yesterday from a number of sources and aviation experts that the most likely scenario given what they saw on the ground and some video that they saw off the plane coming down in a full and golf and fire, that most likely the scenario is that the plane was shot down mistakenly by iran's anti-defense missile. iran has announced their initial report which has more questions than answers. it's at the two black boxes were recovered, but they were damage to the point that some information was lost. it confirms the pilots put out no distress call, but did attempt to turn the plane around and land back at the tehran airport. that was impossible because the plane was engulfed in flames before it crashed. iran initially said that the cause was an engine fire. but ukraine officials now say investigators are looking at multiple scenarios including an antiaircraft missile. the plane was headed to kiev where president zielinski had a memorial yesterday. >> we were surely find out the truth. a thorough independent investigation will be conducted according to international laws. >> as i said, former officials with the faa and transportation safety board says that a fire is unlikely the cause given how fast the plane went down, and on the brie field, the plane broke up before hitting the ground. they say that a missile strike top to the possibilities. canada is calling for a transparent investigation. a 63 of the victims were canadian citizens. and most headed back after a connection in kiev. the question is does iran have the expertise to examine the black boxes, and if not, which country will do it? when i see nancy pelosi trying to defend this monster. >> harris: i want to bring in democratic congressman ro khanna of california, sitting on the house armed service committee. good to see you. thank you for joining me today. you just heard the president talking about there are certain instances, urgent ones where putting more constraint on war powers authorization could be problematic. is there risk in that? >> harris, first of all, nobody is defending soleimani. everybody acknowledges that he has blood on his hands and he killed americans and is a bad actor. the point is before you launch an attack on another state or a state actor like soleimani, you have to come to congress to seek authorization. the president did not do this. there is a limited self-defense exception, that does not apply in this case. it will be one thing if the president said, let's shoot down militias in iran that are threatening the troops, but to go after the second or third ranking person in iran does not strike me as self-defense against an imminent attack. >> harris: some of your colleagues on the hill across the political aisle have said that they felt like that imminent threat as you are talking about was present in the briefings yesterday. not everybody from the opposite political party. just a quick reaction to that, because the briefings were going on for house members in the senate yesterday as we learn details about why soleimani was taken out. >> i don't want to go into the classified briefings, but here's what i can say. the administration has offered no public details about when the attack was going to take place, where it was going to take place -- >> harris: you just said they were classified. >> they could say, why could they not strike particular militia or ammunition where houses? why could they not capture soleimani? there is no justification for why they had to kill him and act without coming to congress. it did not strike anyone in the public as urgent in a way they could not have gotten congressional authorization. >> harris: we don't know what we are striking in the public, do we? i'm wondering what will come about when we know the details. in the meanwhile, how will you vote? i guess that i know the answer, but how will you vote on the war powers authorization? >> i will vote for the war powers authorization. i expect matt gaetz and some republicans to join us. it's important on the war powers resolution it does not restrict the president from taking action on self-defense. the commander and chief has that right as president of the united states. what it restricts as a president to take offensive action in iran. >> harris: this just came in, the minority leader in the house, kevin mccarthy saying this. let's watch. >> today's war powers resolution cannot become law. by definition, it will never be said to the president, and it will never limit his constitutional authority to defending american people. it is a concurrent resolution. this is the type of resolution that we invite the soap box derby to the capital. this is a meaningless vote that only sends the wrong message. >> harris: a bit more from the former national security advisor tweeting "the 1973 war powers resolution is unconstitutional. it reflects a fundamental misunderstanding of how the constitution foreign affairs authority with the president and congress. the resolution should be repealed." congressman connor, your reaction? >> passed by a bipartisan majority is a three's, republicans and democrats, and republicans, matt lee, mike matt gaetz, with voting for war powers resolution to restrict the president in yemen, but to leader mccarthy's point, we also have a bill that would defend any offensive action in iran. that is not a meaningless resolution. congress can defund any action. and matt gaetz and i had a bill in the national defense authorization that would have done that. we'll have a vote on that bill in the house. >> harris: bipartisan on that. foreign policy expert ian bremmer who says he is far from a trump supporter had this to say. >> the united states has killed the head of iran's military in the cabinet. and the response has been virtually nothing. that does not mean that iran is no longer a major antagonist of the united states in the region, but this is a win for trump. and it is clear that it is pretty >> harris: congressman? >> i hope that there will not be a response. i'm glad that no americans were killed. i'm glad and hope that we can ratchet down the rhetoric and have a cease-fire. but iran is .44% of gdp. we are 21%. of china at 15%. americans are scratching their heads and saying, why do we care? >> it appears that that is for domestic consumption, but there has been a shift in messaging from the trump administration about whether the u.s. believes that they were intentionally trying to avoid killing americans in those missile strikes two year -- two nights . >> there is no doubt