newly obtained text messages show hunter biden's former business association discussing a push to get joe biden, "involved" in their now bankrupt chinese business venture. that was back in may of 2017. it may look like a "truly family business" to the chinese. that is what they told them. it's not clear how the group may have intended to get joe biden involved in the plan to set up a chinese energy company. however, in more messages between the former hunter biden associates days later, james gilliar texted tony bobulinski. "don't mention joe being involved. it's only when you are face to face. i know you know that but they are paranoid." meanwhile, joe biden last night defending his son portraying him as a victim. in an interview with late night television host stephen colbert. >> president-elect biden: we have great confidence in our son. i am not concerned about any accusations made against him. it's used to get to me. i think it's foul play. look, it is what it is. he is a grown man. he is the smartest man i know. i mean pure intellectual capacity. and as long as he is good, we're good. >> harris: however, g.o.p. senator tom cotton on outnumbered overtime yesterday told me it's long past time for joe biden to answer serious questions about what happened. >> her and valerie biden owens, trading on biden's name and the public office for 50 years. the content of the e-mails are suggestive that joe biden knew about it all along. it's well past time for joe biden to have a press conference to come entirely clean about what hunter biden, jim biden and the rest of the biden family have done. >> harris: you are watching "outnumbered." i'm harris faulkner. here host of "kennedy" on fox business, kennedy. fox news contributor and attorney emily campagno. fox news contributor and high school of "moms" on "fox nation" rachel campos-duffy. joining us today for the first time on "outnumbered," dave rubin. host of "the rubin report." author of "don't burn this book: thinking for yourself in an age of unreason." dave, welcome. good to have you, everybody on this fine friday. david, start with you. a call you saw there from senator cotton for joe biden to have a news conference and answer questions about the allegations against hunter biden. of course, we know it would require that reporters would be able to ask questions. a trend we haven't necessarily seen with joe biden. >> dave: yeah. i'm glad you framed it that way, harris. that is what this is really all about. we are basically in a reality war at this point. depending on what news channels you watch and what podcasts you listen to and the youtube channels you pay attention to, that is what your truth as designed as. fox will pay attention to the story, there is obviously something there. in the e-mail where they are saying, "get joe involved." is joe a businessman? is joe going to put money in something? no. the reason you want joe involved in things is because joe is a former senator, a former vice president, now i guess the presidentful elect. -elect. he has influence and can make things happen in a way the average person can't. the simple truth is we know that twitter suppressed a lot of the hunter biden stuff before the election. we know that the main stream media cnn and msnbc is not going to cover this. if half the country can't see what is going on here, that explains why we end up fighting about things all the time. we are not even dealing with even set of issues. people live in their own bubbles. >> harris: wow! so well put on so many different levels. rachel, what dave is saying he just simply isn't likely an average joe. >> rachel: no, he's not. by the way, hunter isn't a business, you know, leader either. he is a troubled painter. he has a drug problem. a porn problem. he has a lot of problems. he has no experience in china. he has no language skills to offer. he is only offering up his dad. these e-mails by the way give us a lot of insight in to how this family business was run. hunter paid many of the biden bills. jim would get 20% of which 10% would go to the big guy. jill biden also had keys to the family office in d.c. which by the way, they shared with the chairman ye, were an emissary for chairman ye who headed up the energy conglomerate. it's all super, super shady. the media just seems absolutely not curious about it. and with good reason. because the more that is uncovered about this story -- by the way, we are getting stuff every day. the more that is uncovered, the worse it looks, the worse they look because they covered up probably one of the worst corruption stories in recent history. they did it all before the election. and only decided to kind of cover it now that they think that joe biden has been elected. >> you know what is really complicated, too? before i come to you emily and kennedy, i want to get to this. is there complicity when you look at how it's not covered by others in the media, as dave pointed out? senate judiciary committee chair lindsey graham doubling down on the calls for a special council now to investigate hunter biden's dealings. >> we are not going to sweep this