>> potentially a sacrificial lamb. bernie sanders and mitch mcconnell agree on something, not supporting her is one of them and interesting that her think tank, the center for american progress, she is very progressive and that tax and spend policy is not something they are looking to get behind and the last thing we need is more deficits which she is supportive of. that will be a hard one with both the left and the right not being supportive. >> kamala harris facing backlash for posting a tweet saying she and joe biden want to support small businesses but back in june she asks people to donate to the minnesota freedom fund, an organization that helped bail out protesters, some of the rioters who were put in prison, arrested because they looted and destroyed small businesses. how do you feel about this coming from kamala harris? >> i thought her comment about supporting small business was pretty rich. small businesses and apple pie, businesses that were vandalized because of looters and rioters, the majority of those businesses were black minority owned businesses that supplied services and goods to the community and employed folks in that community. we may find her walking that one back, small businesses are the backbone of the economy that employ a third of our workers and the reality, those who seek to hurt small businesses and support those who hurt small businesses won't be well by the small business community. >> a tough year to look at these numbers, small businesses being the backbone. small business confidence dropped to an all-time low. this is understood after what happened with the pandemic in the course of the last 8 to 9 months but when you look at joe biden in office and what that could mean for small business owners, people are really nervous right now. >> consumer confidence fell, the fact that holiday sales were good, probably retail therapy for all of us but the reality, there is going to need to be stimulus to help small businesses. the patient protection program has money that is unused, helping small business is vital especially as we enter a new phase of lockdowns. >> thank you for your insights, appreciate it, have a good day. >> still had organs spending millions of taxpayer dollars on a covid-19 relief program that only african-americans can apply for. the outrage and legal challenges rolling in. >> accused of stepping multiple people at a church after being deported three times, former dhs legal counsel mike powell on the sanctuary fallout next. [ muffled scream ] stop living with at&t. xfinity can deliver gig to the most homes. >> good morning, the supreme court hearing arguments over excluding illegal immigrants from the 2020 census. joining me to explain the implications, oversight council and senior advisor, mike hill. donald trump wants to exclude illegal immigrants from the census and that counts to figure out how many house seats each state gets. he says if you include illegal immigrants it incentivizes states to promote illegal immigration. what happens during yesterday's up in court hearing and why is this important? >> the president doesn't want to exclude them from the census, the supreme court ruled a year ago they cannot do that. would he wants to do is send a number to congress for a portion that is determining the total number of seats you get in each state for congress and that number should be based on the amount of illegal citizens an area to exclude illegal aliens so the supreme court was grappling with this question yesterday, came up from appeals, the appeals court basically said it could have a chilling effect on participation in the census, now the census taking us over, that's no longer the case, this will have an injury to state because some states will lose representation in an unfair way. the supreme court yesterday, we were not sure how the data would work out. and what the injury would be, to the state. the supreme court had a bunch of questions whether it was the right time to hear this case. between the relevant case law including the census director and secretary of commerce having a lot of authority for the direction of policy questions. they've done this before with foreign citizens who were on business as well as the issue of what to do overseas. >> one of the reasons some say donald trump might have a tough time winning this is because the constitution the weight is worded sort of points to all residents being counted and assistance, covid-19 was even mulling over yesterday. >> the relevant word is persons construed to mean inhabitant which is construed to mean people with allegiance to an area and enduring ties. it is fair to say illegal aliens have no allegiance to the united states, their allegiance is to their home country, so that is one of the questions we are dealing with. from a policy aspect it is a slamdunk. illegal aliens should not be counted for the vote. not the home country to which they bear allegiance, to be drafted into the military or perform service, not relevant to the purpose as congressional districts are structured. >> it decides the house seat and the federal funding each state gets, every state wants a bigger slice of that pie. we appreciate it. >> still had scandal rocking big pharma. in a report claiming a consultant push to give rebates for overdoses as new jersey faces backlash for using the same firm to handle its pandemic response. our next guest who lost her son to an overdose joins us. robinhood believes now is the time to do money. without the commission fees. so, you can start investing today wherever you are - even hanging with your dog. so, what are you waiting for? >> the addiction awareness task force, the horrors of the opioid crisis, my heart goes out to parents who lost loved ones, phil murphy can know his top public relations consulting firm and covid-19 epidemic was put in place, the lives of overdose victims and still stick with them despite that knowledge is unconscionably cold and callous. >> what happens to your son? >> ten years ago my son experienced trauma and unbeknownst to me he was taking pain pills and he came crying to me one day and said i need help and he said i am addicted, taking pain pills. i asked how many he was taking a day and he told me 30. i dropped to my knees, i couldn't even imagine it. i then took him to a doctor who recommended he go to an intensive care patient program and it was a he was turned on to heroin in outpatient program. i had also gone to my pharmacist and asked him how the heck did my son get a hold of that many pain pills and again this was ten years ago and the pharmacist said to me the money, the money, it is all about the money and i never understood what that meant but i do today obviously. >> i am sorry to hear the story, sorry for your loss, how do you feel about the conversation we are having about this big company being involved in the pandemic, the covid-19 response and do you feel a price is being put on the lives of not only your son but the rest of the victims and families out there who lost loved ones because of this? >> 100%. i had to read the article 3 times because i couldn't believe what i was reading. i couldn't believe somebody could be that calculating, to put a price on our kids, my child's head into thousand 17, predicted how many children lost loved ones were going to be murdered from the pill and put 14,800 per incident or event is what they called it, what kind of person puts a price on a child's head. a complete slap to every breathing family member out there, i represent every breathing family member. my organization, drug epidemic awareness walk across america and across every state showing our beautiful children's faces to bring awareness to take away the stigma and to let everyone know this can be your child's. a complete shock, it is a disgrace quite honestly. >> i know you're fighting for debbie and so many others like her. where do we go now as we wrap this up? >> i didn't have a choice. if i close again i won't be able to reopen at all. it was a simple choice for me. we were asked to close for two weeks to help stop the curve and here we are 8 and a half months later and have to close again. we spent thousands on plexiglas, sanitizing stations, air purification systems in a restaurant and still have to close which we can't survive. employees are counting on me to stay open, single moms who need this job. to be it was a no-brainer. i am not the only one out here. most of us are staying open. we have to. we can't survive by closing our doors. try to survive on 25%, crazy as well. >> interesting to hear you say you spend a lot of money on that air purification system and still you are not able to seat people inside. what is the communication been about you staying open? >> it has been pretty good. we are getting support from the community. there are people, i call them haters that don't agree with us staying open but they are not the ones in survival mode. we don't stay open we can't reopen. jumping and helping us out as well, we've been waiting for that for a while. >> you took the words out of my mouth. i was going to ask about stimulus and how much another round of stimulus would help your small business. is that something you really need right now?
