Today, just 20 miles from the crash site, theyve taken down a pair of fighter jets. Investigators continue to work on the badly compromised site for more clues. And all of this as the remains of victims are beginning to return home. Ed henry looks at a president nearly six years in whose leadership credentials are under attack. But we begin with steve herrigan with the latest. Hi, steve. Brett, the rebels have shown once again just how dangerous the skies are over Eastern Ukraine. Less than 20 miles from the wreckage, russianbacked rebels shot down two more aircraft today, both ukrainian fighter jets. One pilot was killed, the other ejected, his fate unknown. The rebels have shot down as many as a dozen Ukrainian Military jets and helicopters since fighting began in april. The pentagon refused to confirm reports that ukraine had previously asked for help in jamming antiaircraft systems in the hands of the rebels. In the wake of this months losses, they are expected to express their case in washington with help for electronic warfare. The fighting occurred as the first bodies for Malaysia Airlines flight 17 finally made it out of ukraine. The first 40 bodies in simple wooden coffins were met by honor guards, the military air base in the netherlands and taken away in individual hearses before a silent crowd of mourners still unsure if their loved ones had come home. They want their children back, thats important for the family and the friends. For everyone. It will take three days to fly the recovered bodies back from Eastern Ukraine. Identification could take anywhere from days to weeks depending on dna, dental and hair analysis. Forensic specialists will then determine how many, up to 98 victims still remain at the crash site. Even reaching the site has proven impossible for Many International experts due to security concerns. Brett . Steve herigan live wednesday morning, rather, in ukraine. Steve, thank you. Our new fox news poll shows nearly 6 out of 10 voters say the administration has not been competent and effective at running the government. As chief White House Correspondent ed henry reports, the president s taken heat lately for how hes managed to continue fund raising for democrats amid major Foreign Policy challenges. Reporter as the trouble in ukraine deepens, there were no interruptions to president obamas schedule as he continued day two of a threeday westcoast fund raising swing. And republicans stepped up their attacks claiming hes not paying enough attention to a range of crises from dealing with russian president Vladimir Putin to the escalating violence in ghana. And the president should be in charge and he should be in charge in substance and appearance and flying around to fund raises does not look like a man whose total concentration is on this. White house officials publicly say the president is always in contact with his National Security team and key world leaders. Privately say hed look panicky by adjusting his schedule to every crisis. A harder case to make, though, when even senior democrats like senator Dianne Feinstein are raising questions about his focus. Im not going to tell the president what to do. But i think the world would very much respect his increased attention on this matter. And i think there ought to be increased attention. While House Democratic whip steny hoyer asked about the midterm elections today told reporters, quote, the fact that the president s popularity is not as high as we would like it is a factor. That struggle is apparent in a new fox poll that shows disapproval of the president s handling of the policy has hit 56 , although approval has inched up to 36 from a record low last month of 32 . As for the president sparring with putin, the new poll finds 75 of americans believe the russian president has the upper hand in ukraine while 14 believe mr. Obama does. For a president who doesnt like photo ops, the photo ops of fund raising when we have israel in crisis, kids coming across our border, russia shooting down an plane that has an american as a casualty, its unacceptable. Democrats say its the president s critics whose priorities are off. They even went off obama the other day, the republicans did, for eating a hamburger. You cant attack him for everything and have any credibility. Though the president went down that road himself last night at a fundraiser in seattle when he charged that the far right of the Republican Party has, quote, gone off the rails. Though the president added to the crowd, quote, i will say im not overly partisan. At that fundraiser, the president took a shot at the media saying he doesnt watch the news, quote, whatever theyre reporting on, i usually know, which raised some republican eyebrows given how many times the president has said he learned about various controversies from the news. Brett . Ed henry live on the north lawn and thank you. In the middle east, the death toll mounts in this, the 16th day of the Israeli Palestinian conflict. Israel is balancing an expansive offensive. Nonstop launching of rockets. This is International Efforts to negotiate a ceasefire appear to have stalled. Connor powell in gaza city. Israel today released video of an air strike on the hospital in gaza. A site they say hamas used to store