deck this afternoon, the uproar over the senate's report on cia interrogation tactics is starting to go global. even china is weighing in. and warning the united states to correct its ways. china's foreign minister claims the u.s. has a double standard for allowing the harsh methods by the cia while at the same time accusing china of violating people's rights. and north korea is joining the pile-on. the government-run media is comparing the cia's interrogation tactics to the killings of unarmed black men by police in ferguson, missouri, and here in new york city, and no, you no wrongdoing was found on the part of the officers as grand jury did not a indict them. of course in north korea, police kill citizens on a whim. millions of people are starving and thousands work in forced labor camps. the report from the senate democrats outlines the cia's enhanced interrogation program in the years following the 9/11 attacks, describing waterboarding and sleep deprivation, detainees slam against walls and stuffed inside boxes the size of coffins. katherine herridge has the news in washington. the new global response and what is the response inside d.c. >> the cia directors a seesment that interrogation led to intelligence of osama bin laden has clearly struck a nerve. >> it was information obtained scent to the application of eits from detainees that was useful in the bin laden operation. >> the democrat-led senate report found the opposite with senator diane feinstein's office live tweeting their rebuttal to the news conference, including critical intelligence that led to bin laden was unrelated to eits, that is short hand for thens hansed interrogation tactics. and another more forceful rebuttal. study definitively approves eits did not lead to osama bin laden and the lawyer for one of detainees, who was part of the cia program, amar'e belushi, has said his client has forth given his interrogators and does not hold a grudge because he saw the suffering that they went through as well as part of that program, and he is important because he is said to be the person who first tied the courier who lived with bin laden at the hideout. >> that's a new detail. it brings me to the question, where are the supporters of the cia on this? >> well, as you know, harris, the cia director yesterday offered a more nuanced assessment of the program and the connection between the waterboarding of al qaeda operatives and the information that they provided. but a former cia officer who has first-hand knowledge of the program told fox news that the architect of 9/11 produced more than 2,000 intelligence reports while in cia custody and he became in effect a walking encyclopedia of al qaeda history, and today the outgoing chairman of the house republican intelligence commitee weighed in on the position. >> the toe say it's unknowable, we know there was certainly the events that happened and information that was gleaned that was later used in everything from fully understanding and being able to put pressure on al qaeda, to -- >> certainly the hope at cia after director brennan's comments was that would effectively put the discussion to bed, but based on the guests on the sunday talk shows this seems unlikely and the story will run at least for another week, harris. >> catherine herridge, thank you very much. let's bring in chris wallace, good to see you. you know, bottom line first of all, people i'm talking with say they're very concerned with national security after the release of this report. we haven't heard any new information yet with regard to that. where do we stand on that? >> well, there are two aspects of this. first of all, as reported, china is tweaking us about it, north korea is tweaking us about it. it is kind of interesting coming from them as defenders of human rights, but that's no big deal. you always expect that when they hear the kind of discussion in the united states that you could not hear in their countries, they're going to take advantage of and it say this shows the u.s. shouldn't be preaching. much more dangerous and more worrisome is the concern in the intelligence community, also secretary of state kerry, who before the report was released, spoke to the chairwoman, dianne feinstein, that this may lead or inspire new attacks, retaliation, because of the actions we took against some of these terror suspects and also the possibility -- and this we may never know -- whether or not some of the informers, the agents we had on the ground, our assets, were -- even though they were given pseudonyms in the report, whether people can identify them and whether they will suddenly disappear. >> being able to triangulate descriptions of places and things, trying to figure out who was in the room. i get that. that brings up something else about people who were actually there. this back and forth about whether or not we really learned anything from the interrogations, interesting, because as i understand this report does not talk to anybody, not interview one person, single person, who hullly did the interrogations. is that true? >> that is entirely true. they did solely from documents. they didn't talk to anybody. and i have to say i think this is one of the weakest parts of the report, because the claim they made when it was pointed out there were three directors of the cia during this period of time, three deputy directors, not only weren't the interrogators interviewed, even the top guys testifying before congress, none of them were interviewed by the staff for this report. the argument that was made is, well, there was a justice department investigation going on and we didn't want to interfere with that. the problem with that is that the justice department investigation ended in 2012, when the decision was made by attorney general holder that they