The case but what did the special counsel mueller do to determine whether, how, the actions taken and the decisions made gathered by a trump hating lead investigator subject it by the subject . Evidence that peter strozk stated in the presence of the f. B. I. Counsel that became part of the special counsel mueller fun diagnosissal evidence and used by the special counsel team. Special counsel mueller was here i know what i would ask him. He is not. But his supervisor is. Mr. Deputy attorney general, what if anything has the special counsel mueller done to determine the actions taken, the decisions made and the evidence collected by special agent peter strozk was impacted by his very clear hatred and bias of President Trump. Congressman, i know you are aware, director mueller has vast experience as a prosecutor and a supervisor to the f. B. I. So i can assure you that he understands the importance of considering any credibility issues in determines whether or not to rely upon a person. With regard to the let me stop you. What actions has he taken, as his supervisor . We are not going to talk publicly about the substance of the investigation. I dont want you to do that. Can you tell me whether he has taken steps to determine . Yes. Director mueller has taken appropriate steps. And keep in mind, congressman let me stop you there. Im thrilled to hear he has taken steps. You and i are both former prosecutors. How does a prosecutor go about eliminating bias, prejudice and expressed hatred from the foundational evidence . Because you know, of course, if your root evidence is fairly called into question, everything that comes from the evidence is fairly called into question, right . I realize that. Im just about out of time. To give a somewhat comprehensive response. As you know, when we conduct an investigation the purpose is to determine if there is spirit evidence to prove, the purpose is the purpose is to prove if there is sufficient evidence in court. If you take court and take a piece of evidence and you rely on a witness you have to consider issues that go to creditability of the witness or the credibility of the evidence. You use the term foundational evidence. Im not sure what you have in mind. If for example director mueller relied upon a document that mr. Strozk produced, or a statement he took or call him as a witness, obviously you need to consider that evidence that would be evidence that would tend to impeach his credibility. And director mueller knows that. I want to respond if i could. I recognize we are out of time. Director mueller and i learned about the issue at the same time. We learned about it from the Inspector General. Brought it to our attention soon after he discovered it. I believe it was last july. Our understanding is the Inspector General conducted the investigation of strozk. So he didnt spend time questioning him. That was probably appropriate. But it didnt take long after seeing the Text Messages to decide what to do. I yield back. Last month i wrote about the human source that was involved in the early stages of the russia investigation. One of my republican colleagues had the gall to quiz about the identity. I asked you to investigate for the potential violation of the intelligence identities act and the other statutes and the Department Guidelines designed to protect covert operatives and the confidential human sources. Director wray, last month you testified before the senate that the day we cant protect human sources is the day the American People start becoming less safe. Can you further and briefly explain what you mean by the statement . Congressman, in investigation after investigation in the counterintelligence front, the counterterrorism front, organized crime front, Human Trafficking front, virtually every area of enforcement that the f. B. I. Is responsible for, we rely lively on human sources to come forward and share information with us. Often at great peril to themselves and their families. That is one of the single most valuable and important tools we have to keep the American People safe. And that is something we relied on now coming up on almost 110 years of the f. B. I. And if we start losing that tool, because people dont trust us to protect their identities appropriately, the American People would be less safe. First, happy 110th birthday. It seems that chairman nunes have asked for identity of undercover agents or sources who may have interacted with the trump campaign. Have you received the request, director . Harris we have breaking news now and it involves the first lady of the United States. We knew that this was potentially coming down. Now we can see her arrival in phoenix, arizona, where she is going to visit this hour an area where Young Children are at a Detention Center who have come across the border illegally. You know she has made a couple of visits. She was down in mcallen, texas, last week in a rainstorm and flooding down there. She went to one facility and left short of visiting the i. C. E. Facility on the border where they do intake and whatnot because of the flooding down there. Now she has gone to arizona, where younger children are held to see the conditions. The first lady has been, has shown a propensity for asking some interesting questions while on the ground in terms of the livelihood and the care of the children in the custody of the United States. Marc short is the white house director of legislative affair s. As this story is breaking now, marc, im glad you are here with me. We see the first lady exiting the plane. Tell me if you will her focus today as she has landed