and understands the gravity? >> kat: part of the reason i did not like the way donald trump seemed to minimize the possibility of russia hacking the election, saying if he did that, he shouldn't have done it. it's a lot more serious and whether it is north korea or russia, another country with the ability to hack into our system systems. when it comes to military, doj systems, that's a very, very serious thing. that's the way people are fighting. we need to make sure we are secure. we need to all unite around this because otherwise i don't even want to think about it. >> if the hacking occurred with the russians, which i don't believe it had any impact on the elections, obama did not keep us safe. he did not protect us. donald trump has the ability to take steps to keep us safe. >> eric: not that they attempted to hack. they have attempted to hack. the chinese want to hack us. virtually every country wants to hack us and we are hacking back at them. did it change any votes? "new york times" reporting president trump asked james comey to shutdown the federal investigation into michael flynn, former national security advisor, during an oval office meeting in february. according to a memo mr. comey wrote shortly after the meeting. we have a response from john roberts. "while the president has repeated his view that general flynn is a decent man, the president has never asked mr. comey or anyone else to end any investigation, including any investigation involving general flynn. the president has the utmost respect for our law enforcement agencies and all investigations but this is not a truthful or accurate portrayal of the conversation between the president and mr. comey." this is breaking news. lead times reporting one thing, the president pushing back. >> eboni: mccabe saying what he testified last week that, consistent with what the white house was saying. we talked about that last week, that certainly we don't know what legal consequences are going to happen around general flynn. i say that respectfully, but it's an ongoing investigation. we don't know ultimately where it's going to lead. if it leads to a breach of law, those consequences have to follow. >> eric: the president asking the fbi director to go easy on one of his campaign advisors? that's entirely unlikely. >> kat: . i don't trust "the new york times." i don't trust trump. i am skeptical of everyone. people say it makes me a pessimist. the investigation is continuing. >> eric: what about "the new york times"? they have to stand on their reporting and sources. >> they do. we have seen this with "the post," the number two man at the department of justice threatened to resign. that very first, the deputy attorney general, said he didn't offer to resign. there's interesting reporting. i love jim comey. he has an intimate event with the president and the president brings it up in an interview, and what does jim comey do? it's why he's not going to be the fbi director anymore. he's a political animal. he had to immediately start leaking about his end of the story paid we want something better than that in the fbi director. we don't want someone who is trying to weasel his way into every story part he always wants to be the eliot ness, and really he is the dirty leaker. >> the president issued a statement. he was very clear and precise. some of the stuff that's off the cuff. this is not off-the-cuff stuff. he is taking to what's factual. as long as he does that, i think in the grand scheme of things as this plays out, he is well served. >> eboni: i think there's a lot of unanswered questions around several things that president has done but on this one, i can't see him at this point in the game risking that much around general flynn. i just can't see it. >> eric: a key excerpt. when we going to have some facts, conclusion on anything. >> eboni: i can get that frustration from the outside looking in. that is how the fbi is. they are slow. >> the president has to let them do their job. >> eric: we are not going to go to break just yet. let's continue to talk about this. jim comey is removed, and that leaves rod rosenstein, the deputy director, to oversee the operations at the fbi. i wonder where he is on this. i wonder if he has some input as to whether or not comey should be doing this. >> rosenstein's number two at doj. then you have mccabe fbi. mccabe is in a terrible position now where he is running the fbi. i think a lot of people feel like he's a lightning rod because he took a pass on the investigations of hillary clinton. this is a big problem, we have an fbi that's a little bit compromise. people have lost confidence. comey lurched right and lurched left bread he looked political during the campaign. the people around him were giving him that advice. now he has this memo. he's not going to prosecute donald trump. just like he is done michael flynn come other people who have crossed them. this sounds like the old days of j. edgar hoover. let's get somebody good to run the fbi. >> eric: something, this level of activation, i would assume would check the box for obstruction of justice. >> eboni: certainly. if the allegation is true from donald j. drum, that would be in the highest form. this is that type of allegation, the type of cloud hovering until this is resolved. if you are an anti-trump person, you love this and it's great. more fuel for the fire. he doesn't understand this constitutionality war. if it's not true, then it's more false alarm. more undermining of what we should be talking about. i'm very concerned about what general flynn did. >> kat: maybe there is something in the middle. maybe trump said, do you like me? who knows. same thing, if any -- of any the world is not falling down right now. things are moving forward. >> eric: there are two separate issues here. what did flynn do and was it illegal or improper or unethical and what happened afterwards? "new york times" says this was an oval office meeting in february. there were a number of people were meeting with the president, including the attorney general jeff sessions. at the end of that meeting, the president asked everyone to leave except the fbi director. according to "the new york times," the president said something to the effect that flynn had done nothing wrong, that the fbi should move on. i hope you can see your way clear to letting this go. the white house pushing back against the language. i expect they are going to push back against this hard because it would be highly inappropriate at the very least for the president to say to the apparent director, i hope you can let this go and move on. at the worst, it could be obstruction of justice. we all know where that could lead to. the white house is behind closed doors right now. communications staff deep in a meeting. it's in the roosevelt room. i think it is probably with other high-level officials of the white house, trying to figure out a way to get past this latest one, which occurs as they white house is in the middle of this other maelstrom over the the presidents meetinh lab rob -- lavrov. somebody's said with this white house, it never ends. there is credence to that. >> eric: yesterday at about 5:45, we have this issue you just brought up, the leak to "the washington post" regarding