home. >> harris: we will break it serious now. just hours after al franken plan to resign in the coming weeks and make sexual misconduct claims, and a republican arizona congressman trent franks that he will step down at the end of january. the house ethics committee open an investigation to look at allegations against franks yesterday. he said, "i had never physicall physically, intimidated, coerced, or attempted to have any sexual contact with any member of my staff." franks admits he made two former female subordinates feel uncomfortable by discussing fertility issues, saying he deeply regrets that it caused distress in a workplace. here's more. the house ethics panel also said it is expanding it to blake farenthold. also republican over allegations that he said two harassed a former member of his staff and retaliated against her for complaining. he denied a wrongdoing when that case was scheduled. i see you nodding your head when this becomes pie partisan, why? >> lawrence: i think it needs to be bipartisan, but i do think there needs to be due process. i have to be honest. the franks thing is weird to me. i don't know why he resigned. maybe there's more that will come out. i thought it was creepy, but i didn't think it was like roy moore with the allegations against franks. or other people that have gotten some national attention. this is getting real messy for me. i got to be honest as a man. i feel very uncomfortable because i believe there's a lot of allegations going out without due process. i think some of them warrant it after people make public statements, or some of the evidence is presented. we will talk about this later in the show. when you have things like the case, i was critical of the guy, and then the post victim says i forged the date in the yearbook. that's problematic for me. >> jessica: she said she added that a peer she didn't say she forged the dope for more and more. >> lawrence: can't added a. >> jessica: i understand what you're saying. we just need the complete picture. i saw on her last night after the franks that this is more to the store that will come out. in the days to come. we will see. nonetheless, it hurts her credibility for now saying that she did something that she otherwise claimed she didn't. >> lisa: on the due process angle, i want to read something. it's most distinct quote i've heard from someone, and it seems to be entering dark times, allegations are being printed as facts and lives are being put in jeopardy without a hearing, due process, or evidence. it mentioned yesterday and the 24-hour news cycle, social media, this mob mentality, how do we get this right where we are weeding out bad actors that should not be in the workforce that are committing horrible acts against women that are completely inappropriate and wrong, but without taking down and innocent people getting sucked up in this? i think it's so important to find that balance. >> harris: as we talk about this, it's not an easy playing field. when the women bravely speak out, their voices are heard differently than the people in power. when you talk about due process, that's why you have an ethics committee. why are these men representing them? why is al franken exiting before this exit committee has had a chance to look at it? why is trent franks exiting? as a because of of the rally, or are there more parts of the story? i don't think we can answer that. there is a due process in place in some regards. >> kennedy: what you have to be careful of is activating the mob and letting the mob mentality take over because what happens is you lose sight of the ultimate goal. you lose sight of protecting victims. men and women are in places where power is not used to abuse and watch and intimidate and coerce them. that's what you have to deal with. the problem is, want to taste a little bit of blood, it really does activate this mentality that become so dangerous and almost consumes itself and takes out all the energy and totally takes the focus of weight from where it supposed to be. in the end, that ends up hurting victims. >> lisa: , we can go back to ferguson who was in sexually indicted by the media and the public before the justice process was able to play itself out. we have to be careful. also to get back to the victims and the people who are making these claims as well. you go on capitol hill, you can look at the compliance and that is clearly stacked against them. i think it's important for congress to also make those changes, which we've seen bipartisan legislation do. >> harris: it is stacked against the women and the men. i like the fact that you brought that up because we are talking about power here. it's more about power than any other category, gender or whatever. what's interesting is the fact, he didn't have a fund for the people who were being accused. you had it for the victims. we do want to be honest about how we look at giving victims a voice. part of that is due process. it doesn't serve anybody, including the victims, not to get the truth. >> jessica: i absolutely agree. i feel very conflicted over al franken's legislation yesterday. it was tried by a jury with 30 plus senators. it had nothing to do with minnesota or the republicans who backed him staying there for the due process or the nature of the allegations compared to some other people have been accused of. it's a tough one because i know democrats are obviously after the moral high ground here and they have a special election on tuesday. i can see that in his face. how upset he was about this. i understand the complaints that he didn't apologize and he denied a lot of the allegations, but i certainly do see -- >> kennedy: that's the contrast you're drawing because he did show more conviction. also, his colleagues -- but that's my problem