i want to squeeze in one more question about Michael Flynn because i can only imagine what he would think. Lying to investigators, thats exactly what he was accused of. Thats right. One of the things that has been brought home in the mueller investigation, dont lie. Tell the truth. It was more important when you go before a grand jury. Just dont lie, tell the truth. We have the fifth amendment privilege, dont lie. You cant keep from lying from incriminating yourself, just say im going to invoke the fifth amendment. Martha ken starr, thank you. I heard reports that the people felt very comforted by her and she sounded confident, competent, but she also was calm and i think that really helped the situation. Martha what was it in your training that kicks in in those moments . I flew enemy attack aircraft, so similar to the Fighter Aircraft and we all go through the same training and whether youre a guy or a gal, you all go through the same training, the same emergency procedures over and over again throughout your whole time in the military. Thats the Great Foundation for many of the pilots to go on to the airline. They have great Training Programs with the airlines and i always say you fight like you train and train like you fight and it kicks in. You do what you have to do. I heard some reports of her saying i was just doing my job and most aviators will say that, i was just doing my job. Martha have you spoken to her . I have come out weve been in contact on text back and forth. Obviously she cant talk about the situation, but her First Response was im okay and that god is good, faith plays a big part of who she is. Martha i want to play a little bit of Marty Martinez who was on that plane to get a sense of the pressure that this captain was under. About 20 minutes into the flight, i hear a loud boom. As you can imagine, everyone on the plane was kind of zoned out and doing their own thing and you hear this boom and i think everybodys thoughts were, did you just hear that . Martha thats terrifying. It is and thats heartbreaking even though they brought the plane down safely and save all those lives, its just so tragic for that young woman to have died. I know tammy joe feels so much sadness and her crew does, but also thankful that all of those other people made it out alive. Martha it could have been so much worse. All of us look at Jennifer Reardon and you feel for her. She was on a business trip, she wants to get home to her kids, we can all understand that feeling, as everybody travels around the country. I want to ask you about the plane and what i said at the beginning of this, about these fans inside and how difficult it is to detect wear and tear on those. What needs to change there . I dont fly for the airlines, so im not an expert in that area, but we always say to the military that its written and blood and every time an accident happens, they have to change the rules and change the procedures. Weve been here for the last couple of days speaking to people who have been in that attack, victims of those attacks. The doctors who treated some of those patients and what we are learning is the concerted effort by the Syrian Regime and the russians to hide the truth of what happened. As you say, supposedly because of safety concerns after claims they were fired at by rebels yesterday. Numerous sources here have told us thats not true. Of course, rebel fighters and dumas were bused out of the area ten days ago. In fact, its because of the chemical attacks, the rebels have finally been able to leave. The evidence is still getting out to the outside world. Bit by bit, we are able to paint a picture of what exactly happened in that terrible chemical attack and dumas. We cant get to the site ourselves, but every day, evidence and witnesses come across this border wall with more horrific details. We met up with a survivor of the chemical attack. One had broken the roof and was stuck. Everybody in that house and at least two other houses have died. The barrel was about 5 feet long, yellow, and made of thick metal. Doctors said they only had room to treat those who had a chance at survival. They left the others to die. Weve also heard that they have found the chemical and taken the bodies so they cannot be tested. And doctors who treated the victims have been harassed and their families threatened if they give evidence, but evidence is getting out. We spoke to the rebel commander in syria who said that americans had been there to take blood and samples from survivors who managed to escape up north. Even if the u. N. Doesnt have that evidence, it appears that now the American Government doe does. Martha thank you so much paid one man caught in the middle of all of us, an American Veteran turned journalist would back to syria in 2012 hoping to shed light on the human suffering there. Austin tice, described as his parents by his parents as a man who loves america, good student, graduate of Georgetown School of Foreign Service and still enrolled in the law school they are. A veteran marine corps captain, a talented freelance photographer, and a loving big brother. In august of 2012, he was kidnapped while he was reporting in syria. Just a days after his 31st birthday. Before he disappeared, he posted on facebook a message to friends and