rockets as well as a military in command center. After warning doctors who removed the patients, israeli jets destroyed the building. Proof israel says of the lengths it goes to protect civilians and of hamas disregard for them. This comes one day after hamas rockets were found for a second time at a United Nations school in gaza. Still, this afternoon, the United Nations Human Rights Commission while condemning hamas also launched an investigation into israel conduct during the war. Saying they had not done enough to protect civilians. This air strike on hamas and Islamic Cultural Center that killed one man walking on the street and injured dozens is the type of incident investigators are looking into. The target was clearly this building, but the damage, well, its everywhere. As the death toll mounts on both sides, secretary of state john kerry arrives in israel and hopes that brokering a ceasefire. Kerry says while some progress has been made toward a truce, a lot of work remains. In the last days, we have been talking about how to achieve an end to the current violence in an effort to try to not only have the ceasefire, but build a process that can create a Sustainable Way forward for everybody. Both sides have specific demands for a ceasefire. Hamas wants israel to lift the eightyear blockade against gaza while israel wants a permanent end to hamas rockets. Neither side seems likely to yield to the others demands. In gaza city, connor powell, fox news. Another commercial plane crash today. Today the irs commissioner returned to capitol hill to field questions from frustrated lawmakers. On capitol hill with the story. Irs commissioners fourth appearance on the hill comes days after stunning revelations uncovered by congressional investigators. Thomas kane told him that the hard drive never crashed but rather was scratched and that some data was likely recoverable. He said the irs knew it in february. Yet only revealed it in june. He said he waited in part so as not to interfere with the investigation. He told me that he did not want us interviewing any witnesses. Republicans werent buying it. I find it vexing that once the i. G. Is involved, nobody else can do anything. That is not supported by the law. Can there be a criminal investigation while theres an i. G. Investigation . There can be all sorts. What i was talking about is there can be a congressional investigation while theres an ongoing i. G. Investigation also, correct . Of course. And they dont tell you and you can come in front of congress four times and not disclose that. And when you do learn in april, you can wait until june 13th that is what the no wonder theres morale concern and a distrust. That is unbelievable. Democrats reject what they believe is a gop fishing expedition. This is unseemly embarrassing, and not a way to spend millions of dollars in taxpayers funds. Morale has plummeted at the irs because of repeated congressional document requests. Workers fearful theyll be summoned to testify and provoked dueling reports from a deeply divided committee. It takes a lot to stun me, but that stunned me. Well keep going until morale is improved. And if she was in the business of trying to hide things, she wouldnt have written 43,000 emails. Securing the border in light of all the illegal immigrant children as well as the potential Foreign Terrorists and gang members is just not an american issue. Far from it. Correspondent looks at how other countries handle a surge at their border. Reporter the u. S. Isnt the only country facing a flood of Illegal Immigrants. People from africa seeking refuge in italy soared this year forcing the italian navy to rescue thousands. In greece, protests over tougher immigration policies, illegal arrivals jumped 142 this year. Yet of 8,000 syrians seeking asylum in 2012, only two of them received it. Bulgaria recently installed a 20mile fence on its border with turkey, cutting arrests from 2,000 a month to 300. The e. U. S Border Patrol supports the fence, but it denies refugees access to europe. The u. S. Actually looks pretty good by comparison to some of the things we see around the world. The Transborder Institute says unaccompanied minors should be detained as a last resort and appointed guardians as soon as they crossed the border, a policy practiced in canada but not europe. France has gotten in trouble for housing kids at airports for long periods of time, spains gotten in trouble for not having a special facility for detaining children. Uk has been challenging juvenile asylum claims. In france, Overcrowded Detention Centers force many immigrants to live on the street. In australia, immigrants are held in offshore Detention Centers for up to nine months. And unlike the u. S. , unaccompanied minors are not reunited with parents or relatives. In 2005, the u. S. Findings from a new gao report that show an alarming lack of oversight in handing out subsidies. Heres chief national correspondent. Reporter in an explosive report, the Government Accountability office says it went under cover applying for subsidies through the federal exchanges online under 12 fictitious names using invalid Social Security numbers or inaccurate citizenship information, 11 of the 12 were approved. We used fictitious