the discussion between lavrov and trump in the oval office from six days ago. today at 5:30, we get this. i've got to ask you, what is this memo? i know "the new york times" is reporting on it, but the comey memo, was he sending it to and how did "the times" get it? stick i couldn't tell you how "the times" got it. we are trying to search for it ourselves. it would seem according to "the new york times" that james comey kind of had an idea. again, according to people who were close to comey, the contents of the memo. they do not have the document itself, that comey was concerned about what the president was up to and wrote detailed notes every time they met. don't forget. the president last week sent a warning shot across comey's bow saying before you start leaking anything, you better concern yourself with whether or not there are any "tapes" of our meetings. we are talking about an oval office meeting. we remember that one president famously taped all of his private conversations. the white house has refused to say whether there is any kind of recording system in the oval office. everyone thought the president was referring to his dinner with comey and his discussions with comey about not being a target of the investigation on the telephone. maybe what the president was referring to was this. we don't know, eric. >> eric: thank you, john roberts. break in again if you have any news. strikes me that this happened a while ago. james comey had the meeting with president trump. maybe the rest of the room was excused. he wrote down notes, decided to hold on to them and days after he's been fired, he decides to write a memo. kind of a scathing memo that can put trump in some hot water if true. >> i was the person in the bush administration, one of the people james comey had to meet with so he could figure out his political point of view. he is whatever he needs to be, liberal, conservative. he is about preserving his own reputation. what did donald trump do? he did what a president is allowed to do. at the pleasure of the president, he let somebody ago. now jim comey is going to prosecute the president for having humiliated him with that decision paired why are we reading about this memo today? because jim comey is striking back. it's how he plays the game and it's going to terrible job politicizing the fbi. >> kat: may be. we don't know. >> eric: let's say it is true. and i'm not saying that but if it is, he has this information and sits on it until a couple days after he's fired. >> eboni: the political implications. he's moving forward. let's take it at face value. there are questions here about loyalty. a lot of people in america are concerned about president trump and this issue of loyalty. the accusation that comey was asked to look the other way when it comes to flynn. even the statement right now, he ultimately says i think flynn is a good guy. i think there are people who are very concerned about how far does donald trump take loyalty and this issue of loyalty? does he take it far enough to obstruct justice? we don't know. i think that's going to be a question that's going to be top. >> kat: you see how he turns on people who disagree with them. this accusation in particular is a very, very extreme one. i don't know if it's evidence he could've done this, his personality. recently don't know. it does make sense why comey would do it now. you get fired and then the stuff comes out. it is always after-the-fact. >> eric: had nothing to do with the good of the country or concerned about the presidency. it only had with his own -- with his being fired. let me read this line. white house response. this is part of it. "the president has never asked mr. comey or anyone else to end any investigation, including any investigation involving general flynn." i think they are denying categorically comey's memo. >> if this were that serious, and it is, it's obstruction of justice, i think. if he uttered those words to comey, why would comey have to come out with it at that point? why wait until now? i think the credibility here is with comey. i don't think anybody can corroborate anything. >> eboni: those who hear this today and are likely to believe it absent evidence, if going back to this concern of how loyal is donald j. trump? how far he will go. >> kat: i don't think anyone's mind is going to change. people who support trump are going to say comey was lying. there's no actual evidence i don't think it's going to change anybody's mind until we have something. >> first of all... it's not shocking to know that conversation the oval oval office are monitored by the secret service, so these conversations are kept track of. let me ask a simple question. if the president is trying to obstruct justice to the fbi director, he never says anything? if the president is asking inappropriate questions of jim comey, he still has dinner with him? jim comey shows a strange pattern of behavior. if the president was pushing to do something inappropriate. the fbi itself is saying the white house pushed back on nothing. they did nothing to try to stop these investigations. the pattern of behavior shows the opposite of what jim comey is saying. >> eric: donald trump ran on draining the swamp. he fires the fbi director. at that moment, comey says i have a conversation with him a long time ago. he broke the law. he obstructed justice. i didn't tell you before but i'm feeling it now. >> we've got "the washington post," "the new york times." these things are not provable on either sides. we are back in the corners. >> eboni: let's talk about the ability to prove it. i hope there are tapes. if i call up j.crew to return a sweater, that call is going to be taped. >> eric: let's say there aren't. it's his word against his word. >> eboni: nobody has any credibility, to be candid. jim comey has major credibility problems. >> eric: the timing on when he decided to write this memo. >> make it public. >> kat: people who want to see trump impeached aren't going to care about that. >> eric: unless there is some sort of tape whenever, recording device. it's his word against his word. >> this is how j. edgar hoover played the game. >> eric: comey is a smart man. there is no way he doesn't realize in the absence of tapes, it's his word against donald trump's word and it's going nowhere. so what is the point? >> it's about his honor. he believes he's the great man that stands up for the constitution. what he really is is a little man who's acting like a politician. we want more in the fbi director than this, which is why every democrat wanted him fired. >> eboni: comey could've made the constitution argument a year and a half ago. there are very few people honestly, if you take the politics outcome of that believe anything about jim comey. >> wouldn't you like to be the new fbi director? >> kat: anything then be the new fbi director. everyone is going to be expecting you to fail. >> maybe they will do a good job. they will do about their work. >> eric: i'm sorry that trey gowdy decided he didn't want the job. >> kat: because he has a republican background. >> eric: we had some breaking news. it's been a great hour. thank you both very much. thank the specialists from toda today, dom giordano and matt schlapp. much more ahead.
