and women who use those weapons. >> reporter: the measure includes allowing veterans living more than 40 miles from a va facility to get outside treatment providing some choice and flexibility. >> i don't believe there will be a flight of all the veterans out of the system. but we don't know until we start this program. >> reporter: the scandal came to light in the spring when whistle blowers said they manipulated waiting lists to hide long delays and allegations that veterans died while waiting for treatment. it cost then secretary his job. >> the va is not sacred, the veteran is. that's the most important thing for all of us to r-. riot provides $5 billion to allow the va to hire more medical professionals and staff. >> we hope that with more doctors and nurses and space coming in, the va system itself will be able to accommodate more veterans in a timely manner. >> reporter: it would allow the vasek to hold incompetent senior executives accountable. >> this bill contains language which will allow the secretary to fire people immediately who are doing -- who are under performing, who are lying. >> reporter: there were times when it appeared the bipartisan talks were on the verge of collapse. all involved say this is not a permanent solution for the va. but the hope seems to be addressing some of the most pressing issues before lawmakers leave for august recess. >> mike, thanks. medicare trustes say slower growth in health care expenses last year has improved the program's long term funding outlook. the trustes say the fund will run out of money in 2030, four years later than previous estimates and in line with the latest figures from the congressional budget office. social security trustes say they will be unable to fully pay all disability claims binghampton 2006. stocks were mixed today. dow gained 22. s&p 500 was up a half. nasdaq lost five. obama administration officials are defending secretary of state john kerry's bid to secure a cease-fire a bid that failed over the weekend with an israeli rejection. the united nations security council is also calling for an immediate and unconditional truce between israel and hamas. as conor powell reports despite efforts to get another deal to the table the fighting continues. >> reporter: the law broken. the conflict resumed. hamas fired rockets across the border while israeli jets pounded gaza a brief calm in the fighting all but forgotten. civilians once again paying the price. explosions rocking a park and a medical building near gaza's main hospital today. both hamas and israel blame each other. at least ten palestinians were killed eight of them children. dozens more were injured. despite the international pressure to stop the fighting most israelis support the war. a poll by the jerusalem post newspaper said 86% of jewish israelis oppose the cease-fire. >> translator: there's no more just war than this one that our heroic sons fight. >> reporter: hamas remains defiant insisting on its conditions for a cease-fire. >> translator: our people lived under the siege of eight years. this is a collective punishment we need to lift the siege. we have to have an airport. >> reporter: any sign of possible expansion of the military operation israel sent text messages to residents in northern gaza warning them to flee the fighting. even though designated safe areas have proven to be dangerous. israeli planes drop leaf lets in gaza with a list of hamas fighters killed. they aim to get people afraid says this man. israeli soldiers continue to attack hamas' vast tunnel system. commanders say they destroyed 60% of the underground network. but hamas fighters were able to infiltrate into israel. both sides suffered casualties. four more israeli soldiers were killed in a mortar attack. secretary of state john kerry said the u.s. will continue pressing both sides to halt the fighting. >> we believe the momentum generated by a humanitarian cease-fire is the best way to be able to begin to negotiate and find out. >> reporter: neither israeli politicians nor hamas leaders are under any domestic pressure to wrap this war up. >> conor powell live in gaza city early tuesday morning. thank you. senior political analyst brit hume is here tonight with thoughts on this entire process. >> is it safe to suppress the rocket attacks from gaza israel has a couple of handicaps. one is the behavior of the people of gaza the other is the government of the united states. the late diplomat said of arabs they never miss an opportunity to miss an opportunity. gaza had an opportunity back in 2005 when israel ended its occupation there leaving that coastal region free to make something of itself. what it did was to continue shooting roberts into israel and in 2006 elected a terrorist organization hamas to run its government. hamas proceeded to turn much of gaza into a fortress in which to hide weapons and dig tunnels to sneak kidnappers and killers into israel. now it complains israel blockaded air and sea and land routes into israel. its critics say the blockade goes well beyond that. the current warfare follows the collapse of john kerry to broke ear peace deal between israel and the palestinians an effort that never seemed promising from the start. israel is ready to see this fight through. hamas counts on world pinto force an early cease-fire and lifting of the blockade. kerry tried to sell that idea to the israelis over the weekend. surprise. he failed. again. >> we saw the administration what looked like appeared to be walking back some of that deal after the israelis on a number of different media outlets criticized the cease-fire that they said almost undermine the egyptian cease-fire. >> the egyptian cease-fire is one that the israelis supported, hamas rejected. kerry flies in and ends up proposing if that draft can be believed and i think kit something that hamas wanted. exactly what hamas and its allies and qatar wanted. so unanimously rejected. you have to remember this. public opinion goes against israel worldwide but not in the united states. united states public opinion is about where it's always been in this conflict and as in