Live. Lets go to live and that it to see what is happening. Reporter not many protesters if any, a few journalists and a few senators because technically the senate is still in session between the vote that happened earlier today on friday and the actual confirmation vote tomorrow afternoon. You can see senator blumenthal, who has been tough about Brett Kavanaugh speaking. Unclear if he will change any minds. Republicans have not yet popped the corks but they are awfully confident about tomorrow afternoon. Loan democrat yes vote or joe manchin faced protesters. [shouting] reporter on the republican side Brett Cavanagh went numtwo3 with jeff flake as a yes. Passions are most inflamed, fear is most in jeopardy. Reporter it was an extra ordinary speech that mitch mcconnell, one of the best i ever heard. It came at the right time. Lisa murkowski took to the senate floor todd 45 to explain her loan republican no vote. He is a good man and learned judge, but in my conscience i could not conclude that he is the right person for the court at this time. Reporter sarah palin tweeted i can see 2022 from my house, referring to a possible primary challenge. With antiBrett Kavanaugh protesters camping outside all day, Capital Police escorting senators to vote and near days end resigned to the inevitability of his confirmation antiBrett Kavanaugh protesters held a confirmation outside mcconnells residence. They will be back here tomorrow before the senate votes to make their way to the Supreme Court as things continue on capitol hill. The balance of power could be tilted for decades. Chad program looks at what Brett Kavanaugh could mean for the high court. Fights over the soup court are always intense, this is whitehot, the confirmation of Brett Cavanagh could tip the balance of the court. Look when Justice Antonin Scalia died 2 interviews ago, Republican Controlled Senate filled his seat with another conservative, neil gorsuch, the balance or maintain check. The retirement of Justice Anthony kennedy single the potential swing to the right with the nomination of Brett Kavanaugh. Many republicans view Brett Kavanaugh as a reliable conservative vote. Democrats do too which is what concerns them. That is why the prospect of confirmation of Brett Kavanaugh aluminate the centrist seat held by kennedy disrupting the old balance of the court. Republican senator Susan Collins declared he told her roe versus wade was, quote, settled law. Antiabortion forces is skeptical about his views on abortion and some conservatives are too. Brett kavanaugh is the first Supreme Court nominee to express the view that precedent is not merely a practice and tradition but constitutionally dictated to Pay Attention and pay heed to the rules of precedent. Collins cast Brett Cavanagh as a centrist, so much so she noted he sided with Merrick Garland on 95 of decisions. Brett kavanaugh sits with garland on the Dc Circuit Court of appeals. Collins reasoning is most democrats liked garland so why not Brett Cavanagh . He personified the rage over the Brett Kavanaugh nomination. And president obama nominated him for the high court, eventually filling that seat with neil gorsuch. The confirmation of neil gorsuch and particularly cavanagh, republican solo seat from their side and that could tip the balance of the court with conservatives. Thank you very much. In announcing her support for Brett Cavanagh republican senator Susan Collins pointed to his centrist views, doesnt mean he will or wont be a reliable conservative vote, who better to ask men republican senator mike lee on the Senate Judiciary committee and you will cast your vote tomorrow. I assume youre still a yes. What did you think of senator collinss be . A lot of people say shes pointing out things conservatives didnt love about him but for her it was what made the case. Not sure what her analysis was but i will tell you what my views are. I looked through his jurisprudence. This is a judicial conservative. Not the same as a political conservative. Additional conservative bases the law on what it says rather than what they wish. That is what i like about him and im confident in his ability to be a Supreme Court justice. Senator feinstein, ranking democrat on the Committee Says never before have we seen a nominee display such flagrant partisanship at a hearing, anger and aggression and interrupted senators. He raised his voice. Most people in that room facing the kind of accusations, the unfair process he was confronted with, might have a reaction to that. I think he was measured in that hearing is all of us can forgive and understand that he might have gotten a little bit emotional. Shannon we will run what senator manchin said today. We saw what the first round of hearings plenty of protests. Many of your colleagues, trying to get the vote and places on the hill. How would you describe it . It has been intent. I have been accompanied by police just to walk to the capital. It has never been like this before the eight years i served in the senate and it is not just that there are people shouting and angry. It is that they are everywhere and trying to get in your way to stop you. You have the feeling they would rip you to shreds if they had the opportunity. This is unusual but it has to stop. Shannon you are on the list as would either of you be willing to step into this if you got the call from the president a real family to do it . A bad week to ask anybody, any confirmation process. I will say Brett Kavanaugh has weathered this well. My colleagues on the Judiciary Committee who handled this remarkably well, proud to serve with them and cast my vote to confirm Brett Cavanagh tomorrow. Shannon you understand people might think twice because of what they have seen this week. This man has been mistreated, subjected to procedures designed to protect him up. He has been subjected to a series of false allegations. Doctor fords allegations are in a different category. When we talk about the ramirez allegations and the avenatti allegations for miss swetnick, people proceeded as if they were the gospel truth and that is why a lot of people would think twice or 3 times or more before being considered to be a nominee for Something Like this. I saw a tweet after senator collins made her speech that the dont ever let her have a moment of peace again. What will your life be like now . I applaud senator collins for voting the way she believes is right. I applaud that senator collins in recent weeks i have spoken to her often 5 or 6 times a day, her only objective is to get to the truth and figure out whether this is somebody she can believe. I admire that answer independence and willingness to vote even though she received a lot of threats. One thing about Susan Collins, you cant push her around, people who tried have been taught they cant get away with it. We will be watching as you and your colleagues vote. The imagery was there for all to see, Susan Collins was two of the republican senators with women behind her as she made a statement but her critics say it proves she doesnt care about womens lives at all. John cornyn praising her, proud