And qualified under the constitution a closer call. The Justice Department has action that will affect maryland and a constitutional and proper way. They dont get to pick who the attorney general is. The president of the department of justice leadership have confidence in Matt Whitaker. The appointment is proper. He has full Legal Authority on vacancy reform act of 1998 unless someone who is a senior official as well as has been there for more than 90 days to serve as acting attorney general. Democrats ramped up the attacks. No significant actions under whitakers authority should be undertaken at the department. Reporter the Judiciary Committee as ranking democrat, dianne feinstein, call for emergency hearings with whitaker and jeff sessions. The committee as republican chairman controls the calendar and knows whitaker from iowa politics, pointed to the ongoing Justice Department ethics review. If he is going through this process are you concerned about comments whitaker made . Long as he made them as a private citizen, no. Reporter sources familiar with the process tell fox news the office of Legal Counsel plans to offer an opinion defending the whitaker appointment and pushing against legal analysis, the appointment is unconstitutional. The opinion is expected in coming days possibly as early as tomorrow. The idea of Matt Whitaker, there opinions from the left and the right whether this appointment was legit. Have you reached a decision on that. The office of Legal Counsel, Katherine Herridge mentioned a few minutes ago is going to issue an opinion. This will carry significant weight. We have the top legal mind in the us government, the office of Legal Counsel. We expect the opinion to issue as soon as tomorrow. I will take a look at that. There are some compelling arguments that need to be considered. Shannon in the meantime there are those who say they fear he will be up to no good including congressman adam schiff who says whitaker, the title is matthew whitaker, we are watching you, could seek access to the special counsels plans including grand jury testimony, in a position not just to funnel information to trump and his Legal Defense team but to abuse his authority to cripple or end the investigation. Most of this is because of the position he has taken in the past with regard to muellers investigation. The fact that people say this is what he could do. All kinds of people could abuse their power. The fact that he could shouldnt disqualify him in advance as a matter of moral character from serving in this position. I dont think thats a fair argument to make just because he could abuse government power we shouldnt assume he will. Shannon do you think the special counsel needs protection . Democrats are talking about linking a measure guaranteeing him protection against being fired from a must pass spending bill, spending will run out for key Government Agencies by december 7th. They are arguing to replicate the previously existing independent counsel that operated as a Fourth Branch of government. A conscious decision to allow that to expire and not put that back in place. We have any executive branch chief executive officer, the president of the United States. I dont think its a good idea to create a Fourth Branch of government which you would be doing if you replicated the independent counsel framework. Shannon you have been active on the bipartisan push for reforms to the Justice System. We are hearing reports the president may have something to say tomorrow, you may have something to gain, you have objections from gop colleagues like tom cotton saying it is a bad idea, a jailbreak situation. What can you tell us right now . The last eight years, i have been working aggressively across the aisle to come up with the criminal Justice Reform package that could pass the u. S. If federal criminal Justice System is in need of a pack, sometimes you end up with a 55 Year Prison Sentence for somebody who sold three quantities of marijuana. That is a problem. That is being reported and it sounds plausible but the one thing is i do not think notwithstanding the back and forth that we can see this as the final product. It is very unlikely that mueller would accept written answers and nothing more. You just really need to see someone across the table and see their tone, etc. If these answers do come at the end of the week, we had a lot of false starts in these kinds of accounts with the president s team. I dont think it means mueller is done trying to get information from the president. Shannon the consensus is for most of his legal team, giving free advice is to not sit down with mueller, they dont think it is a good idea though the president says he what to do it. I have always thought trumps best interest was to sit down with mueller, sit across from the table and answer his questions. The key is when trumps team and over these questions and decide there needs to be more questions asked and he has to decide whether to seek a subpoena, to get the president to show up in person. That is why whitaker, the acting attorney general, constitutionally in the office which i dont think he is but if he were the attorney general could stop the subpoena and then mueller has to issue his report but if the attorney general says issue the subpoena you have the interview. The president under the constitution, chief Law Enforcement officer, sets a bad example for the president of the United States to refuse to sit down and answer questions from federal prosecutors who are his subordinates in the constitutional scheme. Shannon a lot of folks a the key players got in trouble not for what they have done but statements they made and they are worried. I want you to weigh on this idea that we will get indictments from roger stone, jerome corsi, is that as far as mueller goes . You heard professor truly saying that is not really impressive. First of all, will number one, you dont know what he has got until he brings it out. If he does get to stone, if it is really clear that stone knew about the wikileaks hacking before it happened we are a halfstep from the president. Whether or not the president testified, stone, it is clear, was in personal contact with him during the campaign. I agree in a sense that if it starts there, it seems unsatisfying. On the other hand, it may well be at the president s door even if the ultimate recommendations by mueller have to be based on circumstantial evidence, inference and the like. It is quite possible if stone falls which i think is very likely, that than the president is in the crosshairs. I expect mueller will go after corsi and stone but i disagree with my friend harry that these are significant figures in the trump campaign. One thing we have seen is trump is surrounded by all these drifters, weirdos, conspiracy theorists. Just because theyre all conspiring and trying to prove that doesnt mean they have any real role in the trump campaign. This guy corsi is a conspiracy theorist who thinks president obama wasnt born in the United States and someone else blue of the World Trade Center on 911. These are not central figures in the trump campaign. I expect mueller gets the scalps from stone, from the nixon years, doesnt mean it will be enough to go after the president to justify and impeachment. On the republican side to have a guy who stepped up but not enough people who want to follow him to block mccarthy.