under the rug. my big fear is the media could give a damn about this investigation and democrats are gladly sweeping it under the rug if they could. i'm convinced the only avenue available is either a special counsel or a republican senate to get to the bottom of this. >> harris: kennedy? >> kennedy: get joe involved! you saw that there on the screen. and rachel is absolutely right. every day we are learning more and more. there are more text messages and e-mails that come to light. every time we hear something new, we hear of more involvement on the part of joe biden. it makes it impossible for him to deny knowledge. we don't know how deep the involvement was. i personally still have special counsel fatigue. i know hunter biden is the subject of a couple of federal inquiries with the u.s. attorney and the grand jury. lord knows what the f.b.i. is doing. if they are going to appoint special counsel, it's now or never. the clock is ticking. >> harris: special counsel fatigue. emily, that has to describe a lot of people. it doesn't seem like the promises of the bombshell that ever panned out. now you have the actual evidence. you have a paper trail. you got receives. >> emily: that's right, harris. to everyone's point the information and the evidence is mounting literally by the day. there is a valid argument made that no one is necessarily insinuating that joe biden is an insidious malicious character on his own. but i think you cannot deny that there is a machine built around him. and has been for decades. the power of the establishment democrats is such that there is an effect we see every day. a huge undercurrent in this society. and so i think that the notion that well, of course, he might not direct to undermine or downplay any evidence or information, but there is still a machine at play that might in his stead. quick point of the colbert click if i may. it's so striking that a late night comedian that acts the president-elect about china and in that asks how he feels. it's in everyone's best interest to ask these questions. the threat isn't the messenger or the g.o.p. the threat is china. just today we added 80 companies to the already 700 company deep national trade blacklist of which over a third are chinese. we prosecuted dozens in the last few year to point the effort to counter the nefarious efforts and hundreds more fled as a result. the point we should pursue not necessarily the g.o.p. versus the democrat but the depth of the nefarious chinese action in this country regardless of the outcome. >> harris: really quickly,day, before we scooch to commercial, i want a final last thought on this from you. >> dave: simply put, hunter biden has no qualifications to be doing any of this. so any of us are just as qualified to be doing any business with the chinese government. as hunter biden. except the only difference is none of us have a father who was the vice president of the united states. >> harris: yeah. that is a big difference. okay. we'll move on. vice president pence becomes the highest ranking member of government to get the coronavirus vaccine. and we learn a federal panel will hold an emergency meeting this weekend. to talk about who should get vaccinated next. which group of people they are leaning toward and why. just ahead. california sees a historic surge of covid-19 cases becoming the u.s. epicenter. as we learn some democrats are now supporting moves behind the scenes to recall the governor gavin newsom. they will have to catch him at dinner, right? i don't think swalwell has denied having a relationship. all you have to say is i didn't sleep with her, eric. that is all you have to say. >> kennedy: maybe say a little bit more, dave rubin. what does it take to get someone off the house intel committee? i thought it was one of the more important committees. >> dave: yeah. well, trey gowdy is totally right there because first off, yeah, he could say he didn't sleep with her. watch, i can do it. i didn't sleep with a chinese spy. there you go. easy enough. but putting that part aside, you know, swalwell is one of the biggest clowns in congress. for four years he was one of the primo guys on twitter screaming about the russian collusion, going crazy that donald trump jr. had a meeting for 15 minutes with somebody on the upper east side once and the rest of it. he runs around calling everybody racists and bigots. man, maybe you want to look at your own house first. i think nancy pelosi has a huge mess on her hands with this guy. they are lucky. we talk about how the media ignores things that don't fit the narrative. they are lucky we are toking to the end of the year and christmas, people start to put the stories aside. i think the republicans have to, you have to keep the heat on here. between the holidays and just that the media won't like this story because it's a democrat with the spy not a republican, there will be a little bit of oh, let's look away from this thing. >> kennedy: yep. dave makes a good point. dave rubin was the pearl clutcher when it came to the drips and drabs of the russian assets so shouldn't we apply the same standard