there is a lot of accounting on how money goes through inauguration committees. there's all kind of money flowing around. this one had a hundred and $70 million. there is allegations now being investigated. >> there they are often removem the president-elect himself. it is not uncommon for people to make contributions expecting a photograph, nothing is wrong with that. if there were decisions made by officials in the white house, the president or anyone under him has a quid pro quo for some of these enormous contributions to what they're looking at. this started in april when the u.s. attorneys in manhattan, the same ones that were present yesterday when michael cohen was sentenced. they rated michael cohen's office and hotel room at the same time. that office was a couple doors down from donald trump's when he ran the trump organization. they probably discovered some documents in there that reflected what they believed were quick pro pro. michael cohen's m.o. has been, you want access to the president? pay me and i will get it for you. i'm not suggesting that the payments went to him. could trip this money and you will get this access. >> bret: he made more than $4 million in postelection time per inauguration time doing just that. talking to companies, individual saying, i can get you what you need. >> didn't he also run by saying, i know how politics work. there is a fee for access and transactions. he is proving the point. >> and "the wall street journal" report, there is apparently a recording between michael cohen and someone from the transition and that is part of this investigation started. shows you that this thing is just a field of different turns. >> bret: we have seen the recordings. >> the other thing i would say but that is at the transition responded, they haven't been asked for anything else. take a breath away to see how this plays out. we don't know. >> bret: there is a lot of take a breath. the president is pushing back on the campaign finance violation. he is pointing to experts here it is. he did not violate campaign finance law, neither did the presidents. he writes, feca. it specifically says that camping related expenses do not include any expenditures used to fulfill any commitment or obligation or expensive that would exist irrespective of the candidates election campaign. given trump's celebrity status and potential liability to these women existed, we respect the campaign, it is important how can michael cohen or anyone else involved be charged with a knowing and willful violation of the law by facilitating these payments were numerous campaign finance lawyers, federal election committees and commission itself have all said such payments do not violate the law the first place. it seems pretty clear that the federal election campaign act wasn't meant to cover what he has pleaded guilty to which is why the edward prosecution failed. john edwards he is talking about. judge, you disagree. >> he is has the foremost authority. if you make an honest mistake, if you receive more money from a percent on the law permits, if you make an expenditure and filter reported, you can return the money and correct the mistake. if you engage in sophisticated, deceptive substituted to hide the pavement, to make it look like it was a payment to a vendor rather than payments or someone who will say something negative that might impact the campaign, that turns it into criminal. if two people involved in the payments. both of whom say under oath, this was done in conjunction with president trump. this was done specifically to prevent an explosion in the campaign. one in august of 2016, it was already the nominee. one in october and 2016 come on the billy bush tape. it doesn't seem to be any question in the minds of the prosecutors, the federal judge that these payments were made to help the campaign that weren't reported. they came from corporations, they were far beyond what individual contribution could be. there is a least three crimes there. >> bret: not to ignore the seriousness of any of this. prosecutors have laid out the case. there is pushback. the president is tapping into that. >> at this point, i don't have the legal mastery here, my understanding is that the justice department cannot -- there can be a trying sitting presidents. it is a political matter. if the democrats believe this is impeachable, please go ahead. a look in view, it will be deliciously ironic because of course many democrats defended bill clinton when he was impeached for lying about sex. the echo here is too much. i think it also puts republicans in the same hot seat for hypocrisy. i don't think this will be what you can impeach him for. for two years we were talking about collusion with russia, this is not that and i think it will be very difficult to meet the political case, beyond that. >> bret: to your point, the cnn has a poll, should he be impeached? should not come at 50%, that has increased from september. look at independence which is interesting, it increases even more 255% should not be impeached. based on what we know now. polls are polls. speak out you democrats say? democrats want the president impeached. this is a pretext for impeachment, you have the mueller investigation. he produces this report, that will generate another push for impeachment. to his point, it is a political matter because unless you can get the votes to remove and convict in the senate which will not happen, unless there is mass affections, this is going to be an exercise in politics. >> bret: it seems that there is more to go in the mueller stuff. for all the folks who said it was wrapping up, doesn't feel like it. >> he keeps getting more evidence and more rapid holes to run down. some of the evidence he keeps for himself and develops his case against people whose names we can probably suggest, somebody passes to new york. the crowd -- for the prosecutors and new york are not political appointees, our full-time career professional prosecutors have seen far more aggressive in their pursuit of the presidents. they are the ones who reveal to a federal judge that they were investigating and that they had evidence and the orchestrated and paid for cohen's acts. they didn't have to reveal it. why did they?