would not prosecute anybody. this report was just released in 2014. they had two years when there was no justice department investigation to interview cia officials. they didn't do so. >> interesting. and of course, there's been a whole lot of talk about the timing of this and the politics. i want to get to this, though. i wonder, what is the takeaway for just regular americans? i don't know, my dad, who served, and other military vets, military personnel around the world, who are watching this dire discussion about how we protect the rest of us go down. >> well, look. i don't think it's a bad conversation to have about what limits should there be to the kind of interrogation we do. whether -- you can argue whether legally or not but this certainly goes up to the edge of torture, some people say it was. reasonable people can disagree. it did have legal backing from the justice department. that's a sensible conversation to have. concern that people in the intelligence community and who are making the key decisions at the time is this seems to be second-guessing, 20-20 hindsight from the vantage opinion of 2014 when we're feeling less scared about al qaeda, about decisions being made when we were scared to death about al qaeda in the immediate aftermath of 9/11. in 2001, and are we throwing people who were doing simply following orders and doing their best to defend and protect the country, are we throwing them under the bus? >> well, it's a start. we get about 90% of the state's moisture in december, january, and february. as you said the soil can only handle so much. a lot of the rain you saw is going to end up in the ocean. it will recharge the ac we -- ac question fir but the key is the snow pack. a foot of snow near los angeles, a lot more in the sierras and that is the snow bank or the water bank, if you will, for california. that is where we get 75% of our water so this is a beginning but basically living up to our reputation here, the sun comes houston, dries up all the rain, and you know the next verse. back to you. >> our hearts are with those people out there. we're hearing of yet another plane forced to land because of an unruly passenger. this time an airline is reporting a woman threw a cup of hot water at a flight attend adapt's face and it purposed her. the flight was headed from bangkok to eastern china. the pilots had to turn around and land. the woman apparently was angry because she wasn't seated next to her boyfriend. later on that flight the boyfriend reportedly threatened to bomb the plane. the captain and crew reportedly spoke to the girlfriend at the airport and reached what they're calling amicable conclusion. we reached out to the airline for a statement. still waiting to hear back. man on trial for murder after he shot an exchange student in his garage. the suspect claims he feared for his life. now police are shed something light on what they say was really going through the man's head as he fired shot after shot after shot. why couldn't he have just called the police then? >> why do prosecutors feel like they have a case in all of this? if what you're telling me is set a trap, whatever, still the 17-year-old had to go into that place. >> exactly. but one of the things the prosecutor says he may have created the situation so that you can then go in and have the sort of game. witnesses say that kaarma says, i see you there, and started shooting at him. so they're also challenges to say, why didn't you call law enforcement? law enforcement would have been there a few minutes. you're already in your home. if he had been -- if the 17-year-old had been attempting to get into your home, it's more logical you would take deadly force. >> a couple of things coming to right as the trial is going on. the family hosting the german exchange student has spoken about what a great young kid he was. friends described wonderful things about him. they also have a phone call that was recorded while kaarma was in custody, made to his common-law wife. on the call, he said, everyone should rejoice that our neighborhood is safer, expletive. idiots, he added. and then there's some other things in that call. what catches your eye in all of this and what can be used in court. >> all of it can be used in court if they feel he somehow acknowledged that he knew this kid may have been unarnold and wasn't in fear. the fact you have the calling them fing idiots, you have to start to question. this isn't a joke. a 17-year-old died here, and even if there doesn't -- anything that is specifically implicates him in the crime, it's the type of callousness that the prosecutors want to demonstrate. >> one more line from the taped opinion call that he says. quote, see the leaks on the faces when i say homocide. he is telling his wife what the other people are saying. there are no other murders in here. >> he's proud of being a murderer? almost sounds like that. they're fearing me now. you can almost see him pounding his chest and saying, i'm a murder irer now. there's no badge of courage for that. >> isn't it hard to prove what is in a man's heart? >> that's a great point and that's where the defense can step in and say you have no idea what he truly felt. i he reasonably believed his family or he was in fear of imminent harm or death, he could then use deadly force. that's the biggest challenge for the prosecutor. >> where do you think this is going? state hillary clinton. good to see you today, ambassador. >> good to see you. >> this is sickening. really sickening. i want to get your thoughts on this report, and then you have some ideas that i'll ask you about. >> yes. i think it's a reminder to all of us of who isis is. they respect no limits. they reject the other. they are convinced that they hold the absolute truth, and anyone, including other