These abuses in the future. And if it means going to court, i will do that. Harris at the president mocked that legal threat tweeting, i hope he brings a lawsuit, then it will be very easy to get all of his records, texts, emails and documents to show not only the poor job he did but how he was involved with a mueller witch hunt. He wont sue john roberts has more from the north woodlawn. Reporter and people thought the already heated battle between the president and former cia director could not get any hotter but it certainly has. The president their daring brennan to sue. They believe President Trump was trying to stifle free speech but brennan insisting that has frequent scorching of the president was not political. This in here. He continually lies to the american people, and of the types of things hes doing, i think i need to speak out. Ive been speaking out rather forcefully because i believe its important to do so. I dont believe im being political at all, im not a republican or democrat. But there are some people who while they dont agree with the security clearance, they do believe that and brennan is outofbounds with his publicly visceral criticism of President Trump. Listen here. He has been incredibly critical of the president , and i think that has put him in a political place, which actually does more damage for the Intelligence Community, which is a politically apolitical, evens retired. I dont support him being as critical of a president as he has been. Porta mack and other president s taking aim at a number of other people saying the two are worried about losing access to classified information. The president we did this morning Everyone Wants to keep their security clearance. Its worth great prestige and big dollars, even board seats and thats why certain people are coming forward to protect brendan. It certainly isnt because of the good job he did. Hes a political hack. The white house drafting more security clearance revocations and one of the people in the cross hairs is the Justice Department official bruce ohr who was Christopher Steeles handler at the department of justice and, whose wife works for a fusion gps at the time they contracted still to come compile that dossier on President Trump. The president added that ohrs job may be incumbent mike jeopardy ever be fired from the Jeff Sessions Justice Department a total joke. We are told the white house is preparing security revocations for ohr as well as james clapper, the former director of national intelligence, james comey. Hes there twice, that shows how much they dislike him. Sally gates, susan rice and Andrew Mccabe have already lost their security clearance because they lost their jobs. The action, harris, the white house will take this week will be to revoke the security clearance and people who already have it, and for those who have lost it prevent them from getting another one in the future. I guess when you make the list twice, its critical. Clearly they dont like him. Harris republican congressman chuck flashman of tennessee who serves on the appropriations committee, and the Homeland Security subcommittee. So right on time with this issue. The missiledefense caucus, and of the Nuclear Security working group. You are a busy man, in new york, new york, visiting at least appreciate you stopping by, congressman. Lets start with being with security clearances. The one argument we havent heard from john brennan for keeping one is because he might need to stay ready. You know on i needtoknow basis stay by the american people. Its interesting and really that could be his only tenable argument. The courts will look at this, and i think the president is right. The courts will be very deferential to the commander in chief. Donald trump represents the executive branch of government which is very important, there has to be discretion given to the commander in chief when youre dealing with somebody so critically important as National Security. I think he will win on both grounds. Harris the Homeland Security subcommittee, you know what it takes to get a security clearance. Are we in a situation where the president has made a list thats too wide or too long . I dont think so. I think there needs to be an deference to any president whether a former president or future president. Thats why i think that brennan is wrong in the courts need to be careful that our chief executive whether it be donald trump or a future president can look out for the security of the United States. I think with all of the partisan rhetoric, we cant lose fact of the site, National Security is critically important. Donald trump gets out, i get that, i dont know if brennan gets out. Harris do you think there was a problem with him keeping his security clearance in terms of National Security . And i also want to remind everyone that it was senator mark udall and a couple of other democrats who said they took exception to what happened under brennans cia. He came under fire for snooping computers used by senate staffers. They wanted him to resign at that time. What is different now among democrats, would you say, with where he is now . Because they are jumping to his defense. It doesnt erase his past. I think i think thats wrong and bad and will hurt them in the midterm. Think about it, not everyone is a conservative republican