in my mind that they were intending to kill americans. >> originally officials told us that they believe to the iranians warned the americans through the iraqis and also basically were pounding sand. now the shift began when the u.s. military's top officer after seeing the latest battle damage assessment told reporters here at the pentagon late yesterday and early warning system tipped off american forces about the missile strike, sending u.s. troops to shelters that saved lives. but mark milley went on to say, make no mistake, the goal was to avenge qassim soleimani and kill american troops. >> i believe based on what i saw and what i know is that they were intending to cause structural damage and destroy vehicles and aircraft, and to kill personnel. >> vice president pence said today that he believes iran is telling his missiles not to attack u.s. targets. downplaying the impact of the missile strike in his address to the nation. >> we suffered no casualties. all of our soldiers are safe, and only minimal damage was sustained at our military basis. iran appears to be standing down. which is a good thing for all parties concerned, and a very good thing for the world. >> until general milley spoke late yesterday, pentagon officials said that they wanted to avoid killing americans, a message echoed in tehran today from iranian commanders. you telling me that the u.s. military did not attempt to shoot any of the iranian missiles down, because they did not have antimissile systems in place at the two basis. also shifting today after president rouhani said that the retaliation for the strike against soleimani was complete after the missiles were fired, now the commander as you mentioned says that he will take harsher revenge soon. here in the u.s., authorities are warning of the possibility of terror and cyber attacks coming from iran. harris. >> harris: the harsher rhetoric on their part may be for the internal politics in their own country. good to see you, jennifer. thank you. i went to bring a now republican congressman lee zeldin of new york, a member of the house foreign affairs committee and cochair of the israel caucus. the congressman also served in iraq as a lieutenant colonel in the army reserve. good to see you, always, thank you for your service. let's first of all just react to some of jennifer's reporting. in the point that she was making and that i reiterated that the rhetoric may change inside iran, because they have to do a calculus that includes a lot of people, not the ones on the streets, but the other millions of people, citizens that don't agree. they don't want more sanctions. they do want outside help from the world or at least attention. >> the regime in iran has been beholden to hard-liners. there are people in iran, irg see powerless specifically on their supporters where they want a stronger stance. they want to hear death to america, death to israel. they call israel the little satan and america the great satan. when they are engaged in all of the destabilizing activities, there is a portion of the uranian populace that encourages that and props up this regime because of it. you also point out that there are millions of iranians who want stability. peace, freedom, prosperity. that is a different direction for iran that they should pursue going forward. to your question about what you might hear at times for domestic consumption, we have heard in the past and we are hearing it now. we could continue to hear in the future that they say some awful things that are outrageous to us, and some of the messages are not meant for us as much to the hard-liners that keep them in power. >> harris: i love having you on the program, because i cannot ask anybody else this question. you served inside iraq. and i'm curious, how are they making the choice to let iran do something inside their country, and not choose us. you saw on twitter, the president basically telling them, you have to protect the basis where americans are housed, why should he have to say that? >> you also have iraqi soldiers with u.s. troops, you have as you know different types of people who are in the iraqi government, there are some who strongly oppose iran. you have others who have evolved into iranian proxies themselves. they are beholden to iran. in some ways, they are aligned in a positive way for the relationship. others, it is negative. they are doing it because they are scared. they fear whether it is for their life, for their families lives, where they have to take these positions that provide them cover. so under the shia leaders inside the iraqi government, you have to break that down into people who might actually sympathize and others who are just sympathizing because they fear. >> harris: most house republicans are praising the briefing saying that it clearly explained the strike that killed the top general. but on the senate side, president trump's allies like mike lee, rand paul went after it. >> the briefing lasted only 75 minutes, where the breakers left. this is not the biggest problem i have with the briefing. which i would add was probably the worst briefing i have seen at least on a military issue in the nine years i have served in the united states senate. i see no way in the world that you could logically argue that an authorization to have war with saddam hussein has anything to do with having war with people currently in iraq. a spin on the president had this reaction to the g.o.p. critics. >> i get along great with mike lee. i've never seen them like that. but other people have called and they have said that it was the best presentation they have ever seen. we killed a man who killed many, many americans. and many, many people. >> harris: i know you are not in the senate, but that there has to be talked about on capitol hill, mike lee spoke quite some time. >> on the house side i have not heard that from any of my republican colleagues that were in the house briefing that i was in as well. i thought the briefing was fantastic. >> harris: where they get that different? >> i don't know what was different, i wish i could answer that question also sad and on the senate briefing, but what i will tell you is this, that what you know, but all of your viewers know about qassim soleimani's past with the hundreds of people that he killed, the thousands of more there were wounded, though recent killed and wounded, the attack on the embassy, and the irg see put out a statement right after the killing or even they acknowledged that qassim soleimani was in