percentage increase in the number of cases are south dakota and arkansas, states that opted against a mandate. what they failed to mention our they are from mass testing done at a plan in south dakota lift those restrictions, but we don't want to be reckless. that's a reason, in terms of this concert venue, we would love to have the music there. there will be a time for that. but that was -- they were ahead of time on their schedule. it was not permitted. up with they wanted a special privilege in which they could do it early, and we said no. obviously, we expect those public health directives to be followed. they are going to have their concert down the road, if they can follow the guidelines that we present. we want to be able to open up our economy, but we have to do it carefully. that is so important that we send the right signal of balance, that while were opening up, we want our economy to return. we can't forget that this is a very serious virus, that actually kills people. we are reminded of it in recent days and arkansas, as we have had it an uptick in some of the areas of our state that causes us some pods. we want to do it very measurably, we want to be able to keep that balance of economic growth, and returning to the economy for the same time, not forgetting there is a deadly virus that's out there. >> shannon: there's been a lot of talk about testing, how that will be a key in trying to trace -- to get a hold of them when they come. state secretary saying this, and to wear testing all who have symptoms and all people who have had a contact with known or suspected cases of covid-19, then i won't be comfortable. what is the situation now with the availability of testing and arkansas? >> first of all, we set a goal to test 2% of our population, this month in may, at 60,000 test. we are doing close to 2,000 a day right now. that means that objective of all of our health care workers, those that are symptomatic, we also want to expand it so we can do more in terms of our contact tracing. we can do more in terms of spot checking around the state. we've really had an enhancement of our testing capability. that's a radar system. that's our early warning system to let us know where there's a problem, then we engage in the tracking. we are building infrastructure for now, but also for the fall to make sure that we are prepared in event there might be a resurgence of this, or try to come back next year. >> shannon: governor, i want to ask you about a political angle here from former vice president joe biden. he says at a time when we should be uniting our country, president trump is trying to split pennsylvania into dueling camps. testing democrats as doomsayers hoping to keep them grounded, and republicans as freedom fighters trying to liberate the economy. that is the argument a lot of people have been urging the president to make. the vice president said, do you think this is how going to play out? >> president trump census data in america we can continue to shut down the economy, we have to figure a way so that people can work, can make a living consistent with safety. president trump, very proud of the fact that he has worked in a bipartisan way with democratic governors, republican governors, i see democratic governments gog to talk to the present. he's working that faction, i don't think he can be as though throwing out this unmasking list. what it'd show us question mike that very document that the dni released it that was provided to congress, it says proper justifications were submitted. the nsa reviewed it, and everything went through the standard process. no law was broken, nothing ethical, moral, or illegal was broken and how these requests were done. if there's nothing there. spoon this kind of thing when they brought in outside parties to come outside. half of the instruments of government, they do not, or should not go forth each day looking for wrongs to write. they wait for cases to come to them, and when cases arrive, courts normally decide only questions presented by the parties. if i do think that is factoring in here? >> justice ginsburg's wise words, underscored that judge sullivan here is going beyond his judicial role, and to not only that, this is not covered in justice ginsburg's opinion. he's also intruding on the power of the president under the constitution. it is true that judges have to get their leader when a prosecution is dropped. that is to make sure that prosecutors aren't abusing things like dropping a case, and then changing it a little bit, then bringing a gun. if they to defect to the defendant. i never seen it to demand a prosecution continue after the president decides to drop it. second, the president, under the constitution, the only one charged with the duty to take care that the laws are faithfully executed. they prosecuted discussion. they decide what cases to get or not. if they don't have the constitutional power to force the justice department to prosecute you. if they don't want to prosecute anymore. they're starting to turn this into an institutional conflict, when the constitution already provides the answer. >> shannon: it sounds like judge gleason, who is now going to be called in to write this breed, felt that same way. at least in one specific case, he wrote in a memo order this caddy back in 2014, he said the government has absolute discretion to decide, not to prosecute. the government has near absolute power under the federal rules to extinguish a case that it has brought. bradley, expected they briefly get from him this time. it can be varied different from where it was done. >> at a minimum, he's going to try to address whether things were improper. i'm not looking for judges to start being prosecutors and end of their own rights. but there is a law, there something in u.s. code that allows judge sullivan to potentially punish them, even if the justice department doesn't. it's u.s. code section four oh one, if this judge the ability to punish michael flynn before the quote. michael flynn said not once, but twice, yes, i lied. he was repeatedly asked during that hearing. are you sure, where you coerce question mike he said no. he was now course. he lied. he was trying to pull it all back. that's why judge sullivan is checking everything, making sure it's done properly before he signs off on dismissing these charges. spilling to byron, i want to talk to you about what you think happens next. byron, you first. >> we need to find out what was later. michael flynn pled guilty to lying about a conversation that he had an interview with the fbi about a conversation he had with the russian empress terry. you have to know what they said in the conversation with the russian ambassador, and we do have a recording and transcript, or officials have that. but we don't know what he said with the fbi. that seems to me to be an incredible weakness in this whole case. >> shannon: it's john, quick final where to? >> i expect he's either going to get stopped in his tracks, or even the supreme court, and what's really going to happen, is all this information about this january 5th meeting, and the obama administration's effort to use these surveillance other administration wrappers is going to have to get wrapped up. that will tell us what