like me, but most americans who are in the middle, independent and apolitical, they dont want this. They want our country kept safe and they want our president to be able to make sure, as wells are members of congress, that our Intelligence Community is doing the right thing. This is clearly within the purview of the executive branch and i think that except legislative branch. What i hear you saying though is not only that hes not taking the president to court but he would not have a winnable place anyway. Quick thought on that and then i have a follow. I think youre absolutely right. When we look at the separation of powers, the judicial branch, ultimately the Supreme Court will say, this is what a president can and cant do. But i think they will be cognizant of the fact that for future president s, not only President Trump, but we dont want to establish the precedent where the president of the United States is tied to, his hands or her hands are tied when it comes to a situation involving National Security. 4 million americans have National Security clearances. Some are higher, some are lower. Those people that we are talking about are at the highest level and we have to defer to the executive branch and issues such as this. Harris congressman, admiral mccray this and said he would offer up his personal security to the president. Your last quick thought . Rep. Fleisshmann im a member of congress and i have a security clearance. I view that is a tremendous member of responsibility. It donald trump feels the same way. Those who have a security clearance if they are needed by the president or by the legislative branch should be able to use that. However, if they abuse it for political or other purposes, thats got to be something that needs to be addressed. I think its high time that we Start Talking about it as americans, not as republicans and democrats but as americans first. Harris great to see you from the great state of tennessee visiting new york. Thank you. Im under the fox news alert, new reaction from President Trump after the report of the white House Counsel don mcgann has met with muellers team for the past nine months. President has not tweeted disgraced and discredited bob mueller and his whole group of angry democrat thugs spent 30 hours with white House Counsel only with my approval for purposes of transparency. Anybody needing that much time and they know there is no russian collusion is just someone looking for trouble. Doug mckelway reporting from washington with more. Reporter the New York Times saturday bombshell story reported that white House Counsel don mcgann cooperated extensively in the Mueller Probe. He describes how he met with the team voluntarily on three occasions for 30 hours and come up detailing the president s fury towards the Russian Investigation and assuring trumps most intimate views. It suggests that mcgann cooperated in part because he felt the white house was setting him up to be the fall guy for any obstruction of justice charge. Yesterday, Rudy Giuliani tried to quell spec elation that mcgann betrayed the president knowing the white house could have claimed executive privilege but decides not to. Hes got 32 witnesses in which we didnt raise executive privilege. And in the case of mr. Mcgann, he could have had even better privilege, he could have had attorneyclient privilege. The president encouraged him to testify and is happy that he did. Those comments are reaffirmed by mr. Trumps tweet on saturday. He says, i allowed the white House Counsel, don mcgann, and other members to fully cooperate. No collusion, no obstruction, witch hunt. To some, the times story suggests that the Mueller Probe is about to concentrate into a huge construct on the crescendo of indictments and others think its about to fizzle out. It looks like the investigation is actually winding down. If there is not even a hint that the president or campaign of anything to collusion. John brennan takes a different deal. Yesterday he said that on the very night that canada trump called for russia to find missing emails, russian intelligence agents went about doing just that. He also cautions we should all wait for the mullah report to come out before coming to any conclusions. Doug mckelway, thank you so much. Fox news chief political anchor now, bret baier. Lets start with where we are with mcgann, what do we know about him and how does he figure into this, how did he get into the hot seat . The president allowed him to be interviewed as you just heard. We dont know obviously what he told mueller and his investigators and i dont think the trump people know for sure. Obviously, mcgann knows and his attorney knows but what we do know is something that was down in the article, about the ninth paragraph down and beyond that, the 30 30. 