with the democratic party. they have this authoritarian lock where they give you the talking points and you parrot them. the first set of talking points were let's let the ethics committee finish it out and see what's happened with due process. yesterday, once they put out that facebook post conversation. it has to do with al franken's refreshed reaction to the allegations against him. do we have that to watch? let's watch. >> i also think it gave some people some false impressions that i was admitting to doing things that in fact i hadn't done. some of the allegations against me are simply not true. others i remember very differently. >> harris: that was different from that first news said the voters should decide. do you believe that they should decide in all of these cases? and the roy moore decision? >> jessica: the roy moore situation, i certainly think it is his right to state in the race. it is a terrible choice at the voters in alabama have to make between a liberal democrat and someone who is accused, credibly accused, of these atrocious acts. i wish they had an alternative that means they could get their judge picked that they could get somebody who was pro-life, which i know is hugely important to them. i feel sorry for them. i hope i never have to face something like that. i do think they should decide. there's also a reason that the senate can vote to expel someone that they do not think should be there. >> kennedy: to the point about expelling, this would be unprecedented to expel a duly elected senator when the voter had full knowledge of the allegations made against them. there's also a dangerous precedent. there's been times in history were a party has control of two-thirds majority in the senate. this was used in the future as a political tool, these are important things to be talked about. >> harris: breaking news to break into this conversation. u.n.'s is -- to trump's decision to recognize jerusalem as israel's capital. as well as move our u.s. embassy from tel aviv to jerusalem as that new capital. the u.s. ambassador to the u.n., nikki haley there, speaking there. let's watch together. >> the president has announced that the united states recognizes the obvious, that jerusalem is the capital of israel. he has also instructed the state department to begin the process of relocating the u.s. embassy from tel aviv to jerusalem. that is what the president has done. and this is what he has not done. the united states has not taken a position on boundaries or borders. the specific dimensions of sovereignty over jerusalem are still to be decided by the israelis and the palestinians and negotiations. the united states has not advocated changing any of the arrangements of korean grocery. the president specifically calls for maintaining the status quo at the holy site. finally and critically, the united states is not predetermining final status issues. we remain committed to achieving a lasting peace agreement. we support a two state solution, if agreed to by the parties. those are the facts of what was said and done this week. now there are few more points that are central to the discussion of this issue. israel, like all nations, has the right to determine if its capital city. jerusalem is the home of israel's parliament, president, prime minister, supreme court, and many of its ministries. it is simple common sense that foreign embassies be located there. in virtually every country in the world, u.s. embassies are located in the host country's capital city. israel should be no different. the united states took this step and full knowledge that it will raise questions and concerns. our actions are intended to help advance the cause of peace. we must recognize that peace is advanced, not set back when all parties are honest with each other. our actions reflected an honest assessment of reality. i understand the concerns of members have been calling the session. change is hard. but we should never doubt what the truth can do. we should never doubt that when we face the truth, believe in the human spirit, and encourage each other that peace can happen. to those who have good-faith concerns about the future of peace between the israelis and the palestinians, let me again assure you that the president and this administration remain committed to the peace process. to those who do not act in good faith, to any person, leader, country, or terrorist group that uses this weeks decision as a pretense for violence, you are only showing yourself to be unfit partners of peace. finally, i will not let this moment pass without a comment about the united nations itself. over many years, the united nations has outrageously been of the world's foremost centers of hostilities towards israel. the u.n. has done much more damage to the prospects for middle east peace than to advance them. we will not be a party to that. the united states no longer stands by when israel is unfairly attacked and the united nations, and the united states will not be lectured to by countries that lack credibility that goes to treating both israelis and palestinians fairly. it is no coincidence that the stork peace agreements between egypt and israel and jordan and israel were both signed on the white house lawn. if and when there is a historic peace agreement between israelis and palestinians, there's a good likelihood that it too will be signed on the white house lawn. why is that? it's because the united states has credibility with both sides. israel will never be, and should never be, bullied into an agreement by the united nations or by any collection of countries that have proven their disregard for israel security. to my palestinian brothers and sisters, i can tell you with complete confidence that the united states is deeply committed to achieving a