iraq for confrontation against americans. >> harris: i don't know if you were able to hear it or not, but congressman ro khanna was on with me, and he was talking about bipartisan movement with some of your colleagues in the house. so you have that going on in the senate with some pushback on the briefing yesterday, but he says, no, no, guys like matt gaetz might go with him on a war powers resolution, what are you hearing? >> i have not heard that. i will say that consistently you have some republicans through the administration where they believe that there is an important point in time where there is escalation at all with any nation that congress should have an increase role to play. that congress has powers under article one, the president has powers under article two, and under those powers, 1 of 2 that were cited. the president cited an article two, and if you are going to kill 6,000 u.s. troops and wound others and commit all of the acts and have the planning for attacks going forward, i have no problem with you resting in pieces, because you just got blown up by our government for the best of reasons. when nancy pelosi talks about the word disproportionate, at what point is a proportionate? how many troops have to die and how many have to get wounded, as far as my republican colleagues go in their philosophy as far as article one, i respect them. unfortunately this is just -- without any teeth, it is a press release. they are just trying to punch the president in the face with this resolution. and that's why i think a lot of republicans who would normally be inclined to support an effort like this no one anything to do with it. we'll see what happens with the debate in the four vote. >> harris: lee zeldin of new york, thank you very much. joe biden reportedly growing increasingly worried about attacks by bernie sanders campaign. as the iowa caucuses are just days away. is sanders a real threat to him? >> i think she stated it best when she said, she will do it when she is ready. i don't think she is feeling any kind of pressure. i personally agree with those senators who say, turning articles over. the goal has been accomplished. even some unintended goals have been accomplished in terms of putting mitch mcconnell on the hot seat. and we know that he is facing a really tough race against amy mcgrath in 2020 in kentucky. he is the least popular senator in the entire senate. >> harris: i don't know what that has to do with getting the articles of impeachment in the senate? >> i think it has a whole lot to do with it. because as we said the goal to accomplish was to put fairness out there and witnesses and the person who has said that he is not going to be fair is mitch mcconnell. and i think that that is putting that out there that has hurt mitch mcconnell in some ways. >> i disagree, i don't think he is in the hot seat at all. he is finding himself in a really powerful position that he cannot believe he is in. and speaker pelosi, you can see it in the press conference. i think she is increasingly just does not know what to do with this. she has democratic congressman and her party and the house coming out this morning and saying that we need to move on. she quickly put the kibosh on that. in the senate where she has less power, it is clear that there is a growing list of people who are saying, this is not working out. whatever you thought you were going to achieve is not working out and we have to move on, because we are losing momentum. >> harris: it is not just a growing list, senior senators, democrats, senator blumenthal has said that it is time for pelosi to transmit those articles. he does say her delay has had its benefits. watch. >> what i've heard from my democratic colleagues is profound respect for the speaker. she has waited, and the response has been additional evidence. john bolton's offer of testimony. at the documents by security showing the president's direct involvement in withholding aid. there is likely to be more evidence. >> harris: is he saying that the case that democrats have had a difficult time making in the public at times just keeping it streamlined, if you will, that that is stronger now? >> i think what he is saying is that there is more evidence out there that we need to know and that we need to hear from witnesses like john bolton, and there is also -- >> harris: if you're not going to get the witnesses, i want to shave off some time, if you think you won't get them, because nancy pelosi says we want to see what the arena is like, do we have any reason to believe that senator mcconnell is not real when he says he will follow the rules of clinton? >> it is very clearly. when there was no word from the cockpit, that means it was taken out, which is typical with a missile. i'm not a pilot, the skies are saber without me in the sky, but the fact in the matter is this was something ballistic hitting that airplane. it was obvious from the start. and there is only one group of people operating this kind of thing, and that is the iranians. sipping on a of things are happening. there were no americans. 63 canadians, 82 iranians and others. by canada's prime minister and just the next few minutes is expected to address his people with regards to what has happened. so that is coming up at 2:00 p.m. eastern. and iran has had a civil aviation dismissing the reports of ukrainian planes being hit by a missile as "illogical rumors." >> what is illogical as a terrorist bunch running tehran. they came out a couple of hours after the attack and said that a lot has been erased. they were not open the thing let alone doing that. they have been lying since the beginning. so anything that comes out of tehran is very poor comedy. >> harris: right after too, "the wall street journal" asking questions about this just hours later saying, well, you put out some statement that says that you know what cause the plane to go down, something with the engine, how would you know that? iranian officials walked to that back, what would you be looking at at this point? they are not turning in a black box is over, at least not to us, the boeing plane owned by ukrainians, but we are probably not going to get them. >> guaranteed we won't. but keep in mind that the ukrainians, they are going to say not us. and boeing, not us. but that means that tehran pulled a stunt that will isolate them from the global transmit industry, because no airline will want to get near that airport. 8.5 million people. >> harris: why would there be planes flying anyway?
