He describes how he met with the team voluntarily on three occasions for 30 hours and come up detailing the president s fury towards the Russian Investigation and assuring trumps most intimate views. It suggests that mcgann cooperated in part because he felt the white house was setting him up to be the fall guy for any obstruction of justice charge. Yesterday, Rudy Giuliani tried to quell spec elation that mcgann betrayed the president knowing the white house could have claimed executive privilege but decides not to. Hes got 32 witnesses in which we didnt raise executive privilege. And in the case of mr. Mcgann, he could have had even better privilege, he could have had attorneyclient privilege. The president encouraged him to testify and is happy that he did. Those comments are reaffirmed by mr. Trumps tweet on saturday. He says, i allowed the white House Counsel, don mcgann, and other members to fully cooperate. No collusion, no obstruction, witch hunt. To some, the times story suggests that the Mueller Probe is about to concentrate into a huge construct on the crescendo of indictments and others think its about to fizzle out. It looks like the investigation is actually winding down. If there is not even a hint that the president or campaign of anything to collusion. John brennan takes a different deal. We dont know obviously what he told mueller and his investigators and i dont think the trump people know for sure. Obviously, mcgann knows and his attorney knows but what we do know is something that was down in the article, about the ninth paragraph down and beyond that, the 30 30. 30th paragraph. Mcgann told investigators he never saw President Trump exceeded his Legal Authority in all his time, and secret meetings and private negotiations and is talking about this investigation. An interesting statistic, and the the other thing is that we know that he is free to say whatever he wanted to say. In 30 hours of testimony, with the mueller folks, and thats pretty unique for the president to say to a white House Counsel, go ahead and do that. Harris as i was watching, just kind of what was being reported on the timing of all of this, and theres the discussion of whether or not the president should sit down with robert mueller. If you can show that other people can answer 30 hours of questions, it might be harder for you to then ask the president to sit down and tell you something you dont already know, which means other people can verify information which makes it less likely that the president would have to sit dow down. Bret it takes the urgency out of the request. I think the mueller people want to sit down and ask questions of the president and it doesnt seem like its headed that way to listen to Rudy Giuliani. But you are right, i think that openness that the president exhibited with letting the white House Counsel talking all the other officials talk, people say thats a bad legal strategy to protect the president. But the flip side of that is, they believe that there was nothing to see there. There was no there there. The white house will regret not evoking executive privilege. This shows what a c level team will have. You never waive that, absolutely not. And that put mcgann in a possible situation because once you weigh that privilege and turn over all those documents, don mcgann has no choice then but to go in and answer every everything. Harris of course he is looking at it for the eyes of a federal prosecutor, Chris Christie. Bret and we dont know what date or didnt happen in those hours of testimony. But we do know that the initial thought process with the legal team and the president was to be open. And a Chris Christie is saying that is a stupid thing and leaves the president vulnerable, but perhaps there is some evidence there to suggest that they felt like they were on solid ground. Harris i do want to talk about who don mcgann is and who he has been kind of in relationships of the white house. Hes the same don mcgann of the president was talking about getting rid of at one point, at least according to reports. What do you make of who he is in relation to the president . Bret he has survived the turmoil and been behind the scenes. Hes taken a primary role in picking and helping in the process of the nomination for Supreme Court justices. And, in that role i think he is being glorified in the president s eyes because he thinks he has presented him with a lot of good choices, and obviously its been one of the biggest successes the President Trump touts. But as you and i have talked about, you know, it also takes some of the expectation and onus and pressure off of the president s legal team to make them available they can get information from all these others.
