currently underway in the critical court here. there's a couple of planks to this lawsuit. first of all, a claim that signature verification is inadequate. that's placed on the single case of a woman well, the time the registrar says they looked at the case, they investigated it, compare the signature and deemed it to be the correct signature and gave the woman the chance to make a statement challenging that binding. she declined to do so. another plank of that. transparency of the counts. that again is based on one individual, an alleged credential member of the media who says he has not been able to adequately watch the counting of the votes here. again, the judge pretty skeptical asking the republican lawyers what exactly are you asking for? those lawyers were applying, we want people to be able to go in within 6 feet of the counters to see and hear what they are saying and doing. the judge or a plane you're asking me to allow anybody in the world to be able to watch the count? so the judge seeming skeptical, we don't have a ruling on those. again, another plank of the republican claims, they say that they have found 3,062 votes cast by people who they say are not legally resident in nevada. therefore, they say the votes are illegal. democrats say that's meritless, they've got backing from the county registrar who are saying that there are several reasons why the trump campaign launching a number of legal battles. we have few states going to recounts. but the count is continuing as you see on the right side of the screen. >> we are nearing the end of the first part. it's an important part and you could see the states, with biden ahead. and you could see that network in the newspapers even call for him. but in our system, the next part of it, you have a canvassing process in which you check out to make there is not clerical errors, that all the tabulations are correct. you have legal challenges and then you have a recount in there. it's pretty clear at this point, the trump campaign is going to launch a lot of recount efforts. there is enough out there, states that allow that to deny joe biden the certification until the process is done. so, buckle up, folks, this takes a while. most states have at least three weeks to get the canvassing and then the recount. if we could be doing this for the next month. >> bret: thanks for that. [laughter] >> martha: do tom bevan, but given what kimberly sighed and you look at all the data that comes in, where you think we are tonight? >> i agree with kimberly. all of this is precipitated by the trump campaign. it looks like nevada is may be beyond forgetting beyond where the recount is but in arizona, i think the trump campaign has to get the number, they have to move ahead in the count. it is going slow. if they're not able to do that, i think they're fighting an uphill battle as is. but kimberly is right, there's more to the process. >> bret: charles, where do you think we are? >> i think where we are is at the point where a normal rational president, candidate, looking at the numbers would be thinking about the good of the country and thinking about conceding. because the recount that my colleagues are talking about are very far-fetched scenarios. for example, pennsylvania, if biden's margin is about 35,000 where it's headed, there will not be an automatic recount. arizona does not allow or request for recounts. the president is launching an observed and destabilizing charges of fraud. which are making matters very difficult including for people inside his own party. i think where we are is a moment of truth for a lot of republicans. we know what's happening here, joe biden is narrowing on the election and they need to stop up much as likely members of the house and senate leadership in pennsylvania have done. by the state legislature there, they're refusing to go along with this far-fetched idea of naming new electors. adjusting themselves to the new reality, republicans over performed in their happy to be proud of. president trump has lost. >> martha: when you read the tea leaves of the statements, kimberly let me ask you to do that, this is what came out earlier. he is talking about how this is no longer about any single election, this is about the integrity of our entire election process. then he went on to say we will pursue this process through every aspect of the law to guarantee the people have confidence in our government. i will never give up fighting for you and our nation. but look at the most recent tweet, we have that we can put up as well. it has a bit stronger tone to it. i have such a big lead and all the states late into election night only to see the leads miraculously disappear as the days went by. perhaps the leads overturned as our legal proceedings move forward. it kimberly, what you think president's mood is just gleanig from the statements in the tweet tonight? >> obviously, the president is very disappointed in the way things are turning out and i think what's important is that republicans do here and you're seeing more and more members of his party duets. that presidential statement was a little closer to it as well too. it's to make the distinction that it's not good enough to go out and claim that ballots are being burnt in a garbage can outback. if you don't have any evidence of that. there is a different question to mount a legal challenges to argue that certain categories of ballots for instance should not be counted because they weren't cast legally. that's a very different question. and so, that seems to be where the legal team at least is headed and a lot of the states. look at nevada for instance, in question of residency. so, that's the important question. while they succeed, we don't know, but we have a system for this in court. >> bret: thank you very much panel, i said multiple times today different interviews that we have not seen evidence of widespread fraud. i promise if we do see it, we will investigate as journalists, were going to go after that. that's what the trump campaign legal fight is all about. we will see where it goes. that's it for "special report" coverage. we continue america's election headquarters after a short break. >> martha: stay with us, everybody. ♪ ♪ ♪ ♪ since pioneering the suv in 1935, the chevy suburban has carried many things. nothing more important than family. introducing the most versatile and advanced chevy suburban and tahoe ever. our retirement plan with voya gives us confidence... ...we can spend a bit now, knowing we're prepared for the future. surprise! we renovated the guest room, so you can live with us. i'm good at my condo. well planned, well invested, well protected. voya. be confident to and through retirement. but today there's a combination of two immunotherapies you can take first. one that could mean... a chance to live longer. opdivo plus yervoy is for adults newly diagnosed with non-small cell lung cancer that has spread and that tests positive for pd-l1 and does not have an abnormal egfr or alk gene. it's the first and only approved chemo-free combination of two immunotherapies that works together in different ways to harness the power of the immune system. opdivo plus yervoy equals a chance for more days. more nights. more beautiful weekends. more ugly sweaters. more big hugs. more small outings. opdivo and yervoy can cause your immune system to attack normal organs and tissues in your body and affect how they work. this may happen during or after treatment has ended and can become serious and lead to death. some of these problems may happen more often when opdivo is used with yervoy. see your doctor right away if you have a new or worse cough; chest pain; shortness of breath; diarrhea; severe stomach pain; nausea or vomiting; dizziness; fainting; extreme tiredness; weight changes; constipation; excessive thirst; changes in urine or eyesight; rash; itching; confusion; memory problems; muscle pain or weakness; joint pain; flushing; fever; or tingling in hands and feet. these are not all the possible side effects. tell your doctor about all your medical conditions including immune system problems, or if you've had an organ transplant or lung, breathing, or liver problems. here's to a chance for more together time. a chance to live longer. ask your doctor about opdivo plus yervoy. thank you to all involved in our clinical trials. that selling carsarvana, 100% online wouldn't work. ask your doctor about opdivo plus yervoy. but we went to work. building an experience that lets you shop over 17,000 cars from home. creating a coast to coast network to deliver your car as soon as tomorrow. recruiting an army of customer advocates to make your experience incredible. and putting you in control of the whole thing with powerful technology. that's why we've become the nation's fastest growing retailer. because our customers love it. see for yourself, at carvana.com. ♪ >> martha: welcome back to our continuing coverage of democracy 2020 on "the story," a martha maccallum. >> bret: i'm bret baier, we are awaiting details on the expected address to the nation from joe biden and senator kamala harris. we haven't gotten word on contents of the potential address but it's in the parking lot. we keep talking about. according to sources, the campaign has a fireworks display set up and ready to go. maybe they know something we don't know. if we have not seen the numbers move significantly yet. he is leading in three of the forest swing states that we have yet to call on the election.