that he set for the trump administration in terms of talking with and engaging with questionable people from places like russia and china? >> harris: of course, 100%. it should be equitable. i don't know if the public needs to know the ins and the outs of whatever was going on in real-time. but somebody needed to know. who knew contemporaneously and what decisions were made based on what they knew about that woman and congressman eric swalwell and her ability to place an intern in his office? staff that we know, i know from interviewing other people, lawmakers, senators, congressmen and women, they are not vetted the way we would hope they would be. they just aren't. not yet. not yet. there is a push to get more vetting going on with the staff and interns. but they have their hands potentially on anything in a congressperson's office. we are not saying that that person knowingly was placed there with the knowledge that a suspected chinese spy had done it. because i have had c.i.a. experts tell me it doesn't look like that. but the fact that this woman phang had the ability to do that and the trust of eric swalwell, what was the genesis of their relationship? trey gowdy wasn't gentle with how they put it but we want to know behind the scenes was there things she would know about him that could compromise him? and thereby, nancy pelosi and others would have to know. >> kennedy: they have to look for it, though. that is the biggest problem. emily, it seems like adam schiff and nancy pelosi are being incredibly dismissive of this whole thing. and as harris brings up, there are real national security implications here. maybe not just in this case but certainly here, elsewhere throw. though. if you get an intern that easily trained to look for information wherever possible imagine who else could be lurking. >> emily: that is exactly right. at what stage of success is this story in particular representative of? how many other success stories are out there in their line? he started as city council. he has had a trajectory at the help of the chinese. so, of course, the more information we learn the better. that dismissal and his silence is not doing that party or pelosi any favors. her position not removing him from the committee is getting harder and harder to defend. the more information that is uncovered. his silence, too, keeps the story on him. we are talking about him rather than again, searching out and learning about all the other success stories out there. over the holidays it would do her well to remove him. people are paying less attention to congress in the holidays and remove him before the next congress starts. therefore, also send a message that yes, she has taken action against this. there are over 200 democrats in congress that haven't slept with a chinese spy. this is untenable. to your point this is hurtful for the u.s. intelligence. why can't she pick one of them? >> kennedy: yeah. no kidding. swalwell is kind of a blow-hard. i'm sure you have run into him at a congressional event at some point. rachel? >> rachel: i have not. but listen, there are a lot of questions. the f.b.i. told us that phang, the spy, unexpectedly left the country. we need to know, because they gave him a defensive briefing. did swalwell tip her off. >> treasonous. is we usually get a spy we capture and get information, who is directing her, find out there are other assets? we got nothing. she left the country. in the last story on hunter biden, you know, we talk about the corruption. but we are not talking about the national security on the story. and the implications in this one, too. you remember the movie, kennedy "i know what you did last summer." the chinese know exactly what hunter biden, what joe biden, what eric swalwell were doing and they can hold it over their heads and get policies and things that they want done that are against things that we know are best for our country. essentially, selling out our children. selling out our children's future. our companies. our economy. this is serious stuff. the fact that nancy pelosi did not take eric swalwell who clearly has no judgment off the committee tells me that the general in general have a china problem -- the democrats in general have a china problem. there are a lot of problems with china and the democrats right now and we all need to get to the bottom of it. >> kennedy: maybe some day we will. i'm not terribly confident. but i hope so. we will have more on the swalwell-china controversy when the former house oversight chair trey gowdy, he is going to join harris at the top of the hour at "outnumbered overtime." stick around for that. the top biden aide who called republicans a bunch of "f-"ers" is changing her tune. you don't say? "associated press" reporting that the panelists are leaning toward putting essential workers first. because bus drivers, grocery store clerks and the similar employees cannot work from home. however, other experts say people older than 65 should be next along with people with certain medical conditions. those are the people who are dying at the highest rate and the numbers popped