muslims who don't accept their version of the truth, is a nonbeliever, is an infidel and can be put to death or in the case of women, can be their property. this is who they are. and they succeed when they create an image that somehow they're invincible and the challenge for us to demonstrate they represent nobody, their ideology is unacceptable to anyone, and should be unacceptable to anyone, and that basically they're doomed to defeat. they don't represent the wave of the future. they represent one more failed ideology and there's is completely unacceptable and intolerable. >> with all due respect that's a lot of words and we have seen a lot of things fall out of the sky. what we haven't seen is something that will stop these guys. what is that? >> i think the thing that stops them is proving that what they say they are is obviously not the case. they claim to be on a divine mission. they claim to be divine messengers. and yet earlier in your report you talked about talking to a captured isis figure, who claimed to have killed 70 people. well, by definition he was captured. one thing that we need to succeed is not only to impose defeats on them, which by definition means their disvibe mission isn't working, but if they really are divine messengers they wouldn't surrender at all. i we can show pictures of them surrenderrings with their hands up it exposed them for who they are. this is a failed ideaol and in fact they aren't representatives of god, they don't have any kind of divine strength or mission and we can prove them to be something other than what they claim to be. >> fighting ideology with ideology. that can take forever. i have another question. >> that's true. >> this one might be very difficult because it comes not in a vacuum but a time when the senate intel report on interrogation tactics by the cia has been made world known. and so much is known about what the decisions were after 9/11. if you could capture one of these guyses we have, what's appropriate, then? because when you hear about what those people are doing to get people to talk, what is within bounds now? >> i think, obviously, we never wanted to send and become who they are. we represent the different set of beliefs and values and obviously we somehow don't want to sink to their level. now, if you're dealing with what i describe as a ticking bomb, then obviously you have to use whatever measures you think are going to produce a response. i think one of the criticisms of torture, leave aside the more quells which are legitimate -- one criticism of torture, what can be described asker to tire, it produces responses where the person you're torturing tells you whatever it is you want to hear. it isn't necessarily credible. having said that, i would say if you're dealing with a ticking bomb, meaning if you cannot distract what you need to distract, you're going to have a bomb go off and lots of people be killed, that puts you in a very different place in terms of what you need to do to try to distract the information that you need to be able to get. >> ambassador ross, you're talking bat moving line on those interrogation tactics and that's very, very interesting news today. sir, thank you. very much for your expertise. at home a government shutdown narrowry averted at least for now. the house passed a $1 trillion spending bill last night. the final vote, 219 to 206. the hangup, democrats who suddenly bristled at the idea of joining republicans to pass the bill. they said they objected to rolling back some regulations on big banks. some republicans also opposed the bill because it did not undo president obama's executive actions on immigration. now it's on to the senate. mike emanuel is live on capitol hill with the latest on this. mike, vote -- i understand, could potentially come today even. >> that's right, harris. the government is temporarily funded until tomorrow night. the house passed a second emergency extension just in case to take us through tuesday night if needed. senate major yet leader harry reid would like to get it done sooner. >> consider this legislation to keep our government open and funded and we're going to do it today, i hope. for senators who are unhappy with the legislation, they'll have the chance to make their objections heard. >> supporters note it is a bipartisan compromise. there were senators and house members at the table that negotiated it but the rules in the senate allow that one senator could burn some time, harris. >> i thought it was interesting last night, i'm kind of wonky like this, i like to watch things play out, watch the sausage being made, the president and vice-president were calling democrats trying to get them to vote 67 republicans did not vote for this. bus house speaker boehner and president obama on the same page. this bill had a lot of critics. they had a lot of work to do. >> the politics of this are fascinating, interesting alliances built. conservatives wanted to fight the president's executive action. a couple of senators that may not always agree eye-to-eye, elizabeth warren, the liberal from massachusetts, and david vetter, the republican from louisiana, teamed up because they're against the part of this bill that would weaken dodd-frank banking regulations, meanwhile, some conservatives are expressing frustration. >> how obama cad is funded, executive am necessary city is funded. we wanted to insist on a vote that would allow to us cut off all funding to implement his executive amnesty. >> house democratic leader nancy pelosi, who went against the president on this one, sent a holiday greeting to house rank-and-file members, thanking them, expressing her gratitude that aa lot of them held out and allowed the democrats to maintain their leverage. >> mike emanuel, thank you very minute. now let's get to