identities, false information and forged documents as well as instructions from the marketplace itself to circumvent its front and back end controls. It is a crime to submit false information, but this undercover operation shows just how easy it is to get subsidies under the federal exchanges even with a contractor watching. This contractor is not required to look or detect look for or detect fraud and accepts documents as authentic unless they are obvious alterations. Senate seats that are potentially vulnerable for democrats that republicans hope would change the balance of power in washington come november. Tonight, our look at New Hampshire. Former massachusetts senator scott brown is the leading republican and political experts here say its almost certain hell cruise to take on the democratic incumbent. Gene shaheen is leading by 10 1 2 points in the average of polls. Brown insists once republicans unite, the race will be tight. Former senator scott brown has done come from behind grass roots campaigning successfully before. This time, hes using his same truck, but this time, its in New Hampshire. And this time hes facing an incumbent senator and former governor of the state with a family name long tied to New Hampshire politics. Gene shaheen. He would not talk to us despite repeated attempts. So we sat down with brown and attempted to find time senator shaheen has addressed the same issues publicly. One issue, but not only that the businessman date coming in after the election. Youre finding with businesses and individuals that their rates have gone up, coverages have gone down, their lines have gone longer, and the time to get there has gone longer. Countless families and businesses dramatically hurt by this, obamacare. When she was a governor, she actually changed the law, went from 26 down to 1. Theres no competition. Competitions an issue. And also, 10 of the 26 households are actually outside the network. Yeah, its a huge issue. People are very upset about it and want the ability to hold those responsible accountable. Health care costs are beginning to level off. And were seeing insurance rates being released today that will show a decline for people across this country. This is an economic issue. Its about the future well being of our families and the future well being of our country. And we are not going to let anybody defund the health care act. The liberal Group Families usa is an obamacare and jean shaheen supporter. I dont think shell run away from it. And her opponent, scott brown has difficulties of his own. Hes got a very clean mind. Hes been changing it a number of times. He supported the predecessor to the Affordable Care act, romney care, which is the model for the Affordable Care act. And even though theres angst in New Hampshire, you dont think jean shaheens going to have trouble . Whether you like it or dont like it, a clear majority do not want to see this repealed. They want to see it either continue or fixed in some specific ways. Would you have liked to see the president go to the border to get update firsthand . You know, jack, im not going to weigh into that. Thats a partisan political debate thats happening right now. I think whats important is we have a humanitarian crisis on the border with children and families who are fleeing violence in primarily three Central American countries. Right. Guatemala, honduras and el salvador. And thats based on activity thats happening, gang activity, drugs activity. So we have immediate problem in trying to address that humanitarian crisis and trying to make sure that those children are taken care of and that we can reintegrate them back into the country where they came from. Do you think they should be returned at some point . I think unless there are unless they can show they are refugees in danger of immediate threat that, yes, they should be returned. But longterm, we need to fix our immigration system. She wants these kids to stay. In favor of the dream act, in favor of amnesty. They want independent leadership where someone is not going to continue to chip away and tear away at our rights and freedoms. You said she wants them to stay . She absolutely wants them to stay. And what do you want . I believe they should be obviously cared for and put back to their country of origin. We have a system, a mechanism of people being persecuted they can go through those channels. When the president said, oh, boy the way, taking these dream act kids and putting them ahead of the millions of people doing the right thing and basically said to the rest of the world, dont worry, get your kids here and once they get here, theyll be okay. Sending that message out, she supported that effort. Adults working fulltime cannot support their families on the minimum wage. And that needs to change. The fair minimum wage act would increase the minimum wage to 10. 10 over two years. That would provide raise to nearly 20 of New Hampshires workforce and lift 10,000 people in New Hampshire out of poverty. We have the highest Corporate Tax rate in the industrialized world. We have obamacare coming in on the businessman date. Youve got energy costs that are going to be out of sight this year. The lack of regulatory intact certainty and then you have the state and local taxes and regulations. By the time its all over, now youre going to throw increased minimum wages. The Business Leaders need to be at the table before we make any of those decisions. Would i be open providing the folks are at the table. Is 10. 