recently. i want to bring in now the new york city physician and the fox news contributor. it feels like two weeks in a row that we get to celebrate. on the verge of celebrating again another breakthrough that includes a weapon against covid-19. but we are not there yet. who gets it next in your medical opinion? >> that is right. the vice president said clearly this is an incredible scientific feat but this is still a time of tragedy with thousands of americans dying every day and 100,000 still hospitalized. the question is we know the healthcare workers and the long-term care facilities are first in line to get the vaccine. but this is really, it can be ethically and morally a debate that people will find themselves in. i think it needs to be a targeted approach. ultimatedly our goal is keep people out of the hospital and save lives. so we know a loft the age based dependent vulnerability in this virus. there .6% for covid-19 but it doubles after you are 65 to 1.4% and it goes up from there. so since the goal of the vaccine is prevent symptomatic disease, it's not necessarily able to prevent the transmission of the disease it's going to behoove to us focus on those who will likely end up in the hospital and require intensive care and save their lives. i understand getting the front line workers the bus drivers and the others who can't work remotely why we want to vaccinate them but if the overarching goal is save lives and keep people out of the hospital then it needs to be a targeted approach and looking at who is going to be more severely affected by the virus. >> harris: i'm not the only one with questions. we will go around the horn as much as we with the time we have. dave, i'm coming to you first. >> dave: i totally agree with the doctor there. there is an ethical and a moral debate we can have about this but the numbers bare out older people and the sicker people, people with the comorbidities are the people dying. so if we stop that first, people on the front lines, the bus drivers and the delivery people, they are catching it like everybody else but they are surviving. if we take care of people dying first and then that allows us to start seeing people again and opening up the country again and everything else. that is where i would go first. i think there is some healthy debate. and maybe it can be more case specific than saying okay, this group and this group. >> harris: kennedy, your question? >> kennedy: dr. sapphire, i'm wondering. i was reading the "los angeles times" today, some southern california i.c.u.s are at 0% capacity. i'm wondering what do those hospitals and the health centers do when they have no i.c.u. beds? >> i'll tell you, kennedy, this is a scary situation for everybody working in the hospital. we get alerts of what the i.c.u. capacity is at all times. when it approaches 0%, it doesn't necessarily mean people will be stopped at the door and not allowed in. however, what they will have to do is start making additional room for the patients. so, what we did here in the northeast, a lot of the hospitals we made the makeshift i.c.u. beds out of different floors. we took operating rooms and changed them to i.c.u. they will be creative to use the existing space within the hospital to be able to care for the critical patients. but as you know, this is not best practice scenario. we shouldn't be doing that here in the united states. where we have one of the strongest healthcare system. we have to keep the patients out of the hospital. we have to keep them out of the i.c.u. so whatever we can do to lessen the spread until the hospital system can catch up needs to be done. >> harris: rachel, your question for the doctor? >> rachel: hi, nicole. how are you, doctor. i have a mom question for you. no surprise, right? a lot of moms you know are saying listen, i'm following the science. my kids aren't very vulnerable. i don't want to give them the vaccine because it's a new vaccine. what are your thoughts on that? >> well, as you know, rachel, i have three kids of my own. right now we are not giving our children the vaccine because it hasn't been tested in kids yet. there is trials underway right now about vaccinating children with this vaccine. however we know in terms of covid-19 the children are not severely affected by it. ultimately we may change recommendations saying we have enough data now, we have given it to enough adults and we have more longer-term safety data that maybe we will consider to give it to children in the future. however right now the recommendation is not to be given to children. really focus more on the people who are going to suffer the severe consequences of covid-19. but on the other hand, the flu can severely affect children. children should be getting the flu shot. >> harris: yeah. we saw with the pediatric deaths just from 2019. that can happen. and it does. last question, people i'm talking to even on the front lines who are prepping to get the shots are saying they want to go to the doctor. thaw don't know the training with the people at the drugstores. that is a concern of theirs. should they be concerned?