the breaking news. this is just coming in from oregon. portland police say at least two people have been shot as rose mary anderson high school. they say that the suspect or suspects left the area. we don't know how they know that yet. we're still working the story. the school is in north portland. and air traffic is being affected as this investigation develops. so air traffic in that area and they are starting to set up posts around to deal, as you can imagine, with the parents that want to know what is happening at the school. we're working on getting more information. we'll bring it to you as it comes in. again, police say at least two people shot at a high school in north portland. a powerful hollywood executive and a top movie producer are saying they are very sorry for what they call insensitive comments they made about president obama and a lot of other people after hackers made their stolen e-mails public. it was private e-mail exchange between sony pictures co-chair, amy, and producer, scott. it takes place around the time of a fundraiser event. the web site, buzz feed, get ahold of the e-mails. one writes, would he, referring to president obama, like to finance some movies? she writes issue doubt it. should i ask him if he likes django? he responds, 12 years, reference to 12 years a slave. she replied, or the butler, or think like a man to which he replies, ride along. the news comes three weeks after hackers broke into the computer systems in sony pictures leaking unreleased films and company document. the hackers call themselves guardians of peace. will carr is live. what are the executives saying in the apology? >> mascal came out and said her comments were insensitive and inappropriate. keep in mind those words coming from one of the most powerful executives in the movie business and a big financial backer for national democrats. they both went into damage control yesterday after the i'ms were leaked under. brooden, who produced movies like money ball, social network, captain phillips, apologized as well. today for the first time white house press secretary josh ernest reacted to the e-mails about president obama. >> i think that there are a lot of people who did have a personal reaction that caused then maybe to cringe a little bit. i think that the decision that she made to apologize was the appropriate one. >> the leaks come at the same time as the release of the sony movie, the interview, star seth rogue began, centering on an assassination tim kim jong-un. there was a red carpet event last night in ahead. no cameras allowed but one of the stars, seth roguen, spoke up and said he wanted to thank pascal for having the courage to move forward with the movie, i've paraphrasing because what he said is probably not great for television. >> thank you for that. there's now word of another warning message from the hackers. what is it? >> that's right. time is reporting that the group, the guardians of peace, came out and put a warning into the computers of a none or sony employees yesterday saying if their demands are not met they'll continue to release many of these internal e-mails from sony. one of the biggest demands is that the movie not run and it's supposed to come out christmas day. so far it doesn't look like that's going to happen. >> will california r, thank you very much. >> let's go back to breaking news situation in north portland, oregon, right now, as police are setting up a perimeter. they're trying to obviously secure the scene of a school shooting but also deal with the many parents who want to know what happened there. this is rose mary anderson high school, located in north portland. early information indicates there are two victims and the suspect or suspects have left the area. we're trying to work to figure out how they know that. early reports say a 17-year-old was shot in the back, and a separate female student was shot in the chest. police are searching for suspects. we're now told in the shooting. >> both portland community colleges and other schools in the surrounding area, another high school nearby, jefferson high school, all on lockdown right now, according to local newspapers there. a school shooting in north portland. we're on it. for at, risk students. there are a couple of campuses. there are about 190 students. we don't know how many at one location. mamany students, we understand,i mentioned, at risk, are homeless, but it's an incredible program they're running there. it has a 90% graduation rate and there has been a shooting there today. at least two people shot at this school. that we're learning. suspect or suspects transported to a nearby hospital from here. two of them are confirmed gunshot victims. the types of injuries to the third patient we don't know yet. the shooting investigation obviously underway here students in this school. it's an alternative high school which means these are kids who are not exactly thriving in regular public schools and as you say, we have confirmed from portland police or fire, rather, that two people have been shot. we're hearing that a third person could have been shot but that has not yet been confirmed. you can see from the scene outside of the high school that it's not exactly hectic because the suspects are said to be on the run. no idea where they might be. this we're told is a middle class neighborhood in portland, but all of the other high schools, the surrounding high schools, are on lockdown as we speak, trying to figure out exactly who these suspects might be or what their motive might have been. we said two people confirmed to have been shot, but so far we have no ages of the people who were shot, 0 so we do not know if they were associated with the school, students at the school, maybe teachers. that is unclear. we know the school has 190