30th paragraph. Mcgann told investigators he never saw President Trump exceeded his Legal Authority in all his time, and secret meetings and private negotiations and is talking about this investigation. An interesting statistic, and the the other thing is that we know that he is free to say whatever he wanted to say. In 30 hours of testimony, with the mueller folks, and thats pretty unique for the president to say to a white House Counsel, go ahead and do that. Harris as i was watching, just kind of what was being reported on the timing of all of this, and theres the discussion of whether or not the president should sit down with robert mueller. If you can show that other people can answer 30 hours of questions, it might be harder for you to then ask the president to sit down and tell you something you dont already know, which means other people can verify information which makes it less likely that the president would have to sit dow down. Bret it takes the urgency out of the request. I think the mueller people want to sit down and ask questions of the president and it doesnt seem like its headed that way to listen to Rudy Giuliani. But you are right, i think that openness that the president exhibited with letting the white House Counsel talking all the other officials talk, people say thats a bad legal strategy to protect the president. But the flip side of that is, they believe that there was nothing to see there. There was no there there. The white house will regret not evoking executive privilege. This shows what a c level team will have. You never waive that, absolutely not. And that put mcgann in a possible situation because once you weigh that privilege and turn over all those documents, don mcgann has no choice then but to go in and answer every everything. Harris of course he is looking at it for the eyes of a federal prosecutor, Chris Christie. Bret and we dont know what date or didnt happen in those hours of testimony. But we do know that the initial thought process with the legal team and the president was to be open. And a Chris Christie is saying that is a stupid thing and leaves the president vulnerable, but perhaps there is some evidence there to suggest that they felt like they were on solid ground. Harris i do want to talk about who don mcgann is and who he has been kind of in relationships of the white house. Hes the same don mcgann of the president was talking about getting rid of at one point, at least according to reports. What do you make of who he is in relation to the president . Bret he has survived the turmoil and been behind the scenes. Hes taken a primary role in picking and helping in the process of the nomination for Supreme Court justices. And, in that role i think he is being glorified in the president s eyes because he thinks he has presented him with a lot of good choices, and obviously its been one of the biggest successes the President Trump touts. Harris summer making the argument today that this assignment that the president obviously trust because he did open the door on transparency. But as you and i have talked about, you know, it also takes some of the expectation and onus and pressure off of the president s legal team to make them available they can get information from all these others. Bret we dont know what we dont know, we have to say that every day. We dont know exactly what mueller is going after or if there is something that is coming that we dont see. Everything here is speculation, but what we can say is that mcgann told investigators that he never saw the president exceeded his Legal Authority. You can argue what that is but its pretty significant. Harris bret baier, we will see you at 6 00 p. M. Eastern as always, on special report. We are awaiting a jurys verdict in the financial trial of Paul Manafort. Who extended deliberations could benefit, according to his attorney. And what we can expect in his next trial, yes, a change of venue in washington, d. C. Plus trouble may be ahead for the president s former personal attorney. Harris fox news alert, jurors deliberating for day number three on the financial fraud trial of former jump camn manager Paul Manafort. Prosecutors say its a good sign for their client. Peter doocy is live outside the white house. Reporter upon returning from a weekend away, jurors who had been sitting in the same seats in the courtroom just about every single day came in and sat in different seat seats. Nobody knows what that means yet and they havent had any questions for the judge yet today but the judge has been doing his best to protect their identities, insisting today that their names will remain under seal even after the trial is done and of other things are released publicly. The judge says that he woulds suspect they would be subjected to threats similar to the ones hes received since the start of the proceedings now on the 15th day. The judge had to deny a motion by a group of news outlets like cnn, the New York Times at the apa who wanted everything on sale before the end of the trial including juror names. Now the Manafort Team believes that the trial has taken on the feel of the final days of the 2016 president ial campaign when he many experts and pundits expected things to go one way and certainly others were surprised by the results. The difference is many people here had predicted a quick verdict in this case and it has not happened yet. The lead defense attorney also continues to express his belief that the longer deliberations drag on, the better for their side. The Manafort Team met today and hes being held in a small cell without access to a tv, book or anything like that and a source indicated that when or lose in alexandria, they will have to quickly refocus for his next trial in federal court, in d. C. Next month. Harris and peter, thank you very much. We will come back to you as a news warrants.