peace agreement between the israelis and the palestinians. we have demonstrated that commitment over many years and with the investment of large quantities of financial resources and diplomatic energy. sadly, peace between the two sides has not been achieved, but we will not give up. our hands remain extended to you. we are more committed to the cause of the israeli-palestinian peace today than we have ever been before. we believe that we might be closer to that goal than ever before. both israelis and palestinians have very real stories to tell. painful stories of challenges, distrust, and destruction. but this conflict is not just about that. it must not be about all those painful stories. it must be about future generations. palestinian and israeli children both deserve a future of peace, one no more and no less than the other. when those children are grown, they should look back and look to this time when the parties and genuinely for their sake. these palestinian and israeli children deserve to have hope of a brighter and more peaceful future. our wish and prayer is that this is the time both sides stop thinking about present needs and to start thinking about future generations. i urge all countries and the security council and in the middle east to temper their statements and their actions in the days ahead. peace remains achievable. we must all do our parts to achieve it. thank you. was doing was outside the lines of talking about what the president did yesterday with regards to israel, which was where she started, recognizing jerusalem. so should our u.s. u.s. embasse there. that's what the president was saying. nikki haley than furthering that. she brought this point about the damage that the united nations has done on its own in the middle east peace process, and help -- i'm paraphrasing her here, to be making some anti-israel moves over time. do we have time to come out and chat about this? i'm asking our team here, because i see with the big thought bubbles. >> lawrence: they have been anti-israel, is just the fact of the matter. i think this needs to be said. this is bipartisan issues. people voted on this. they said they wanted this in jerusalem. and then you keep that promise. the bipartisan of people that are still elected into offense and former presidents. i don't like how this is being planted as just president trump going rogue. he's honoring, not only his promise, but the promises of former presidents as well as senators and congressmen. >> harris: six months ago and they voted on this in congress, it was unanimous. we will move on. new development now after congressional leaders met with the president yesterday. a deal to keep the government running, but it won't last long. another huge fight looms just before the holidays. we get a signing off on a temporary bill averting a shutdown for now. this after congress passes a measure that funds the government for the next two weeks. moniker still face a turbulent road ahead. they look to draw a broader budget by the new december 22nd deadline. the president hosting from both parties yesterday to try and hash out a long-term solution. plenty of optimism going in. >> we hope we will make some great progress for our country. i think that will happen. >> we are sick here in the spirit of let's get it done. >> we are here to reach a bipartisan agreement to reach out the year. we are happy to be here. >> kennedy: everyone was there and good faith, but democrats still have some demands. they want a six of daca. >> they come back to the table, they can come back -- we just have to kennedy: lawrence, let's discuss this a little bit. it is nice to see lawmakers from both parties together because it has been such a contentious year after such a contentious election. it's nice to see them sitting around the table. the problem is, how will they spend a bunch of money? >> lawrence: i'm mad as hell around about it. my generations going to be paying for this. i don't mind them shutting down the government. they need to feel how the average american feels when they can't pay their bills or the let's go off. donald trump went down to washington and said he was going to drain this. i would like the balanced-budget amendment. if they are going to come together -- >> kennedy: without a not jessica tarlov? >> jessica: it was a half not. >> harris: you almost got an amen. >> will do it again in three or four months. a lot of republicans also want this fixed. why can't this way? >> kennedy: there needs to be comprehensive immigration before. that's the pushback. it's been necessary for quite some time. both sides agree to that. they have very different means for getting there. different ways of input. however, i have to say, it's kind of funny to watch democrats that here and hold the republican feet to the fire over capricorn, howling that is going to add to the deficit. meanwhile, all they want to do is add more domestic spending, in addition to spending in their way on immigration. these are the programs we cannot afford. >> lisa: not to mention the fact that there was an 86% increase in the national debt under president obama. if you're the democrat party, i don't blame them. this is what you do when you are it in the minority. they are trying to leverage the power that they do have. if you want us to vote for this funding measure, then let's get something down with daca. that being said, if you're the republican party, don't play ball. you need some thing better than just moving forward with the plane daca bill. they need to push for something like the raise act. president trump has endorsed and said that he supports to get rid of chain migration and diversity lottery. i can't talk today. >> harris: we feel blessed that you came they will have bipartisan immigration reform, both