We are told by sources at the white house that the president is expected to sign an executive order dealing with a lot of these protests that we have seen about defacing and trying to pull down monuments. The white house is moving with some speed and trying to get this done as quickly as possible. Though the text is still being developed. We do know that the president yesterday tweeted about and later talked about this idea that people who deface or otherwise try to damage federal monuments could spend up to 10 years in jail. Listen to what he said as he was leaving the white house for arizona yesterday. We are looking at longterm jail sentences for these vandals and these hoodlums and these anarchists. And agitators and call them whatever you want. Some people dont like that language but thats what theyre. They are bad people. They dont love our country. They are not taking down our monuments. I just want to make that clear. John there are new security precautions john up near the white house. The steel fencing used to create a perimeter for summits and other big events like political conventions reappeared blocking off one block north of the white house and now surrounding st. Johns church which had a small fire set in the basement two weeks ago by protesters. The fencing went back up after protesters on monday night defaced and then tried to pull down a statue of americas 7th president Andrew Jackson which really is the dominant feature there in Lafayette Square miss managed to stop the protesters from doing it. Here is what the president says he wants to see going forward. We believe in law and order. We support the men and women of Law Enforcement and why stand with the citizens in every city and every community. [cheers and applause] and every part of our country who wish to live in safety, security, dignity and peace. [cheers and applause] to that end, interior secretary David Bernhardt has asked the d. C. National guard to post about 100 National GuardService Members around the city of washington, d. C. To protect these monuments. Those National GuardService Members will be unarmed by the way we should point out, dana. We will hear more from the president on this and a lot of other things im sure, including the flynn ruling when he hosts a two on two press conference with the polish president andre duda. That will be 3 30 in the rose garden. We should point out president duda is going to be the first foreign leader to visit at the white house since the whole coronavirus happened. Ari, i made the point that there seemed to be no historian in the mob. I dont even know if they realize what they i dont know if they realize what they are doing. What they actually want. Mobs arent typically known for their thoughtfulness, are they . Its just rage. And as we saw in wisconsin, the rage now has been taken out on prounion people who wanted to abolish slavery. They are not safe, their statues. Look, this is lawlessness. And were not having a summer of love, dana. We are having a summer of violence. And people need to wake up and realize how threatening and how dangerous this is when the mob can do what it wants to do with impunity. I hope people stand up to them. What about a moment for joe biden to maybe stand up and show what he stands for in all of this. Absolutely. Where is joe biden . Where are the governors . Where are the mayors . Where are the police in these democratic cities . If you let mobs run wild and rampage and take down that which they want and engage in violence, we have a lawless society. Did you see mob activities . Did you see people tearing things down . If they did, the media would have hounded them. You are seeing a lawlessness thats on one side. Its not on both sides. Today in the Senate Senator tim scott of South Carolina put forward his bill. It has been shot down by democrats. They dont even want to come to the table. Ari, he offered to entertain any amendment and still they turned him down. Yesterday, Speaker Pelosi said this about the production efforts. For something to happen, they are going to have to face the reality of police brutality. The reality of the need for justice in policing and the recognition that there are many, many good people in Law Enforcement but not all, but so far they were trying to get away with murder, actually. The murder of george floyd. Dana which was so upsetting to hear the speaker say that she was asked about it today, are ay. Listen to what she said. Republicans are demanding an apology for that statement. Will you apologize . Absolutely, positively not. Dana thats where we stand after a month of bipartisan house reform. The speaker of the house the democrats accusing republicans of actually the murder of george floyd. This is a new tragic low. George floyds murder brought everybody together on behalf of a cause. That was to try to accomplish some level of reform at Police Departments where it was needed. And everybody condemned the murder of george floyd. So for nancy pelosi then to try to turn that around and accuse one side of murder . This is mindlessness in washington. No wonder that town cant compromise. When you have leaders like nancy pelosi who say things like that, you push the polarization. You cannot decry donald trump and polarization when you practice it yourself. Dana a big win today for President Trump and his Justice Department, a federal Appeals Court ordering the dismissal of the criminal case against the president s former National Security advisor Michael Flynn. Lets get right to the judge fox news senior judicial analyst Andrew Napolitano. Judge, great to see you. What does this mean right now for Michael Flynn . Is it over . Well, its about 99. 