[ laughs ] >> because i think it has cast a shadow of over what it should not and will not touch. >> carolina's senator, tim scott says this is a huge conflict of interest. senator scott, good evening, a clear of conflict of interest, did she know better or if she did, why did she do it? >> you got to think that president bill clinton form attorney general speaking to an attorney general, both understand that situation is at the very least unethical, whether it reminds the good of people or if it reminds of some of the smoke filled back rooms where deals are cut. i am not sure what happened on that plane. i know those two, attorney general and former attorney general both understand the consequences. i cannot imagine an everyday person having a spouse under investigation sitting down with the investigators. that would never happen to the common folks here in south carolina but for the privilege, for the elite, they must have a very difficult standard. >> senator, the sad part of all this is the fact of the code of conduct, rule 14 as it relates to these prosecutors making it very clear that it is the very least of the appearance of priority. if someone's spouse is under investigation, approached me, either my body guard or my staff or my security would have said don't even come in, turn right around and walk up this plane. he's also a potential target and a potential witness. why didn't she do that? she's smart enough to know that. are the rules different for the clintons? >> it appears that the rules are different for the clintons and this is exactly why so many people are turning towards republican party, donald trump. they are outraged by this consistent philosophy that's different from the privilege class where the clintons are the elite and the rest of us obeys the law of the country. general lynch spoke to the outcome that she will take whatever the fbi gives her. we are thinking of the process that brings us to the outcome. we have to understand that we work in a country where we can trust the outcome of the judicial process. >> but -- yeah, lady justice is blind. do you really know what she said in the end? i got to tell you, it was a lot of -- i am not real clear. she says she's going to take the information from the fbi from the director and career prosecutors but she's not going to reaccuse herself, should she have taken herself out? >> i have been here for a long time and i agree with senator john cornyn. this emphasizes the fact that the last several months those of us calling led by john cornyn, we now crystallized why it is important to have a special prosecutor. >> senator tim scott, thanks so much for being with us tonight. >> good to be with you judge. >> and attorney general lynch is not rechoosing herself from the clinton's investigation. instead, she says she will do this. >> they'll make recommendations on how to resolve what those facts lead to. the recommendations will be reviewed by career super siviso and the fbi director and it is a common process, they present it to me and i fully expect to accept the recommendations. while i don't have a role in those findings, i will be briefed on it and i will be accepting the recommendations. >> but, accepting those recommendations enough or should loretta lynch rechoose herself on this case? >> our defense attorney, ted williams is here. all right, ted hit it, right or wrong? >> judge, let me just say while i don't question the integrity of loretta lynch, i think she's a person who's done an extraordinary job as an attorney general. under the circumstances here, except in the recommendations and the findings are just not enough in this case. or, she has to purge herself from this. she has to recuse herself making into a decision. why does she have to be briefed on anything. i am not for a special prosecutor but you got people like salley yates or one of the prosecutors there whose integrity never been questioned. >> ted, you just said you don't question her integrity, you just said it. admit it ted. [ laughs ] >> what do you think? >> i think that special prosecutor is beyond needed in this case. how do you not remove yourself? she says she's going to expect to listen to what's going on, that's not the same thing and ted knows that's not the same thing. >> recuse yourself to nobody can question the integrity of the results. >> you know ted, i was talking greta this afternoon who got the night off. she says, janine, i can understand the president comes on the plane and you just heard what i said, security and nobody would have allowed that. at one point refleckiting on it at that point having an obligation to rescuse herself. >> loretta lynch is a very smart woman. she knew that there is an investigation ongoing and it does not take rocket science to know if there is an investigation going on. you cannot talk to the spouse. >> why did she do it? >> in many cases, we have seen career prosecutors and the fbi pushed further than the department of justice is willing to go. >> think about general patraeus. the prosecutors ultimately went on a leent yenient on that one. it could go stronger as the case maybe. >> phillip, i wonder about timing. bill clinton is one of the smartest, political operatives in modern american history. the man is a genius. why today and what's going on? are we going to prosecute the guy? after the six times he legally entered the united states, i would ask a 48 hours notice if marion county decides to let him go. he's being held on bond and he's also looking at the death pe penalty in oregon if he actually gets convicted. >> and ted, of the steinle's case, they'll even inform of this? >> judge, you know what happened with the steinle cl's clas thea. >> the bottom line is no. the local authorities don't work together. as a result of that, the criminal and the people coming in and out of mexico, they realize that there is weakness in a system. >> there is no sanction. he keeps oncoming back and he killed three people. there is two issues. but, given what has happened, do you think there is any way, katy, i want you to think outside the box. >> sure. >> can we start sanctioning some of these agents or local police or allow for a lawsuit against them so that we can over come on our own of this with sanctuaries. >> two different vehicles and great suggestions. >> one is sanction, if you are not accountable for what you have done wrong. the other great suggestion you said is a lawsuit. hit him where it hurts. where it hurts for most people? >> reporter: jey johnson yesterday testified that in the aftermath of the brussels attack which occurred on march 22nd that we would see stepped up security not only here at reagan national but at transit hubs across the country. here it is the week of the turkey attack, we have yet to see stepped up security. for the most part, things are very routine here. keep in mind, the tsa is trying to strike the delicate balance between security and too much security which impedes people from getting passengers on their planes. there have been long wait lines and thousands of people missing their flights. secretary johnson said that the wait lines have been reduced to 30 minutes and not coming at the expense of security. >> as i said last month, we will not rare cut security. >> reporter: that doesn't guarantee any safety soft targets from restaurants and bars to football stadiums and fourth of july celebrations. chicago police brace for violent weekend. there has been a huge increase in violence from the same time last year. fox news correspondent matt finn is live in chicago. >> someone is shot every two hours and murdered every ten hours. if we applied this stat to any other place in america, it would make headlines but here in chicago it's become a way of life for so many. the police superintendent has announced he will be beefing up security and the presence across the streets of chicago. 5,000 officers by land, air and boat will patrol the security. police raids are under way right now and police want to keep tourists safe. it's increasing patrols at chicago's famous navy pier and ballpark. the chicago police chief says make no mistake, there's a list of those who keep pulling the trigger and is coming for them this weekend. in fact, today, police say the repeat offenders will keep shooting until stopped. also today, this afternoon, three illinois legislators announced new legislation that will prevent repeat offenders from returning to the streets before adequate time served behind bars. adding to this perfect storm, police stop and frisk have dropped by a whopping 90%. officers are afraid of lawsuits, being called racist or internet videos that might appear to incriminate them. judge? >> all right. matt, you know, the previous superintendent of police believe that judges should take polls before they've made any legal decisions and there was a contrast between michigan avenue and south side of chicago. how are they bracing for this weekend? >> yeah, there was a startling contrast. police are putting police all over. they are trying to penetrate, i think, every neighborhood and every street of chicago but a special emphasis on the south side which is a blood bath. judge?