previous conbe fli-- conflicts. the administration saying gee we didn't really mean that or didn't put it that way but that's what it comes down to. it's a blunder. >> up next missile. >> translator: the plane was destroyed by shrapnel coming from a rocket blast he says and went down because of massive explosive decompression. >> reporter: russia denies aiding the rebels despite the release of satellite images, the u.s. state department says show russian rockets being fired against ukrainian position. russia's foreign minister said such claims are part of a smear claim by the west against russia. he says more than 1100 people have been killed in the fighting in eastern ukraine. >> steve harrigan live in kiev. fighting in both syria and libya is intensifying tonight. >> reporter: syrian president of ramadan at a mosque in damascus after months of air strikes, assad's forces stand poised to retake aleppo in the north an event that would deprive syrian rebels that the u.s. supports of their last major enclave. assad's forces have suffered 1,200 casualties in ten days. losses inflicted by the savage and well financed jihadist army that now controls eastern syria and much of neighboring iraq known as isis. >> it's bad news for assad and bad news for the united states in that moderates are losing and isis is yuaning. >> reporter: u.s. aid to the syrian rebels those battling assad and isis has been piecemeal. >> the president will extend food and medical supplies to the opposition. >> i'll work with congress to ramp up support for those in syrian opposition. >> reporter: the rebels have long complained of spotty delivery. many on capitol hill fault the obama administration for doing too little too late in syria. >> after three years of not effectively getting engaged in a major way, you know the clock begins to run out and things happen on the ground. >> the right time to equip the moderate syrian opposition was well over a year ago. >> reporter: a former aid, secretary of state hecht rejects such criticism. >> there was no one sensitive moment in syria where the u.s. government had a slightly different policy or extremely different policy, the without come would have been different. >> reporter: in libya where u.s. military personnel helped to evacuate the american embassy crossfire between warring militias leaving many to worry that u.s. and nato ousted moammar gadhafi only to great a terrorist safe-haven. >> the international community knows not just the united states that these transitions take time. and we days and there's still no sign that anything will to be done about the surge in illegal immigration on the southern border. senior white house foreign affairs correspondent tells us tonight president obama and other democrats may be modifying positions. >> reporter: under pressure from immigration activists president obama had softened his push to change a law that keeps the u.s. from immediately returning child migrants from central america. the change was not part of a $3.1 billion emergency funding request that mr. obama sent to congress after initial indications it would be. potential 2016 presidential candidate hillary clinton told fusion turns v it's not on her agenda either. >> no. i don't agree we should change the law. >> reporter: both the president and his former secretary of state say kids should apply for asylum in their home countries even though mr. obama concedes most would be turned down. republicans believe the 2008 law requiring are the children get immigration hearings that can take more than a year to schedule amounts to an invitation. >> even his own homeland security secretary the 2008 law needs to be changed. we got to go make those changes and ultimately this is the president's responsibility. >> reporter: secretary jeh johnson testified earlier. >> what we have in mind is treating migrants, unaccompanied my grant from the three central american countries as being from contiguous countries. >> reporter: images of children clinging to trains have encouraged more americans to see them as refugees. aides said the president wants to give johnson more flexibility in implementing the law and wants more money to care for the kids and speed up the immigration hearings. >> we should not allow the debate around what should be included in that language to hold up something that everybody agrees is necessary which is additional resources. >> reporter: house republicans say mr. obama is looking for a blank check. they want the focus to be on border security. but just like their failure to pass comprehensive integration reform the child my grant issue is alienating republicans from hispanic voters. >> thank you. a federal judge here in washington, d.c. has struck down the district's ban on carrying guns outside a person's home. latest victory for gun reits activities. in 2008 the ban on hand guns was ruled unconstitutional. a federal appeals court says va's voter approved ban on same sex marriage is unconstitutional. the case is one of several that koend up in the u.s. supreme court. vians voted 57% to 43% to approve that ban back in 2006. the obama administration has finally picked a nominee for its top job on religious freedom. correspondent shannon broome is here tonight to tell us who it is and why some are already complaining. >> reporter: david sapperstein is a well respected scholar who is about to become ambassador at large for religious freedom. >> when it comes to the work of protecting religious freedom, it is safe to say that david sapperstein represents the gold standard. >> reporter: skeptics say they are worried about his views including his decision to author a letter to every house member in 2000 urging them to vote against the ban on partial birth abortions which became law in 2003. there are questioning his definition of religious freedom giving comments he made regarding the supreme court's hobby lobby decision which found the government cannot force corporations to provide cost free access to contraceptives company owners believe cause abortions in violation of their personal religious convictions. >> the real problem is