>> that is a big question. the desire was to consolidate some other governmental agency's power into one bureau, that would have regulatory control over consumer financial products. the problem is, the power here is so concentrated in one person. unlike other agencies that are accountable directly to the president or some agencies that are made up of commissions of multiple members, you have one guy, richard cordray, who resigned on friday, it was all of the power. a court that has looked at that instant, that is too much power. in order to be accountable in our constitutional system, he has to answer to the president. that is the constitutional background about this agency. >> dana: does it also get money to run, not from the congress, but from profits from the federal reserve? >> that is right. the federal reserve pays the freight on the cfpb. congress does not appropriate funds directly like it does for every other agency. you do not even have real accountability to congress. there is no checks and balances on the system. the latest dispute is really another sign of that. >> dana: it president trump has said, my guy, mick mulvaney, whose argument senate confirmed, i will put him over there as they had. cordray before he leaves slides in this one, because the rules of from cordray's perspective says he can do that. do you think the law is on president trump's side? >> i think it is. and cordray it resigns on friday. he feels the job that has been left vacant for over two years. and then claims that that person can act until president trump actually gets a permanent replacement confirmed. this is like a modern war of the roses. two different directors are acting as if they have power. it is a question of, how do you construe two different statutory authorities. the department of justice hasn't taken the position that they do not conflict, the president gets to choose who gets to run the agency. even this weekend, the cfpb's own general counsel, we had great his own counsel, she agrees with trump. spill it let me about schumer. he said the cfpb it should be led by somebody who is committed to working to working around-the-clock on behalf of consumers, not by a part-time director who clearly is with the agency. he was looking at this from mick mulvaney and the congressman. listen. >> the place, it is a wonderful example of how a bureaucracy will function if it has no accountability to anybody. it turns up in a joke, and that is the cfpb, it has been in a sick, sad cutaway. very little you are elected to help you to protect you with overreach. >> dana: we have that. how do you get results? >> for the most part, yes, because today, we have the news that rand paul is likely to be a "yes" vote, and traders have been talking about it, feeling that optimism. the big picture is that they are betting on tax reform. they have been betting on it since last november since trump was voted in. we see the market go 18,000 now towards 23500. a new record in fact. everything is at records. i will tell you, goldman sachs has been putting out a bullish note, they put this out and talked about rational exuberance and if it passes, and they are bullish on this, investing financials. they are saying, the markets can move higher in 2018, 19, putting a target at the end of 2018. that is roughly again. most people expect a pullback, and goldman sachs, you may see a down arrow of about 5% by the end of next year, if we do not get the tax overhaul. people are betting on it, and you cd optimism. one record after another. the dow has about 20% this year. the economy, fundamentals, earnings. consumer confidence. shirley and tax reform as well. >> dana: one my favorite topics, shopping. tell me about the retailers. they are well-positioned for the holidays, and today is cyber monday. how's it going? >> you are right on point. that is exactly $6.6 billion. and that is a record we saw on black friday. they came in at 5 billion higher than last year's member of 3.3 billion. everything is doing great this month. we are seeing names like foot locker, abercrombie, more than 20%. walmart, gap, 15%. amazon, 8% this month. surely outpacing the averages. the s&p is up about 1%, just to give you some other details, how much are you spending? >> i do not think so. it speaks to a double standard that i find particularly troubling. at america rising, we do opposition research. this is exactly the thing that we would put before voters, before an election for them to evaluate. we do opposition research probably so that voters do not have buyers remorse at the end of the day. why should an elected official, someone in the public trust get any kind of special treatment, and ethics hearing, special training, counseling, something just because they are in elected office. in my opinion, they are not any kind of employer. they should be held to a higher standard, and this is what really troubles me about the entire incident. >> dana: apparently, there is not more to come about john al franken, but john conyers, and other reporters are chasing down leads, because there are more stories to come, perhaps from other sides of the aisle. how do you feel about this is staffers?