family who had questioned why he would stay in such a dangerous place and heres what austin said. Im living in a place at a time and with the people where life means more than anywhere i have ever been because every single day, people hear it laid down their own for the sake of others. Coming here to syria is the greatest thing i have ever done and it is the greatest feeling of my life. Now five years and eight months later, no one knows exactly where austin is or who is responsible for his disappearance. There is a one milliondollar award for information leading to his safe return, but parents have been told by credible sources that austin is alive and they are fighting, as they happen every day to bring him home. Foley, its a really difficult, harrowing experience. Its certainly a steep learning curve and i also want to say that when we hear about whats going on there, we do pray diligently for healing in syria. I voted for him for cia director, i think hes got a great intel background, but he just has a track record of statements that are antidiplomatic during the discussion about the iran deal. I think he set a poor example in terms of american values, so i will strongly oppose his nomination. Martha talking about mike pompeo of course. They take a jab at democrats and some republicans were giving pompeo push back asking who needs a secretary of state . Today, President Trump accept his decision tweeting demonstrates our one of our next guests says the object of justice of karma. Former Senior Advisor is tweeting senator bob corker who wrote mike pompeo deserves a vote and confirmation. Hillary clinton or john kerry got 94 votes. Doesnt this point to a lack of civilized behavior on the hill when you look back at the records of the way Condoleezza Rice and colin powell and john kerry were approved by vast majorities and yet mike pompeo who went to harvard, graduated at the top of his class from west point, hes having some problem. Mike pompeo doesnt have 90, 94, 95 votes because he doesnt have the entire republican caucus, the person you didnt show is rand paul. Rand paul at the moment is the biggest impediment to mike pompeo taking it out of committee, let alone on the floor. I think in terms of tradition, the senate has been differential to the president very much especially on their first cabinet. 15 months later and President Trump god through the first cabinet without a problem except for the labor secretary who pulled out himself, but 15 months later, you have Rex Tillerson who was fired, David Chilcote who was fired, you have tom price who was fired. Martha thats apples and oranges. Youre talking about people who didnt work out once they were in their job. I want steve to weigh in on the basic question which is is this something that the president would like to see at the state department and he was proved roundly . I think the default should be the president s nominees. The argument that philippe is making is in favor of confirming mike pompeo. Hes somebody who has had a successful tenure at the cia. He went in and a difficult position as an elected official, republican, somebody who is going to represent the Trump Administration when the president elect was in a fight with the intel agency and he wanted bureaucracy and conducted himself by all accounts as a very effective cia director, sweet and have something that you would want to have in Donald Trumps ear negotiating with north korea or fixing the iran deal. I would think democrats would be fast to have somebody who is stable and thoughtful as my pompeo is. Martha why are they . Thats a good question for jeff flake and rand paul. Rand paul has fled outside martha the fact of the matter when you look back ill let you finish, but its been a very bipartisan thing, and there will be people on both sides of the fence about now. The fact that theres been this vote of confidence, that the president is the president and he should have the person he wants in his position and the person doesnt have three heads or something ridiculously egregious, then its courtesy to let him go through with those moves. There is no courtesy left, it would appear. He got his cabinet last year and i think that was an overwhelming differential to the president. There have been less than a dozen in our nations history of cabinet secretaries who have been voted down. Im not sure mike pompeo is going to be the next one. We already had a democrat today who said they would vote for him, so the only reason it wouldnt happen is if rand paul took really extreme procedural steps. I think after 15 months again, people are weary. Mike pompeo had a hearing and he said things during the hearing that people were concerned by. Democrats and republican. Thats the job. The senate is not a rubber stamp here theres a balance between being differential the democrats are playing games. I understand why he would want to focus on rand paul, but if you look at what bob menendez, the senior democrat is doing, he submitted 698 questions for the record that mike pompeo and his team are supposed to answer. Thats not because he wants to grind the process to a halt. If the leaders of the democratic side are clamoring about politics at a moment like this, through public and put a 942 to 4 Hillary Clinton, i think its disgraceful.