9 over. The reason there is that little window is because the former judge, john gleeson, who was appointed to defend well, to recommend and then defend what judge sullivan, the trial judge did, still has a window of time in which to ask the entire District Of Columbia circuit of appeals to take the case. So, the ruling this morning was from three judges on that court. There are 11 on that court. If six of them say we want to hear it, then there will be another appeal. I dont know that thats going to happen. If it happens, we will know about it within the next four or five days. But, if it doesnt happen, then this is over for Michael Flynn. Dana, this is not the reversal of a conviction this is an acquittal. This is a dismissal of the charges against him. Even though he twice pleaded guilty all of that is undone or will be undone if and when judge sullivan complies with the order of the Appellate Court this morning. Dana so, what kind of redress could Michael Flynn have . Can he sue the Justice Department for legal fees that he has accumulated over these years . Ordinarily the answer to that is no. So, if a defendant is investigated, tried, prosecuted and acquitted, the defendant cannot sue the prosecutors or the fbi agents who developed and brought the case against him. But, in this case, the documents of the doj filed said there was no good faith basis for the prosecution from day one. Where there is no good faith basis, then the people involved in the prosecution, lose their immunity and the go. Loses its immunity. And the only issue to be resolved is how much does the government Michael Flynn. Now, his legal fees up to the time Sidney Powell represented him. She is the absolutely marvelous lawyer from texas who took over the representation of him and began the process about a year ago that culminated today. Prior to her taking over, he was represented by a firm headed by former attorney general eric holder. That firm billed general flynn are you ready for this 6. 7 million. So the general can file an application for actually have a trial if there is to be one for that 6. 7 million as well as whatever he or whatever was paid in his behalf paid to Sidney Powell. And then that will be before judge sullivan and the issue will be were these legal fees reasonable and fair and if they were, then the feds you owe this money to mike flynn. Its an extraordinary case with an extraordinary ending. Dana and catch me up also on is there still an investigation into the origins of all of this . Like how this all started in the first place . We are still waiting for that investigation. As far as we know there are two investigations into the origin of this. One is a criminal investigation by the United States attorney for the district of connecticut appointed by attorney general barr. He is investigating whether or not any crimes were committed. A failure to have a good faith basis for a prosecution as wrong and horrific as that is not always a crime. Thats one investigation. The other is investigation of the Senate Judiciary committee headed by senator lindsey graham. The Senate Judiciary committee cant indict or charge, it can infer evidence that it has accumulated to the doj and the doj can decide whether or not it wants to take that to a grand jury. I have a feeling that we havent seen the end of this. The attorney general has been hinting that this prosecutor in connecticut may have some pretty heavy bombs to drop some time around labor day after the political conventions and before the president ial campaign gets going in earnest. Then there still is the chance, a very small chance that judge sullivan, the trial judge in the case, in the flynn case, may decide nah, im not so sure im going to dismiss this until i decided why they changed their minds. Bubba wallace saying he did not personally see the rope as it was discovered by his crew and later shown to him but insisting there is no doubt what it was. Its a straight up noose. The fbi has stated it was a noose over and over again. Nascar leadership has stated it was a noose. I can confirm that i actually got evidence of what was hanging in my garage over my car. Fbi says although the rope was tied like a noose. No hate crime was committed because video shows it hanging in the garage last year when was occupied by somebody else. Nascar releasing a statement, quote we appreciate the fbis quick and thorough investigation and are thankful to learn that this was not an intentional, racist act against bubba. We remain steadfast in our commitment to providing a welcoming and inclusive environment for all who love racing. This coming one day after every driver and their crews marked down pitt row in a support of wallace. Only black driver become the target of critics as he successfully pushed to have the Confederate Flag banned at events and has been vocal on social issues.