in arizona. Well, harris, i think the first lady is a phenomenal representative of not just the white house but a great representative for United States. She is down there helping to draw attention to the plight we have at the border. I think her concern is separation of the children from the parents. Been an advocate to make sure reuniting them as fast as possible. One of the challenges we face in the administration that your network covered is that with the most recent District Court case in san diego that says you must keep parents and children together, there is another law that Congress Passed in 2008 that says after 20 days, the children must be released. So if you have to keep them together, and you have to release them, the natural consequence is families will be released in the United States with the expectation of showing up for a court date to be adjudicated in the future. That creates incentive for the additional open borders. So there is a growing crisis on the southern border. We need the help of congress to pass legislation to give the administration the tools to make sure that these families are detained together as they go through the adjudication process. Harris marc, you lay out an interesting dilemma that maybe people are not aware of, they are not talking about it. I throw this in the mix as well. Some of the children by the time they are released, their parents have already been booted from the country. They have been deported. What does the future look like for the thousands of children who need to be reunited just based on what your are capable of doing now as a what you are capable of doing now as a federal government . The federal government has a very successful way of reuniting the families. The challenge we face is the law in 2008 was wellintended. In many cases children were being sexually trafficked across to the United States border and they were victims. So Congress Said lets separate them quickly and put them in the h. H. S. Facilities for their protection. That created an incentive for coyotes and the human traffickers to say hey, lets take your children and push them across the boarder to get them out of your country. Along the way we find in many cases they are sexually and physically abused getting across the across the thousandmile journey to border. This is wellintended but we need to fix the law so if they come across we keep them together many Detention Center through the adjudication process. Right now the law requires you release them in 20 days and the adjudication process is not complete. So they are like go in the American Society and rarely, less than 10 ever get deported. People in south america and mexico know that. Its an incentive to push them across the border. Harris as you are talking again we are showing the audience there melania trump, our first lady landed in arizona. We understand and we can confirm now with you, marc, round table discussion he is will be having at the migrant facility there in west phoenix. As the news happens in the next few minutes ill show the audience that. But now that you are with me, i have questions. Anthony kennedy, as he leaves, you were already seeing a battle that the democrats are not going to work to confirm anybody. They dont even know who it is yet. What is the white house plan for pushing through an eventual nominee . Well, harris, you can see from 136 judges that the president nominated for the district and the Circuit Court judges the type of candidate he will put forward. He is choosing from 25 he is choosing from for the position. I think the American People can take confidence in way gorsuchs nomination took place and how he represented himself on the Supreme Court. The president will nominate another superior candidate. But the democrats are preparing for an armageddon and they are saying no matter who it is well resist and oppose. As opposed to say how do we prepare a fair process to sequelifications the candidate may or qualifications that the candidate may or may not have. They are opposing it already and plan to stop it. Harris the democrats are saying they didnt push hard enough against gorsuch. This is going to kind of be a stronger stand for them. Elizabeth warren of massachusetts said she would wait to see who republicans and the president put up. She didnt have a whole lot of confidence it would be, according to reports im seeing, somebody she could support. But its interesting she is putting that in the mix. Lets talk about the breaking news right now that is happening with Deputy Attorney general Rod Rosenstein and the f. B. I. Director Christopher Wray on the hill. It has been contentious at moments. What is your take on what you have seen so far . I think the president is pushing for more transparency and for the d. O. J. To share documents with congress in the investigation. But there is also what is coming to life for the American People when you talk about peter strozk. The lead investigator texting with his mistress, another investigator on the same case, about ways to stop trump from becoming president of the United States. That is a harrowing incident that is unprecedented in history. So people understand how bias the investigation was. The head of the f. B. I. In director comey who was intentionally leaking information to the press to bias the case as it was. There is all sort of bias happening to stop the president from first being elected and then trying to impair the ongoing investigation. So some of that is coming out to light now. The president is anxious to share more documents with the American People so there is