down our drone we have to be prepared for them to take counteraction against this. those are the questions the president has been asking the intelligence community. >> i appreciate donald trump's desire to be measured and soft but when it comes to iranian provocation, what will the world's response be if iran follows through on their threat to restart nuclear enrichment. i hope the united states will make this a red line. the president talked a lot during the campaign, he doesn't -- to pull a lot of those things but when confronting a situation like this, become commander-in-chief the reality of what you are facing may be different than what you campaigned on. >> this is a president who is trying to balance his promise to keep the us out of wars and not start new wars with the reality, he will probably use military force if iran does this. if iran starts enriching again i don't consider that red line, iran was cheating on this nuclear deal so badly this was coming anyway. i think the president is trying to be careful and restrained and iran dodged a bullet. they know military forces on the table. he is just taking his time waiting for the right moment. shannon: is that what it was or wasn't, it is how iran perceives the president's actions, that is what we are looking for an reflections from the intelligence community. iran sees us flexing our excellent old enough to remember when democrats fled the state of texas because of legislation they didn't like and the rangers rounded up the democratic legislators as well. it is a little inconsistent. should be condemned by everyone. shannon: quick reply. >> the republicans beef is the process isn't democratic enough because one of the demand they have is this law not be placed in place immediately. they are making an exception to the law, using an emergency statute to place immediately which would keep oregon voters from taking this to a referendum and decide whether they want this. shannon: there were 11 republicans gop senators in n oregon, things change. california, they have a legal bill that would limit police officers can do. there's been a lot of fighting about this. san francisco chronicle says the measure would direct police officers to use deadly force only when necessary in defense of human life but doesn't especially define what would be considered necessary.at courts consider the actions of police and the suspect when determining whether an officer is justified in opening fire. people who have lost loved ones as a result of police shootings need stricter controls but a lot of people are worried because they think this is so watered down that it is not any good. we are examining this in light of the case earlier this week we covered where the female officer was gunned down. other officers couldn't get to her. apparently there's an investigation. quick comment from both of you. >> any time there is a loss of law enforcement, very difficult job to do. the way the law is in the state of california, unlimited ability to take life. when you talk to law enforcement they all know of somebody who is trigger-happy and there's nothing you can do about it. this bill might not be the perfect solution to redefine the middle ground work, people being gunned down in the streets either.. shannon: the vast majority of law enforcement officers are very responsible who don't want to shoot someone. this is going to make some of the worry about being sued which is always possible in these e cases but there are concerned that law enforcement has not been supportive of this bill. there are folks who are worried offices think twice about walking into a situation where someone's like might be at stake. >> that could be an allowance for increase in crime. we need to strike the right balance when it comes to cases like this. the occasional bad policing should not be an excuse to endanger the lives of the many good officers who serve our country all over t place. the key is focus on good vetting and good framing. shannon: there has been a lot of input on this bill, a lot of voices so compromising on the most important point, i don't know. it herself and appointed a right-hand man as the state attorney. there is no role of acting state attorney in illinois. the law requires when fox recused herself, special prosecutor should have been assigned. the search is on for an out of county prosecutor to examine the jussie smollett case, special prosecutor can bring the same or new criminal charges against jussie smollett and probe kim fox's office and for malfeasance or corruption. sheila o'brien submitted a petition in april requesting a special prosecutor arguing she felt compelled because the public deserves the truth. >> the most important thing, confidence in the judicial system will be restored to all of us. the case will be handled by somebody who does not have a conflict. >> reporter: justice o'brien feels there wasn't conflict in this case because kim fox recused herself for communicating with jussie smollett's family members. the judge ruled there was no actual conflict between fox and jussie smollett. in a statement kim fox responded, quote, i am pleased there was no conflict of interest regarding recusal, follow the advice and counsel, and in any respect i respectfully disagree in the absence of any conflict, the appointment of special prosecutor is required. kim fox did not indicate whether she plans to appeal the ruling and the cook county inspector general is investigating this case. shannon: thank you very much. a missouri judge said the planned parenthood clinic facing multiple charges failed abortion in health emergencies can stay open tonight. state health officials say the clinic will >> reporter: the director of the missouri department of health announced he's not renew a license for the clinic and questioned how the judge can allow it to remain open since only four of 30 deficiencies the state senate found have been corrected by planned parenthood. >> i hope you understand if a plane crashes we can't say you had 10,000 flights last year that went well. sometimes these things happen. you don't do that. they go in and rigorously examine exactly what happened. to make sure there is not a systematic process that needs to be corrected. >> reporter: mike person issuing a statement reading, quote, planned parenthood is losing its license because it failed to meet basic standards of care and placed multiple patients and life-threatening situations, performed multiple failed abortions where the patients are made pregnant. planned parenthood plans to operate the clinic as long as it can. >> i call on governor parsons to take this issue seriously, to immediately stop weapon icing the regulatory process. >> reporter: what is not clear is how long the injunction will stay in place. legal abortions will continue in missouri and we will watch the story. shannon: no