the hobby lobby case. by giving religious exemptions to a broad category of employers, millions of employers in this country, and allowing them to make religious claims to discriminate on the basis of religion this is deeply, deeply troubling. >> reporter: dr. russell moore president of the southern baptist liberty commission said he's grateful the white house has nominated someone but has concerns about sapperstein's views. >> that's a troubling statement because it indicates that this is someone who doesn't understand what's at stake in the hobby lobby decision. hobby lobby decision is about the religious freedom restoration act, about government not being powerful enough to pave over the conscious of people in this country. >> reporter: more echos from what i heard from a number of senate offices, concerned about sapperstein but a willingness to give him a chance to explain. we'll tell you about a political race in which one requires many things. keeping up with your taxes is not one of them. the government accountability office say 83,000 defense department employees and contractors who are eligible for security clearances owe $730 million in unpaid federal taxes. that does not automatically prevent those people from having a government clearance but poor finances are a potential hazard because an individual may resort to illegal means to generate funds. republican senator tom coburn says it is not just about the money, quote federal tax cheats with security clearances jeopardize both our national and economic security and could unnecessarily put our nation's classified information at risk. the gao found that less than half of the delinquents are in a repayment plan right now. california is a big state. so big it needs four governors this week. right now california's acting governor is actually the state's lieutenant governor. yesterday elected governor jerry brown released his power before he left for mexico. tomorrow the leadershipcarousel leaving the governor pro temp. then the speaker gets the power for nine hours. the succession rules are outlined in the state's constitution. many states actually have similar procedures to handle a governor's absence. finally a michigan state senate primary is getting very personal. wayne schmidt has been endorsed by his opponent's mother who says schmidt is the better candidate. schmidt gladly accepted the endorsement quote politics can bring out many differences among friends and families. greg mcmaster said he wants people to focus on his record not on his mother who says he does not speak to, quote for voters politics should be about my positions, the votes i have taken, my conservative values. we are now inside the 100 day mark to fall mid-term elections but many people are already focusing two years down the road and the 2016 presidential election. it's hard to believe. but tonight the latest fox poll news results are out. carl cameron handicaps the field. >> reporter: his handling of the crisis of unattended central american minors have helped to lift rick perry to the top of the 2016 presidential candidates. jeb bush lost two points since april and perry has more than doubled his support fouling an actual tie. kentucky senator rand paul is third. new jersey governor chris christie is fourth. he's slipped five points since our last poll. firebrand texas senator and tea party darling ted cruz is fifth. measured against hillary clinton, jeb bush loses 13 points. paul comes up 11 short. christie gets closest trailing by ten. but as clinton wraps up her nationwide book tour her poll numbers don't slide. she still crushes other democrats but fallen five percentage points. joe biden dropped two. while massachusetts senator elizabeth warren and new york governor andrew cuomo both gained three points each. maryland governor martin o'malley brings up the rear. he's an over shadowed underdog and casts himself as a liberal to defends the obama agenda and battles the right. it only takes one person and then another to stand up and say enough. enough obstruction. enough wasted time. stop shutting down our government. and stop selling our country short. >> reporter: a dead last long shot despite of more than a year of campaign trips to early voting strips o'malley got a warm reception in iowa. >> it makes for a better campaign, you know, you don't want an anointed one. >> reporter: with her book tour wrapping up the clintons plan to spend the rest of the summer in the hamptons. senator cruz heads to the hamptons in august too not to hang with the clintons but for gop fundraisers. rand paul continues to ramp up, he's just hired a national political director. the first big gathering of iowa social conservatives of the 2016 presidential cycle is next week called the family leadership summit. it helped catapult senator rick santorum to a win in 2012. he'll thereabout along with mike huckabee. senator ted cruz, governor rick perry and louisiana governor bobby jindal. >> the corruption trial for former virginia republican governor bob mcdonnell and his wife began today in richmond. the mcdonnells are accused of accepting more than $165,000 in gifts and loans from the owner of a dietary supplement company. they have pleaded not guilty. the fighting intensifies in the world's hot >> the administration is still stuck in their bubble and thinks they are doing everything pretty much right and the media needs be more patient and let the president give him some space. part of the problem is look a lot of this is out of his control. the american public really don't want us to be involved in the world. a lot of the problems you showed there on the map go back to, you know, america's push to bring more freedom and democracy into the middle east, into the arab spring. there's a lot of unintended consequences evolved out of what's happening in the middle east and what happened frankly with president bush going to war in iraq. a lot of it spins out of that. yes i think the president should be doing a lot more but we can't look at that map and say that map is his fault. >> the difference between the u.s. being engaged in the world and in