10 fair . As a result of the hobby lobby case, some employers have the ability to claim religious objection as a justification for not providing contraceptive health care with no copay. Where a woman works should not determine whether she gets Insurance Coverage that has been guaranteed to her under federal law. We never wouldve had the hobby lobby decision come forward if it wasnt for obamacare. Imposed on people of faith as a result of obamacare. The Supreme Court issued a narrow decision, hobby lobby as you know is providing certain types of contraception. Its a question of who is going to pay for the remaining . Then the federal government has to find a way to pay for it. As ive said, i support contraception. I believe women should have the ability to get whatever they want and do whatever they want with their bodies. I have a house full of women, one of my daughters got married, another one is getting married. So to think i dont care about women is obviously a lie. That being said, i think obamacare actually hurts women. Runs in New Hampshire versus massachusetts. A couple of times people have hit you for saying massachusetts instead of New Hampshire. Is it a problem running in New Hampshire instead of massachusetts . They take and do things and twist things. I get it, its politics, im a big boy. I have long and strong ties to our state. People dont talk to me about where im from, they talk to me about where im going. We have a dysfunctional washington, our Foreign Policys a joke, our economic policys flat, our Energy Policy is nonexistent. We are in trouble right now. People are upset. Thats whats driving the rice, the ability and desire to take back our state, the country, the senate. All the bills on harry reids desk and make him the minority leader and put them on the president s desk and right the ship a little bit. The irs commissioner answering questions about this hard drive, whether it was scratched, whether lois lerners emails were retrievable or not. What about all of this . Lets bring in our panel. Senior writer for the weekly standard, the associate editor of the hill and syndicated columnist Charles Krauthammer in brady bunch boxes tonight. Steve, what do you think of all this . I think he had another tough day on capitol hill. We would expect that. Particularly answering questions about why he didnt notify members of Congress Earlier about these developments with lois lerners emails. But the most Important Development may have come after the hearing when he was talking to reporters and in effect became a character witness for lois lerner. Look, if she was hiding emails, she wouldnt have produced or written 43,000 emails on her own saying suggesting that he knows what she was doing that she didnt do that. I think thats a very dangerous place for John Koskinen to go in effect defending lois lerner, particularly because weve got emails we know that lois lerner was, in fact, trying to keep things from congress. Makes you wonder why is John Koskinen going beyond defending the irs as an institution, going beyond answering questions truthfully and defending someone like lois lerner. Doesnt this get increasingly sticky for the Obama Administration and the irs . This has become a side show. If you look at the descriptions coming out of the irs about what happened to the emails, first the computer crash then a recycling event. Then maybe they were scratched or shattered. I mean, really sounds like a bunch of frat boys a the the bottom of their keg at 2 00 in the morning. John koskinen came in as a cleanup artist, someone with sterling credentials as a management expert and made a fool of himself in these in this testimony. At one point early on did not know about the fact that the emails were lost. When he later learned, he did not inform congress. Today he basically said i dont ask questions about this stuff, i dont look into it. His job as steve points out to defend lois lerner and make explanatio explanations. His job is to find out, ask the tough questions and clean it up. Thats exactly what hes not doing. All right. So charles, heres the question, how many people are paying attention to this . I guess the question is also, is the media paying attention to this story as it continues to develop . Take a look at the number two on our poll. The question about the treatm t treatment, fair treatment by the irs. The question reads, how competent is the Obama Administration in managing fair treatment by the irs . Very to somewhat, 45 , not very not, 49 . Well, tells you that the story has penetrated. Its not, obviously, as hot now as it was a year ago when it first when even the president had to express outrage and to fire the acting director and pretend this was an awful thing and, of course, few months later he says on the air that there isnt a smidgen of corruption. But i do think right now with the volume of crises around the world, ukraine, the middle east, and everything the border, its now not obviously the number one issue. That doesnt mean it isnt