of senator collins for resisting the intimidation. Lets bring in the cohost of the five on fox news, juan williams, former special assistant to donald trump Mark Slaughter and director of the Georgetown Center for the constitution randy barnett, great to have you with us. I know you want to jump all over each other. I want to play a Little Something that senator hirono who will be a no vote, heres what she says. I dont think this will be helpful to the institution of the Supreme Court and how people view the Supreme Court because of theres one thing that is really clear Brett Kavanaugh made clear what a partisan operative he is and that is what he will take to the Supreme Court. Partisan operative. It shows once again democrats continue to move the goalposts at every opportunity. They accuse Brett Kavanaugh of being a rapist and then get upset because he was angered by that and defended himself. It is outrageous. I think this has done more to bring republicans together. Former president george w. Bush, ted cruz, Lindsey Graham, Susan Collins, so many people who at times had very terse words with donald trump all coming together. Never trump is coming together to say this man belongs on the Supreme Court, it is bringing republicans together. Not everybody is happy about this. I know how you feel about Brett Kavanaugh. I went to review what Lindsey Graham obviously a big supporter of the judge, heres what he says about Susan Collinss but, unlike most critics collins actually took the time to do her job, read his opinions, indepth interviews, listened to the accuses and apply the process of the full of law versus the rule of the mob. The rule of the mob. I thought senator hrono was on target, all our institutions are at very low trust, getting low approval from the American People and there will be damage to the Supreme Court and anything Brett Kavanaugh touches, talking with senator lee about the intensity of the protests. I dont think that will diminish in the aftermath of tomorrows vote. With regard to the process, remember i find it so distorting that people act as if we had this man life and liberty at stake. He is a judge on a federal court, what we are talking about is a nomination to the Supreme Court and we had not a charge of rape but sexual assault. A third accuser was talking about gang rape. That got dismissed, that wasnt even investigated. It comes down to professor ford who i thought and donald trump thought gave compelling testimony. The question was would the fbi look at this . Talk to her . They didnt. They said they had enough testimony from her and others. I want to talk about a point, the institution, what we think about congress and the Supreme Court. Matthew rights this, the reason for these increasingly closely decided Supreme Court battles is the last we for nominees have been originalists and textual lists who threatened the progressive doctrine of the living constitution, the lefts hold over this up in court is under threat. You think the court more broadly will have issues because of this partisan battle we have gotten into. I read that piece, i think he is right. If i were a progressive i would not be happy. I dont blame them for being unhappy. I do blame some for the way they are expressing their unhappiness but i would be unhappy and the 2016 election if it goes the other way i would be very unhappy with the direction of the court under president Hillary Clinton because replacing Justice Kennedy with Brett Cavanagh will move at least somewhat to the right. We dont know exactly how far. He is a former kennedy clerk but to move in an originalist textual this direction will change things from now on. Shannon a chance at the same question, i will start with you. What do you think the impact is on the midterms . I think it is energizing republicans, they will expand their majority in the senate by 3 or four seats. It will energize republicans in areas where the senate is not being contested. A lot of people will come around and republicans will hold on to the house for no other reason than you have democrats saying we will move to impeach and investigate Brett Kavanaugh once we take power. You have a different take on how you see this playing out. I look at the polls. You got to take anything from me with a grain of salt because i never think donald trump would be president but look at the range of polls, we still see generic reference favoring democrats by 7 Percentage Points at this juncture. Mark is right about republican enthusiasm. The question is whether it holds because it looks as if Brett Cavanagh will be confirmed tomorrow. The problem with an off year election is the president of party loses interest in the election and the Republican Party electorate has been energized by what they have seen. We will see. People are fired up. Mark, juan, professor barnett, thank you. Have a good night. Senator collins in her speech, believe that he will not overturning robie wade. How are conservatives feeling about her efforts to paint him as a centrist. He and chief judge Merrick Garland voted the same way in 93 of the cases they heard together. Judge garland was an obama nominee. Pastor Robert Jeffers ways in live after the break. Packaging for restaurants. And weve grown substantially. So i switched to the spark cash card from capital one. Shannon a crucial swing vote Susan Collins says today shannon Susan Collins said she is supporting Brett Kavanaugh because she believes abortion rights are safe in america. Many on the left are not convinced. When i asked him would it be sufficient to overturn the long established precedent 5 current justices believed that it was wrongly decided he emphatically said no. It is going to be overturned, abortion will be illegal in a significant part of this country because of what happened. Views on what this could mean, Senior PastorRobert Jeffers is here to weigh in. Always happy to have you on fox news at night. Susan collins was going through the list of all the things she thinks makes Brett Kavanaugh qualified to become a justice. My conservative friends texted me giving me all the reasons i didnt want him to be the pick because she didnt think he was that conservative. Today with her being convinced he wont touch roe v wade how do conservatives feel about him becoming a justice . I talked to a friend of mine who knows Brett Cavanagh and talked about his judicial philosophy and confirmed Brett Kavanaugh is a constructionist, a conservative, he believes the role of the curtis to interpret the law, not make the law but hes not a radical and those who expect Brett Kavanaugh to start to work to overturn roe v wade are mistaken. The most likely outcome is at some future time the high court will review state abortion rights and interpret those restrictions in light of roe and the most likely outcome is they might narrow the application of roe without overturning it but make no mistake this is a huge win to have Brett Cavanagh on the high court, win for donald trump and all conservatives. It is bringing a lot of people together as we talk about potential political impacts, Brett