is missouri reject license for abortion clinic, among the problems of the investigators have cited with two failed abortions requiring additional surgeries and another that led to life-threatening complications for the mother. aside from abortion with your pro-choice or pro-life, what does this say about the fact that these are health standards you would want anybody regardless of what treatment they are seeking to be safe and protected and this clinic will not cooperate with the investigation. >> i'm definitely pro-woman and that is what these anti-health politicians are not. i hear you on these fabricated regulations that anti-health politicians have created to shutdown abortion services in missouri. this is strategic. it is a decade-long plan. this is something that the organization has been focused on. it is not about these regulations but shutting down abortion. >> there are documented cases and i have read this, talking about women thinking they had a successful abortion and come back weeks later finding out they are still pregnant, all kinds of things that are very odd to happen and they are looking for answers. they won't do interviews or make themselves available. a number of women have gone to the hospital, if you are pro-women i would think you would want all of them to be safe. >> i want this service to stop being the most inappropriately regulated health service in the country. this is a decision between a woman, her family, her doctor, her god. politicians like the governor in missouri have wanted to shutdown abortions and whether how large your door size is. these regulations are intended to shutdown abortion and that is against women's health. shannon: what about the point? planned parenthood says the governor in their statement, health and human services weapon icing the regulatory process to deny an abortion facility a license to be the last remaining health center that provides abortion. you heard the argument but she's not alone in people saying it is really just about shutting down access to legal abortion and that is what this is about. >> let's talk about what this report says. our doors stay open no matter what. now we know what that is. this planned parenthood in st. louis failed 24 very health and safety standards. one of those was failing to follow state law. they are not regulations but laws put in place to keep women safe. things like expired medications being used. they were using single-dose medicines on multiple people, multiple patients. this st. louis planned parenthood has sent women who thought they got abortions back still pregnant, they had to return for a second abortion and send with sepsis and lightning complications, the document is 60 pages long of problems at this location. they should not receive a license. this is not political. the health department made clear we cannot give this license in good conscience to this facility and planned parenthood who says they care for women, that they put safety first, will not cooperate. they only address four of those 30 discrepancies so absolutely we applaud missouri for doing the right thing and planned parenthood wanted to take care of women they shouldn't be not cooperating with this investigation. they are hurting women at this facility. we are applauding missouri for doing the right thing. women should be terrified to walk into planned parenthood. it is a taxpayer-funded travesty. a taxpayer-funded trap for women when they put abortion money over safety every time. >> both sides of had their say. there trans heather: in minnesota against ge usa powerlifting after a transgender athlete, biological male identifying as female was not allowed to compete in the women's bench press event. tonight have policies rooted in bias, fear and unfounded stereotypes. we believe usa powerlifting over the top blanket ban on transgender women athletes is clear discrimination under minnesota law and we will fight for jc's opportunity to compete. >> i think there are right that issue here. it is important women's rights matter too and similar rights protect and courts have viewed that is gender. could that change in the future? possibly. there cases pending before the supreme court next turned but this time i think we have to think about all people involved. it could put women at a disadvantage in terms of science. we talk about height, weight, speed. there are differences biologically between men and women. shannon: analysis of scientific data reflects the inherent differences in strengthened powerlifting between biological males and biological females. they went through puberty and are inherently discriminatory against the federally protected class of women. >> there is an interesting case. can't wait to see how it breaks down but i think there will be difficulty for usa and what they did. there are already a protected class under state law. secondarily, there was a decision, $20,000 jury verdict, who are transgender, who want to go into the women's football league and was denied and there was a considered violation of state law. thirdly, the international olympic committee and international federal power committee has since 2004 allowed transgender to go into power with different testosterone levels are at a certain point thinking they are not medically in a better position. they essentially admitted the drugs they have to take, substantially weakened, they can't perform like men but are not allowing them to go in so essentially you deprive a transgender person from ever competing anywhere. the courts will not look favorably on that. shannon: i am no stranger to a challenge, usa power blanket ban violates not just the law but the spirit of sports. how much do you think that will factor in? >> it is interesting to see. what we have seen so far in places like connecticut, women have spoken out and said they are always playing second. they know the outcome before the race begins. i remember the 70s there was a trans-female who entered the us open at 25, 32 women pulled out. it could be as some women have come forward, it could end of destroying female sports because wants to compete for second. shannon: quick final word for you, bob, from usa powerlifting, the dispute goes to the heart of whether it is appropriate for government to intrude on practices and rules of private entity acting to protect fairplay in recognition of scientific evidence, they say, about the factors involved. >> that is right. i was shocked when researching this. there is a lot of dispute about scientific evidence. it is not clear. i would imagine down the road, if you lower your testosterone level to a point what females are at how can you argue being born a male you have an advantage? that is the first thing. secondarily the government does have a right to ensure protected classes are not discriminated on. shannon: the powerlifting group says they are