important and isnt sustainable. As long as theres new information, and theres got to be because were hearing from the irs witnesses especially from the director is sort of the strategic uses of ignorance. He says i dont know this, i didnt know that. And, of course, and then the deliberate ignorance by saying, you know, as long as the igs investigating, we cant touch this. This is the classic response in coverup where you say theres an ongoing investigation, ive got to stay out of it. That works on some stuff, but ultimately, i think this stuff is going to come out. Down the road, special prosecutor or not . No, not with this administration. I dont think so. I dont think you could rule it out at this point. Were getting so much more information at a certain point, i think the levee may break. Next up, the crisis in ukraine and Foreign Policy in general for this administration. And he doesnt think that this president has taken this crisis seriously. I think he has good reason to come to that conclusion. A. B. . Well, i dont think there is anything president obama is going to do, militarily that will be supported by this country. If you look at recent polls over the last just week alone, you see americans thinking that we should be doing less to counter russian aggression, which is really quite stunning. President obama has to use rhetoric or sanctions. He has tried on his own to use sanctions. He hasnt gone far enough, of course, with what they call sectoral or level three sanctions that would really really hurt. He was on the phone with president putin, the day that the airliner went down. Because putin was be upset with what he sees as another step towards painful sanctions. He cant convince the europeans yet to get on board unless he changes our Energy Policy. Its hard to imagine how he is make putin hurt. It looks like with two downed jets and insurgent admitting today they did have the the buk Missile Technology putin will do whatever he wants. President obama should not be at fundraisers. Putin watches that too. Frankly until the europeans get on board, i think his hands are tied. Charles, i want to turn to you israel and hamas the gaza strip. The u. N. Sect, the expression of outrage, shocked, shocked to discover there are missiles in the u. N. School is preposterous. How do you smuggle 20 missiles into a classroom . Can you imagine the principle in the u. S. Saying well, i really am not sure how they got there. What did hamas do . Put them in a golf bag . Walk them in and say he is preparing for the gaza open . The u. N. Workers have collaborated with hamas for years and years. They know that there are missiles in the schools, in the hospitals, in the mosques, and they know whats going to happen. Kids will be killed and thats going to be on television. The seax general complains that this was smuggling into the schools. The problem isnt smuggling. The problem is that the use of human shields is a violation of the fundamental law of war. Thats whats happening and the u. N. Is aiding and abetting. Another thing charles raised eyebrows at the u. N. Today. That is that ban kimoon is flying around for emergency meetings on a plane funded by cut tar, the country of cut tar which a lot people know is a supporter of hamas. Why would the u. N. Take the plane provided by qatar . Because the u. N. Doesnt even care about appearances anymore. The bias it has against israel, its Human Rights Commission today said was going to open an inquiry into the Human Rights Violations out of the israelis when the ones, the use of human shields, the rocketing of innocence is what is happening on the part of hamas. We hear almost nothing about that. The u. N. Is so committed to the palestinian cause and in this case the hamas cause that it doesnt even care about appearances. And after all, who, but you, and a few other outlets are going to report it it how many have reported the rockets in the school . I dont know. But its not many. I guarantee you that panel, stay tuned for some thoughts on the New Hampshire senate race. We have you weigh in from washington. Im here in concord. Stay with us. Cloudy night in concord as we are back with our panel. One of the senate races that could tip the balance of power in washington. What about scott brown . He still has to get through a primary september 9th. Evan think hes is going to do that easily here. Then he faces jean shaheen thats a bit of an uphill battle. Recent polls suggest that its going to be a quick challenge for him. One obamacare. Number one issue, how he talks about it will be very important. Yesterday, after the ruling came out he put out a statement lamenting primarily the loss of the subsidies which is not an argument that i think will resonate well with the National Mood and how that goes. I think he will benefit from that. All right, a. B. . Jeanne shaheen is a former governor and she has done all the care and feeding that not only an incumbent senator does but a governor, i dont know, a republican who thinks that scott brown is a good candidate or is going to win in november. All right. 10 seconds, charles . She is ahead on the fundraising, almost 3 million last quarter. He took in only 2. Its hard to run from out of state unless you are a Bobby Kennedy or a clinton.