these different places and actually putting troops on the ground in these different places are two different things. >> that's true. i do think we have to remember the unintended consequences and the problems that we're seeing right now are because of too much aggressiveness on the part of the united states, i think. even if you take libya, for example, why did we overthrow moammar gadhafi again? it doesn't make any sense. we would go after gadhafi who had given up his nuclear weapons and was trying to play nice with the world and so now i'm not saying he was a great man but he wasn't -- it wasn't the kind of chaos we're seeing right now so we made that situation worse. in iraq we made things worse. saddam hussein a horrible man but christians said they had to flee because of the chaos there. we see what's happening with isis and the christian population. a lot of these problems are not things also that i don't know what president obama is supposed to do about them necessarily. that's not to say he shouldn't be engaged i'm just not sure what he's supposed to do. >> charles? >> look most of this is as a result of american disengagement and withdrawal. when you see what happens when america engages you wonder whether we shouldn't have more disengagement. look at the wreckage kerry has done in intervening in the israeli/gaza fighting. he decides he has to go, the israelis did not invite him. the egyptians didn't want him. he said he advanced a peace plan that was sort of building on the egyptian one. it didn't at all. it underminded it. there was a left wing paper that said kerry had dug a tunnel under the egyptian peace plan. egypt wanted a cease-fire in place. which means no reward for hamas starting this war by attacking the civilians which is a war crime. that was proposed before the ground incursion. the casualties would have been lower. israel accepted. hamas said no. kerry goes over and negotiates in paris who with, qatar and turkey and returns essentially as the lawyer for hamas, hands israel a proposition that is so outrageous that the cabinet votes 19-0 against it. israeli cabinets have never voted 19-0 on whether the sunrises in the east. it was unbelievable. it would have given hamas all of its demands. as a result -- there's one thing he doesn't seem to understand. there's a miracle happening in the middle east which is a tacit alliance between israel, egypt, jordan and palestinian authority of all people, saudi arabia, the uae, all of them are our friends who want to see hamas squeezed. the arab league supported the egyptian peace plan and this entirely undermine. it's a peace plain that all the arabs supported. if i can add one point. the palestinian authority leader attacked the plan and said what was kerry doing in paris negotiating can qatar and turkey and leaving out egypt. >> if you look at the jerusalem post poll about this cease-fire and the possibility of one, 86.5% oppose this deal. you were going to say? is it a lucien? we're back with the panel. kirsten? >> well, it's obviously a positive step when both sides of congress can come together and do something. i think this is for a good, you know, good cause. i do have to question whether this is enough money. it's hard to believe that we have talked so much about all the problems that face the v.a. and they seem to be so endemic. and it just -- it seems like somewhat small amount of money i think to tackle such a big problem. >> the overall budget for the v.a. is -- the obama administration has increased that budget and yet these problems expanded. so, some people would argue, ron, that money is not the issue here. >> actually this is a case where i would take that argument up. i do agree it's a good thing. these jokers finally got something done. pat them on the back and send them home on recess. this is a huge systematic problem. i was looking for big reforms. this is not going to be able to be handled with a few billion dollars and, let's let -- have a little bit of freedom in spending. we have a look at things like and i don't know if this is something i would support down the road. we at least have to look at things like full vouchers. too we need to have all these hospitals and all these guys for these hospitals. should we make it easier for them to take their money where they need to go. not just nibbling around the edges here. >> there are some things in here, charles, that the success is measured by the quality of the care and not that you are on a line. that senior officials can be fired by the secretary. those are steps in policy that are changes. >> i think it's a very good stop gap. you have to do something now. although, i have to say i love the bill where $2 billion for miscellaneous. i wish i had a budget like that. miscellaneous 2 billion-dollar. the 10 billion for the voucher which is called the veterans choice card where you go to any hospital to get cured. i think is a brilliant idea. the pouring of a billion into more doctors for a system that is corrupt is not a good idea. i would pay the price in order to get the bill through. but i really think the one thing you need here and i hate to say you wanted to study, but and i'm with ron on this, that you really have to have the idea that we are going to abolish the system. you take all the hospitals. you you -- you are not going to tear then down, you turn them into regular hospitals, open to everybody. you voucher rise the system and you see can't get the kind of efficiency that you get in normal hospitals because, also, it's obsolete, you really want veterans have to drive halfway across the state to get to some place particularly in the west when you can have them, use local facilities. so that, i think, ought to be the multi-mat objective. >> real quickly, what is about this system of fire to do their jobs right? >> this is not just the v.a. >> the state department, many places have said they had issues with various things and they couldn't fire people. >> very strong union guy but we got to be able to fire people. >> quickly. >> need that $2 billion for miscellaneous for firing. >> quickly, are they on a roll?