more transparency. Harris trey gowdy said finish it up about the russia investigation. I want to give you the last word. Yes. I think the president and the Vice President making case to the American People this is now a year yeah going on. Its been year and a half going on and tens of millions of dollars. There is no evidence of the russia collusion. Time to wrap it up so the American People can move on with business. Harris marc short with the white house covering breaking news with the first lid first lady visiting migrant facility for children. Thank you. Thank you for having me. Harris sure. Now bring in fox news Political Editor chris stirewalt. I like to say the stereo is the stire is on fire. We are glad to have him. There you go harris the news flow is simultaneous so lets unpack it. Start with the Supreme Court. This is huge news and the vitriol dripping from both sides of the conversation hit us like a wall yesterday. What is single takeaway that you see about Justice Kennedy exiting the Supreme Court . Well, an effort by republicans to recenter the Supreme Court that started under Ronald Reagan that really started 40 years ago and more after the roe v. Wade decision is going to bear fruit this year. They are going to get to the point where the center point on the Supreme Court which once upon a time was Sandra Day Oconnor and today is Anthony Kennedy is likely, quite likely in fact to be john roberts. A justice who would have been seen as very conservative 20 years ago likely now to end up as the midpoint as the deciding vote on so many cases. That tells you how far and how long republicans have worked. And how successful they have been at remaking the Supreme Court. Harris so, you know, chris, we are all covering in the news right now the fear that has been infused in the conversation from one side of the political aisle saying you will lose things like abortion rights. Roe v. Wade may be tinkers with, like a thousand cuts i have heard some people say. What are the realistic areas that you think a more conservative court would look at and want to change . Well, the biggest question is more than anything else, what is the power of the executive branch . Do the regulatory agencies have the authority to come to the courts and say we are speaking the truth, we carry the power of decisionmaking and coming like a prosecutor would in a case. What is going to happen if you have justice more conservative on the court, you have a possibility that the federal government standing, the executive Branch Standing on the Supreme Court is going to be neutralized and they will be just another defendant, or just another litigant in a court. That is a big deal for people who are small government conservatives. I do agree with the democrats who talk about its not going to be overturning roe v. Wade. Its not in one moment that roe v. Wade is overturned. We have already seen by the way in the past decade more and more restrictive rules as it relates to access to elective abortion come in play from states across the country. The court as constituted approved those and i will expect that you will continue to see not one massive overturning of roe v. Wade but a continuing allowance for more restrictions on elective abortions. Harris we look across the country and we how people are voting and an outsider in the white house who expresses himself and people greet with a thank you for coming and being real and raw. Where is the country . If they are center right, what is the fight for democrats . Ma should be the message . If the country is center right, how do you fight that . If that is where it wants to be isnt this the pendulum going back and forth . We have seen it in both directions. Not everybody thanks the president for being raw and real. Harris im talking about people who support him. The people who support him do feel that way. But we have to remember this. American public life is a tangle and a jumble. People hold different opinions. There are strong proponents of the Second Amendment and the same time believe that elective abortion should be available. People have confusing and contrary views that are hard to stuff in one Political Party or the other. Trumps success is reflective of the jumble. He was a democrat and he took apostate positions on conservative stuff and is now governing as basically a tea party conservative. Its confusing and jumbley. But the Supreme Court is not reflection of the Political Energy of the country. Its job is to be the last refuge, the last place where americans feel okay, we can trust what you are doing. Harris all right. Chris stirewalt, i have to break in with breaking news because we have the first lady of the United States who has arrived at migrant facility where they house children. This is part of her day that will be a round table discussion as she meets with officials. We have seen her in this role before and now she is back. She tends to ask interesting and hardhitting questions about how the children are cared for. Lets watch and listen together. Border protection. To your left is the chief. With our interim partners and the key stake holders we are honored to welcome you to the u. S. Custom and Border Protection Processing Center to talk to you a little bit about the operations and then challenging the critical aspect of the mission where we care for families and children that crossed the border and we have taken them into custody. Yesterday alone there was several people that arrived including 539 members. This continues to be a significant problem. A major challenge. We appreciate your support and engageme