sides will have to give up something. >> harris: what are we inclined to on that particular issue before christmas? >> kennedy: it doesn't belong here. >> harris: that stopgap measure. i was born with gap teeth. i wanted to get that gap out. i'm just wondering if at this point why democrats then are pointing a finger across the aisle at tax reform and how fast it's moving. forgetting how with obamacare that wasn't exactly the most open conversation the country has ever seen. there was some back and forth, but not as open as it could have been. then on an issue as important as daca, they want to rush it through. >> lawrence: not just rushing it, how about you take an issue that actually affects the american people first? i'm not saying we need immigration reform. >> harris: if you couple it with these other ideas like border wall and all that, it becomes national security too. if you want to talk about it in a broad term. >> lawrence: get tax reform done. get health care done. and then we can start talking about immigration reform affecting noncitizens. i don't think today that is going to. >> jessica: they are the flowing into southern california, as president trump declares a state of emergency due to the raging wildfires. there they are, a new fire erupting overnight. flames tearing through a horse training facility. we now know 25 horses have at least died. six major wildfires have destroyed hundreds of homes in california. many are still in danger. high winds are expected to return today. they've got a little bit of a break overnight. it didn't make that much difference on the ground, and now it's going to get worse. live with more, will. >> harris, the winds have really died down today. that is good news. the fire crews trying to take advantage of that. we have numerous helicopters up right now. they're going and picking up water from a nearby lake and attacking this hillside, trying to hit down these flames while they can while these wins are down. we had two new fires yesterday. one of those in san diego county. we know that fire has destroyed at least a 65 structures and hit that horse training facility. we learned that more than a dozen of those horses died in that fire. this is all due to the santa and to winds that had been ripping through this area this week. we were on the front lines yesterday when they were blowing the horn. take a look at what we saw. >> these flames have raced on this hillside and the past couple minutes. they are being fanned by the fierce winds would have throughout the course of the day. you can see that they are eating everything in their path. the reason this is such a concern is because on this side of the pacific coast highway, you have a number of beach homes. you can see just how close all of these flames are. they are firefighters on the other side spraying these down, trying to do everything they can to protect this community. >> as i mentioned, the good news that the winds are in a wall right now. theirs was to pick up and be strong throughout the course of the weekend. >> harris: will carr, thank you very much. was demoted this week after house investigators discovered he met with the dossiers author, chris of her steel through the 2016 campaign. he also met with the election with them to confirm that hired steele to compile the dossier. ohr did not to close the meetings to doj officials. this is raising new questions about what the two justice department knew about the dossier and if it was used to he saying he's not campaigning for roy moore, but he's 20 something miles from the border. how much of a boost is this? >> lawrence: surprisingly, i don't think it's very much of a boost. the voters of that state decided when the president endorsed his opponent that they didn't care what he said. they are only concerned about what they feel. i don't think the president coming does anything to boost roi more. i think a kind of hurts him because people are wondering why he supporting this guy just from a constitutional standpoint, the guy doesn't respect the constitution, and that's what he was in jail. i think this is a bad mood by the president, but he's going to do what he wants to do. >> lisa: kennedy, president trump's tweet said that jones is 100% of a time against us. he spent on crime, life, border, but that's, guns, how much does that play into the calculus of alabamians when they had into the polls? >> kennedy: thing just got nailed it earlier in the show. it's a tough choice. i don't think there are a lot of voters that want to be faced with that. it's for them, the lesser of two evils. they have to be decide which side of their soul to compromise in order to pull the lever. i wouldn't be surprised if a lot of people stayed home. the thing is, -- coat >> lisa: do you think the yearbook, we are still learning a lot about this. >> kennedy: is part of the dossier is compromised, then you can't take any of it. it's the same thing with the yearbook inscription. if part of his compromise, part of it is forged or added, then you can't take that as a valid claim. having said that the testimony from what she has said, her words and the way she has describe their interaction is so unnerving that even if she were the only person would come forward. >> lisa: jessica, we all listen to senator franken speech yesterday on the senate floor. you had mentioned this earlier in the show, but how much of that was about roy moore? >> jessica: it was explicitly about roy moore and donald trump, saying that there is a great irony that i am standing down today in a few weeks, and we have an absent and available office with 16 credible allegations and eight for roy moore who are taking an alabama senate seat. i think that it's a very sad choice. >> lawrence: you want to talk about dirty bill though?
